About approval of Rules of certification of producers of original and elite seeds, seeds of the first, second and third reproductions, implementors of seeds

According to the subitem 6) of Item 1 of article 6 of the Law of the Republic of Kazakhstan "About seed farming" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" I ORDER:

1. Approve the enclosed Rules of certification of producers of original and elite seeds, seeds of the first, second and third reproductions, implementors of seeds.

2. To provide to department of production and conversion of crop products and phytosanitary safety of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of certification of producers of original and elite seeds, seeds of the first, second and third reproductions, implementors of seeds

Chapter 1. General provisions

1. These rules of certification of producers of original and elite seeds, seeds of the first, second and third reproductions, implementors of seeds (further – Rules) are developed according to the subitem 6) of Item 1 of article 6 of the Law of the Republic of Kazakhstan "About seed farming" (further – the Law on seed farming), the subitem 1) of article 10 of the Law of the Republic "About the state services" (further – the Law) and determine procedure for certification of producers of original and elite seeds, seeds of the first, second and third reproductions, implementors of seeds, and also procedure for rendering the state service "Certification of Producers of Original, Elite Seeds, Seeds of the First, Second and Third Reproductions and Implementors of Seeds" (further – the state service).

2. In these rules the following basic concepts are used:

1) the certificate on certification - the document issued within competence by local executive body of area (the city of republican value, the capital) (further - local executive body (service provider)), testimonial of recognition by the state of activities of the certified subjects in the field of seed farming;

2) original seeds - the seeds made by the author of grade of agricultural plant authorized by it-faced or originatory grades and intended for production of elite seeds;

3) seeds of the first, second and third reproductions - the subsequent reproduction of seeds of elite by years: the first year - the first reproduction, the second year - the second reproduction, the third year - the third reproduction;

4) No. 367 is excluded according to the Order of the Minister of Agriculture of the Republic of Kazakhstan of 04.11.2022

5) the applicant (further - (the applicant (uslugopoluchatel)) - the physical person or legal entity which submitted the application on the web portal of "the electronic government" (further - the portal) for passing of certification and receipt of the certificate on certification;

6) superelite seeds - the seeds belonging to original, received from harvest of nursery of reproduction, conforming to requirements of national standards and other regulating documents in the field of seed farming and intended for production of elite seeds;

7) producers of seeds - the physical persons and legal entities performing activities in the field of seed farming according to the Law on seed farming;

8) seed-growing economy - the business entity certified by local executive body (service provider), enabling production and the realization of seeds of the first, second and third reproductions;

9) the implementor of seeds - the physical person or legal entity certified by local executive body (service provider), performing sales activity of batches of seeds of agricultural plants and (or) issue of the seed loan;

10) elite seeds - seeds of agricultural plants which are received from original or superelite seeds and conform to requirements of the legislation of the Republic of Kazakhstan on seed farming;

11) elite and seed-growing economy - the business entity certified by local executive body (service provider), enabling production and the realization of elite seeds;

12) the operator of information and communication infrastructure of "the electronic government" (further – the operator) – the legal entity determined by the Government of the Republic of Kazakhstan according to the subitem 2) of article 6 of the Law of the Republic of Kazakhstan "About informatization" to who ensuring functioning of the information and communication infrastructure of "the electronic government" assigned to it is assigned;

13) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

3. Certification of producers of original seeds, elite and seed-growing farms, seed-growing farms, implementors of seeds is carried out by local executive body (service provider) with issue of the certificate on certification according to the declared type of activity in form according to appendix 1 to these rules.

4. For carrying out certification of producers of original seeds, elite and seed-growing farms, seed-growing farms, implementors of seeds the resolution of local executive body (service provider) creates permanent certifying commission (further - the commission) with numerical structure at least five people (the chairman and four members of the commission).

Working body of the commission is the structural division of local executive body (service provider) performing functions in the field of agricultural industry (further - working body).

5. The certificate on certification is granted according to the declared type of activity on condition of compliance of the applicant (uslugopoluchatel) to requirements imposed to the producers of original seeds, elite and seed-growing farms, seed-growing farms, implementors of seeds specified in appendix 2 to these rules (further - requirements).

6. The business entity who received the certificate on certification of seed-growing economy and meeting requirements imposed to elite and seed-growing farms can apply for receipt of the certificate on certification of elite and seed-growing economy.

The elite and seed-growing economy meeting requirements imposed to producers of original seeds can apply for receipt of the certificate on certification of the producer of original seeds.

Chapter 2. Procedure for certification of producers of original seeds, elite and seed-growing farms, seed-growing farms, implementors of seeds

7. For passing of certification and receipt of the certificate on certification the applicant (uslugopoluchatel) in electronic form by means of the portal by means of the EDS directs the following documents:

1) the statement for carrying out certification (recertification) in form according to appendix 3 to these rules (further – the statement);

2) form of data on compliance to requirements imposed to producers of original seeds according to appendix 4 to these rules;

form of data on compliance to requirements imposed to elite and seed-growing farms according to appendix 5 to these rules;

form of data on compliance to requirements imposed to seed-growing farms according to appendix 6 to these rules;
