1. Approve the enclosed standard of the state service "Document Creation on Departure out of Limits of the Republic of Kazakhstan on the Permanent Residence".

2. To provide to department of migratory police of the Ministry of Internal Affairs of the Republic of Kazakhstan:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";

3) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan and on the intranet portal of state bodies.

3. To impose control of execution of this order on the deputy minister of internal affairs of the Republic of Kazakhstan Turgumbayev E. Z. and Department of migratory police of the Ministry of Internal Affairs of the Republic of Kazakhstan (Sainov S. S.).

4. This order becomes effective after ten calendar days from the date of its first official publication.

Standard of the state service "Document Creation on Departure out of Limits of the Republic of Kazakhstan on the Permanent Residence"

Chapter 1. General provisions

1. The state service "Document Creation on Departure out of Limits of the Republic of Kazakhstan on the Permanent Residence" (further - the state service).

2. The standard of the state service is developed by the Ministry of Internal Affairs of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears territorial subdivisions of the Ministry (further - the service provider).

Reception of an application and issue of result of rendering the state service is performed through:

1) service provider;

2) Non-commercial joint-stock company "The Government for Citizens state corporation (further - the State corporation).

Chapter 2. Procedure for rendering the state service

4. Term of rendering the state service:

1) from the moment of delivery of document package to the service provider - 30 calendar days;

from the moment of delivery of document package in the State corporation:

1 stage: consideration of documents by the service provider, with the positive conclusion of the approving bodies - 21 calendar day;

2 stage: decision about document creation at departure out of limits of the Republic of Kazakhstan on the permanent residence, issue of the document confirming departure out of limits of the Republic of Kazakhstan on the permanent place residence for removal of uslugopoluchatel from military accounting (in case of the relation to conscription) and removals from registration on the permanent residence in the territory of the Republic of Kazakhstan, or issue of the notification on refusal in provision of the state service - 1 calendar day;

3 stage: removal of uslugopoluchatel from military accounting (in case of the relation to conscription) and removal from registration on the permanent residence in the territory of the Republic of Kazakhstan - 7 calendar days;

4 stage: issue of result of rendering the state service in the form of the decision on document creation on departure out of limits of the Republic of Kazakhstan on the permanent residence - 1 calendar day.

In case of the appeal to the State corporation day of acceptance does not enter rendering the state service in time.

2) the most allowed time of expectation for delivery of document package of uslugopoluchatel at the service provider - 30 minutes, in the State corporation - 15 minutes.

3) the most allowed time of servicing of uslugopoluchatel at the service provider - 30 minutes, in the State corporation - 15 minutes.

5. Form of rendering the state service – paper.

6. Result of rendering the state service - the decision on document creation on departure out of limits of the Republic of Kazakhstan on the permanent residence in form, according to appendix 1 to this standard of the state service, or the motivated notification on refusal in rendering the state service in form, according to appendix 1-1 to this standard of the state service in cases and on the bases, stipulated in Item 10 these standards of the state service.

Form of provision of result of rendering the state service - paper.

7. The state service is rendered on paid basis. For rendering the state service the state fee which according to article 613 of the Code of the Republic of Kazakhstan of December 25, 2017 "About taxes and other obligatory payments in the budget" (Tax code) - 1 monthly settlement indicator is collected.

In case of filing of application on receipt of the state service through the State corporation payment is performed through payment gateway of "the electronic government" (further - PShEP) or banks of the second level.

8. Working schedule:

1) the service provider – Monday through Friday from 9-00 till 18-30 o'clock, with lunch break from 13-00 to 14-30, except days off and holidays, according to the labor law of the Republic of Kazakhstan.

Reception of applications and issue of results of rendering the state service is performed in place of registration of uslugopoluchatel from 9:00 to 17:30 o'clock with lunch break from 13:00 to 14:30 o'clock.

Acceptance by the service provider is performed in turn, without making an appointment and the accelerated servicing.

2) the State corporation – Monday through Saturday inclusive, according to the established working schedule from 9-00 till 20-00 o'clock without interruption for lunch, except for Sundays and holidays, according to the labor law of the Republic of Kazakhstan;

Acceptance in the State corporation is performed in place of registration of uslugopoluchatel according to the procedure of "electronic" queue, without the accelerated servicing or booking of electronic queue by means of the web portal of "the electronic government" www.egov.kz.

9. The list of the documents necessary for rendering the state service, in case of the personal address of uslugopoluchatel (for the children and citizens recognized by court incapacitated, their legal representatives (parents, guardians, custodians). Parents, guardians, custodians confer the documents confirming powers on representations (for the children and citizens recognized by court incapacitated):

1 stage:

1) the statement questionnaire in form, according to appendix 2 to this standard of the state service;

2) the identity certificate and the passport of the citizen of the Republic of Kazakhstan, the certificate of birth of the children who did not reach sixteen-year age (for identification of the personality);

3) the agreement on payment of the alimony signed according to the procedure, provided by Chapter 22 of the Code of the Republic of Kazakhstan of December 26, 2011 "About scrap (matrimony) and family" if in the territory of the Republic of Kazakhstan family members leaving to which it under the law shall provide content constantly live. In case of not reaching an agreement leaving is represented the judgment about determination of the size of the alimony in firm sum of money or lump sum payment of the alimony or provision of certain property on account of the alimony, either payment of the alimony otherwise, or factual determination of absence at leaving the obstacles provided by the law for departure.

4) the conclusion of guardianship and custody bodies about accounting of opinion of the child who reached ten-year age in case of decision making about its departure with parents or other legal representatives;

5) in case of departure on the permanent residence of the citizens of the Republic of Kazakhstan who did not reach eighteen years together with one of parents (the guardian, the custodian) - the notarized consent of other parent living in the territory of the Republic of Kazakhstan. In the absence of consent departure of the minor can be resolved judicially;

6) the copy of the document confirming payment of the state fee.

In case of lack of data on registration for the territories of the Republic of Kazakhstan of the faces specified in subitems 3) and 5) of this Item, the citizen petitioning for departure files petition in form, according to appendix 3 to this standard of the state service in law-enforcement bodies for factual determination of their registration for territories of the country.

After adoption of all documents the receipt on documents acceptance from uslugopoluchatel, or from the employee of the State corporation in form, according to appendix 4 to this standard of the state service is issued to uslugopoluchatel.

Data on identity documents, certificates of birth of children if registration was made after 2008 in the territory of the Republic of Kazakhstan, the document confirming payment by uslugopoluchatel in the budget of the amount of the state fee for issue of the notification in case of payment through PShEP, the employee of the State corporation receives from the corresponding state information systems through lock of "the electronic government".

The employee of the State corporation receives the written consent of uslugopoluchatel to use of the data which are the secret protected by the law, containing in information systems when rendering the state service if other is not provided by the laws of the Republic of Kazakhstan;

2 stage:

in case of the positive decision on document creation on departure out of limits of the Republic of Kazakhstan on the permanent residence the service provider or the employee of the State corporation issues to uslugopoluchatel the document confirming departure out of limits of the Republic of Kazakhstan on the permanent place residence for removal from military accounting and removal from registration in form according to appendix 4-1 to this standard of the state service.

3 stage:

removal of uslugopoluchatel from military accounting and delivery of the military ID (in case of the relation to conscription);

removal of uslugopoluchatel from registration on the permanent residence in the territory of the Republic of Kazakhstan.

2) it is detained on suspicion of making of criminal offense or attracted as the suspect, the person accused, or concerning it the decree on qualification of act of the suspect – before decision on case or introductions in legal force of the court verdict is issued;

3) it is condemned for crime execution – before departure of punishment or release from punishment;

4) evades from obligation fulfillment, assigned to it by court, – before the termination of these obligations;

5) passes conscription military service – before completion of passing of this service or before release from it according to the Law of the Republic of Kazakhstan of February 16, 2012 "About military service and the status of the military personnel";

6) reported about himself obviously false data in case of document creation for departure from the Republic of Kazakhstan – before elimination of the reasons which formed the basis for refusal, and submission of authentic data;

7) is defendant in civil legal proceedings – to the introduction in legal force of the judgment;

8) has tax debt.

In case of provision by uslugopoluchatel of incomplete document package according to the list, stipulated in Item 9 these standards of the state service, the service provider or the employee of the State corporation refuses reception of an application, at the same time the employee of the State corporation issues the receipt on refusal in documents acceptance in form, according to appendix 5 to this standard of the state service.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of the service provider and (or) his officials, the State corporation and (or) his workers concerning rendering the state services

11. Appeal of decisions, actions (failure to act) of the service provider and (or) his officials or the Ministry of questions of rendering the state services moves addressed to the head of the service provider to the addresses and phones specified in Item 14 of this standard of the state service or addressed to the head of the Ministry of the address: 010000, city of Astana, Prospekt Tauyelsizdik, 1, phone: 8 (7172) 71-40-33, 71-40-03.

The motivated answer about results of consideration of the claim goes to uslugopoluchatel by mail or is issued purposely in office of the service provider or the Ministry.

The claim to actions (failure to act) of the employee of the State corporation is sent to the head of the State corporation to the addresses and phones specified in Item 14 of this standard of the state service.

12. In disagreement cases with results of the rendered state service, the uslugopoluchatel has the right to take a legal action according to the procedure, established by the legislation of the Republic of Kazakhstan.

Chapter 4. Other requirements taking into account features of rendering the state service

13. Uslugopoluchatelyam, having violation of health with the permanent disorder of functions of organism limiting life activity, in case of need documents acceptance is made by the service provider or the employee of the State corporation with departure at the place of residence by means of the address of uslugopoluchatel through Single contact for rendering the state service - the center 1414, 8 800 080 7777.

14. Addresses of places of rendering the state service are placed on:

1) Internet resource of the Ministry – www.mvd.gov.kz in the Section "About the Ministry", the subsection "Web Resources of Structural Divisions of the Ministry of Internal Affairs of the Republic of Kazakhstan";

2) Internet resource of the State corporation: www.con.gov.kz.

15. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of single contact center concerning rendering the state services.

16. Contact telephone numbers of service desks of the service provider concerning rendering the state service are specified on the www.mvd.gov.kz Internet resource. Single contact center concerning rendering the state services: 1414.
