1. 1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of carrying out strain testing of agricultural plants

Chapter 1. General provisions

1. These rules of carrying out strain testing of agricultural plants (further - Rules) are developed according to the Law of the Republic of Kazakhstan of July 13, 1999 "About protection of selection achievements" and the Law of the Republic of Kazakhstan of February 8, 2003 "About seed farming" and determine procedure for carrying out strain testing of agricultural plants.

2. In these rules the following basic concepts are used:

1) agricultural plants - grain, leguminous, groat, forage, oil-bearing, essential oil-bearing, commercial, vegetable, medicinal, flower, fruit, berry crops, potatoes, grapes;

2) the vegetative period - the period from emergence of shoots before maturing;

3) databank - the code of passport data of grades on which expertize and testing for patentability and economic usefulness were carried out, with separation into the grades included in the State register of the selection achievements recommended for use in the Republic of Kazakhstan (further - the State register), and the grades which are not included in the State register;

4) field trial on distinguishability, uniformity and stability - studying of new grades in field conditions in comparison with grades standards, on the signs determined by techniques for each culture by their visual assessment on compliance to criteria of distinguishability, uniformity and stability;

5) laboratory research - testing of grades of agricultural plants in vitro regarding distinguishability and uniformity on morphological and biochemical features and compliance to the description provided in the request for patent grant for selection achievement;

6) advisory council on consideration of entering of changes into the State register of the selection achievements recommended for use in the Republic of Kazakhstan (further - Advisory council) - the advisory body of State commission created for the purpose of preparation of offers on the state testing and protection of selection achievements;

7) State commission - The state commission on strain testing of crops which is under authority of authorized body in the field of seed farming, performing examination and testing of grades of agricultural plants for patentability and economic usefulness;

8) the applicant - physical person or legal entity which submitted the application for patent grant for selection achievement and (or) the request for inclusion of selection achievement in the State register;

9) use cycle - the period of use of long-term herbs during which harvesting is made;

10) patentability - grade compliance to criteria of novelty, distinguishability, uniformity and stability;

11) the expert organization - the organization subordinated to authorized state body in the field of protection of selection achievements performing activities in the spheres referred to the state monopoly (rendering services in the field of protection of selection achievements);

12) authorized state body in the field of protection of selection achievements - Ministry of Justice of the Republic of Kazakhstan;
