According to part 5 of article 7 of the Federal Law of December 29, 2006 No. 256-FZ "About additional measures of the state support of the families having children" (The Russian Federation Code, 2007, No. 1, Art. 19; 2020, 9, of the Art. 1127) I order to No.:

1. Approve:

Rules of filing of application about the order means (part of means) of the maternity (family) capital according to appendix No. 1;

the list of the documents necessary for realization of the right of the order means of the maternity (family) capital, according to appendix No. 2.

2. Recognize to invalid:

the order of the Ministry of Labour and Social Protection of the Russian Federation of August 2, 2017 No. 606n "About approval of Rules of filing of application about the order means (part of means) of the maternity (family) capital and the list of the documents necessary for realization of the right of the order means of the maternity (family) capital" (registration No. 48973) is registered by the Ministry of Justice of the Russian Federation on November 22, 2017.

Rules of filing of application about the order means (part of means) of the maternity (family) capital

1. These rules establish procedure for filing of application about the order means (part of means) of the maternity (family) capital (further respectively - the statement, means of maternity capital).

2. Have the right to submit the application persons who received the state certificate on the maternity (family) capital (further respectively - the applicant, the certificate), personally or through the representative.

According to part 2 of article 7 of the Federal Law of December 29, 2006 No. 256-FZ "About additional measures of the state support of the families having children" (The Russian Federation Code, 2007, No. 1, Art. 19; 2020, No. 9, of the Art. 1127) if applicant is child(children), the application can be submitted by adoptive parents, guardians (custodians) or adoptive parents of child(children) with preliminary permission of guardianship and custody body after 3 years since the birth of the child, except as specified, of stipulated in Item 4 these rules at any time, or child(children) on reaching it (them) age of majority or acquisition by it (them) capacities in full before attainment of majority.

3. The application can be submitted after 3 years since birth (adoption) of the child at any time, in connection with the birth (adoption) of which there was right to additional measures of the state support, except as specified, of stipulated in Item 4 these rules.

4. According to part 6.1 of article 7 of the Federal Law of December 29, 2006 No. 256-FZ "About additional measures of the state support of families, the having children" the application can be submitted at any time since birth (adoptions) of the child in connection with which birth there was right to additional measures of the state support, in case of need uses of funds of maternity capital for payment of the initial contribution and (or) repayment of principal debt and interest payment on the credits or loans for acquisition (construction) of premises, including the mortgage loans granted to citizens according to the credit agreement (loan agreement) signed with the organization, including credit institution on payment of paid educational services in implementation of the educational programs of preschool education, on payment connected with receipt of preschool education of other expenses on receipt of monthly payment in connection with the birth (adoption) of the child before achievement of age of three years by it, on purchase of goods and the services intended for social adaptation and integration into society of handicapped children and on receipt of remaining balance of means of the maternity (family) capital in the form of lump sum payment.

5. The statement providing the order funds of maternity capital for receipt of monthly payment in connection with the birth (adoption) of the child before achievement of age by it three years moves according to Rules of the direction of funds (part of means) of the maternity (family) capital for receipt of monthly payment in connection with the birth (adoption) of the child before achievement of age of three years by it, the list of documents (data) necessary for the order funds (part of means) of the maternity (family) capital for receipt of monthly payment in connection with the birth (adoption) of the child before achievement of age of three years by it, the application form about the order funds (part of means) of the maternity (family) capital for receipt of monthly payment in connection with the birth (adoption) of the child before achievement of age of three years by it and the application form about refusal of its obtaining, approved by the order of the Government of the Russian Federation of February 1, 2023 No. 133.

5(1). The statement providing the order funds of the maternity (family) capital for receipt of remaining balance of means of the maternity (family) capital in the form of lump sum payment moves according to Rules of the direction of funds of the maternity (family) capital for receipt of lump sum payment, the application form about the order the funds of the maternity (family) capital for receipt of lump sum payment approved by the order of the Government of the Russian Federation of September 11, 2024 No. 1249.

6. The statement and documents can be filed directly in case of the personal appeal to territorial authority of Fund of pension and social insurance of the Russian Federation, through the multipurpose center of provision of the state and municipal services (further - the multipurpose center), are directed by means of mail service or in electronic form by means of the federal state information system "Single Portal of the State and Municipal Services (Functions)" or information system of Fund of pension and social insurance of the Russian Federation "Personal account of insured person" (further respectively - the Single portal, the Personal account of insured person).

The statement and documents can be filed to territorial authority of Fund of pension and social insurance of the Russian Federation through credit institution or the single institute of development in the housing sphere determined by the Federal Law of July 13, 2015 No. 225-FZ "About assistance to development and increase in management efficiency in the housing sphere and about modification of separate legal acts of the Russian Federation" (The Russian Federation Code, 2015, No. 29, Art. 4351; 2019, No. 49, the Art. 6960) (further - single institute of development in the housing sphere), based on the signed agreements which standard form is established by Fund of pension and social insurance of the Russian Federation according to part 13 of article 10 of the Federal Law of December 29, 2006 No. 256-FZ "About additional measures of the state support of the families having children" in case of the order means (part of means) of the maternity (family) capital for the purpose of payment of the initial contribution and (or) repayment of principal debt and interest payment on the credits or loans for acquisition (construction) of premises, including mortgage loans.

7. The application is submitted to any territorial authority of Fund of pension and social insurance of the Russian Federation irrespective of the residence (stay) or the actual accommodation of the applicant.

The applicants who left on the permanent residence of the territory of the Russian Federation and not taking confirmed with registration residences (stay) in the territory of the Russian Federation submit the application directly to Fund of pension and social insurance of the Russian Federation.

8. In case of the personal appeal to territorial authority of Fund of pension and social insurance of the Russian Federation or through the multipurpose center the application is submitted with presentation of the following documents:

a) identity documents;

b) identity documents and power of the representative of the applicant, - in case of filing of application through the applicant's representative.

In case of the appeal of the applicant to territorial authority of Fund of pension and social insurance of the Russian Federation by means of the Single portal, the Personal account of insured person by filing of application electronically, signed the simple digital signature, according to Item 2.1 of Rules of determination of types of the digital signature which use is allowed in case of the request for receipt of the state and municipal services approved by the order of the Government of the Russian Federation of June 25, 2012 No. 634 "About types of the digital signature which use is allowed in case of the request for receipt of the state and municipal services" (The Russian Federation Code, 2012, No. 27, Art. 3744; 2018, No. 36, of the Art. 5623), submission of the documents specified in the subitem "an" of this Item is not required.

9. Are specified in the statement:

a) the name of territorial authority of Fund of pension and social insurance of the Russian Federation to which the application is submitted;

b) surname, name, middle name (in the presence) applicant;

c) the status of person who received the certificate (mother, the father, the child);

d) data on the identity document of the applicant (the name, series and number by whom and when it is issued);

e) place of residence (stay) (postal index, name of the region, area, city, other settlement, street, house number, case, apartment);

e) data on the place of the actual accommodation (postal index, name of the region, area, city, other settlement, street, house number, case, apartment);

g) information about the applicant's representative (surname, name, middle name (in the presence), residential address (stay), actual accommodation, insurance number of the individual ledger account);

j) data on the chosen direction of use of means of maternity capital (on improvement of housing conditions, education by child(children), forming of funded pension, compensation of purchase costs of the goods and services intended for social adaptation and integration into society of handicapped children, receipt of remaining balance of means of the maternity (family) capital in the form of lump sum payment with indication of expense type and the amount of means of maternity capital);

k) ceased to be valid according to the Order of the Ministry of Labour and Social Protection of the Russian Federation of 01.08.2022 No. 441n

c) the list of the enclosed documents;

r) data on acquaintance:

with the Rules of the direction of funds of the maternity (family) capital for improvement of housing conditions approved by the order of the Government of the Russian Federation of December 12, 2007 No. 862 (The Russian Federation Code, 2007, No. 51, Art. 6374; 2020, No. 8, the Art. 1004), - in case of the direction of funds of maternity capital for improvement of housing conditions;

with Rules of the direction of funds of the maternity (family) capital for purchase of goods and the services intended for social adaptation and integration into society of handicapped children, by compensation of purchase costs of such goods and services, approved by the order of the Government of the Russian Federation of April 30, 2016 No. 380 (The Russian Federation Code, 2016, No. 20, Art. 2828; 2020, No. 7, the Art. 841), - in case of the direction of funds of maternity capital for purchase of goods and the services intended for social adaptation and integration into society of handicapped children;

with the Rules of refusal of the direction of funds (part of means) of the maternity (family) capital for forming of funded pension approved by the order of the Ministry of Labour and Social Protection of the Russian Federation of March 11, 2016 No. 100n (registration No. 42000) is registered by the Ministry of Justice of the Russian Federation on May 4, 2016, with the changes made by orders of the Ministry of Labour and Social Protection of the Russian Federation of August 3, 2017 No. 609n (registration No. 47883) is registered by the Ministry of Justice of the Russian Federation on August 21, 2017, of January 26, 2018 No. 36n (it is registered by the Ministry of Justice of the Russian Federation on February 14, 2018, registration No. 50045) and of March 31, 2020 No. 176n (registration No. 59192) is registered by the Ministry of Justice of the Russian Federation on August 6, 2020, and also with the Rules of the direction of unused funds (part of means) of the maternity (family) capital for forming of funded pension approved by the order of the Ministry of Labour and Social Protection of the Russian Federation of February 26, 2021 No. 92n (registration No. 62936) is registered by the Ministry of Justice of the Russian Federation on March 31, 2021, - in case of the direction of funds of maternity capital for forming of funded pension;

s) data on acquaintance with information on obligation to draw up the premises acquired (built, reconstructed) with use of means of maternity capital, in common property of person who received the certificate, his spouse (spouses), children (including the first, second and subsequent children) with determination of the size of shares under the agreement;

t) information on reliability of the data provided in the statement, and also knowledge of the applicant of responsibility for reliability of the provided data.

The application is signed by the applicant with putting down of date of filling of the statement.

10. The statement and documents (the copy of documents) which list is provided by appendix No. 2 (further - documents), filed directly in case of the personal appeal to territorial authority of Fund of pension and social insurance of the Russian Federation, are registered in day of the address of the applicant. The official of territorial authority of Fund of pension and social insurance of the Russian Federation issues to the applicant the notification on reception of an application.

11. The statement and documents (the copy of documents) can be directed by means of mail service by the method allowing to confirm the fact and date of departure.

In this case originals of documents do not go also identification, witnessing of authenticity of the signature of the applicant on the statement, the certificate of fidelity of copies of the enclosed documents are performed:

a) notary or other person according to the procedure, stipulated by the legislation Russian Federation;

b) officials of consular establishments of the Russian Federation if the citizen constantly lives outside the territory of the Russian Federation.

The statement adopted by means of mail service is registered no later than the first working day following behind day of its receipt of pension and social insurance of the Russian Federation by territorial authority of Fund, and to the applicant the notice on the date of receipt of the statement goes.

12. The statement and documents in the form of electronic documents processed according to the order of the Government of the Russian Federation of July 7, 2011 No. 553 "About procedure for registration and submission of the statements and other documents necessary for provision of the state and (or) municipal services, in the form of electronic documents" (The Russian Federation Code, 2011, No. 29, the Art. 4479) sent to territorial authority of Fund of pension and social insurance of the Russian Federation by means of the Single portal or the Personal account of insured person are registered in the automatic mode.

The basis for the reception of an application directed in electronic form by means of the Single portal or the Personal account of insured person is the direction the applicant by means of the Single portal or the Personal account of insured person of data from the documents specified in part 6 of article 7 of the Federal Law of July 27, 2010 to No. 210-FZ "About the organization of provision of the state and municipal services" (The Russian Federation Code, 2010, No. 31, Art. 4179; 2020, No. 9, the Art. 1127) if other is not provided by legal acts of the Russian Federation in case of regulation of provision of the state service in issue of the certificate.

The term of submission of documents by the applicant (the data from documents) shall not exceed 5 working days from the date of the direction territorial authority of Fund of pension and social insurance of the Russian Federation notifications.

In case of representation by the applicant by means of the Single portal or the Personal account of insured person of documents (data from documents) the official of territorial authority of Fund of pension and social insurance of the Russian Federation in day of receipt registers them and sends to the applicant electronically the notification on reception of an application.

If the applicant did not submit during the specified term documents (data from documents), he is notified on refusal in consideration of the application by means of the Single portal or the Personal account of insured person within 1 working day following behind day of the termination of term of submission of documents with indication of causes of failure.

13. The statement and documents (copies of documents which fidelity is established by persons specified in Item 9 of these rules (data from documents) can be submitted to territorial authority of Fund of pension and social insurance of the Russian Federation through the multipurpose center according to the procedure, established by the Rules of the organization of activities of the multipurpose centers of provision of the state and municipal services approved by the order of the Government of the Russian Federation of December 22, 2012 No. 1376 (The Russian Federation Code, 2012, No. 53, Art. 7932; 2020, No. 7, Art. 836).

Date of the reception of an application given to the multipurpose center date of its registration in the multipurpose center is considered.

The term of submission of documents (data from documents) shall not exceed 5 working days from the date of the direction territorial authority of Fund of pension and social insurance of the Russian Federation notifications in the multipurpose center.

If during the specified term the multipurpose center does not submit documents (data from documents), the territorial authority of Fund of pension and social insurance of the Russian Federation sends to the multipurpose center the notification on refusal in consideration of the application with indication of causes of failure and possibility of submission of the statement and documents (data from documents) repeatedly.

14. In case of the order means of maternity capital for the purpose of payment of the initial contribution and (or) repayment of principal debt and interest payment on the credits or loans for acquisition (construction) of premises, including mortgage loans, provided according to the credit agreement (loan agreement), the statement and documents (the copy of documents) can be filed to territorial authority of Fund of pension and social insurance of the Russian Federation through credit institution or single institute of development in the housing sphere. At the same time submission of the statement and documents (copies of documents) to territorial authority of Fund of pension and social insurance of the Russian Federation by the applicant it is not required.

Date of reception of an application and the documents filed through credit institution or single institute of development in the housing sphere date of their receipt in territorial authority of Fund of pension and social insurance of the Russian Federation via secure channels of communication or with use of single system of interdepartmental electronic interaction is considered.

The official of territorial authority of Fund of pension and social insurance of the Russian Federation sends the notification to credit institution or single institute of development in the housing sphere for informing the applicant on acceptance of its statement no later than the first working day following behind day of its receipt of pension and social insurance of the Russian Federation by territorial authority of Fund.

16. Documents (copies of documents, the data from documents), the order rights, necessary for realization, by means of maternity capital, are requested by territorial authority of Fund of pension and social insurance of the Russian Federation in the bodies providing the state services, the bodies providing municipal services, other state bodies, local government bodies and the organizations subordinated to state bodies or local government bodies if the specified documents (copies of documents, data from documents) are at the disposal of such bodies or organizations.

The applicant has the right to submit on own initiative the documents necessary for realization of the right of the order means of maternity capital which list is provided by appendix No. 2.

17. In case of consideration of the application the territorial authority of Fund of pension and social insurance of the Russian Federation has the right to check reliability of the data containing in the submitted documents (copies of documents).

18. The statement adopted by territorial authority of Fund of pension and social insurance of the Russian Federation can be cancelled at the request of the applicant by giving by it personally or through the representative of the plea of nullity of earlier submitted application (further - the plea of nullity).

The plea of nullity can be submitted to territorial authority of Fund of pension and social insurance of the Russian Federation to which the application, before transfer by territorial authority of Fund of pension and social insurance of the Russian Federation of means of maternity capital according to the statement in time no later than 5 working days from the date of receipt of the notification on the adopted statement and documents (copies of documents) was submitted earlier.

20. The notification of the applicant on cancellation of the statement and return (at his desire) the documents (copies of documents) submitted together with the statement are performed by territorial authority of Fund of pension and social insurance of the Russian Federation within 1 working day from the date of receipt of the plea of nullity in the form providing possibility of confirmation of the fact and date of departure of the notification and documents.

to the Order of the Ministry of Labour and Social Protection of the Russian Federation of March 24, 2020 No. 149n

List of the documents necessary for realization of the right of the order means of the maternity (family) capital

1. Permission of guardianship and custody body about expenditure of means of maternity capital in the chosen directions - in case of filing of application about the order means (part of means) of the maternity (family) capital guardians (custodians) or adoptive parents of minor child(children).

2. The documents (data from documents) confirming acquisition by minor child(children) of capacity to act in full before attainment of majority (the marriage certficate, the decision of guardianship and custody body or the judgment about the announcement of the minor sui juris), - in case of filing of application about the order means (part of means) of the maternity (family) capital minor child(children).
