About approval of Aviation rules of flights in airspace of the Republic of Belarus

Based on article 63 of the Air code of the Republic of Belarus and for the purpose of establishment of single procedure for accomplishment of flights in airspace of the Republic of Belarus the State committee on aircraft of the Republic of Belarus and the Ministry of Defence of the Republic of Belarus DECIDE:

1. Approve the enclosed Aviation rules of flights in airspace of the Republic of Belarus.

2. Not apply the Basic rules of flights in airspace of the USSR enacted by the order of the commander-in-chief of the Air Force of July 3, 1985 No. 161.

3. This resolution becomes effective since July 1, 2004.

Aviation rules of flights in airspace of the Republic of Belarus

Chapter 1. General provisions

1. Aviation rules of flights in airspace of the Republic of Belarus (further - Rules) are developed based on the Air code of the Republic of Belarus and according to the Rules of use of airspace of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of November 4, 2006 No. 1471 (The national register of legal acts of the Republic of Belarus, 2006, No. 190, 5/24224), standards and recommendations of International Civil Aviation Organization (further - ICAO).

2. These rules establish general procedure for accomplishment of flights by aircrafts (further - AF) civil and state aviation in airspace of the Republic of Belarus. Flights of automatic aerostats are carried out by rules which are established by the Ministry of Defence of the Republic of Belarus (further - the Ministry of Defence).

3. These rules extend to all AF, the carrying-out flights in airspace of the Republic of Belarus, and AF of the Republic of Belarus which are carrying out flights in airspace of other states if their provisions do not contradict the rules of flights established in these states.

4. These rules are obligatory for management and execution by all physical persons and legal entities operating AF, performing servicing of air traffic (management of flights).

5. In case of factual determination of abuse of regulations officials shall take measures for violation suppression immediately.

6. Violation of requirements of these rules involves the responsibility established by the legislation of the Republic of Belarus.

7. For the purposes of these rules the following main terms and their determinations are applied:

emergency stage - stage of uncertainty, alarm or stage of disaster depending on circumstances;

the model aircraft - the small-sized aircraft is heavier than air, with the engine or without it, not capable to lift the person who is used for sports competitions or entertainment, but not for the commercial, research or military purposes;

aviation works - the works performed with use of flights of AF in agricultural industry, construction for protection and environment protection, delivery of health care and other purposes;

airfield - the land or aquatic area which is specially prepared and equipped for ensuring take-off, landing, taxing, the parking and servicing of AF;

airfield mountain - the airfield located on the area with the crossed relief and relative excesses of 500 m and more in radius of 25 km from control point of airfield and also the airfield located at the height of 1000 m and more above sea level;

airfield reserve - the airfield intended for landing of AF in case use of airfield of appointment is impossible. Can be reserve as well airfield of departure;

airfield of appointment - airfield in which landing of AF is provided by flight plan or task for flight. Airfields of appointment are subdivided into airfields of intermediate and final landing;

airfield movement - all movement on the working area of airfield, and also flights of AF around airfield;

airfield dispatching servicing - dispatching servicing of airfield movement;

aeronautical information - the data concerning characteristics and actual state of airfields, airline hubs, elements of structure of airspace and means of radio engineering providing (further - RTO), necessary for the organization and accomplishment of flights;

the aerostat - the aircraft is easier than air, not set in motion by the power plant. Aerostats are subdivided on piloted, automatic, fastened and free;

airline hub - close located airfields, the organization and accomplishment of flights from which require special approval and coordination;

disaster - condition in case of which AF and persons which are on its board are threatened by serious and direct danger or is required the immediate help;

safe flight altitude - flight altitude excluding collision of AF with land (water) surface or obstacles in it;

the unmanned aerial vehicle (further - BLA) - the aircraft is heavier than air without crew on its board, except for model aircrafts;

bumpiness - the chaotic movements of AF arising when flying in the conditions of turbulence of the atmosphere (bumpiness is considered weak when the surplus of overload reaches no more +/-unit 0,5; moderated - to +/-unit 1,0; strong - +/-1,0 of unit and more, and when landing: moderated - + / - unit 0,3-0,4; strong - more +/-unit 0,4);

take-off - flight stage from the moment of the beginning of the accelerated movement of AF from the line of start on land (water) or artificial surface (the moment of department from the specified surface in case of vertical take-off) until set established heights and speeds of flight in relation to specific AF;

rise of aerostat - movement of aerostat in air in case of which there is increase in height of its flight;

landing strip (further - the runway) - the part of airfield intended for running start in case of take-off and run after landing of AF;

visibility (visibility range) - the maximum distance from which objects are visible and are identified;

visibility on the runway (visibility range on the runway) - the maximum distance within which the pilot of AF who is on the axial line of the runway can see marking of its covering or light reference points. Visibility of light reference points is accepted to visibility on the runway at night;

visibility flight - visibility from cabin of AF in flight;

visual weather conditions (further - VMU) - the weather conditions expressed in sizes of visibility range, distances to clouds and height of the lower bound of clouds in case of which flight is carried out according to the visual flight rules (further - PVP);

visual landing approach - landing approach when space provision AF and its location are determined by crew visually by the natural horizon, terrestrial reference points, and also concerning other material objects and constructions;

air situation - simultaneous relative positioning of AF and other material objects in certain region of airspace;

the aircraft - the aircraft supported in the atmosphere due to interaction with air, other than interaction with the air reflected from the Earth's surface or water;

the airway (further - W) - the corridor limited on height and width in airspace intended for flights of AF and equipped with controls, control and radio navigation;

air traffic - movement of AF, being in flight and to airfield maneuvering areas;

height absolute - distance down from the average level of the sea to the level, point or the object accepted for point;

height true - height determined from point on the land (water) surface located directly under the object of measurement to this object;

height relative - distance down from the specified initial level to the level, point or the object accepted for point;

relief height - the absolute height of land relief;

flight altitude - distance down from certain level to AF;

height of the lower bound of clouds - distance down between land (water) surface and the lower bound of the lowest layer of clouds;

transition height - the established height for transfer of scale of pressure of the barometric altimeter into standard pressure in case of set of the set echelon;

decision making height (further - VPR) - height established for exact landing approach at which the maneuver of leaving on the second circle shall be begun if before achievement of this height by the commander of AF the necessary visual contact with reference points for continuation of landing approach or provision AF in space was not come or parameters of its movement do not ensure safety of landing;

border of action of permission - boundary (Item), to which really dispatching permission issued on flight accomplishment;

pressure in airfield - atmospheric pressure at the level of working threshold of the runway;

pressure atmospheric standard - the established value of pressure 1013,25 of hectopascal (760 millimeters of mercury or 1013,25 of millibar);

deltadry (paradry) - the site of the land surface with slope prepared and marked for placement, take off and landing of hang-gliders (paraplanes);

demonstration flight - flight for the purpose of display of opportunities of AF, flight skill (display of aviation equipment, aviation parade, etc.);

the airship - the aircraft is lighter than air, set in motion by the power plant;

the request for flight - the document of the established sample (flight plan, the preliminary plan of flight, the repeating flight plan, etc.) containing necessary data for providing and accomplishment of flight;

stocked heights over obstacle - the minimum distance down from AF to the horizontal surface passing through the highest point of the obstacle considered in the established borders;

zone airfield (flight) - part of airspace of the established sizes for accomplishment of flight tasks;

zone of take off and landing - part of airspace of the established sizes within which AF carries out maneuvering in case of take-off and landing approach;

the temporary restricted area of flights - part of airspace of the limited sizes which is established by operational body of the Single system of air traffic management (further - the EU air traffic management) for the organization of use of airspace requiring temporary air space reservation, input of short-term restrictions or for the purpose of carrying out search and wrecking for the term of no more than 24 hours according to the procedure, determined by the Instruction for use of airspace of the Minsk district of the flight information approved by the resolution of the Ministry of Defence of the Republic of Belarus of January 8, 2004 No. 1 (The national register of legal acts of the Republic of Belarus, 2004, No. 26, 8/10534) (further - the Minsk RPI);

the prohibited area - part of airspace of the established sizes within which use of airspace without special permission is forbidden;

restriction zone - part of airspace of the established sizes within which use of airspace is limited to certain conditions;

the waiting area - the part of airspace of the established sizes located, as a rule, over radio navigational point of airfield (the area of airfield, airline hub) and intended for expectation of AF of the queue of landing approach or approach to airfield;

the danger area - part of airspace of the established sizes within which during certain period the activities posing safety hazard of flights of AF can be performed;

zone (corridor) special - the part of airspace of the established sizes intended for accomplishment of test flights, refueling in air, flights at small and extremely small heights, missiles launches, air firing practice and other special flights;

zone navigation (further - ZNAV) - the navigation method allowing AF to carry out flight on any trajectory within operation of radio beacon-type navigation aids or in the limits determined by opportunities of special autonomous means or their combinations;

the commander of the aircraft (further - the commander of AF) - person having in stipulated by the legislation cases of the Republic of Belarus the certificate (certificate) of the pilot (pilot), and also the preparation and experience necessary for independent management of AF of certain type;

control point of airfield (further - KTA) - the point determining location of airfield in the chosen system of coordinates;

circle of flights - the established route (scheme) around airfield on which or as regards which ascent after take-off, landing approach, landing expectation, flight over airfield or exit of AF out of limits of airfield are carried out;

route of zone navigation (further - ZNAV route) - the route of servicing of air traffic (further - Department of Internal Affairs) established for flights of AF which can apply ZNAV;

local air-line (further - MVL) - the corridor limited on height and width in airspace intended for flights of AF at heights below the lower echelon and secure Department of Internal Affairs;

the area mountain - the area with the crossed relief and relative excesses of 500 m and more in radius of 25 km, and also the area with absolute height of relief of 1000 m and more;
