About Rules of registration and issue of the foreign passports containing electronic media of information and certificate on return to the Republic of Tajikistan to citizens of the Republic of Tajikistan
According to article 13 of the constitutional Law of the Republic of Tajikistan "About the Government of the Republic of Tajikistan" and article 57 of the Law of the Republic of Tajikistan "About regulatory legal acts" the Government of the Republic of Tajikistan decides:
1. Approve Rules of registration and issue of the foreign passports containing electronic media of information and certificate on return to the Republic of Tajikistan to citizens of the Republic of Tajikistan (are applied).
2. To the Ministries of Foreign Affairs and internal affairs of the Republic of Tajikistan, and also to their divisions to be guided by these rules in case of registration and issues of the foreign passports containing electronic media of information and certificate on return to the Republic of Tajikistan to citizens of the Republic of Tajikistan.
3. To the Ministries of Foreign Affairs and internal affairs of the Republic of Tajikistan within six months to develop and approve the Joint instruction about procedure for application of Rules of registration and issue of the foreign passports containing electronic media of information and certificate on return to the Republic of Tajikistan to citizens of the Republic of Tajikistan.
4. Declare invalid the order of the Government of the Republic of Tajikistan of April 2, 2009 No. 203 "About approval of Rules of issue of the foreign passports containing electronic media of information and certificate on return to the Republic of Tajikistan to citizens of the Republic of Tajikistan".

1. To citizens of the Republic of Tajikistan for trip abroad, temporary and permanent residence abroad and returns to the Republic of Tajikistan are issued the following documents:
- the diplomatic passport of the citizen of the Republic of Tajikistan (further - the diplomatic passport);
- the service passport of the citizen of the Republic of Tajikistan (further - the service passport);
- the all-civil foreign passport of the citizen of the Republic of Tajikistan (further - the all-civil foreign passport);
- the certificate on return to the Republic of Tajikistan (further - the certificate on return).
2. Diplomatic, service, all-civil foreign passports (further - foreign passports) and certificates on return are property of the Republic of Tajikistan and their owners are under protection and protection of the Republic of Tajikistan.
3. The citizen of the Republic of Tajikistan shall store the foreign passport carefully.
4. Authorized state bodies on issue of foreign passports:
- Ministry of Foreign Affairs of the Republic of Tajikistan;
- diplomatic representations and consular establishments of the Republic of Tajikistan abroad (further - foreign organizations of the Republic of Tajikistan);
- The Ministry of Internal Affairs of the Republic of Tajikistan and its territorial subdivisions (further - the Ministry of Internal Affairs of the Republic of Tajikistan).
5. Diplomatic and service passports are issued to government employees and members of their families, in the cases provided by these rules, the Ministry of Foreign Affairs of the Republic of Tajikistan and foreign organizations of the Republic of Tajikistan. Categories of the government employees and members of their family having the right diplomatic and office" passports are provided in appendix 1 to these rules.
6. Diplomatic and service passports are used in the office purposes. In case of private trip the government employee having the diplomatic or service passport in accordance with the established procedure addresses to authorized state bodies on issue of foreign passports for receipt of the all-civil foreign passport. Diplomatic and service passports are stored in personnel service of state bodies.
7. The concept "family members" of these rules is understood as the spouse (a), children including who are adopted/adopted - before achievement of 23-year age by them.
8. All-civil foreign passports are issued by the Ministry of Foreign Affairs of the Republic of Tajikistan to the following persons:
- the government employee of the Republic of Tajikistan leaving in official foreign journeys;
- to citizens of the Republic of Tajikistan who are abroad; to the citizens leaving for implementation of labor activity according to international agreements;
- to the citizens of the Republic of Tajikistan who are constantly living abroad and temporarily staying in the Republic of Tajikistan;
- to the staff of the state organizations and legal entities, regardless of patterns of ownership, leaving in official journeys.
9. Foreign organizations of the Republic of Tajikistan issue diplomatic and service passports to personnel of diplomatic service to members of their families if before the termination of effective period of the specified passports there are less than 6 months, and also all-civil foreign passports to citizens of the Republic of Tajikistan who constantly or temporarily live in adoptive state of foreign organization of the Republic of Tajikistan.
10. All-civil foreign passports in the territory of the Republic of Tajikistan are issued by the Ministry of Internal Affairs of the Republic of Tajikistan to citizens in the place of their permanent or temporary residence or in the place of their stay.
11. Foreign passports are issued by the Ministry of Foreign Affairs of the Republic of Tajikistan based on the following documents:
- the order of the President of the Republic of Tajikistan about foreign office trips;
- the letter of the Head of Executive office of the President of the Republic of Tajikistan and his first deputy, the written petition of management of the ministries and departments, chairmen of the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, and other state organizations and legal entities, regardless of patterns of ownership, the statement of staff of central office of the Ministry of Foreign Affairs of the Republic of Tajikistan and foreign organizations of the Republic of Tajikistan, and also members of their families;
- passport of the citizen of the Republic of Tajikistan;
- the certificate of birth for citizens up to 16 years;
- information on payment of the state fee and other charges, except the citizens exempted from payment of the state fee and obligatory payments according to regulatory legal acts of the Republic of Tajikistan;
- the copy of the official ID or the reference about post of the government employee (for diplomatic and service passports).
12. The all-civil foreign passport is issued by foreign organizations of the Republic of Tajikistan based on the following documents:
- passports of the citizen of the Republic of Tajikistan or all-civil foreign passport;
- certificates of birth and its copies for citizens up to 16 years;
- copies of the presidential decree of the Republic of Tajikistan about acceptance in citizenship of the Republic of Tajikistan or the reference confirming acquisition of citizenship of the Republic of Tajikistan issued by authorized state bodies of the Republic of Tajikistan;
- information on payment of the consular fee, In foreign representations of the Republic of Tajikistan only the consular fee abroad is levied.
13. If on reasonable excuses (theft, loss, decay, etc.) by the citizen the documents specified in the first, second and third paragraphs of Item 12, the all-civil passport are not submitted it is issued after approval of the Ministry of Foreign Affairs of the Republic of Tajikistan and the conclusion of the head of foreign organization of the Republic of Tajikistan.
14. In case of execution of the foreign passport foreign organizations of the Republic of Tajikistan shall specify about the applicant's belonging to citizenship of the Republic of Tajikistan and about lack of nationality of other state at it. In issue of the foreign passport refuses in case of the applicant's belonging to nationality of other state if other is not provided by the international legal acts recognized by the Republic of Tajikistan.
15. In case of the technical difficulties and other questions requiring conducting check or provision of additional data for the purpose of issue of foreign passports, foreign organizations of the Republic of Tajikistan have the right to send inquiry for execution of the foreign passport to the Ministry of Foreign Affairs of the Republic of Tajikistan. The procedure for provision of requests for execution of foreign passports is determined by the Ministry of Foreign Affairs of the Republic of Tajikistan.
16. The all-civil foreign passport is issued by the Ministry of Internal Affairs of the Republic of Tajikistan based on provision of the following documents:
- passports of the citizen of the Republic of Tajikistan;
- certificates of birth for citizens up to 16 years. In case of disputes on the child's belonging to citizenship of the Republic of Tajikistan, the certificate of birth with stamp and seal confirming the child's belonging to citizenship of the Republic of Tajikistan, or the reference issued by competent state bodies, confirmatory belonging to citizenship of the Republic of Tajikistan is provided;
- information on payment of the state fee and other charges, except the citizens exempted from payment of the state fee and obligatory payments according to regulatory legal acts of the Republic of Tajikistan.
17. Execution of the foreign passport to the citizen to 16-year age is performed based on written consent of the father or mother, the adoptive father, the guardian, the custodian or other persons replacing them assured by the notary or foreign organization of the Republic of Tajikistan. In other cases, also in case of disagreement of the father, mother, the adoptive father, the guardian, the custodian or other their replacement persons on issue of the foreign passport to the citizen to 16-year age, the issue is resolved judicially.
18. According to requirements of Chapter 3 of these rules after adoption of the relevant documents and conducting necessary checks by authorized state bodies to the citizen of the Republic of Tajikistan the foreign passport is drawn up.
19. Foreign passports are filled in Cyrillic (in Tajik) and Latin (in English) with letters.
20. The foreign passport is drawn up based on the personal data which are written down in the passport of the citizen of the Republic of Tajikistan. The foreign passport to the minor citizen is younger than 16 years, receiving the foreign passport for the first time, is drawn up based on the data which are written down in the certificate of birth.
21. The foreign passport is drawn up to the citizen 16 years, constantly living abroad, not having the passport of the citizen of the Republic of Tajikistan or the all-civil foreign passport, after identification and belonging to citizenship of the Republic of Tajikistan based on the data which are written down in the certificate of birth are more senior.
22. Samples, classification, technical specifics and technical protection of forms of foreign passports of the citizens of the Republic of Tajikistan containing electronic media of information are accepted according to the requirements established by the Government of the Republic of Tajikistan.
23. In case of execution of the foreign passport by the staff of authorized state bodies on issue of foreign passports the application form for receipt of the passport in electronic form is filled in.
24. The employee who filled in the application form for receipt of the passport photographs the applicant according to requirements to the photo in case of photography of the citizen for execution of the foreign passport (appendix 2), and after verification of all data entered in the statement for issue of the passport sends the electronic file to the head consular department of the Ministry of Foreign Affairs of the Republic of Tajikistan.
25. The head consular department of the Ministry of Foreign Affairs of the Republic of Tajikistan after personalisation of data of the applicant and production of the foreign passport sends it to the authorized state body on issue of foreign passports which filled in the electronic file for issue to its owner.
26. In case of issue of the foreign passport the responsible of authorized state body on issue of foreign passports shall check correctness of filling of all details of the passport and be convinced of similarity of the citizen to the photo in the passport.
27. The procedure for registration and issue of foreign passports is determined by the Joint instruction about procedure for application of Rules of registration and issue of the foreign passports containing electronic media of information and certificate on return to the Republic of Tajikistan to citizens of the Republic of Tajikistan (further - the Instruction).
28. Before expiration of the foreign passport exchange or issue of the foreign passport is made in the following cases:
- in case of change of official position of the owner of the passport when such change requires replacement of one type of the foreign passport by other type;
- in the absence of free pages in the passport for introduction of records, marks and visas;
- in case of mechanical depreciation of the passport or its unfitness for further use;
- in case of loss of the passport;
- in case of change by the citizen in accordance with the established procedure surnames, name, middle name and other data proving the identity;
- in case of receipt of the second passport if activities of the citizen of the Republic of Tajikistan are connected with regular trips out of limits of the Republic of Tajikistan. For confirmation of frequent trips the petitioning person shall show the valid foreign passport which is available for it, with application of copies of pages of the foreign passport with at least than four marks about crossing of frontier within two months.
29. The new foreign passport is issued on condition of withdrawal of earlier issued foreign passport which term did not expire. Provisions of this Item do not concern to owners of the second foreign passport.
30. If in the valid foreign passport of the citizen of the Republic of Tajikistan there are no free pages, there are valid visas of foreign states and he addressed for receipt of the new foreign passport, according to the petition of person the new passport without withdrawal old can be issued. In this case in earlier issued passport the end-to-end pro-chop in the left bottom corner of the photo of the owner is made. Execution of the new foreign passport is made according to requirements of Chapter 3 of these rules.
31. When losing the foreign passport in the territory of the Republic of Tajikistan, its owner shall address to authorized state bodies on issue of foreign passports.
32. When losing the foreign passport abroad, its owner shall address without delay to relevant organ of adoptive state, and also to foreign organization of the Republic of Tajikistan in this country which without delay sends information to the Ministry of Foreign Affairs of the Republic of Tajikistan with indication of surname, name, middle name of person which lost the foreign passport, series and numbers of the foreign passport, the place of its losing (country) and if the citizen of the Republic of Tajikistan who lost the foreign passport arrived to official journey, with indication of the name of the department sending him abroad.
33. In case of loss of the foreign passport and absence of foreign organization of the Republic of Tajikistan in this country, the citizen of Tajikistan shall report without delay about the happened incident in relevant organ of adoptive state, and then in foreign organization of the Republic of Tajikistan in the next country or in the Ministry of Foreign Affairs of the Republic of Tajikistan for protection of the rights and interests and receipt of the foreign passport or the certificate on return.
34. Authorized state bodies on issue of foreign passports shall inform border troops of the State committee of homeland security of the Republic of Tajikistan on loss of the passport.
35. In the Republic of Tajikistan the found foreign passports, and also foreign passports of the died citizens of the Republic of Tajikistan are given in authorized state bodies on issue of foreign passports. Abroad such documents are given in foreign organizations of the Republic of Tajikistan for the subsequent direction to representatives state - to the bodies for issue of foreign passports which issued the passport.
36. Authorized state bodies on issue of foreign passports make the decision on return of the found foreign passport to the owner, or on its destruction. In case of decision making about return of the passport to its owner, authorized state bodies on issue of foreign passports, direct information on return of the passport to border troops of the State committee of homeland security of the Republic of Tajikistan for office use.
37. The foreign passports which are not issued to owners during effective period are destroyed in accordance with the established procedure.
38. In case of loss of the foreign passport abroad, to the citizen the foreign passport based on supporting documents and after conducting special checks on identification of the applicant is issued or for return to the Republic of Tajikistan the new foreign passport or the certificate on return to the Republic of Tajikistan is granted.
39. In case of detection of technical scrap in the foreign passport, the new passport without provision of additional documents and collection of the state fee and other obligatory payments is issued to the citizen.
40. In case of receipt of the all-civil foreign passport presence of the citizen is obligatory. Ready diplomatic and service passports can be received by the authorized staff of the petitioning public institutions.
41. Foreign passports are issued to citizens from 16 years for the following term:
- the diplomatic passport - for a period of 5 years;
- the service passport - for a period of 5 years;
- the all-civil foreign passport - for a period of 10 years.
42. Foreign passports for children up to 16 years are issued for the following terms:
- from the moment of the birth up to 6 years - for a period of 3 years;
- from 6 to 11 years - for a period of 4 years;
- from 11 to 16 years - for a period of 5 years.
43. Diplomatic passports to members of Majlisi milli of Majlisi Oli of the Republic of Tajikistan, deputies of Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan, are issued for term of office of the member of Majlisi milli of Majlisi Oli of the Republic of Tajikistan and the deputy of Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan.
44. Petitions of physical persons and legal entities of the Republic of Tajikistan for issue of foreign passports are considered within 15 working days. To the citizen of the Republic of Tajikistan in connection with office (for the staff of state bodies) need, performing the emergency treatment, serious illness or the death of the relative living abroad the foreign passport is drawn up within 3 working days without collection of payment for urgency. The bases for urgent execution of the foreign passport are the letter on urgent office trip, the reference of the medical organization or the international cable message certified in the appropriate order.
45. Petitions from citizens about issue of foreign passports in foreign organizations of the Republic of Tajikistan are considered within no more than one month.
46. For urgent consideration of the applications of physical persons and legal entities the amount of collection increases on the following percent:
- within 3 working days for 200%;
- within 7 working days for 100%.
47. Transfer of ready foreign passports from the head consular department of the Ministry of Foreign Affairs of the Republic of Tajikistan, in the Ministry of Internal Affairs of the Republic of Tajikistan and in foreign organizations of the Republic of Tajikistan is drawn up by the acceptance report.
48. Foreign organizations of the Republic of Tajikistan shall represent quarterly to the Ministry of Foreign Affairs of the Republic of Tajikistan the detailed report about the number of the issued foreign passports, certificates on return and the number of the damaged forms together with the relevant act.
49. The procedure and form of provision of reports of foreign organizations of the Republic of Tajikistan are established by the Ministry of Foreign Affairs of the Republic of Tajikistan.
50. Account of issue (issued) foreign passports is kept on a centralized basis in the automated procedure in the electronic database of the head consular department of the Ministry of Foreign Affairs of the Republic of Tajikistan, access to which is provided to the Ministry of Internal Affairs of the Republic of Tajikistan for the office purposes.
51. Forms of foreign passports, the made foreign passports and certificates on return are stored in iron safes in specially equipped rooms provided for document storage of the strict reporting and according to the procedure, providing their reliable protection.
52. Passports instead of which are issued new of the passport of persons which lost citizenship of the Republic of Tajikistan, and also the passport of the dead are liable to withdrawal and destruction (burning) under the act which one copy is stored in cases of authorized state bodies on issue of foreign passports. Cases with acts after fixed term of storage are given in archive of authorized state bodies on issue of foreign passports.
53. The statement is drawn up by the commission and affirms management of authorized state bodies on issue of foreign passports. The procedure for creation of the act and destruction of invalid passports is determined in the Instruction.
54. The damaged forms of foreign passports are destroyed burned) according to the procedure, established by the Instruction.
55. To the citizen of the Republic of Tajikistan it can be temporarily refused issue of the foreign passport in the following cases if the citizen:
- it is informed on the data which are the state secret before the expiration of fixed term from the moment of the termination of access for the citizen to these data. The specified term shall not exceed 5 years, it can be extended by the commission formed by the Government of the Republic of Tajikistan in individual procedure taking into account the confirmed fact of acquaintance of the citizen with the data which are the state secret. Reference of data to being the state secret is performed according to the legislation regulating protection of the classified information;
- it is detained on suspicion of crime execution, or attracted as the person accused - before decision on case or introductions in legal force of the court verdict;
- it is condemned for crime execution - before departure (execution) of punishment or before release from punishment, except for deprivations of the right to hold certain positions or to be engaged in certain activities;
- evades from obligation fulfillment, imposed on it by court - before obligation fulfillment or before achievement of consent by the parties;
- reported about himself obviously false data;
- concerning it the decree of the legal executive on temporary restriction of departure out of limits of the Republic of Tajikistan - before removal of prohibition is issued;
- is in criminal investigation department for crime execution;
- according to the legislation of the Republic of Tajikistan it is called up for military service - before the termination of military service.
56. The written answer in which the bases and the term of restriction in issue of the foreign passport are specified is provided to the citizen.
57. The foreign passport of the citizen of the Republic of Tajikistan can be withdrawn or cancelled by authorized state bodies in cases;
- illegal introduction in ю the passport of the changes connected with identification of the personality;
- the terminations of powers of the government employee or transfer into other work which is not providing the right to the diplomatic or service passport;
- counterfeits of passports;
- factual determinations issue of the passport on false or illegally to the received documents;
- terminations of citizenship of the Republic of Tajikistan;
- in other cases, stipulated by the legislation the Republic of Tajikistan.
58. Concerning return of diplomatic and service passports of government employees which term of office expired or transferred to other position, and members of their family which is not requiring the diplomatic or service passport responsibility is born by those bodies which requested such passports for the employees. The returned diplomatic and service passports are transferred to the Ministry of Foreign Affairs of the Republic of Tajikistan within 15 days from the moment of change of the status of the government employee for acceptance of the subsequent actions.
59. The certificate on return is the temporary identity document of the citizen of the Republic of Tajikistan providing to it, the right to return to the Republic of Tajikistan and issued for the term of no more than 60 days.
60. The certificate on return is granted by foreign organizations of the Republic of Tajikistan, and in case of absence of foreign organizations of the Republic of Tajikistan in this or that state, the Ministry of Foreign Affairs of the Republic of Tajikistan based on the following documents:
- statements of the petitioning person which sample is constituted and affirms the Ministry of Foreign Affairs;
- certificates of Department of Internal Affairs or other relevant organ of adoptive state of the citizen of the Republic of Tajikistan of the fact of the address of the citizen concerning loss of the passport;
- identity documents and belonging of the petitioning person to citizenship of the Republic of Tajikistan (the passport of the citizen of the Republic of Tajikistan, the certificate of birth, the military ID, the reference on the identity of the government employee, the military ID of the reserve officer). In case of lack of identity documents and belonging of the petitioning person to citizenship of the Republic of Tajikistan, the certificate on return is granted based on the passport copy of the citizen of the Republic of Tajikistan or the foreign passport copy (after their check of authenticity), and in case of their absence, based on the copy of form No. 1 or the reference of single base of issue of passports of the Republic of Tajikistan;
- the medical certificate about the child's birth before achievement of one year by the child if the certificate of birth is not granted;
- 2 color photos size 3kh4mm;
- information on payment of the consular fee (if in this organization issue of such documents is performed on paid basis).
61. By provision of the above-named documents, the certificate on return is granted without additional approval.
62. In the absence of documents, stipulated in Item 60, the authorized employee of foreign organization of the Republic of Tajikistan addresses to the Ministry of Foreign Affairs of the Republic of Tajikistan or is direct in the Ministry of Internal Affairs of the Republic of Tajikistan or its territorial subdivisions about identification of the petitioning person.
63. The Ministry of Internal Affairs of the Republic of Tajikistan and its territorial subdivisions within at least 5 calendar days hold events for identification of the petitioning person and inform the authorized state bodies which requested е on results.
64. Foreign organizations of the Republic of Tajikistan after identification and determination of belonging of the petitioning person to citizenship of the Republic of Tajikistan, grant the certificate on return.
65. The term of consideration of the petition for issue of the certificate on return cannot exceed 10 calendar days. In necessary cases (additional verification of documents), the term of consideration of the petition can be extended by the head of foreign organization of the Republic of Tajikistan for the term of no more than 10 days.
66. The certificate on return is granted only for return of the citizen to the Republic of Tajikistan and cannot form the basis for stay abroad.
67. In cases of impossibility of return of the citizen at the scheduled time (extraordinary, situations, the serious illness and other cases not dependent on the citizen), the certificate on return is in exceptional cases granted repeatedly for a period of 30 days based on the reasonable petition from the citizen or reasonable request of relevant organs of foreign state or the international organization with appendix of the relevant documents.
68. The certificate form on return is determined and affirms the Ministry of Foreign Affairs of the Republic of Tajikistan.
69. The payments connected with the services provided by these rules are performed in non-cash form.
69. Physical persons and legal entities are made for non-compliance with these rules responsible according to the legislation of the Republic of Tajikistan.

The list of government employees and members of their families having the right to diplomatic and service passports
1. Diplomatic passports are issued to the following persons:
1) to the President of the Republic of Tajikistan and members of his family;
2) to the Chairman of Majlisi milli of Majlisi Oli of the Republic of Tajikistan and Chairman of Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan, members of Majlisi milli and deputies of Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan;
3) to the chairman of the Constitutional court of the Republic of Tajikistan, chairman of the Supreme Court of the Republic of Tajikistan, chairman of the Supreme economic court of the Republic of Tajikistan and their deputies;
4) to the Prime Minister of the Republic of Tajikistan, first deputy and deputy prime ministers;
5) to the Head of Executive office of the President of the Republic of Tajikistan, the first deputy and the deputy manager of Executive office of the President of the Republic of Tajikistan, special advisors to the president of the Republic of Tajikistan, ministers and their deputies, chairmen of the state committees and their deputies, Deputy Commissioners for Human Rights in the Republic of Tajikistan, to the Ombudsman for Children in the Republic of Tajikistan, to the chairman of the Central commission on elections and referenda, the Attorney-General and deputy attorneys general, the secretary of the Security Council and the deputy secretary of the Security Council, the chairman of Audit Chamber and vice-chairmen of Audit Chamber, heads of bodies in case of the President of the Republic of Tajikistan, to heads of offices of Majlisi milli and Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan, heads of organizations under the Government of the Republic of Tajikistan, to chairmen of the Gorno-Badakhshan Autonomous Region, areas and city of Dushanbe;
