About approval of Rules of issue of the foreign passports containing electronic media of information and certificate on return to the Republic of Tajikistan to citizens of the Republic of Tajikistan
According to article 52 of the Law of the Republic of Tajikistan "About regulatory legal acts" and for the purpose of execution of the Presidential decree of the Republic of Tajikistan of February 20, 2009 "About input of foreign passports of the citizens of the Republic of Tajikistan containing electronic media of information" the Government of the Republic of Tajikistan decides No. 624:
1. Approve Rules of issue of the foreign passports containing electronic media of information and Certificate on return to the Republic of Tajikistan to citizens of the Republic of Tajikistan it (is applied).
2. Apply these rules to foreign passports of the Republic of Tajikistan before complete implementation of the foreign passports containing electronic media of information.
3. To the Ministry of Foreign Affairs of the Republic of Tajikistan, diplomatic representations and consular establishments of the Republic of Tajikistan abroad, to the Ministry of Internal Affairs of the Republic of Tajikistan and its territorial subdivisions it is strict to be guided to these Rules in case of issue of the foreign passports containing electronic media of information to citizens of the Republic of Tajikistan.
4. Declare invalid the order of the Government of the Republic of Tajikistan of February 1, 1999 No. 8 "About approval of the Procedure for issue of foreign passports to citizens of the Republic of Tajikistan".

1. To citizens of the Republic of Tajikistan for trip abroad, permanent residence abroad and returns to the Republic of Tajikistan are issued the following documents:
- the diplomatic passport, including the diplomatic passport containing electronic media of information (further the diplomatic passport);
- the service passport, including the service passport containing electronic media of information (further the service passport);
- the all-civil foreign passport, including the all-civil foreign passport containing electronic media of information (further the all-civil foreign passport);
- the certificate on return to the Republic of Tajikistan (further the certificate on return).
2. The Ministry of Foreign Affairs of the Republic of Tajikistan, diplomatic representations and consular establishments of the Republic of Tajikistan abroad, the Ministry of Internal Affairs of the Republic of Tajikistan and its territorial subdivisions are authorized state bodies of the Republic of Tajikistan on issue of foreign passports.
3. Diplomatic and service passports are issued to government employees (to members of their families, in the cases provided by these rules) by the Ministry of Foreign Affairs of the Republic of Tajikistan. Categories of the government employees having the right to diplomatic and service passports are determined in appendix 1 to this rule.
4. Diplomatic and service passports shall be used in the office purposes. In case of private trip of the government employee having the diplomatic or service passport the all-civil foreign passport by authorized state bodies on issue of foreign passports is issued to it.
5. In these rules are understood as the family member - the spouse (a), children who are adopted/adopted before achievement by them 23 summer age.
6. All-civil foreign passports are issued by the Ministry of Foreign Affairs of the Republic of Tajikistan: the government employee of the Republic of Tajikistan leaving in official foreign journeys; to citizens of the Republic of Tajikistan who are abroad; to the citizens leaving for implementation of labor activity according to intergovernmental agreements; to citizens of the Republic of Tajikistan, constantly living abroad and temporarily staying in the Republic of Tajikistan; and also to employees of legal entities, regardless of patterns of ownership, leaving in official journeys.
7. Diplomatic representations and consular establishments of the Republic of Tajikistan abroad issue all-civil foreign passports to citizens of the Republic of Tajikistan who constantly live or temporarily stay in adoptive state of diplomatic representation or consular establishment or its consular district.
8. All-civil foreign passports are issued by the Ministry of Internal Affairs of the Republic of Tajikistan to citizens of the Republic of Tajikistan for trip abroad on private affairs, on tourism, for work, rest, treatment and on permanent residence.
9. Foreign passports of the Republic of Tajikistan are issued by the Ministry of Foreign Affairs of the Republic of Tajikistan based on the following documents:
- orders of the President of the Republic of Tajikistan about trip abroad of the military personnel and law enforcement officers of the Republic of Tajikistan; orders Chief of Staff of the President of the Republic of Tajikistan and its deputies; the written petition of management of the ministries and departments, chairmen of the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, areas of republican subordination and other legal entities, regardless of pattern of ownership; statement of staff of central office of the Ministry of Foreign Affairs of the Republic of Tajikistan, diplomatic representations and consular establishments of the Republic of Tajikistan abroad and members of their families;
- statements questionnaires, the Republic of Tajikistan signed by the citizen or his legal representative (appendix 2). The statement questionnaire it shall be certified by seal and the signature of the head of the petitioning organization. Statements - questionnaires of staff of central office of the Ministry of Foreign Affairs of the Republic of Tajikistan, diplomatic representations and consular establishments of the Republic of Tajikistan abroad and members of their families, are certified by the signature of their direct heads;
- 4 photos in size 3, 5x 4,5 (requirements to the photo are specified in appendix 4);
- passports of the citizen of the Republic of Tajikistan and photocopy of the passport;
- receipts on payment of the state fee and other obligatory payments. For issue of the diplomatic or service passport payment is performed only by the petitioning organization. In case of execution of the diplomatic or service passport for members of families of government employees, payment for their issue can be performed as the petitioning organization, and the government employee;
- copies of the official ID or the reference about post of the government employee (for diplomatic and service passports).
10. Government employees and members of their families which have the right to the diplomatic or service passport fill in the statement questionnaire (appendix 3).
11. Statements questionnaires are filled in on the typewriter, by means of computer means or is by hand legible capital printing letters. The data specified in the statement questionnaire shall be accurate and exhaustive. In case of provision of false information, the applicant bears responsibility according to the legislation of the Republic of Tajikistan.
12. All-civil foreign passports are issued by diplomatic representations and consular establishments of the Republic of Tajikistan abroad on the basis:
- statements questionnaires, the Republic of Tajikistan signed by the citizen or his legal representative in case of submission of the documents confirming its rights (appendix 2);
- 4 photos in size 3, 5x 4,5 (requirements to the photo are specified in appendix 4);
- passports of the citizen of the Republic of Tajikistan and its photocopy or foreign passport and its photocopy;
- receipts on payment of the consular fee. In diplomatic representations and consular establishments of the Republic of Tajikistan only the consular fee abroad is levied.
13. In case of execution of foreign passports, diplomatic representations and consular establishments of the Republic of Tajikistan abroad shall, make sure of the applicant's belonging to citizenship of the Republic of Tajikistan and lack of nationality of other state at it. In issue of the foreign passport refuses in case of the applicant's belonging to nationality of other state if other is not provided by the international legal acts recognized by the Republic of Tajikistan.
14. In case of technical difficulties in issue of foreign passports, diplomatic representations and consular establishments of the Republic of Tajikistan abroad have the right to petition for execution of the foreign passport in the Ministry of Foreign Affairs of the Republic of Tajikistan or to prolong them, according to provisions 5 of the Section of these rules. The procedure for provision of petitions on execution of foreign passports is established by the Ministry of Foreign Affairs of the Republic of Tajikistan.
15. Foreign passports of the Republic of Tajikistan are issued by the Ministry of Internal Affairs of the Republic of Tajikistan based on the following documents:
- the written petition of the firms which are engaged in tourism, petitions from citizens of the Republic of Tajikistan or the petition of their legal representatives in case of submission of the documents confirming their rights;
- statements questionnaires, the Republic of Tajikistan signed by the citizen or his legal representative (appendix 2). Statements questionnaires of the citizens of the Republic of Tajikistan who are engaged in labor activity or students are certified of educational institutions by the sign and seal of the head of the organization;
- 4 photos in size 3, 5x 4,5 (requirements to the photo in appendix 4);
- passports of the citizen of the Republic of Tajikistan and its photocopy;
- the military ID or the assigned certificate (for citizens aged from 18 up to 27 years);
- receipts on payment of the state fee and other charges;
16. By consideration of the petition for issue of the foreign passport to the minor citizen up to 16 years, it is necessary to provide its certificate of birth. In case of matters of argument on belonging to citizenship of the Republic of Tajikistan, the certificate of birth with stamp about the child's belonging to citizenship of the Republic of Tajikistan is submitted.
17. And before achievement of 16-year age the passport is issued to the minor citizen from the date of its birth based on the statement questionnaire, filled on one of parents or the legal representative in case of submission of the documents confirming its rights.
18. Issue of the foreign passport to the minor citizen up to 18 years, in case of independent departure, is performed based on representation of notarized consent of parents or legal representatives, or the document confirming absence of the second parent (death certificates, the judgment about deprivation of the parent rights, the judgment about recognition is unknown absent, etc.)
19. After documents acceptance according to requirements 3 Sections of these rules and conducting necessary checks, the state authorized body to the citizen of the Republic of Tajikistan are drawn up the foreign passport.
20. Foreign passports of citizens of the Republic of Tajikistan are filled in on Cyrillics (in Tajik) and Latin letters (in English).
21. The foreign passport is drawn up based on information which is written down in the passport of the citizen of the Republic of Tajikistan. The foreign passport of the minor citizen is drawn up based on information which is written down in the certificate of birth of the child.
22. On the 32nd page of the foreign passport fit in surname (the first column from above), name (the second column from above) and middle name (the third column from above) the petitioning person, Cyrillics in Tajik. The columns "nasab\surname" and "nom\given name" shall be completed without fail.
23. On inside of back cover of the foreign passport the photo by the size 3, 5x 4,5 of the established sample which is sealed authorized state body on issue of foreign passports is pasted. This page is filled in with Latin letters (in English).
24. In the column "rakham shinosnoma\rassport No." fit in the series and number of the foreign passport corresponding to the letter and figures pro-perforated through all internal pages of the foreign passport.
25. In the column "nasab" and "nom" the surname and name petitioning which transfer into Latin letters is made by the computer program fit in. If in case of transfer by the computer program of name or surname of the petitioning person, the inappropriate letter is specified, the authorized state body can change based on the reasonable statement of the petitioning person his name or surname only in Latin letters. In this case, the applicant shall write this information in the statement questionnaire.
26. In the column "шахрванди\nationality" the word "Tajikistan" Latin letters fits in.
27. In columns "tajrikh tavvalud\date of birth", "tajrikh судур \"date of issue", "tajrikh, oyat ejtibor\date of expire" date and year register in figures, month - registers in cursive script Latin letters.
28. In the column", инсех" the sex of the citizen in English of "F" (woman), "M" (man) fits in.
29. In the column", ои tavvalud\rlase of birth" fits in the name of the state in English in which the citizen of the Republic of Tajikistan was born.
30. In the column "ма, ohm, ки the shinosnoma will give the rest \áuthoruty" the name of the state authorized body which issued the foreign passport fits in in English.
31. Procedure for execution of the foreign passports containing electronic media of information are determined by the joint Instruction of the Ministry of Foreign Affairs of the Republic of Tajikistan, the Ministry of Internal Affairs of the Republic of Tajikistan and the State committee of homeland security of the Republic of Tajikistan.
32. Before expiration of the foreign passport, exchange or issue of the foreign passport in the following cases is made:
- in case of change of official position of the owner of the passport when such change requires replacement of one type of the passport of other type;
- in the absence of free pages in the passport for introduction of records, marks and visas;
- in case of mechanical depreciation of the passport or its unfitness for further use;
- in case of loss of the passport;
- in case of change by the citizen, in accordance with the established procedure, surnames, name, middle name;
- in case of receipt of the second passport.
33. The new foreign passport is issued on condition of withdrawal of earlier issued foreign passport which term did not expire.
34. Foreign passports which effective period expired are not withdrawn.
35. If in the valid foreign passport of the citizen of the Republic of Tajikistan there are no free pages, and there are valid visas of foreign states, and he addressed for receipt of the new foreign passport, according to the petition of person the new passport without withdrawal old can be issued. In this case, in earlier issued passport, the end-to-end pro-chop in the left bottom corner of the photo of the owner is made. Execution of the new foreign passport is made according to requirements 3 Sections of these rules.
36. When losing the foreign passport in the territory of the Republic of Tajikistan, its owner shall address to authorized state body on issue of foreign passports.
37. When losing the foreign passport abroad its owner shall address without delay to law-enforcement bodies of adoptive state, and also to consular establishment of the Republic of Tajikistan in this country which immediately reports in the Ministry of Foreign Affairs of the Republic of Tajikistan with indication of surname, name, middle name of person which lost the foreign passport, series and numbers of the foreign passport, the place of its losing (country) and if the citizen of the Republic of Tajikistan who lost the foreign passport arrived to official journey, with indication of the name of the department sending him abroad.
38. In case of loss of the foreign passport and absence of consular establishment of the Republic of Tajikistan in this country, the citizen of Tajikistan shall report without delay about the happened incident in law-enforcement bodies of adoptive state, and then in consular establishment of the Republic of Tajikistan in the next country or in the Ministry of Foreign Affairs of the Republic of Tajikistan for protection of the rights and interests.
39. Authorized state bodies on issue of foreign passports inform Head department of border troops of the State Committee of homeland security of the Republic of Tajikistan on loss of the passport.
40. If the citizen of the Republic of Tajikistan lost the foreign passport which is earlier issued to him which term did not expire, the new foreign passport is issued only on condition of the formal notice of relevant organs of the Republic of Tajikistan on loss of the previous foreign passport.
41. In the Republic of Tajikistan, the found passports, and also passports of the died citizens of the Republic of Tajikistan, are given in authorized state bodies on issue of foreign passports. Abroad, such documents are given in diplomatic representations or consular establishments of the Republic of Tajikistan for the subsequent direction to authorized state bodies on issue of foreign passports in the Republic of Tajikistan.
42. The authorized state body on issue of foreign passports, makes the decision on return of the foreign passport to the owner, or on its destruction. In case of decision making about return of the passport to its owner, the authorized state body on issue of foreign passports, sends this information to Head department of border troops of the State Committee of homeland security of the Republic of Tajikistan for use it in office activities.
43. The foreign passports which are not issued to citizens during the term of their action are destroyed in accordance with the established procedure.
44. In case of loss of the foreign passport abroad, to the citizen for return to the Republic of Tajikistan the certificate on return is granted.
45. If activities of the citizen of the Republic of Tajikistan are connected with regular (more than 2 once a month) by trips out of limits of the Republic of Tajikistan, the second foreign passport, with effective period of the first foreign passport can be issued to him.
46. For confirmation of frequent trips, the petitioning person shall show the valid foreign passport which is available for it, with application of copies of pages of the foreign passport with at least than four marks about crossing of Frontier within two months.
47. Provisions of Item 45 and 46 concern only all-civil foreign passports.
48. In case of issue of the passport, the authorized person of state body shall check correctness of filling of all details of the passport and similarity of the citizen to the photo.
49. In case of detection of technical marriage or specifying in the foreign passport of the wrong information, the new passport, without provision of additional documents and collection of the state fee and other charges is issued to the citizen.
50. In case of issue of all-civil foreign passports to the citizens who are constantly living abroad and to the citizens who are going abroad on permanent residence the mastic stamp "on permanent residence" is put down, and record about instead of what document the passport is issued, fastened with the authorized signature, and seal of authorized state body on issue of foreign passports is made.
51. The corrections made to foreign passports shall be stipulated in the Tajik and English languages on the free page of the passport which are fastened with the authorized signature, and seal of authorized state body on issue of foreign passports.
52. In case of receipt of the all-civil foreign passport presence of the citizen or his legal representative is obligatory. Diplomatic and service passports can be received by the authorized staff of the petitioning public institutions.
53. Diplomatic, service, all-civil foreign passports are issued to citizens of the Republic of Tajikistan for a period of 5 years, and the all-civil foreign passports containing electronic media of information for a period of 10 years.
54. Diplomatic passports are issued to deputies of Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan, members of Majlisi milli of Majlisi Oli of the Republic of Tajikistan and members of their families for term of office of deputies of Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan and members of Majlisi milli of Majlisi Oli of the Republic of Tajikistan.
55. In case of technical difficulties in execution of foreign passports or urgent trip of the citizen abroad, foreign passports can be extended by authorized state bodies on issue of foreign passports.
56. All-civil foreign passports are prolonged for term no more than 3 years and only once.
57. Diplomatic and service passports are prolonged by the Ministry of Foreign Affairs of the Republic of Tajikistan either diplomatic representations or consular establishments of the Republic of Tajikistan abroad in coordination with the Ministry of Foreign Affairs of the Republic of Tajikistan for the term of no more than one year and only once.
58. In case of prolongation of effective period of the foreign passport on the separate page of the foreign passport the mastic stamp fastened with the authorized signature and seal of authorized state body on issue of foreign passports is put down.
59. Registration of prolongation of effective period of the foreign passport shall be made from the date of the termination of effective period of the passport shown on prolongation.
60. Petitions of physical persons and legal entities of the Republic of Tajikistan for issue of foreign passports are considered within 15 working days. In case of execution of the foreign passport to the citizen of the Republic of Tajikistan due to the need of the emergency treatment, serious illness or the death of the relative living abroad the application for issue of the foreign passport is considered within three working days without collection of payment for urgency. The bases for urgent consideration of the applications about issue of the foreign passport are the letter or the reference of the medical organization, the international cable message certified in the appropriate order.
61. The application for issue of all-civil foreign passports for departure from the Republic of Tajikistan on the permanent place residence is considered no more than three months in time.
62. The petition from citizens about issue or prolongation of effective period of foreign passports in diplomatic representations or consular establishments of the Republic of Tajikistan abroad, are considered within no more than one month.
63. For urgent consideration (within 7 working days) statements of physical persons and legal entities, the amount of collection increases by 100%, within 3 working days for 200% respectively.
64. Children aged up to 16 years, can be entered in passports of their parents or faces of their attendants.
65. The children entered in the foreign passport are photographed separately from parents or person in whose passport they are brought, irrespective of age.
66. On the 30th page of the foreign passport the photo of the child which is certified by seal of authorized state body on issue of foreign passports is pasted.
67. On the 31st page of the foreign passport the surname, name, sex of the child Cyrillics (in Tajik) and Latin letters (in English), day, month and year of birth - figures fit in. The surname and name of the child entered in the first line of page 31 shall correspond to the photo of the child pasted in frame of 1 page 30.
68. In need of introduction of large number of records about children, in the lower part of page 31 the reference to other page of the passport sealed authorized state body is introduced: "ниг. oh са... \See page...".
69. The children following abroad separately from parents fit into the passport of person who accompanies them in the presence of the notarized consent of parents of pla of their legal representatives. In this case on the blank page of the foreign passport the photo of the child is pasted, and the following record in the Tajik and English languages is made: "(Nasab, number ва salt tavallud кдак) oh shinosnoma мазкур ворид the card the clown", "(Name, last name, and date of birth of child) included to this passport". Record and the photo, are fastened with the authorized signature and seal of authorized state body on issue of foreign passports.
70. In case of departure of minor children without maintenance, except the passport they shall have in case of themselves notarially drawn up consent of parents or legal representatives by provision of the documents confirming their rights.
71. Also is more senior than children at the age of 16 years it is not allowed to enter in passports of parents or persons accompanied by which they follow.
72. The description in the passport of children can is made in case of their birth, adoption (adoption), establishment of guardianship over them citizens of the Republic of Tajikistan.
73. In case of different nationality of parents, the minor citizen of the Republic of Tajikistan is brought in the foreign passport of the parent consisting in citizenship of the Republic of Tajikistan. Enter the children who are citizens of the Republic of Tajikistan, in documents, the foreign citizens, and also minor foreign citizens accompanying them in foreign passports of parents, legal representatives - citizens of the Republic of Tajikistan, it is forbidden.
74. In case of the statement of minor children from the passport, in it the following entry in the Tajik and English languages is made: "(Nasab, number ва salt tavallud to, so) az of shinosnomaa мазкур barovarda the clown", "(Name, last name and date of birth og child) excluded from this passport". Record are fastened with the authorized signature and seal of authorized state body on issue of foreign passports.
75. Authorized state bodies record issues of foreign passports in the magazine in the following form:
- date of issue;
- series and passport number;
- surname, name and middle name of the citizen of the Republic of Tajikistan to whom the passport is issued;
- basis of issue of the passport.
76. Transfer of foreign passports in the Ministry of Foreign Affairs of the Republic of Tajikistan, diplomatic representations and consular establishments of the Republic of Tajikistan abroad is drawn up acceptance, but the delivery act. About expense of forms of foreign passports the report is quarterly constituted and it is represented for approval to the Minister of Foreign Affairs of the Republic of Tajikistan. Acts of diplomatic representations and consular establishments of the Republic of Tajikistan abroad are constituted in duplicate, one of which goes to the Ministry of Foreign Affairs of the Republic of Tajikistan.
77. Diplomatic representations and consular establishments of the Republic of Tajikistan abroad shall quarterly, submit in the Ministry of Foreign Affairs of the Republic of Tajikistan reports of expense of forms of foreign passports, certificates on return, the number of prolonged foreign passports of citizens and terms of their prolongation, the number of the damaged forms, together with the relevant acts.
78. The procedure and form of provision of reports by diplomatic representations and consular establishments of the Republic of Tajikistan abroad are established by the Ministry of Foreign Affairs of the Republic of Tajikistan.
79. In the Ministry of Internal Affairs of the Republic of Tajikistan acceptance transfer of forms of foreign passports is performed under the act in accordance with the established procedure. Quarterly in the Ministry of Internal Affairs of the Republic of Tajikistan and its territorial subdivisions are performed about condition of accounting, storage, expenditure of forms of foreign passports about what statements are drawn up. Statements of territorial subdivisions of the Ministry of Internal Affairs of the Republic of Tajikistan are drawn up in triplicate, one of which goes to the Ministry of Internal Affairs of the Republic of Tajikistan.
80. Information on issue of the foreign passports containing electronic media of information contain in the established electronic databases. Procedure for their content are determined by the joint Instruction of the Ministry of Foreign Affairs of the Republic of Tajikistan, the Ministry of Internal Affairs of the Republic of Tajikistan and the State committee of homeland security of the Republic of Tajikistan.
81. Forms of foreign passports and certificates on return are stored in specially equipped rooms provided for document storage of the strict reporting.
82. The damaged forms are destroyed burned) under the act which is stored in cases of the Ministry of Foreign Affairs of the Republic of Tajikistan, diplomatic representations and consular establishments of the Republic of Tajikistan abroad, the Ministries of Internal Affairs of the Republic of Tajikistan and its territorial subdivisions. The statement is drawn up by the commission and affirms the head of authorized state body on issue of foreign passports. Cases with acts, after fixed term of storage, are given in archive of authorized state bodies on issue of foreign passports.
83. Passports instead of which are issued new and also passports of persons at which citizenship of the Republic of Tajikistan, and passports of the dead stopped are liable to withdrawal and destruction (burning) under the act which one copy is stored in cases of authorized state bodies on issue of foreign passports. Cases with acts after fixed term of storage, are given in archive of authorized state bodies on issue of foreign passports.
84. The statement is drawn up by the commission and affirms management of authorized state bodies of the Republic of Tajikistan. Destruction of passports is made at least once a half-year. In the act are specified: surname, name, middle name of the owner of the passport alphabetically, series and passport number by whom and when it is issued for what reason it is destroyed.
85. To the citizen of the Republic of Tajikistan it can be temporarily refused issue of the foreign passport in the following cases if:
- he is informed on the data which are the state secret before the expiration of fixed term from the moment of the termination of access for the citizen to these data. The specified term shall not exceed 5 years, it can be extended by the Commission formed by the Government of the Republic of Tajikistan in individual procedure taking into account the confirmed fact of acquaintance of the citizen with the data which are the state secret. Reference of data to being the state secret is performed according to the legislation regulating protection of the classified information;
- he is detained on suspicion of crime execution, or attracted as the person accused - before decision on case or introductions in legal force of the court verdict;
- he is condemned for crime execution - before departure (execution) of punishment or before release from punishment;
- it evades from obligation fulfillment, imposed on it by court - before obligation fulfillment;
- he reported about himself obviously false data;
- to it the civil action in court - before the end of proceeedings is made;
- he according to the court verdict is recognized as especially dangerous recidivist or consists under administrative supervision of militia - before repayment (removal) of criminal record or the termination of supervision;
- it according to the legislation of the Republic of Tajikistan is called up for military service - before the termination of military service.
86. Withdrawal or cancellation of the diplomatic and service passport of the citizen of the Republic of Tajikistan can be performed in excitement cases against it criminal case, the termination of its powers as the government employee or transfer into other work which is not providing the right to the diplomatic or service passport.
