1. Bring in the order of the Government of the Republic of Kazakhstan of May 25, 2011 No. 575 "About approval of Rules basic, grant, program target financing of scientific and (or) scientific and technical activities" (SAPP of the Republic of Kazakhstan, 2011, No. 40, the Art. 500) the following changes:

1. These rules basic, grant and program target financing of scientific and (or) scientific and technical activities (further - Rules) are developed according to the Law of the Republic of Kazakhstan of February 18, 2011 "About science" and determine procedure for basic financing, and also grant and program target financing of scientific research, scientific and (or) scientific and technical projects and programs at the expense of means of the government budget.
2. In these rules the following concepts are used:
the specification on research work - the initial technical document for carrying out scientifically research works establishing requirements to content, amounts and terms of accomplishment of these works;
the subject of scientific and (or) scientific and technical activities - the physical persons and legal entities performing scientific and (or) scientific and technical activities, accredited in authorized body in the field of science;
the private partner - the individual entrepreneur, particular partnership, consortium or the legal entity, except for persons acting as the state partners, signed the agreement of public-private partnership;
the state order - the order of authorized body and (or) industry authorized bodies to the subject of scientific and (or) scientific and technical activities based on the contract for accomplishment of the research works financed by the government budget in the form of basic, grant and program target financing.
3. Financing of subjects of scientific and (or) scientific and technical activities can be performed at the same time in the form of basic, grant and program target financing with the conclusion of the separate agreement in each form.
4. The contract for accomplishment of the state order and (or) the state task on basic financing consists between the subject of basic financing and authorized body or industry authorized body on ensuring the current activities of the subject of basic financing.
The contract for accomplishment of the state order on grant or to program target financing (further - the agreement) is signed between the subject of scientific and (or) scientific and technical activities and authorized body or industry authorized body or the other person performing financing of scientific and (or) scientific and technical activities, determined by the Government of the Republic of Kazakhstan.
5. Basic financing is allocated to the state scientific organizations and the scientific organizations equated to the state, state higher educational institutions, higher educational institutions, fifty and more percent of voting shares (shares in the authorized capital) which belong to the state, and also higher educational institutions in which fifty and more percent of voting shares (shares in the authorized capital) directly or indirectly belong to legal entities, fifty and more percent of voting shares (shares in the authorized capital) which belong to the state, accredited in authorized body and performing the state task and (or) the state order for carrying out scientific research in the directions, priority for them (further - subjects), certain industry authorized body.
6. The list of the organizations which are subjects of basic financing is created by authorized body, including based on offers of industry authorized bodies, and affirms the Government of the Republic of Kazakhstan.
7. Basic financing includes expenses on regulations of basic financing on the current providing scientific infrastructure and property, including buildings, the equipment and materials, compensation of administrative and service personnel, and also information maintenance of scientific and technical activities of subjects.
8. Subjects of basic financing which do not receive the state task and (or) the state order for carrying out scientific research in the directions, priority for them, determined by authorized body or industry authorized body within the last two years are subject to exception of the list of subjects of basic financing.
9. Subjects of basic financing annually no later than April 1 of the year preceding planned represent the budget request for basic financing according to the approved regulations of basic financing which is drawn up according to requirements of the budget legislation to authorized body and (or) industry authorized body.
10. Regulations of basic financing are developed by authorized body and affirm the Government of the Republic of Kazakhstan.
11. Industry authorized bodies introduce the summary budget requests on basic financing which are drawn up according to the budget legislation in authorized body no later than May 1 of the year preceding planned.
12. The authorized body introduces the summary budget request on basic financing in the central authorized body on budgetary planning according to the procedure, established by the budget legislation.
13. Financing of subjects of basic financing is performed by authorized body, industry authorized bodies within the approved budget for the corresponding financial year according to the distributed budget program.
14. The report on use of allocated funds on basic financing is submitted subjects of basic financing in authorized body or industry authorized body till December 31 of accounting year according to appendix 1 to these rules.
Industry authorized bodies the summary report on use of means of basic financing of subjects of scientific and (or) scientific and technical activities is submitted, according to appendix 2 to these rules in authorized body till January 25 of the year following for reporting.
The subject of basic financing provides reliability and legitimacy of the reflected information in the report on use of allocated funds on basic financing of subjects of scientific and (or) scientific and technical activities.
15. Reliability of the documents and details confirming justification of inclusion in the list of subjects of basic financing and amounts of basic financing provide authorized body, industry authorized bodies and subjects of scientific and scientific and technical activities.
16. Grant financing is allocated for carrying out scientific research for the purpose of increase in level of research works, scientific and technical potential and competitiveness of the scientific organizations and their collectives, scientific. From means of grant financing competitions on grant financing for young scientists can be announced.
17. Grant financing is provided gratuitously and irretrievable from means of the government budget for realization of basic and applied scientific research.
18. Industry authorized bodies till February 1 of the year preceding planned send to authorized body of the offer on the priority, specialized directions and amounts of grant financing according to the priority directions of development of science of the Republic of Kazakhstan determined by the Highest scientific and technical commission under the Government of the Republic of Kazakhstan (further - VNTK), according to appendix 3 to these rules.
19. The authorized body sends offers of industry authorized bodies to "National Center of the State Scientific and Technical Examination" joint-stock company (further - the center of examination) within two working days from the date of the termination of term of submission of offers.
20. The center of examination within two working days from the date of receipt of offers on the priority and specialized directions and amounts of grant financing sends them for consideration to national scientific councils (further - NNS) for receipt of decisions on them.
The center of examination sends solutions of NNS to authorized body till February 20 of the year preceding planned.
21. The authorized body after receipt of NNS provided by the center of examination of the decision on grant financing within five working days sends them for consideration of VNTK.
22. VNTK till April 1 of the year preceding planned makes the relevant decision in accordance with the established procedure, according to the Regulations on the Highest scientific and technical commission under the Government of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of April 20, 2011 No. 429.
The authorized body within fifteen working days sends the solution of VNTK to the central authorized body on budgetary planning.
After decision making of VNTK in the priority directions of development of science and amounts of grant financing with breakdown in the priority directions the authorized body and industry authorized bodies till May 1 of the year preceding planned are developed, approve the tender documentation and announce competition on grant financing.
23. Grant financing is performed by the authorized body or industry authorized body which announced competition or the other person authorized by the Government of the Republic of Kazakhstan on implementation of financing of scientific and (or) scientific and technical activities.
24. Grant financing is performed on competitive basis within the means provided in the government budget.
The contractor represents to authorized body or industry authorized body the report on use of allocated funds on grant financing ((intermediate) (the first year (except for projects with the term of realization 1 (one year), the second year of projects implementation (except for projects with the term of realization 2 (two years)) till December 25 of the current accounting year and final till December 10 of the current accounting year according to appendix 4 to these rules.
The contractor provides reliability and legitimacy of the reflected data in the report on use of allocated funds on grant financing.
25. Funds of grant financing are allocated for the expenses which are directly connected with carrying out scientific research on the scientific and (or) scientific and technical projects approved by the solution of NNS.
Costs belong to expenses on:
1) compensation - system of the relations connected with ensuring obligatory payment with the employer to the scientists and persons performing financial and economic and legal maintenance of remuneration for their work according to the Labor code and other regulatory legal acts of the Republic of Kazakhstan, and also agreements, labor, collective agreements and acts of the employer;
2) official journeys - the business trips connected with implementation of the scientific and (or) scientific and technical project;
3) other services and works - the services of scientific laboratories of collective use, other laboratories, other organizations, subjects of entrepreneurship necessary for accomplishment of researches, including the arrangement fees for participation in conferences, seminars, symposiums.
The other services and works including accomplishment of research works (outsourcing) are provided with indication of contractors and disaggregation by types, amounts, the expected results of works.
4) acquisition of materials - acquisition of consumable materials for accomplishment of researches;
5) acquisition of the equipment and (or) the software (for legal entities);
6) scientific and organizational maintenance - expenses on publications, patenting and acquisition of analytical materials;
7) lease of rooms - the expenses connected with lease of the rooms used for accomplishment of scientific research and scientific and organizational maintenance on the project;
8) lease of the machinery and equipment - the expenses connected with lease of the machinery and equipment, the scientific research used in accomplishment on the project;
9) operating expenses of the machinery and equipment - the expenses connected with use of the machinery and equipment for accomplishment of researches, including connected with their commissioning and content;
10) taxes and other obligatory payments in the budget.
In case of decision making of NNS about the termination of financing of the implementable project the authorized body and (or) industry authorized bodies terminate the agreement with the contractor.
At the same time the authorized body or industry authorized bodies allows based on the solution of NNS funds redistribution within the current year between projects within grant financing of scientific and (or) scientific and technical activities.
26. Accredited subjects of scientific and (or) scientific and technical activities, and also the autonomous organizations of education and their organization on equal terms have the right to take part in tender on grant financing.
27. The tender documentation on grant financing is developed and affirms authorized body and (or) industry authorized body, goes to the center of examination within two working days.
28. The tender documentation and the announcement of tender on grant financing shall contain the following data:
1) the name of authorized body or industry authorized body, announced competition;
2) name of the priority and specialized scientific directions;
3) requirements to form and content of the bid on grant financing of scientific, scientific and technical projects;
4) the tender purpose on grant financing;
5) amount and conditions of contribution from the private partner;
6) language in which the request for grant financing is submitted;
7) the types of researches and the amounts of financing recommended to NNS and approved by VNTK;
8) qualification requirements to the research supervisor and research group, and also other qualification requirements;
9) the positive conclusion of the local and (or) central commission on bioethics questions (for biomedical researches over people and animals);
10) data on the responsible persons of authorized body or industry authorized body who announced competition which perform explanations according to the tender documentation;
11) the final term of order taking shall be at least 45 and no more than 60 calendar days from the date of the announcement of tender;
12) the name and the reference to information system of the center of examination for application;
13) requirements to the expected results on scientifically, scientific and technical projects;
14) the draft agreement on accomplishment of the state order on grant financing.
29. The participant applying for receipt of grant on applied researches provides participation of the private partner with partial providing the project with necessary resources, including financial, except for projects of applied researches in the field of ensuring national security and defense, use of atomic energy, social, humanitarian and social sciences.
Confirmation of intention of the parties is the agreement on contribution in any form with indication of their terms of realization and the deposit amount or necessary resources.
In cases of refusal of the private partner of intention of contribution in the project progress or lack of equivalent replacement, according to the solution of NNS financing of the project can be stopped.
In case of decision making of NNS about the termination of financing of the project the authorized body and (or) industry authorized bodies terminate the agreement on accomplishment of the state order on grant financing with the contractor.
At the same time the authorized body or industry authorized bodies allows based on the solution of NNS funds redistribution within the current year between projects within grant financing of scientific and (or) scientific and technical activities.
30. Competition on grant financing is announced within five working days after approval of the tender documentation on grant financing through periodic printing editions and is subject to placement on Internet resource of authorized body or industry authorized body, announced competition, and also Internet resource of the center of examination.
31. The bid on grant financing is constituted in form according to appendix 5 to these rules.
32. The authorized body or industry authorized body which announced competition send requests for grant financing to the center of examination within three working days after the expiration of final term of order taking for tender.
33. The state scientific and technical examination, and also assessment of justification of the required amounts are performed according to the Rules of the organization and conducting the state scientific and technical examination approved by the order of the Government of the Republic of Kazakhstan of August 1, 2011 No. 891.
34. Solutions of NNS in the form of minutes abstract of NNS go the center of examination to authorized body and (or) industry authorized body no later than five working days from the date of decision making in time.
35. On grant financing the decisions of NNS made according to each request for grant financing and approved by authorized body or industry authorized body are result of tender.
