About approval of changes which are made to some Orders of the Government

The government DECIDES:

1. Approve changes which are made to some orders of the Government (are applied).

2. To financial institutions till December 28, 2020 to provide to National cash desk of social insurance of confirmation concerning the amounts of the social benefits distributed into accounts of receivers and to return into the accounts of National cash desk of social insurance opened for each type of social benefits separately, the amounts of social benefits which are not distributed into accounts of receivers including the available amounts which were requested based on orders.

3. To the state company "Posta Moldovei":

1) till December 24, 2020 to provide to National cash desk of social insurance electronic lists and reports on pension payment, the public social benefits and benefits on restriction of opportunities owing to labor accident and occupational disease;

2) till December 28, 2020 to provide to National cash desk of social insurance electronic lists and reports on payment of other types of social benefits and to return in full into the accounts of National cash desk of social insurance opened for each type of social benefit separately, the amounts of social benefits which are not paid/blocked, including not paid with postal money transfers and also the available amounts which were requested based on orders.

4. This resolution becomes effective on January 1, 2021, except for Items 2 and 3, which will become effective from the date of publication in the Official monitor of the Republic of Moldova

Changes which are made to some Orders of the Government

1. In the Order of the Government No. 374/1999 about approval of the Regulations on payment procedure of immediate compensation for the damage caused to health, persons with limited opportunities from among participants of mitigation of consequences of the Chernobyl catastrophic crash and nuclear testing, accidents with the ionizing radiation and their effects on nuclear civil or military facilities (Official monitor of the Republic of Moldova, 1999, Art. No. 48-49, 364), with subsequent changes, to make the following changes:

Item 2 of the resolution to declare 1) invalid;

2) In the Provision:

a) in Item 6:

the second offer to state in the following edition:

"Payment of immediate compensation for the damage caused to health is performed by means of the payment method chosen by the receiver and available within government electronic payment service (MPay).";

the third offer to exclude;

b) add with Item 6-1 of the following content:

"6-1. Payment of the immediate compensations established and not received by the receiver within 12 months in a row stops.

Payment of immediate compensations is resumed on the basis of the statement of the receiver or the representative authorized by the power of attorney and the identity certificates of the applicant submitted to body of social insurance and is paid in retroactive procedure for the period three years preceding date of the address.";

c) in Item 12 of the word "about its payment" shall be replaced with words "about purpose of immediate compensation";

d) state Item 13 in the following edition:

"13. The expenses connected with payment of immediate compensation are financed by means of the government budget.";

e) declare Item 14 invalid;

f) recognize appendices No. 1 and No. 2 invalid.

2. The regulations on procedure of payments of the time capitalized payments approved by the Order of the Government No. 127/2000 (Official monitor of the Republic of Moldova, 2000, Art. No. 19-20, 209), to add with Item 3-1 of the following content:

"3-1. Payment of the time capitalized payments is performed according to the procedure, the provided Regulations on the payment procedure of pensions in the public pension system and the public social benefits approved by the Order of the Government No. 929/2006 of year.".

In the Regulations on procedure for establishment of benefit on restriction of opportunities from labor mutilation or occupational disease approved by the Order of the Government No. 1101/2001 (Official monitor of the Republic of Moldova, 2001, No. 129, of the Art. 1163), with subsequent changes, to make the following changes:

Item 4-3 to state 1) in the following edition:

"4-3. The benefit on restriction of opportunities is indexed according to provisions of article 13 of the Law No. 156/1998 on the public pension system.";

To add 2) with Item 13-1 of the following content:

"13-1. Allowance payment on restriction of opportunities as a result of labor mutilation or occupational disease is performed according to the procedure, established in Regulations on the payment procedure of pensions in the public pension system and the public social benefits approved by the Order of the Government No. 929/2006.";

Item 14 to declare 3) invalid.

4. In the Regulations on procedure for the periodical capitalized payments from the government budget in case of liquidation of the companies without legal succession approved by the Order of the Government No. 341/2002 (Official monitor of the Republic of Moldova, 2002, Art. No. 46-48, 437), with subsequent changes, to make the following changes:

Item 10 to state 1) in the following edition:

"10. Payment of monthly compensation payments is performed by means of the payment method chosen by the receiver and available within government electronic payment service (MPay). Accounting of payments of the periodical capitalized payments is performed by National cash desk of social insurance.";
