About modification and amendments in some Orders of the Minister of Transport and Communications of the Republic of Kazakhstan
I ORDER:
1. In the order of the Minister of Transport and Communications of the Republic of Kazakhstan of June 13, 2011 No. 362 "About approval of qualification requirements to person for receipt of the certificate of aviation personnel" (it is registered in the Register of state registration of regulatory legal acts for No. 7058) to make the following change:
The qualification requirements to person for receipt of the certificate of aviation personnel approved by the specified order to state in edition according to appendix 1 to this order.
2. In the order of the Minister of Transport and Communications of the Republic of Kazakhstan of September 28, 2013 No. 764 "About approval of Standard programs of professional training of the aviation personnel participating in safety of flights" (it is registered in the Register of state registration of regulatory legal acts for No. 8785) to make the following changes and addition:
in Standard programs of professional training of the aviation personnel participating in safety of the flights approved by the specified order:
state item 4 in the following edition:
"4. In these Standard programs the following terms and determinations are used:
1) the emergency equipment - the equipment which is installed or is onboard the aircraft (further - AF), for use in emergency and emergency situations which require immediate taking measures for the purpose of safety of flights and preserving life all being on board (supply of oxygen in passenger salon, the axe, the fire extinguisher, smoke-proof oxygen hood, the mechanical instrument of disconnection, emergency chute);
2) emergency procedures - the procedures established by the operator in management on production of flights and applied in supernumerary and emergencies. The situation which is not typical or standard is called supernumerary, conducts to variations and creates threat of emergency;
3) aviation training center (further - AUTs) - the legal entity performing preparation, retraining and maintenance of professional level of aviation personnel;
4) aviation personnel - the physical persons having special and (or) professional training, performing activities for accomplishment and ensuring flights of AF, airborne transportations and aviation works, maintenance (further - THAT) AF, to the organization and servicing of air traffic, air traffic control;
5) possibilities of the person - the capabilities of the person and limits of its opportunities influencing safety and efficiency of aviation activities;
6) authorized body in the field of civil aviation (further - authorized body) - the central executive body performing management in the field of use of airspace and activities of civil and experimental aviation;
7) instrument time - flight time on devices or time of land training on devices;
8) heavy aircrafts:
airplanes - AF with the maximum take-off mass of equal and more than 5700 kg;
helicopters - AF with the maximum take-off mass of equal and more than 3180 kg;
9) aerostat - AF is easier than air, not set in motion by the engine;
10) real maintenance of aircrafts or involvement in real maintenance of aircrafts - work of the specialist on AF having the existing certificate of the specialist in AF and use of powers of certified permission and (or) real accomplishment, at least, on the same AF type or groups of the AF systems determined in individual certified permission;
11) privileges of the specialist in technical I service aircrafts (AML Holder Privileges) - the limited rights and obligations officially provided or the organization and to repair of the aircraft equipment (further - RAT) to the owner of the acting certificate on the basis of the entries in the column "Rating" of the AF types, the engine and category of the specialist on THAT AF, and also certified permission to accomplishment THAT AF, or in conditions when THAT AF is carried out, and the organization for TO and PAT is not required - the existing certificate of the specialist on THAT by AF and the corresponding entry in the column "Rating";
12) type of aircrafts - classification of AF on the basis of the established main characteristics:
airplane;
helicopter;
glider;
free aerostat;
AF with system of increase in carrying power;
airship;
motor-hang-glider;
autogyro;
13) the aircraft - the device supported in the atmosphere due to its interaction with air excepting interaction with the air reflected from land (water) surface;
14) maintenance of aircrafts - work, necessary for ensuring preserving (maintenance) the flight validity of AF, including control recovery work, checks, replacements, elimination of defects which are carried out as separately, and in combination, and also practical implementation of modification or repair, excepting accomplishment by preflight inspectorate;
15) the commander of the aircraft under observation - the second pilot who is carrying out under observation of the commander of AF of obligation and function of the commander of AF according to the technique of observation acceptable for authorized organization;
16) the commander of the aircraft (further - KVS) - the pilot appointed the operator or, in case of aircraft of general purpose, the owner of AF to carry out obligations of the commander and to be responsible for safe accomplishment of flight;
17) type of aircrafts - all AF of the same basic design, including all their modifications, except for those which lead to change of flight or flight characteristics;
18) servicing of air traffic (further - Department of Internal Affairs) - flight and information servicing, the emergency notification, dispatching Department of Internal Affairs (district dispatching servicing, dispatching servicing of approach and airfield dispatching servicing);
19) watch system of servicing of air traffic - the general term which separately is understood as the ADS-B, PORL, VORL systems or any other comparable land system allowing to identify AF;
20) servicing of air traffic on the basis of observation - the term used concerning one of types of the servicing provided directly by means of watch system of Department of Internal Affairs;
21) preparation on adopted agenda - the preparation performed under control and according to the special program approved by the contracting state;
22) (approved) organization approved educational - the organization approved (approved) by the contracting state and functioning under its control for carrying out preparation on adopted agenda;
23) the approved (approved) organization for maintenance - the organization approved (approved) by the contracting state according to requirements of Chapter 8 "Maintenance of airplanes";
24) the onboard electronic equipment - any electronic device, including its electric part, held for use onboard AF, including the radio equipment, system of automatic flight control and the instrument equipment;
25) nondestructive control (NDT) - the control method used for control of condition of the materials, components and systems applied on AF, power plants, the related systems and components for the purpose of check of condition of these products and detection of defects without damage of the products which are exposed to control;
26) qualification - combination of the abilities, knowledge and installations required for accomplishment of task at the ordered level;
27) qualification mark - the record made in the certificate or having relation to it the document, being its part in which the special conditions, the rights or restrictions relating to this certificate are specified;
28) the qualification block - the discrete function consisting of number of qualification elements;
29) the qualification test - demonstration of theoretical knowledge and practical skills for obtaining (confirmation, prolongation of effective period) the certificate or qualification mark;
30) qualification element - the action representing task which has the initiating event and the completing event, borders which are accurately determining it, and observed result;
31) the aircraft certified for flights with one pilot - the AF type which according to the decision of the state of registration made during certification is allowed to operation with flight crew of the minimum structure, namely one pilot;
32) the combined training - carrying out professional training by combination of different forms of education;
33) the technique promoting preparation - the active method of preparation in which are used effective poll, attentive listening and without estimative approach and which is especially effective in development of skills and the relations to case gives help to trainees in receipt of more profound knowledge and development of own decisions that leads to higher level of understanding, storing of training material and interest;
34) the preparation purpose - the accurate formulation consisting of three parts: desirable performance indicators or what the listener presumably is able to do on the termination of term of preparation (or upon termination of these or those specific stages of preparation); the standard of efficiency which is reached for confirmation of skill level of the listener; conditions in which the listener shows the qualification;
35) independent raid - time of flight during which the pilot cadet is the single person onboard AF;
36) the airship - the aircraft which is easier than air, set in motion by the engine;
37) the second pilot - person, having the certificate of the pilot who performs any functions of the pilot, except the KVS functions, exception is constituted by the pilot who is onboard AF only for the purpose of passing of flight training;
38) the examiner (appraiser) - the physical person having the corresponding qualification, authorized and appointed by authorized organization to carry out assessment of theoretical knowledge and (or) practical skills of aviation personnel, specialists for the purpose of issue or prolongation of certificates or introduction of qualification marks or the admission to independent activities;
39) conditions - everything that is considered special environment in which efficiency will be shown;
40) time of land training on devices - time during which the pilot works on the earth simulated flight on devices on the training device of imitation of flight;
41) the member of kabinny crew - person belonging to aviation personnel who for the benefit of safety and for the purpose of servicing of passengers and (or) transportation of goods carries out the obligations onboard AF charged to it by the operator or KVS, but not being the member of flight crew;
42) professional training (training) - initial preparation, retraining and maintenance of professional level;
43) maintenance of professional level - training process of aviation personnel which purpose is updating of professional knowledge, skills and abilities for the purpose of compliance to qualification requirements;
44) complex training - carrying out professional training by one-time implementation of all training program for the established period;
45) complex course of training of pilots of commercial aircraft - training of pilots within one continuous training course to the skill level necessary for issue of the certificate of the pilot of commercial aircraft (further - CPL);
46) modular course of training of pilots of commercial aircraft - training of pilots within final stage of training course to the skill level necessary for issue of the certificate CPL and (or) qualification mark about the right of accomplishment of flights on devices;
47) commercial air transportation - activities of legal entities for transportation of passengers, baggage, loads and mailings by civil aircrafts for a fee or on hiring according to the agreement of airborne transportation;
48) the aircraft with system of increase in carrying power - AF is heavier than air, capable to carry out vertical take-off, vertical landing and flight at small speed that is generally provided with the mechanization of wing put in action by the engine or draft of the engine, used for creation of carrying power on these modes of flight, and also not rotating aerodynamic surfaces creating carrying power in case of accomplishment of horizontal flight;
49) to certify the validity to flights (to allow AF or component to operation) - to issue the certificate (certificate) that AF or his parts meet existing rules of the flight validity after accomplishment of maintenance of AF or his parts;
50) the dispatcher of servicing of air traffic with qualification mark in the certificate - the dispatcher of Department of Internal Affairs having the certificate and the valid qualification marks corresponding to the rights performed by it;
51) giving of force (certificate) - action as a result of which the contracting state instead of issue of own certificate recognizes the certificate granted to other contracting states as equivalent to its own certificate;
52) retraining - the training process of specialists of industry of civil aviation directed to studying of the aircraft equipment, acquisition of new (additional) professional knowledge, skills of abilities;
53) mistake - action or failure to act of the member of operational personnel which leads to departure from intentions or expectations of the organization or this member of operational personnel;
54) control of mistakes - process of detection of mistakes and response to them by means of counter-measures which reduce or eliminate effects of mistakes and reduce probability of further mistakes or undesirable conditions;
55) threat - events or mistakes which occur out of the sphere of competence of the member of operational personnel increase complexity of operation and which need to be managed for maintenance of admissible level of safety;
56) control of factors of threat - process of detection of threats and response to them by means of counter-measures which reduce or eliminate effects of threats and reduce probability of mistakes or undesirable conditions;
57) the equipment for safety - the equipment which is installed or is onboard AF, for permanent use for the purpose of safety of the flights and all persons which are on board (seat belts, security guidelines, demonstration set);
58) distance training - the training performed in case of interaction of the teacher and students at distance including using information and communication technologies and telecommunication means;
59) flight time on devices - time during which the pilot manages the aircraft in flight only according to indications of devices without use of external reference points;

68) the certificate (certificate) of the admission to operation (Certificate Release to Service (further - CRS) - the permission to operation of AF issued by the specialist after performance of works on THAT AF or his components for the purpose of confirmation of its flight validity. The certificate of the admission to operation is implemented through the personal signature of the specialist or statement of the individual stamp issued by the organization for TO and PAT to the specialist in record in maintenance of the flight validity of AF or component;
69) practical training (On the Job Training (further - OJT) - the practical training on AF held in the conditions of the organization for TO and PAT and only her specialists on AF (supervisors and appraisers of practical training) for the purpose of receipt of the 1st AF mark by the candidate in category, new to the specialist ("B2", "B3" (only for the An-2) airplane) and subcategories ("B1.1", "B1.2", "B1.3", "B1.4") in the column "Rating" of the certificate of the specialist THAT AF;
70) quality control system - documentary drawn up organizational procedures and the principles, internal audit of these principles and procedures, the overview of management system and issue of recommendations about improvement of quality;
71) the certifying personnel - the personnel responsible for issue of the certificate of the admission to operation after accomplishment of maintenance of AF or component;
72) certified requirements - requirements to aviation training centers imposed for the purpose of establishment of compliance of the organization, content, level and quality of training of aviation personnel to accepted standards;
73) certified permission (Certification Company Authorisation, CCA) - the permission issued by the HECTARE organization to the specialist on the right of implementation of certain activities in amounts of the powers permitted individually. In the conditions of the organization for TO and PAT certified permission is issued to the certifying personnel, not certifying personnel, the personnel providing training and assessment; in the conditions of aviation training center - to the instructor and examining personnel, the certifying personnel (appraisers). Certified permission is issued individually and unpacked on the separate form;
74) session - period of time during which the candidate takes the examination which is not exceeding 10 consecutive calendar days;
75) standard procedures or standard working procedures of the operator (Standard Operating Procedures (further - SOP)) - procedures which are established by the operator in management on production of flights for accomplishment of standard actions on board (for example, preflight instructing of kabinny crew, check of the AF passenger salon before flight, instructing of passengers, reduction in safe provision of kitchen rooms, toilet rooms and the AF passenger salon, monitoring of the AF passenger salon during flight);
76) offsetting - recognition of alternative means or the qualification received earlier;
77) training - in-plant training under the leadership of person providing training for the purpose of practical mastering specialty, adaptation to objects of servicing and management, and also bystry orientation on workplace and development of new working methods;
78) theoretical preparation - the stage of process of professional training when which passing the trainee acquires special theoretical knowledge and also supports and enhances them according to adopted agendas of training;
79) signing of the certificate on maintenance (issue of the certificate of the admission to CRS operation) - the certificate of the fact that work on THAT AF or component is executed well according to applicable in this case air worthiness standards in witness whereof the certificate on maintenance is granted (the certificate of the admission to CRS operation);
80) criteria of efficiency - the simple, giving-in to assessment statement of required result of qualification element and the description of the criteria used for determination of whether the required level of efficiency is reached;
81) training preparation - the stage of process of professional training of aviation personnel when which passing the trainee acquires supports and enhances practical skills and abilities by means of the imitating devices approved by authorized organization in the field of civil aviation (further - authorized organization);
82) night - the period of night-time between the solar phenomena, nightfall and dawn (the end of evening civil twilight and the beginning of morning civil twilight);
83) helicopter - AF is heavier than air which is supported in flight generally due to reactions of air with one or several bearing screws rotated by the power plant around the axes which are approximately in vertical position;
84) airplane - AF, is heavier than air, set in motion by the power plant which carrying power in flight is created generally due to aerodynamic reactions on the surfaces remaining motionless in these flight conditions;
85) flight training - the stage of process of professional training of members of flight crew when which passing the trainee acquires and enhances practical skills and abilities of accomplishment of flight;
86) the training device of imitation of flight - any of the following three types of devices by means of which on the earth flight conditions are imitated:
the exercise machine imitating flight conditions which provides the exact reproduction of cabin of crew of the AF certain type allowing to imitate real functions mechanical, electric, electronic and other onboard management systems, situation, regular for members of flight crew, and flight characteristics of the AF this type;
the exercise machine for working off of the technology of piloting which provides real reproduction of situation in cabin of crew and imitates indications of devices, simple functions mechanical, electric, electronic and other onboard systems, and also flight technical characteristics of AF of certain class;
the simulator for the main preparation for flights for devices which is equipped with the corresponding devices and which imitates situation in crew cabin, similar to situation during flight of AF on devices;
