Changes which are made to the resolution of the Cabinet of Ministers of Ukraine of March 20, 2020 No. 225

1. Procedure for carrying out purchases of the goods, works and services necessary for implementation of the actions directed to prevention of origin and distribution, localization and liquidation of flashes, epidemics and pandemics of koronavirusny disease (to state COVID-19) in the territory of Ukraine approved by the specified resolution in the following edition:

Procedure for carrying out purchases of the goods, works and services necessary for implementation of the actions directed to prevention of origin and distribution, localization and liquidation of flashes, epidemics and pandemics of koronavirusny disease (COVID-19) in the territory of Ukraine

1. This Procedure determines rules of carrying out goods by the customer of the purchases, works and services necessary for implementation of the actions directed to prevention of origin and distribution, localization and liquidation of flashes, epidemics and pandemics of koronavirusny disease (COVID-19) in the territory of Ukraine.

2. In this Procedure terms are used in such value:

purchase - acquisition by the customer of goods, work or service which are necessary for implementation of the actions directed to prevention of origin and distribution, localization and liquidation of flashes, epidemics and pandemics of koronavirusny disease (COVID-19), according to the rules determined by this Procedure;

person authorized by the customer on carrying out purchases (further - person authorized by the customer), - office (official) face of the customer which is determined by it responsible for the organization and carrying out purchases.

Other terms are used in the value given in the Law of Ukraine "About public purchases" and other regulatory legal acts.

3. When carrying out purchases the customer and persons authorized by the customer are guided by the Constitution and the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine accepted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, other acts of the legislation.

4. Procurements are conducted with respect for the following principles:

fair competition among participants;

maximum economy, efficiency and proportionality;

openness and transparency during the organization and purchase execution;

nondiscrimination of participants and equal attitude towards them;

objective and impartial determination of the winner of purchase;

prevention of corruption offenses.

5. Procurement planning is performed by the customer based on the available need for purchase of goods, works and services.

6. Person authorized by the customer:

plans purchases and enters information in the annual plan of purchases in electronic purchasing system, in particular about technical, quality and other characteristics of subject of purchase;

organizes and carries out purchases. The customer can independently establish criteria of respectability and reliability of the choice of person with whom the purchase agreement will be signed;

provides creation, approval and storage of the relevant documents concerning purchases;

provides promulgation in electronic purchasing system of information necessary for accomplishment   of Items 8 and 9 of the Section I of the Law of Ukraine of March 17, 2020 to No. 530-IX "About modification of some legal acts of Ukraine, directed to prevention of origin and spread of koronavirusny disease (COVID-19)";

makes other actions provided by this Procedure.

All solutions of the face authorized by the customer are drawn up by the protocol with indication of decision date.".
