Millie Majlis of the Azerbaijan Republic, being guided by Items 1, of 10, of 11, 17 and 24 parts I of article 94 of the Constitution of the Azerbaijan Republic, decides:
Article 1. Article 2. Make the following changes to the Customs code of the Azerbaijan Republic (Collection of the legislation of the Azerbaijan Republic, 2011, No. 9, Article 787; 2014, No. 10, Article 1155, No. 11, Article 1368; 2016, No. 11, Article 1791; 2017, No. 3, Article 339, No. 7, Article 1303, No. 8, Article 1510; 2018, No. 1, Article 30, No. 11, article 2211, No. 12 (book I), Article 2521; 2019, No. 1, Article 30; The Law of the Azerbaijan Republic of May 3, 2019 No. 1584-VQD):
2.1. In Article 9.0.5 after words" (the certificate of goods" to add the word", the certificate of food safety (health) concerning foodstuff, the statement from the state register about registration of food safety of their producers";
2.2. In Article 92.2.3 after words" (with certificates) goods" to add the word "with the certificate of food safety (health) concerning foodstuff, with the statement from the state register about registration of food safety of their producers".
Article 3. In the Law of the Azerbaijan Republic "About fishery" (Collection of the legislation of the Azerbaijan Republic, 1998, No. 6, Article 362; 2002, No. 5, Article 241; 2004, No. 2, Article 57; 2007, No. 10, Article 938; 2014, No. 8, of the Art. 959, No. 11, of the Art. 1366) to make the following changes:
3.1. Under Article 2:
3.1.1. To state the first part of this Article in the following edition:
"The legislation on fishery consists of this Law, the Law of the Azerbaijan Republic "About foodstuff" and other regulatory legal acts";
3.1.2. add the word the "quality", "minimum" before the word, in the second part of this Article;
3.2. Under Article 13:
3.2.1. state the first and second parts in the following edition:
"In the Azerbaijan Republic fish products which minimum quality and safety conform to requirements of technical regulatory legal acts in the field of food safety the having documents on origin and quality made by the subjects accepted on registration of food safety can be included in business volume.
Fish products are packed and marked according to article 11 of the Law of the Azerbaijan Republic "About foodstuff";
3.2.2. in the sixth part of the word "in the legislation of the Azerbaijan Republic" shall be replaced with words "in the Law of the Azerbaijan Republic "About foodstuff";
3.2.3. cancel the seventh part.
Article 4. In the Law of the Azerbaijan Republic "About foodstuff" (Collection of the legislation of the Azerbaijan Republic, 2000, No. 1, Article 8; 2001, No. 12, Article 736; 2003, No. 1, Article 7; 2004, No. 1, Article 6; 2007, No. 6, Article 560; 2009, No. 2, Articles 49, 55; 2011, No. 4, Article 257; 2013, No. 11, Article 1290; 2014, No. 11, Article 1365; 2015, No. 11, Article 1252; 2017, No. 5, Articles 718, 747; 2018, No. 4, article 642, No. 12 (the book II), Article 2492) to make the following changes:
4.1. To state the thirteenth paragraph of the first part of Article 1 in the following edition:
"The subjects performing activities in the field of food (foodstuff) - business entities, and also state bodies (organizations), the municipalities performing activities at all stages of power-supply circuit";
4.2. Under Article 5:
4.2.1. exclude the word "standards" in the first part;
4.2.2. state the second part in the following edition:
"Development and acceptance of technical regulatory legal acts in the field of food safety is performed by body (organization) determined by relevant organ of the executive authority";
4.2.3. state the third part in the following edition:
"Technical regulatory legal acts in the field of food safety on all equipment and means used for production of foodstuff are accepted by body (organization) determined by relevant organ of the executive authority";
4.2.4. exclude from the fourth part of the word "technical regulations and";
4.3. In the first offer of the third part of Article 6 of the word "according to the legislation" shall be replaced with words "in the appropriate order";
4.4. State Article 7.3 in the following edition:
"7.3. The business entities who are not accepted on registration of food safety are forbidden to work in the field of foodstuff, despite their acceptance for tax accounting";

5.1. Under Article 1:
5.1.1. State Article 1.0.4 in the following edition:
"1.0.4. The minimum quality of grain and products of its conversion - compliance of consumer properties of grain products to technical regulatory legal acts in the field of food safety";
5.1.2. add Article 1.0.5 of the following content:
"1.0.5. technical regulatory legal acts in the field of food safety - the technical regulatory legal acts determined by article 5 of the Law of the Azerbaijan Republic "About foodstuff".
5.2. In Article 2.1 after words of "this Law" to add the word of "the Law of the Azerbaijan Republic "On foodstuff";

The grain products imported to the Azerbaijan Republic shall have the certificate of food safety (health) recognized in the appropriate order or issued by body (organization), determined by relevant organ of the executive authority. If the producer of import grain products was registered food safety, products of this producer do not require the certificate of food safety (health)";
5.6. State Article 12 in the following edition:
"Article 12. Ensuring the minimum quality of grain products
12.1. The minimum quality of grain products is provided according to article 4 of the Law of the Azerbaijan Republic "About foodstuff".
12.2. For the purpose of determination of compliance of indicators of quality to the requirements established in the corresponding standard, grain products voluntarily will be certified by accredited bodies on assessment of conformity at the discretion of the producer. Accreditation of conformity assessment bodies is performed according to the Law of the Azerbaijan Republic "About accreditation in the field of assessment of conformity";
5.7. Under Article 13:
5.7.1. in the name of the word "regulation of quality requirements" shall be replaced with words "requirements to the minimum quality";
5.7.2. In Article 13.1 before the word "quality" to add the word "minimum", in this Article of the word of "standards and requirements" shall be replaced with words "technical regulatory legal acts in the field of food safety";
5.7.3. State Article 13.2 in the following edition:
"13.2. Requirements in the field of ensuring the minimum product quality of conversion of grain are determined by technical regulatory legal acts in the field of food safety";
5.8. Cancel Article 14. 3, 14.4 and 14.5;
5.9. Under Article 15:
5.9.1. In Articles 15.1 and 15.3.1 15.3.7 of the word of "standards and requirements" shall be replaced with words "requirements of technical regulatory legal acts in the field of safety of foodstuff", in Article 15.3.7 of the word to "standards and requirements" shall be replaced with words to "requirements of technical regulatory legal acts in the field of safety of foodstuff";
5.9.2. In Article 15.3.7 before the word "qualities" to add the word of "minimum";

"15.4. The state control of observance of requirements of technical regulatory legal acts in the field of food safety in connection with ensuring the minimum quality and safety of grain products is performed according to article 8 of the Law of the Azerbaijan Republic "About foodstuff".
Article 6. Make the following changes to the Law of the Azerbaijan Republic "About wine growing and winemaking" (Collection of the legislation of the Azerbaijan Republic, 2002, No. 1, Article 3; 2003, No. 1, article 15, No. 12 (book I), Article 674; 2005, No. 4, Article 278; 2007, No. 5, Article 397, No. 10, Article 938; 2008, No. 12, Article 1044; 2013, No. 11, Article 1291; 2016, No. 1, Article 29; 2017, No. 5, Article 716, No. 7, Article 1264; 2018, No. 6, Article 1163; 2019, No. 4, Article 577):
6.1. In Article 2.1 after words of "this Law" to add the word of "the Law of the Azerbaijan Republic "On foodstuff";
6.2. In Article 5.0.7 and the name of Article 27 before the word "quality" to add the word "minimum" and in the name of Chapter VI before the word "QUALITIES" to add the word of "MINIMUM";
6.3. add Articles 6.4 and 6.5 of the following content:
"6.4. The instructions regulating rules and conditions of production, storages, packagings, transportations and realization of grape landing materials and also indicators of quality are established by body (organization) determined by relevant organ of the executive authority.
6.5. The legal entities and physical persons which are engaged in creation of vineyards and cultivation of grape landing materials, including production of high-quality (branded) wine products and brandy (cognac) in the procedure established by the law bear responsibility for purity and phytosanitary condition, high-quality and sowing qualities of the grades.";
6.4. State Article 7 in the following edition:
"Article 7. Technical regulatory legal acts in the field of food safety of commodity grape products and the production technology of grape products
Technical regulatory legal acts in the field of food safety of commodity grape products and the production technology of grape products are accepted in cases and according to the procedure, the stipulated in Clause 5 Laws of the Azerbaijan Republic "About foodstuff".
6.5. In Article 8.3 of the word "the existing regulating documents" shall be replaced with words "the technical regulatory legal acts specified in article 7 of this Law";
6.6. In Article 9.1 of the word to "requirements of the corresponding standards, the approved agrotechnical and technological instructions, and also sanitary standards and rules" shall be replaced with words "technical regulatory legal acts in the field of food safety";
6.7. Cancel Article 9. 2, 12.4, 14.3.3, 14.8, 14.9, 14.14, 15,8, 16, 21.3, 23, 24.2, 24.3, 25, 26.3;
6.8. In Article 9.3 of the word "with the legislation of the Azerbaijan Republic" shall be replaced with words "with article 11 of the Law of the Azerbaijan Republic "About foodstuff" and article 15 of this Law";
6.9. In Article 10.3 of the word "with the approved technological instructions with observance of requirements of the corresponding standards, sanitary standards and rules" shall be replaced with words "technical regulatory legal acts in the field of food safety";
6.10. State Article 11.8 in the following edition:
"11.8. For the purpose of determination of compliance of indicators of quality to the requirements established by the corresponding standard, winemaking products voluntarily will be certified by accredited bodies on assessment of conformity at the discretion of the producer. Accreditation of conformity assessment bodies is performed according to the Law of the Azerbaijan Republic "About accreditation in the field of assessment of conformity";
6.11. Under Article 12:
6.11.1. In the first offer of Article 12.3 of the word of "the existing standards" shall be replaced with words "technical regulatory legal acts in the field of food safety";
6.11.2. As the second offer of Article 12.3 of the word "the separate technological instruction for its preparation which affirms during product assessment is constituted" shall be replaced with words "the compounding affirms";
6.11.3. In the first offer of Article 12.6 of the word to "the regulating documents approved in the appropriate order" shall be replaced with words to "requirements of technical regulatory legal acts in the field of food safety", and the second offer of this Article - to exclude;

6.13. Under Article 14:
6.13.1. State Article 14.10 in the following edition:
"14:10. The winemaking products made under the new name shall be patented according to the Law of the Azerbaijan Republic "About patents";
6.13.2. Exclude from Article 14.12 of the word "according to the legislation shall be registered in the state register, are certified for the consumer market and";
6.13.3. Exclude from Article 14.13 of the word "registration in the state register and certification";
6.14. State Article 15.1 in the following edition:
"15.1. Packaging, marking, storage and transportation of products of winemaking are performed according to requirements of article 11 of the Law of the Azerbaijan Republic "About foodstuff";
6.15. State Article 15-1.6 in the following edition:
"15-1.6. According to the Law of the Azerbaijan Republic "About foodstuff" if producers or importers of products of winemaking are accepted on registration of food safety or product of the importer who was not registered food safety has the certificate of food safety (health), advertizing of these products is allowed. In advertizing number of registration of food safety or the certificate of food safety of the producer, date of its issue and the name of the body which issued the certificate shall be specified";
6.16. State Article 20.3 in the following edition:
"20.3. The winemaking products imported to the Azerbaijan Republic shall have the certificate of food safety (health) recognized in the appropriate order or issued by body (organization) determined by relevant organ of the executive authority. If the producer of the imported products of winemaking was registered food safety, products of this producer do not require the certificate of food safety (health). Import to the Azerbaijan Republic of the products of winemaking made with use of genetically modified plants or the agricultural plant materials created by modern methods of biotechnology and genetic engineering is not allowed";
6.17. State Articles 21.4.4 and 21.4.5 in the following edition:
"21.4.4. If producers or importers of products of winemaking are not accepted on registration of food safety according to the Law of the Azerbaijan Republic "About foodstuff" or if the product of the importer who was not registered food safety has no certificate of food safety (health);
21.4.5. if products does not conform to requirements of technical regulatory legal acts in the field of food safety or are made with use of genetically modified plants or the agricultural plant materials created with use of modern methods of biotechnology and genetic engineering";
6.18. State Article 22 in the following edition:
"Article 22. Application of rationing arrangements
22.1. Checks of subjects of entrepreneurship, and also application of rationing arrangements are performed according to the Law of the Azerbaijan Republic "On regulation of the inspections which are carried out in the field of entrepreneurship and protection of interests of entrepreneurs";
22.2. Destruction or use of the products of winemaking withdrawn from circulation is regulated according to the Law of the Azerbaijan Republic "About foodstuff".
22.3. During emergency or warlike situation in places of its introduction the specific mode of turnover of products of winemaking according to the laws of the Azerbaijan Republic "About emergency state" and "About warlike situation" can be set.
6.19. State Article 26.1 in the following edition:
"26.1. According to the Law of the Azerbaijan Republic "About foodstuff" winemaking products, producers or importers of which are not accepted on registration of food safety, have no certificate of food safety, the right to patent belongs to other persons in whose etiquette the production site is not specified or specified incorrectly, the origin of production or the trademark of which are incorrect, it is considered counterfeit";
6.20. Under Article 27:
6.20.1. In Article 27.1 of the word of "requirements of regulating documents" shall be replaced with words "requirements of technical regulatory legal acts in the field of food safety", and words of "hygienic standards" - to exclude;
6.20.2. State Article 27.2 in the following edition:
"27.2. The state control of observance of requirements of technical regulatory legal acts in the field of food safety on ensuring the minimum quality and safety of products of winemaking is performed by body (organization) determined by relevant organ of the executive authority according to article 8 of the Law of the Azerbaijan Republic "About foodstuff".;
6.20.3. Repeal Article 27.3.
Article 7. Make the following changes to the Law of the Azerbaijan Republic "About iodination of salt for the purpose of mass prevention of iodine-deficiency diseases" (Collection of the legislation of the Azerbaijan Republic, 2002, No. 1, Article 10):
7.1. In article 2 after words of "this Law" to add the word of "the Law of the Azerbaijan Republic "On foodstuff";
7.2. State Article 5.0.5 in the following edition:
"5.0.5. "obligation of the technical regulatory legal acts in the field of food safety determining conditions of production, transportations, storages, packagings, markings and realization of iodized salt according to article 5 of the Law of the Azerbaijan Republic "About foodstuff";
7.3. In Articles 6. 2, 6.3 and 11 before the word "quality" in the corresponding cases to add the word "minimum" in the corresponding cases, in these Articles of the word "standards and requirements" in the corresponding cases shall be replaced with words "requirements of technical regulatory legal acts in the field of food safety";
7.4. Under Article 7:
7.4.1. In the first offer of Article 7.1 before the word "quality" to add the word "minimum", and words to "standards and requirements" in this offer shall be replaced with words to "requirements of technical regulatory legal acts in the field of food safety";
7.4.2. State Article 7.2 in the following edition:
"7.2. Conditions of production, transportations, storages, packagings, markings and realization of salt are performed according to technical regulatory legal acts in the field of food safety";
7.4.3. Repeal Article 7.3;
7.5. State Article 8 in the following edition:
"Article 8. Requirements to production and import of iodized salt
8.1. Activities of producers of iodized salt in the Azerbaijan Republic are checked for the purpose of ensuring compliance to requirements of technical regulatory legal acts in the field of food safety, their products are exposed to examination, and these subjects are accepted on registration of food safety.
8.2. The iodized salt imported to the Azerbaijan Republic shall have the certificate of food safety (health) recognized in the appropriate order or issued by body (organization) determined by relevant organ of the executive authority. If the producer of the imported iodized salt was registered food safety, products of this producer do not require the certificate of food safety (health).
8.3. Production, sale and import to the Azerbaijan Republic not of iodized salt for the food and fodder purposes are prohibited.
8.4. For the purpose of determination of compliance of indicators of quality to the requirements established by the corresponding standard, iodized salt voluntarily will be certified by accredited bodies on assessment of conformity at the discretion of the manufacturer. Accreditation of conformity assessment bodies is performed according to the Law of the Azerbaijan Republic "About accreditation in the field of assessment of conformity".
Article 8. Make the following changes to the Law of the Azerbaijan Republic "About tea growing" (Collection of the legislation of the Azerbaijan Republic, 2004, No. 11, Article 881; 2007, No. 12, Article 1218; 2016, No. 7, Article 1242; 2017, No. 1, Article 7, No. 5, article 715, No. 12 (book I), Article 2209; 2019, No. 1, Article 10):
8.1. At the end of Article 1.0.5 to replace point with semicolon and to add Article 1.0.6 of the following content:
"1.0.6. technical regulatory legal acts in the field of food safety - the technical regulatory legal acts determined by article 5 of the Law of the Azerbaijan Republic "About foodstuff";
8.2. In Article 2.1 after words of "this Law" to add the word of "the Law of the Azerbaijan Republic "On foodstuff";
8.3. In Article 2.2 before the word "quality" to add the word "minimum";
8.4. In Article 6.0.4 before the word "quality" to add the word "minimum";
8.5. Add Article 10.4 of the following content:
"10.4. The instructions regulating rules and conditions of production, storages, packagings, transportations and realization of materials for tea landing and also quality indicators, are determined by body (organization) determined by relevant organ of the executive authority";
8.6. State Article 11 in the following edition:
"Article 11. Legal regulation of production technologies of leaves of green tea
11.1. Regulations in the field of ensuring the minimum quality and safety of leaves of green tea, the quality requirement and safety of these products, conditions of their production, transportation, storage, packaging, marking and sale are determined by technical regulatory legal acts in the field of safety of foodstuff.
11.2. Admissible limits of use of the chemical, biological and other medicines used in case of cultivation of leaves of green tea are regulated by technical regulatory legal acts in the field of food safety";
8.7. State Article 12 in the following edition:
"Article 12. Requirements to processing equipment on processing of leaves of green tea and production of tea products
12.1. Processing of leaves of green tea covers preprocessing of leaves and production of tea products on the basis of special technologies and is performed according to technical regulatory legal acts in the field of food safety and the approved recipes.
12.2. Technical regulatory legal acts in the field of food safety on all equipment and means used for production of products from leaves of green tea are accepted by body (organization) determined by relevant organ of the executive authority.
12.3. Content of caffeine and tannins in tea products cannot be lower, and amount of moisture and metallomagnetic mixes - above the limits set by technical regulatory legal acts in the field of food safety.
12.4. Processing equipment for production of tea products shall be equipped with electronic survey meters and the automated weight counters.
12.5. Use of the chemical, biological and other medicines containing drugs and psychotropic substances when processing leaves of green tea is not allowed.
12.6. By preparation of new brand of tea for production compliance of their structure, indicators of quality, safety for human body and expiration date to the corresponding technical regulatory legal acts in the field of food safety is established, these indicators join in the regulating documentation of products.
12.7. For the purpose of determination of compliance of indicators of quality to the requirements established by the corresponding standard, tea products voluntarily will be certified by accredited bodies on assessment of conformity at the discretion of the producer. Accreditation of conformity assessment bodies is performed according to the Law of the Azerbaijan Republic "About accreditation in the field of assessment of conformity";
8.8. Under Article 13:
8.8.1. In Article 13.1 of the word "according to the legislation of the Azerbaijan Republic" shall be replaced with words "according to requirements of article 11 of the Law of the Azerbaijan Republic "About foodstuff";
8.8.2. Cancel Article 13.2-13. 4, 13.6, 14, 15, 16.5 and 20;
8.9. State Article 16.4 in the following edition:
"16.4. The new brand of tea products shall be patented according to the Law of the Azerbaijan Republic "About patents";
8.10. State Article 17 in the following edition:
"Article 17. Advertizing of tea products
Advertizing of tea products is performed according to the Law of the Azerbaijan Republic "About advertizing";
8.11. State Article 18.3 in the following edition:
"18.3. The tea products imported to the Azerbaijan Republic shall have the certificate of food safety (health) recognized in the appropriate order or issued by body (organization) determined by relevant organ of the executive authority. If the producer of the imported tea products was registered food safety, products of this producer do not require the certificate of food safety (health). Import to the Azerbaijan Republic of tea and the tea products made with use of genetically modified plants or the agricultural plant materials created with use of modern methods of biotechnology and genetic engineering is not allowed";
8.12. State Article 19 in the following edition:
"Article 19. Application of rationing arrangements
