RESOLUTION OF THE MINISTRY OF TRANSPORT AND COMMUNICATIONS OF THE REPUBLIC OF BELARUS

About approval of the aviation rules "Certification of Copies of Civil Aircrafts"

Based on Articles 6, 20 and 25 Air codes of the Republic of Belarus and subitem 5.9 of Item 5 of the Regulations on the Ministry of Transport and Communications of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 31, 2006 No. 985, the Ministry of Transport and Communications of the Republic of Belarus DECIDES:

1. Approve the aviation rules "Certification of Copies of Civil Aircrafts" (are applied).

2. Recognize to invalid:

the resolution of the Ministry of Transport and Communications of the Republic of Belarus of January 21, 2009 No. 9 "About approval of the Aviation rules "Certification of Gliders, Hang-gliders, Paraplanes, Easy and Extralight Aircraft, Aero Static Devices and Aircrafts of Amateur Design";

item 4 of the resolution of the Ministry of Transport and Communications of the Republic of Belarus of March 18, 2010 No. 18 "About modification and amendments in some regulatory legal acts of the Ministry of Transport and Communications of the Republic of Belarus and the State committee on aircraft of the Republic of Belarus".

3. This resolution becomes effective after its official publication.

Aviation rules "Certification of Copies of Civil Aircrafts"

Chapter 1. General provisions

1. These aviation rules are developed according to article 25 of the Air code of the Republic of Belarus and establish procedure for carrying out certification of copies of civil aircrafts, held for use only in aircraft of general purpose and the commercial and international flights which are not intended for accomplishment.

2. For the purposes of these aviation rules the following main terms and their determinations are applied:

the aircraft equipment - aircrafts, aviation engines and air screws;

the owner of copy of the aircraft - the legal entity or physical person owning aircraft copy on the property right according to the lease agreement or other legal cause;

the holder of the certificate of copy of the aircraft - legal entity or physical person to which based on the legislation about ministerial procedures and according to these aviation rules the certificate of copy of the aircraft is issued;

evidential documentation - documentation containing results of checks, testing, researches and estimates of technical condition of copy of the aircraft;

the manufacturer of copy of the aircraft - the legal entity or physical person performing production of aircrafts to which requirements of these aviation rules extend;

testing of the aircraft equipment - certified testing of the aircraft, the aviation engine and air screw which carrying out is necessary for issue of the certificate of copy of the aircraft;

aircraft component - any component of the aircraft;

change of design of copy of the aircraft - any change of the accepted design of copy of the aircraft and (or) its components which significantly influences their flight validity or affects their characteristics influencing the environment;

airworthiness standards - the comprehensive and detailed airworthiness standards established, accepted or recognized by the Republic of Belarus for the aircraft, the aviation engine or the air screw;

design documentation - set of properly processed documents containing depending on their appointment this, necessary for development, production, control and carrying out testing of copy of the aircraft;

developer of copy of the aircraft - the legal entity or physical person performing development of aircrafts to which requirements of these aviation rules extend;

certified basis - the complex of requirements to the flight validity and environmental protection extending to this copy of the aircraft;

the table of correspondences of copy of the aircraft - the document containing data on aircraft compliance to applicable rules of the flight validity;

aircraft copy design - aircraft copy design (including its flight characteristics and operational restrictions) which compliance to requirements of certified basis is established by results of certification of copy of the aircraft;

the center of examination and certification (certified testing) - the certified center which is the organization (structural division of the organization) which is performing certified works and having on that appropriate authority certain the agreement signed with Department on aircraft;

copy of the aircraft of amateur design - the aircraft of nonindustrial construction which does not have and not having the certificate of type or its equivalent and made in one copy or the aircraft of industrial construction which is not conforming to the requirements to standard design established by the certificate of type or its equivalent, but parameters which flight qualities and condition of design on condition of observance of the set restrictions allow to ensure safety of flights;

operational documentation of copy of the aircraft - set of the documents regulating flight operation and maintenance of specific copy of the aircraft and its components.

Other terms applied in these aviation rules are used in the values specified in the Air code of the Republic of Belarus and other aviation rules.
