About modification and amendments in some decisions of the Government of the Republic of Kazakhstan

1. Approve the enclosed changes and additions which are made to some decisions of the Government of the Republic of Kazakhstan.

2. This resolution becomes effective from the date of its signing and is subject to official publication.

Changes and additions which are made to some decisions of the Government of the Republic of Kazakhstan

1. In the order of the Government of the Republic of Kazakhstan of April 24, 2008 No. 387 "About some questions of the Ministry of Finance of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2008, No. 22, the Art. 205):

In Regulations on the Ministry of Finance of the Republic of Kazakhstan approved by the specified resolution:

add Item 16 with subitems 417-1) and 417-2) of the following content:

In the order of the Government of the Republic of Kazakhstan of July 31, 2014 No. 865 "About approval of Rules of cost recovery to Items of storage of material values of the state material reserve, and also cost recovery for the material values of the state material reserve used for the prevention and liquidation of emergency situations and their effects, rendering the regulating impact on the market, the help to refugees and the humanitarian assistance" (SAPP of the Republic of Kazakhstan, 2014, No. 48, the Art. 497):

"2) department of authorized body (further – department) – the structural division of authorized body performing realizable functions in the field of the state material reserve;";

The subordinated organizations and Items of storage perform storage of material values of the state material reserve based on the agreement of storage of material values of the state material reserve and rendering the services connected with storage (further – the agreement of storage), concluded with department.".

4. In the order of the Government of the Republic of Kazakhstan of March 4, 2015 No. 108 "About approval of Rules of accounting of material values of the state material reserve" (SAPP of the Republic of Kazakhstan, 2015, No. 12, the Art. 60):

add Item 2 with subitem 1-1) of the following content:

"1-1) utilized goods – the goods received after technological conversion of material values of the state reserve;";

Statements are drawn up in day of bookmark, signed with own hand or by means of the digital signature according to the legislation of the Republic of Kazakhstan by the head, the chief accountant, the responsible person, the employee of mobilization division (in the presence in the organization of mobilization division) Item of storage and the subordinated organization, are sealed (in the presence) and one copy of acts in 5 (five) working days goes to department for registration of material values of the state reserve.

The documents confirming compliance of material values to requirements of the legislation of the Republic of Kazakhstan in the field of technical regulation are attached to acts (documents on assessment of conformity in registration forms (state registration), testing, the confirmations of conformity, examinations confirming quality and safety of goods).";

add with Item 9-1 of the following content:

"9-1. The utilized goods in case of acceptance in Items of storage and the subordinated organization for the subsequent realization are registered departments based on the delivery-acceptance certificate in form according to appendix 2 to these rules.

Statements are drawn up in day of acceptance of the utilized goods in Items of storage and the subordinated organization, signed with own hand or by means of the digital signature according to the legislation of the Republic of Kazakhstan by the head, the chief accountant, the responsible person, the employee of mobilization division (in the presence in the organization of mobilization division) Item of storage and the subordinated organization, are sealed (in the presence) and one copy of acts in 5 (five) working days goes to department for registration of the utilized goods.

The documents confirming compliance of the utilized goods to requirements of the legislation of the Republic of Kazakhstan are attached to acts (documents on assessment of conformity in registration forms (state registration), testing, the confirmations of conformity, examinations confirming quality and safety of goods).";

"10. Department considers the acts provided by Items 9 or 9-1 of these rules and in 5 (five) working days from the date of their obtaining performs statement of material values or the utilized goods on accounting in the state reserve or returns acts on completion.

Acts return to completion in cases:

1) discrepancies of acts to the requirements specified in Items 9 or 9-1 of these rules and to appendices 1 and 2 to these rules;

2) availability of erasure or addition, the crossed-out words and others, the corrections which are not stipulated in them, documents performed by pencil and also documents with the damages which are not allowing to interpret unambiguously their content;

3) discrepancies of the act to the delivery agreement (in case of availability of the delivery agreement).

In 5 (five) working days from the date of return Items of storage and the subordinated organization send to department modifed acts for registration of material values or the utilized goods of the state reserve.";

"13. Documents on assessment of conformity in registration forms (state registration), testing, the confirmations of conformity, examinations confirming the quality and safety of goods represented in case of bookmark with suppliers according to the signed agreement to deliver goods are stored in technological department of the subordinated organization or accounting service of Items of storage together with documents of delivery.".
