In pursuance of the laws of the Kyrgyz Republic "About HIV/AIDS in the Kyrgyz Republic", "About modification and amendments in the Law of the Kyrgyz Republic "About public welfare payments in the Kyrgyz Republic", for the purpose of creation of effective mechanisms on rendering the public assistance to persons living with HIV/AIDS and to members of their families to the prevention of spread of HIV/AIDS in the territory of the Kyrgyz Republic the Government of the Kyrgyz Republic decides:
2. Determine that and when performing obligatory periodic medical examinations persons provided in the lists specified in Item 1 of this resolution are subject to obligatory medical examination for detection of HIV infection in case of revenues to work.
3. To the Ministry of Internal Affairs of the Kyrgyz Republic in accordance with the established procedure to develop and submit for consideration of the Government of the Kyrgyz Republic the bill of the Kyrgyz Republic "About entering of amendments into the Code about the administrative responsibility", providing administrative expulsion out of limits of the Kyrgyz Republic of the foreign citizens who are in the territory of the Kyrgyz Republic in case of their intentional evasion from passing of obligatory medical examination on HIV.
4. To the Ministry of Health of the Kyrgyz Republic in accordance with the established procedure to make changes and additions to the Regulations on licensing of private medical practice in the Kyrgyz Republic approved by the order of the Ministry of Health of the Kyrgyz Republic of January 15, 2003 No. 10, concerning determination of complex of requirements to medical examination on HIV.
5. Declare invalid the Order of the Government of the Kyrgyz Republic of September 1, 1997 No. 507 "About measures for prevention of AIDS and diseases, sexually transmitted, in the Kyrgyz Republic".
6. To impose control over the implementation of this Resolution on management of social and cultural development of the Office of the Prime Minister of the Kyrgyz Republic.
7. This Resolution becomes effective from the date of official publication.

1. These rules the Republics are developed according to the laws of the Kyrgyz Republic "About HIV/AIDS in the Kyrgyz Republic", "About protection of public health in Kyrgyz" and establish single procedure for medical examination of citizens of the Kyrgyz Republic, the foreign citizens and persons without citizenship living or staying in the territory of the Kyrgyz Republic on detection of the human immunodeficiency virus (HIV), medical accounting and observation of persons living with HIV/AIDS in the Kyrgyz Republic.
2. Rules are obligatory for accomplishment by all ministries, state committees, administrative departments, companies, organizations and organizations, irrespective of patterns of ownership, their officials and citizens.
3. In these rules the following concepts are used:
HIV infection - the disease caused by the human immunodeficiency virus (HIV);
AIDS - acquired immunodeficiency syndrome - final stage of HIV infection with the displays of disease caused by deep defeat of immune system of the person human immunodeficiency virus;
LZhVS (person living with HIV/AIDS) are persons infected with human immunodeficiency virus both at stage of lack of displays of disease, and at stage of the deep damage to immune system caused by human immunodeficiency virus;
voluntary medical examination - physical examination of person on detection of human immunodeficiency virus at his desire;
anonymous medical examination - voluntary physical examination on the detection of human immunodeficiency virus conducted without production of documents, proving the identity, and without message of personal data of osvidetelstvuyemy person;
confidential medical examination - physical examination on detection of human immunodeficiency virus in case of which to the inspected person preserving in secret is guaranteed to information on the fact of passing of survey and on its results;
obligatory medical examination - physical examination of person on detection of human immunodeficiency virus, from its consent which is the mandatory requirement for separate categories of citizens and accomplishment of certain actions;
forced medical examination - physical examination of person on detection of human immunodeficiency virus, without its consent, by a court decision based on the resolution of the investigator, the prosecutor;
psychosocial consultation - the confidential dialogue between the inspected person and person providing support giving the chance to overcome psychoemotional stress and to make the decision concerning HIV/AIDS;
osvidetelstvuyemy (inspected) - person undergoing medical examination on detection of virus of immunodeficiency;
