About approval of Rules of rendering the state service "Document Creation on Departure out of Limits of the Republic of Kazakhstan on the Permanent Residence"

According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:

1. Approve the enclosed Rules of rendering the state service "To document creation on departure out of limits of the Republic of Kazakhstan on the permanent residence".

2. Recognize invalid some orders of the Ministry of Internal Affairs of the Republic of Kazakhstan according to appendix to this order.

3. To provide to committee of migratory service of the Ministry of Internal Affairs of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement on official Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising deputy minister of internal affairs of the Republic of Kazakhstan and the Committee of migratory service of the Ministry of Internal Affairs of the Republic of Kazakhstan (Kabdenov M. T.).

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of rendering the state service "Document Creation on Departure out of Limits of the Republic of Kazakhstan on the Permanent Residence"

Chapter 1. General provisions

1. These rules of rendering the state service "Document Creation on Departure out of Limits of the Republic of Kazakhstan on the Permanent Residence" (further – Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services", item 4 of article 55 of the Law of the Republic of Kazakhstan "About population shift" and determine procedure for rendering the state service in document creation on departure of citizens of the Republic of Kazakhstan, the foreigners who are constantly living in the territory of the Republic of Kazakhstan and persons without citizenship who are constantly living in the territory of the Republic of Kazakhstan out of limits of the Republic of Kazakhstan on the permanent residence.

2. In these rules the following concepts are used:

1) the applicant (uslugopoluchatel) – the face which submitted the appeal to administrative authority, to the official for implementation of ministerial procedure and also person concerning whom the administrative act is adopted is made administrative action (failure to act) (the addressee of the administrative act);

2) the administrative act (result of rendering state service) – the decision made by administrative authority, the official in the public relations, exercising the rights established by the laws of the Republic of Kazakhstan and obligation of certain person or individually certain group of people;

3) administrative authority (service provider) – state body, local government body, the state legal entity, and also other organization which according to the laws of the Republic of Kazakhstan are given authority on adoption of the administrative act, making of administrative action (failure to act);

4) ministerial procedure is the activities of administrative authority, the official for consideration of administrative case, acceptance and execution on it of the decision made based on the address or on own initiative and also the activities performed according to the procedure of the simplified ministerial procedure;

5) the web portal of "the electronic government" www.egov.kz (further – the portal) – the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;

6) payment gateway of "the electronic government" (further – PShEP) – the information system automating processes of information transfer about carrying out payments within rendering the paid services rendered electronically;

7) the digital signature (further – the EDS) – set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

3. The state service "Document Creation on Departure out of Limits of the Republic of Kazakhstan on the Permanent Residence" (further – the state service) appears territorial authorities of police (further – the service provider).

4. The authorized body in the field of migration sends information on the made changes and (or) additions to these rules in the State corporations, to the operator of information and communication infrastructure of "the electronic government" and in Single contact center concerning rendering the state services.

Chapter 2. Procedure for rendering the state service

5. Citizens of the Republic of Kazakhstan leave the Republic of Kazakhstan on the permanent residence and freely return to the Republic of Kazakhstan. Departure and return are performed according to the passport of the citizen of the Republic of Kazakhstan.

6. For receipt of the state service physical persons (further – uslugopoluchatel) submit to the service provider the statement questionnaire in form according to appendix 1 to these rules with application of documents, stipulated in Item 8 Lists of the main requirements to rendering the state service "Document Creation on Departure out of Limits of the Republic of Kazakhstan on the Permanent Residence" (further - the List) through non-commercial joint-stock company "The Government for Citizens state corporation (further – the State corporation) or the portal.

In case of the address through the portal the statement questionnaire is filled in electronically, the electronic copies of documents specified in Item 8 of the List which are certified by the EDS of uslugopoluchatel are attached.

The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service are stated in annex 2 to these rules.

7. In case of lack of data on registration for the territories of the Republic of Kazakhstan of the faces specified in subitems 3) and 5) of Item 8 of the List, the citizen petitioning for departure files petition in form, according to appendix 3 to these rules in law-enforcement bodies for factual determination of their registration for territories of the country.

Persons having permanent registration for the territories of the Republic of Kazakhstan which drew up getting out of nationality of the Republic of Kazakhstan or lost nationality of the Republic of Kazakhstan, documents for departure out of limits of the Republic of Kazakhstan for the permanent residence draw up after registration as the foreigners or the stateless person who are constantly living in the Republic of Kazakhstan according to requirements of the order of the Minister of Internal Affairs of the Republic of Kazakhstan of December 4, 2015 No. 992 "About approval of Rules of issue to foreigners and stateless persons of permission to temporary and permanent residence in the Republic of Kazakhstan" (No. registered in the Register of state registration of regulatory legal acts 12880).

8. In case of documents acceptance through the State corporation the receipt in form according to appendix 4 to these rules of acceptance of the relevant documents is issued to uslugopoluchatel.

Day of the appeal of uslugopoluchatel to the State corporation does not enter rendering the state service in time.

In case of provision by uslugopoluchatel of incomplete document package and (or) documents with the expired effective period, the employee of the State corporation refuses documents acceptance and issues the receipt on refusal in documents acceptance, according to appendix 5 to these rules.

In case of filing of application through the portal, in "personal account" of uslugopoluchatel the status about acceptance the statement for rendering the state service, and also the notification with indication of date and time of receipt of result of the state service is displayed.

The office of the service provider in day of receipt of documents performs their acceptance, registration and transfers to execution to responsible structural division. In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law, reception of applications and issue of results of rendering the state service is performed the next working afternoon.

The employee of responsible structural division of the service provider within two working days from the moment of document registration, checks completeness of the submitted documents.

9. By provision uslugopoluchately complete document package the employee of division of the service provider enters data on uslugopoluchatel into the Information system of migratory service of the Ministry of Internal Affairs of the Republic of Kazakhstan (further – IS MT) with attachment of electronic copies of all documents necessary for rendering the state service.

The employee of division of the service provider within one working day considers the documents submitted in request for lack of the bases for refusal in rendering the state service and within one working day sends requests for approval in state bodies: territorial subdivisions of Committee of homeland security of the Republic of Kazakhstan, Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan, the Ministry of Justice of the Republic of Kazakhstan, Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan and the Ministry of Defence of the Republic of Kazakhstan (further – state bodies).

Approval of materials of authorized state bodies is performed electronically through IS MT within ten working days, in the absence of integration bumazhno, by means of sending an inquiry in state bodies.

Accounting case on IS MT channels within one day from the moment of acceptance of document package is sent for approval in Management of migratory service of Department of police of areas, cities of republican value and capital (further – UMS DP).

The responsible of UMS DP performs check of timely and high-quality entering of data into information system. Further, based on answers from authorized state bodies confirms through IS MT consent on issue of permission or refusal in rendering service.

Based on results of approval of UMS DP and state bodies the employee of division of the service provider within one working day prepares the decision on document creation on departure out of limits of the Republic of Kazakhstan on the permanent residence (further - the decision) or the notification on refusal in provision of the state service and in the same day enters information on the made decision in IS MT.

In case of decision about refusal in provision of the state service, the service provider sends to uslugopoluchatel the provisional solution or notifies on time and the place (method) of carrying out hearing, for expression of line item of uslugopoluchatel according to the provisional solution of the service provider.

The provisional solution about refusal in provision of the state service, or the notification on hearing goes at least in 3 working days prior to completion of term of rendering the state service. Hearing is carried out no later than 2 working days from the date of the notification.

By results of hearing the service provider issues result of rendering the state service.

In case of decision making about refusal in provision of the state service the service provider within one working day returns to uslugopoluchatel originals of documents and the motivated notification on refusal in provision of the state service in form according to appendices 6 or 7 to these rules. In this case in case papers the copies of documents certified by the contractor of the service provider join.

In case of the positive decision the employee of division of the service provider through IS MT in "Integration lock of the Automated system of mobilization resources" (further – ISh the EXPERT of MR) the notification goes to territorial subdivision of local authorities of military management (further – MOVA) for the purpose of removal from military accounting. MOVA within one working day processes request and directs the withdrawal notice of uslugopoluchatel from military accounting.

Then the Integration information system "Service Center of the Population" (further – IIS TsON) creates request in IS MT about removal from military accounting of uslugopoluchatel and jointly the following children (in case of their availability) and need of the appeal to the State corporation for removal from registration on the permanent residence in the territory of the Republic of Kazakhstan which goes to the State corporation or the portal.

Within one working day after receipt of the notification the uslugopoluchatel addresses to the State corporation for delivery of the identity certificate or the residence permit of the foreigner in the Republic of Kazakhstan or certificates of the stateless person.

After delivery confirmation the identity certificate or the residence permit of the foreigner in the Republic of Kazakhstan or the certificate of the stateless person the service provider performs on the same day removal from registration on the permanent residence, issue to uslugopoluchatel (or to his representative under the notarized power of attorney) decisions on document creation on departure out of limits of the Republic of Kazakhstan on the permanent residence in form according to appendices 8 or 9 to these rules.

In case of the address through the portal the decision on document creation to departure out of limits of the Republic of Kazakhstan to the permanent residence goes to "personal account" in electronic form, the head signed by the EDS.

10. To the citizens of the Republic of Kazakhstan leaving the Republic of Kazakhstan on the permanent residence irrespective of their age, the passport of the citizen of the Republic of Kazakhstan is drawn up. Their identity certificates are given in the law-enforcement body which processed documents for departure out of limits of the Republic of Kazakhstan for the permanent residence.

11. The citizens of the Republic of Kazakhstan who left the Republic of Kazakhstan on temporary cases and showed willingness to remain there on the permanent residence address to foreign institutions of the Republic of Kazakhstan.

12. The citizens of the Republic of Kazakhstan who undertook obligations whenever possible of restriction of the departure out of limits of the Republic of Kazakhstan in connection with their admission to the state secrets (further - sekretonositel) and intending to go abroad, beforehand get the exit visa at heads of those state bodies or other organizations where they signed the specified obligations (further - the organizations).

In cases of reorganization of the organizations the decision on possibility of departure of sekretonositel out of limits of the Republic of Kazakhstan on the permanent residence is made by heads of the organizations, being their legal successors.

In case of liquidation (abolition) of the organizations the decision on possibility of departure is made by heads of territorial authorities of homeland security at the place of residence of sekretonositel.

13. The service provider provides entering of data into information system of monitoring of rendering the state services on stage of rendering the state service according to the procedure, established by Rules of entering of data into information system of monitoring of rendering the state services about stage of rendering the state service approved by the order of the acting minister of transport and communications of the Republic of Kazakhstan of June 14, 2013 No. 452 (it is registered in the Register of state registration of regulatory legal acts No. 8555).

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of the service provider and (or) his officials, the State corporation and (or) his workers concerning rendering the state services

14. Consideration of the claim concerning rendering the state services is carried out by higher administrative authority, the official, authorized body by assessment and control of quality of rendering the state services (further – the body considering the claim).

15. The claim is submitted to the service provider and (or) the official whose decision, action (failure to act) are appealed.

The service provider, the official, whose decision, action (failure to act) are appealed, no later than three working days from the date of receipt of the claim send it and administrative case to the body considering the claim.

At the same time the service provider, the official whose decision, action (failure to act) are appealed, has the right not to send the claim to the body considering the claim if he within three working days makes the decision or other administrative action, completely meeting requirements, specified in the claim.

The claim of uslugopoluchatel which arrived to the service provider who is directly rendering the state service according to Item 2 of article 25 of the Law of the Republic of Kazakhstan "About the state services" is subject to consideration within five working days from the date of its registration.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within fifteen working days from the date of its registration.

16. The claim to action (failure to act) of employees of the State corporation when rendering services through the State corporation is submitted addressed to the head of the State corporation whose administrative action (failure to act) is appealed.

17. If other is not provided by the Law, appeal in court is allowed after appeal in administrative (pre-judicial) procedure according to Item 5 of Article 91 Administrative procedural - the Procedure Code of the Republic of Kazakhstan.

8	The list of the documents and data requested at uslugopoluchatel for rendering the state service	Through the State corporation, in case of the personal address of uslugopoluchatel (for the children and citizens recognized by court incapacitated, their legal representatives (parents, guardians, custodians). Parents, guardians, custodians confer the documents confirming powers on representations (for the children and citizens recognized by court incapacitated): 1) statement questionnaire; 2) the identity certificate or its electronic form provided by means of service of digital documents and the passport of the citizen of the Republic of Kazakhstan, the certificate of birth of the children who did not reach sixteen-year age or its electronic form provided by means of service of digital documents; the residence permit of the foreigner in the Republic of Kazakhstan; the certificate of the stateless person (for identification of the personality); 3) the agreement on payment of the alimony signed according to the procedure, provided by Chapter 22 of the Code of the Republic of Kazakhstan "About scrap (matrimony) and family" if in the territory of the Republic of Kazakhstan family members leaving to which it under the law provides content in case of availability concerning uslugopoluchatel of the operating enforcement proceeding on collection of the alimony constantly live. In case of not reaching an agreement leaving is represented the judgment about determination of the size of the alimony in firm sum of money or lump sum payment of the alimony or provision of certain property on account of the alimony, either payment of the alimony otherwise, or factual determination of absence at leaving the obstacles provided by the law for departure. Note: – to receivers of the alimony are carried by the Code to family members: minor children; parents; the disabled needing spouse (spouse); the spouse, including former, during pregnancy and within three years since the birth of the general child; the needing spouse (spouse) including being performing care of the general child with disability before achievement of age by it eighteen years and also in case of determination to the general child with disability on reaching eighteen years of the first or second group of disability; the disabled needing former spouse (spouse) who became disabled before annulment of marriage (matrimony); the minor brothers and sisters needing the help; minor persons in need in the help grandsons; disabled persons in need in the help the grandfather and the grandmother; the disabled needing persons which actually raised and containing minor children; the disabled, needing the help stepfather and stepmother who were bringing up and containing the stepsons or stepdaughters. 4) the conclusion of guardianship and custody bodies about accounting of opinion of the child who reached ten-year age in case of decision making about its departure with parents or other legal representatives; 5) in case of departure on the permanent residence of the citizens of the Republic of Kazakhstan who did not reach eighteen years together with one of parents (the guardian, the custodian) – the notarized consent of other parent living in the territory of the Republic of Kazakhstan. In the absence of consent departure of the minor can be resolved judicially; 6) the document, confirming payment of the state fee. 7) the statement (in case of lack of data on registration for the territories of the Republic of Kazakhstan of the faces specified in subitems 3) and 5) of this Item). Through the portal: 1) statement questionnaire electronically; 2) data on payment of the state fee for rendering the state service through payment gateway of "the electronic government"; 3) electronic copies of documents in the scanned option according to the List of documents necessary for rendering the state service. For removal from registration on the permanent residence in the territory of the Republic of Kazakhstan, the uslugopoluchatel provides to the employee of the State corporation within one working day after receipt of the notification the identity certificate; the residence permit of the foreigner in the Republic of Kazakhstan; certificate of the stateless person.
9	The bases for refusal in rendering the state service established by the legislation of the Republic of Kazakhstan	Uslugopoluchatel: 1) has the data which are the state and protected by the law other secret and did not notify on the fact of the departure out of limits of the Republic of Kazakhstan the relevant authorized bodies – before cancellation of these circumstances; 2) it is detained on suspicion of making of criminal offense or attracted as the suspect, the person accused, or concerning it the decree on qualification of act of the suspect – before decision on case or introductions in legal force of the court verdict is issued; 3) it is condemned for crime execution – before departure of punishment or release from punishment; 4) evades from obligation fulfillment, assigned to it by court, – before the termination of these obligations; 5) passes conscription military service – before completion of passing of this service or before release from it according to the Law of the Republic of Kazakhstan "About military service and the status of the military personnel"; 6) reported about himself obviously false data in case of document creation for departure from the Republic of Kazakhstan – before elimination of the reasons which formed the basis for refusal, and submission of authentic data; 7) is defendant in civil legal proceedings – to the introduction in legal force of the judgment; 8) has tax debt – before its complete repayment; 9) is debtor on enforcement proceeding; The Requirement of the subitem 9) does not extend if the debtor on enforcement proceeding provided: the voluntary settlement signed with the claimant approved by court; the agreement on dispute settlement with the claimant according to the procedure of mediation; the documents confirming execution of collection or other requirement of the executive document; the documents confirming cancellation of the decision of relevant organ based on which the executive document is issued. The service provider refuses rendering the state service in cases of the stipulated in Article 19-1 Law of the Republic of Kazakhstan "About the state services".
10	Other requirements taking into account features of rendering the state service including rendered electronically and through the State corporation	Uslugopoluchatelyam having permanent disorders of functions of organism, complete or partial loss of capability, or opportunity to perform self-service, independently to move, be guided by documents acceptance, rendering the state service, is made by the employee of the State corporation with departure at the place of residence by means of the address through Single contact - the center 1414, 8 800 080 7777. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of single contact center concerning rendering the state services "1414". Contact telephone numbers of service desks concerning rendering the state service are specified on Internet resource: mvd. gov.kz.
