About approval of quarantine phytosanitary requirements

1. Approve the enclosed quarantine phytosanitary requirements.

2. Declare invalid the order of the Minister of Agriculture of the Republic of Kazakhstan of January 30, 2015 No. 4-4/66 "About approval of the phytosanitary requirements imposed to the imported quarantine products" (it is registered in the Register of state registration of regulatory legal acts for No. 11781, it is published on September 1, 2015 in information system of law of Ad_let).

3. To provide to department of veterinary and phytosanitary safety of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Quarantine phytosanitary requirements

Chapter 1. General provisions

1. These quarantine phytosanitary requirements are developed according to the subitem 5) of Item 1 of article 7 of the Law of the Republic of Kazakhstan "About quarantine of plants".

2. These quarantine phytosanitary requirements are imposed to the quarantine products (quarantine freights, quarantine materials, quarantine goods) which are subject to phytosanitary quarantine control and supervision (further - quarantine products), and also to quarantinable objects and are directed to non-admission of import and distribution of quarantine objects.

3. In these quarantine phytosanitary requirements the following basic concepts are used:

1) bouquet - the gathered cut flowers, buds, leaves, branches, herbs, mosses, lichens and (or) other parts of plants without flowers or buds, fresh or dried, in number of no more than fifteen pieces;

2) movement of quarantine products - interregional transportations of quarantine products on the territory of the Republic of Kazakhstan;

3) free zone - part of the territory of the Republic of Kazakhstan for which lack of quarantine object and alien type is scientifically proved and in which if necessary it is maintained under direct supervision and supervision of authorized body on quarantine of plants;

4) empty seat of production - administrative and territorial unit or set of the parcels of land for which lack of quarantine object and alien type is scientifically proved and on which if necessary it is supported under direct supervision and supervision of authorized body on quarantine of plants during the certain period of time (at least one vegetative period);

5) the free site of production - the field, garden, the greenhouse, forest either the parcel of land or other quarantinable object for which lack of quarantine object and alien type is scientifically proved and on which if necessary it is supported under direct supervision and supervision of authorized body on quarantine of plants during the certain period of time (at least one vegetative period).

4. Movement of the quarantine products infected with the quarantine objects and (or) alien types included in the list of quarantine objects and alien types in relation to which actions for quarantine of plants are established and performed No. 4-4/282 approved by the order of the Minister of Agriculture of the Republic of Kazakhstan of March 30, 2015 (it is registered in the Register of state registration of regulatory legal acts No. 11739) (further - the List), except as specified, provided by these quarantine phytosanitary requirements is not allowed.

5. The moved quarantine products in which the quarantine objects and (or) alien types included in the List were revealed are subject to conversion, disinfecting, return to the sender or destruction (including container), except as specified, provided by these quarantine phytosanitary requirements.

8. Moved, including in mailings, the accompanied and unaccompanied baggage of passengers of courts, airplanes, cars, vehicles, members of crews of vessel, airplanes and in dining-cars, seed and landing material (including seed and food potatoes and material for the selection and research purposes) is followed by the phytosanitary certificate.

These quarantine phytosanitary requirements extend to local executive bodies, legal entities, physical persons (including registered as individual entrepreneurs) whose activities are connected with production, procurement, conversion, transportation, storage, realization and use of quarantine products.

Chapter 2. The quarantine phytosanitary requirements imposed to seed and landing material of plants

12. Seed (in the form of seeds or fruits) and landing (in the form of seedling) material shall be free from quarantine objects, including from quarantine weed plants.

Seed material (in the form of seeds and fruits) shall be prepared in zones, free from plants of sort of strig (Striga spp.).

Landing material (in the form of seedling) shall be free from sort plants dodder (Cuscuta spp.).

13. Batches (part of batch) of seed and landing material move in packed form in the presence of the marking containing information on product name, the country, the place and (or) the site of production, the exporter. The moved without the specified marking and (or) unpacked seed and landing material is not allowed to movement.

14. Potatoes for the seed and selection purposes, include seeds, tubers of klubneobrazuyushchy types of the sort Solanum (generally Solanum tuberosum type), minitubers (the tubers coming from the microplants of potatoes which are grown up on nutrient medium) and microplants (plants, including the microtubers containing in fabric culture of the klubneobrazuyushchy sort Solanum spp.). 16. Batches (part of batch) of seed and landing material in which quarantine objects were revealed are subject to disinfecting, return to the sender or destruction. The quarantine phytosanitary requirements imposed to seed and landing material are determined according to appendix 1 to these quarantine phytosanitary requirements.

Chapter 3. The quarantine phytosanitary requirements imposed to vegetables and potatoes

17. Soil impurity in potatoes and other klubneplodny and rhizocarpous vegetables is allowed to one percent from actual weight of products.
