According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:

1. Approve Rules of rendering the state service of the Department of Energy of the Republic of Kazakhstan "Approval of designing and construction of the duplicative (shunting) power lines and substations" according to appendix 1 to this order.

2. Recognize invalid some orders of the Department of Energy of the Republic of Kazakhstan according to appendix 2 to this order.

3. To provide to development department of power industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

5. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of rendering the state service "Approval of Designing and Construction of the Duplicative (Shunting) Power Lines and Substations"

Chapter 1. General provisions

1. These rules of rendering the state service "Approval of Designing and Construction of the Duplicative (Shunting) Power Lines and Substations" (further - Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" (further - the Law) and determine procedure for approval of designing and construction of the duplicative (shunting) power lines and substations.

2. Approval of designing and construction of the duplicative (shunting) power lines and substations is carried out for the purpose of official recognition by authorized body in the field of power industry of competences of the legal entity to carry out designing and construction of the duplicative (shunting) power lines and substations with certain technical parameters.

3. The state service "Approval of Designing and Construction of the Duplicative (Shunting) Power Lines and Substations" (further - the state service) appears the Department of Energy of the Republic of Kazakhstan (further - the service provider).

4. In these rules the following basic concepts are used:

1) the state service - one of the forms of realization of the separate state functions performed in individual procedure according to the address or without address of uslugopoluchatel and directed to realization of their rights, freedoms and legitimate interests, provision of the corresponding material or non-material benefits by it;

2) the standard of the state service - the list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service;

3) the web portal of "the electronic government" www.egov.kz (further - the portal) - the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;

4) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

5. The list of the main requirements to rendering the state service is provided in the standard of the state service "Approval of Designing and Construction of the Duplicative (Shunting) Power Lines and Substations" according to appendix 1 to these rules.

Chapter 2. Procedure for rendering the state service

6. The legal entity (further - uslugopoluchatel) for receipt of the letter approval of designing and construction of the duplicative (shunting) power lines and substations sends to the service provider by means of the portal:

1) the statement in electronic form with indication of technical parameters of the designing and construction of the duplicative (shunting) power lines and substations certified by the EDS in form, according to appendix 2 to these rules;

2) the electronic copy of the act of differentiation of balance sheet accessory of power networks and operational responsibility of the parties with the existing scheme of connection of the consumer to power networks;

3) the electronic copy of the planned scheme of connection of the consumer to power networks in any form;

4) the electronic copy of the conclusion of the relevant power transferring organization about impossibility of electric power supply to the consumer for the existing power networks in any form;

5) the electronic copy of the operating specifications.

7. Aggregate term of rendering the state service by the service provider constitutes 20 (twenty) working days from the moment of acceptance and registration of a statement.

8. Data on identity documents, state registration (re-registration) of the legal entity the service provider receives from the corresponding state information systems through lock of "the electronic government".

9. The responsible structural division of the service provider within 2 (two) working days from the moment of registration of the submitted documents specified in Item 6 of these rules checks their completeness.

10. In case of representation by the applicant of incomplete document package, the responsible structural division of the service provider prepares motivated refusal in further review of the statement in form, according to appendix 3 to these rules and sends it to the applicant by means of the portal in electronic form.

11. In case of representation by uslugopoluchatel of complete document package, the these rules specified in Item 6, the responsible structural division of the service provider within 3 (three) working days from the moment of registration of a statement sends inquiries:

1) about approval of designing and construction of the duplicative (shunting) power lines and substations - in the authorized body performing management in the respective spheres of natural monopolies and to the system operator which review the provided request within 7 (seven) working days from the moment of its receipt;

2) about issue of the conclusions about technical feasibility of construction of the duplicative (shunting) power lines and substations for objects of 110 kV and below, 220 kV and above - in local executive bodies of areas, cities of republican value, the capital which review request within 7 (seven) working days from the moment of its receipt.

12. In case of receipt of affirmative answers about approval of designing and construction of the duplicative (shunting) power lines and substations, and also the conclusions about technical feasibility of construction of the duplicative (shunting) power lines and substations for objects of 110 kV and below, 220 kV and above, responsible structural division of the service provider within 10 (ten) working days establish compliance or discrepancy of uslugopoluchatel to the requirements established by these rules and article 9 of the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry".

13. In case of compliance of uslugopoluchatel to the requirements specified in Item 12 of these rules, the responsible structural division of the service provider within 1 (one) working day prepares the letter - approval of designing and construction of the duplicative (shunting) power lines and substations in form, according to appendix 4 to these rules or motivated refusal in rendering the state services in form, according to appendix 3 to these rules.

14. The refusal in rendering the state service is performed on the following bases:

1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them;

2) discrepancy of uslugopoluchatel and (or) the provided materials, supplied and the information necessary for rendering the state service, to the requirements established by these rules and article 9 of the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry";

3) negative reply to the request about approval, stipulated in Item 11 these rules;

4) concerning uslugopoluchatel there is judgment which took legal effect based on which the uslugopoluchatel is deprived of the special right connected with receipt of the state service.

15. The service provider provides entering of data on stage of rendering the state service into information system of monitoring of rendering the state services.

16. When rendering the state service by means of the state information system of permissions and notifications data on stage of rendering the state service arrive in the automatic mode in information system of monitoring of rendering the state services.

3. Procedure for appeal of decisions, actions (failure to act) of the service provider concerning rendering the state services

17. The claim to decisions, action (failure to act) of employees of structural divisions of the service provider can be submitted addressed to the head of the service provider and (or) to authorized body by assessment and control of quality of rendering the state services.

The claim of uslugopoluchatel which arrived to the service provider according to the subitem 2) of Item 3 of article 25 of the Law is subject to consideration within five working days from the date of its registration.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within fifteen working days from the date of its registration.

18. In disagreement cases with results of the decision of the service provider the uslugopoluchatel can appeal results judicially.
