Procedure for covering of expenses on free use of transport services

1. General provisions

1. The procedure for covering of expenses on free use of transport services (further - the Procedure) establishes rules of expense recovery for use of persons having the right to free pass in public transport (except taxi) on the international, long-distance, suburban, city, district settlement and rural routes, by rail on the international, local and suburban passenger routes and air transport on the international and internal passenger routes established by legal acts.

2. Basic concepts:

- the transport card having free rate - the carrier of electronic means of payment in plastic form for reuse of payment of free pass on road transport public (further - the card);

- electronic payment system - the automated system of acceptance of electronic payments on road public transport;

- the public transport - common carrier, control of which is exercised of authorized state body in the field of road transport or authorized body by means of the admission of carriers to implementation of activities for transportation of passengers and baggage on the basis of establishment of requirements to level and service quality, rates, characteristics of route network and requirements to their forming;

- person having the right to free pass - person having the right to free pass in passenger transport according to the legislation of the Republic of Tajikistan and/or the international treaties recognized by Tajikistan;

- the preferential coupon - special leaf of person having the right to free pass with presentation of the passport and supporting document, the acquisitions of the travel free document (ticket) granting the right on international and local passenger railway and aviation transport routes;

- passenger road transport - the passenger motorized vehicle intended for transportation more than 8 people (excepting the driver) and equipped for transportation of the passengers both sitting, and standing;

2. Procedure for free use of transport services

3. On passenger road transport:

- the passenger having the right to the free pass which is not provided with the official car has the right to use transport services on suburban, long-distance and international routes, for receipt of the ticket shows responsible for terminal servicing the supporting document (certificate) of availability at it of the right to free pass and is registered responsible for servicing of the terminal in the report (appendix 1). The report is the basis for covering of expenses of carrier for transportation of the passengers having the right to free pass;

- the passengers entering the vehicle on suburban, long-distance, district and rural routes from intermediate stops in which the journey electronic payment system is not implemented on presentation of the supporting document about availability at it of the right to free pass are registered the driver or the conductor in the ticket (appendix 2). The ticket is the basis for covering of expenses of carrier for transportation of the passengers having the right to free pass;

- on city routes in case of implementation of electronic payment system of journey, transportation of the passengers having the right to free pass if are not provided with official cars is performed only by means of the card on presentation of the supporting document;

- production and issue of cards is performed by the authorized subject of local executive body of the government.

4. On rail transport:

- person having the right to free pass on local and suburban messages in case of presentation of the supporting document, free of charge uses services of rail transport. Each passenger having the right to the free pass using free services of rail transport is registered in the special list the responsible person the company of the railroad. This list is the basis for covering of expenses of carrier on transportation of the passenger having the right to free pass;

- person having the right to free pass for acquisition of the travel document (ticket) on rail passenger transport of the international message provides the passport, the supporting document and the preferential coupon of journey to cash desk. 5. In case of the fact of loss of preferential coupons, after careful check of loss, based on the application in person with appendix of the corresponding reference of Department of Internal Affairs and the copy of the newspaper in which it is declared cancellation of the lost preferential coupons the Ministry of Health and Social Protection of the Republic of Tajikistan in necessary cases can issue to persons having the right to free pass the one-time letter to free pass.

6. On the air transportation:

- person having the right to free pass on local airlines on submission of the supporting document and letter of the Ministry of Health and Social Protection of the Republic of Tajikistan uses free of charge services of the air transportation. Each passenger using free of charge services of air transport is registered in the sheet the responsible person, from airline. This sheet is the basis for covering of expenses of carrier for transportation of the passenger having the right to free pass;

- person having the right to free pass for receipt of the travel document (ticket) on local and international passenger airlines submits the passport, the supporting document and the letter of the Ministry of Health and Social Protection of the Republic of Tajikistan and the preferential coupon of free pass to airline. 3. Procedure for receipt of cards and preferential coupons

8. Cards for persons determined by the legislation are issued in accordance with the established procedure by authorized subjects of local executive bodies of the government based on requests of the relevant state bodies.

9. Preferential coupons are issued by the Ministry of Health and Social Protection of the Republic of Tajikistan based on written requests of local authorities of social protection of the population and the power of attorney after creation of delivery note and with the permission of management of the ministry, to these bodies.

10. Local authorities of social protection of the population constitute the register of issue of coupons on the preferential drive in which issue of coupons to each person having the right to free pass is fixed. The number of the transported passengers having the right to free pass on district, city, suburban and long-distance automobile routes where the journey electronic payment system is not implemented the cost of the transported passengers having the right to free pass is determined based on the report completed by terminals (appendix 1), and in the absence of terminals - the driver or the conductor according to the ticket (appendix 2) on the actual trips.

15. Accounting of transportation of the passengers having the right to free pass and payments for the rendered services on rail transport is performed based on the special list which is drawn up by the authorized person of carrier. Monthly the carrier represents this list to relevant organ for covering of expenses for transportation of the passengers having the right to free pass.

16. Transportation of persons having the right to free pass by air transport is performed according to supporting documents, including preferential coupons and the certificate.

5. Source of covering of expenses for free use of transport services

17. The company of air transport provides services to persons having the right to free pass within the provided means of the government budget.

18. Source of covering of expenses for free use of transport services is state (republican and local) the budget.

19. Cost recovery for free use of railway, air and automobile services on the international, long-distance and suburban routes is performed within annually provided means of the republican budget.

20. Expense recovery for free use of services of public passenger transport in the cities, areas (except taxi) is performed at the expense of means of the government budget.

21. Cost recovery on free use of public transport services for the member of Majlisi milli, the deputy of Majlisi namoyandagon, the deputy of Majlis of People's Deputies of GBAO, area, the city of Dushanbe, the city and the area, the military personnel, law enforcement officers and social security authorities are implemented at the expense of the means of the government budget provided for these bodies.

22. The expense rate on free use of services of public passenger transport in the city, being the user of the preferential card (except taxi), is established on one indicator for calculations per capita in month.

23. Means for covering of expenses on free use of transport services are provided by the Ministry of Finance of the Republic of Tajikistan based on request of the relevant ministries and departments financed from the government budget with financial reasons in case of project planning of the relevant budget.

24. The relevant ministries and departments annually plan necessary means in expense budget for covering of expenses on free use of transport services.

25. In case of implementation of electronic payment system of journey the relevant ministries and departments receive cards from the supplier of cards and distribute them among the persons having the right to free pass.

26. The carrier monthly provides information with appendix of reasonable documents on transportation of number of the passengers having the right to free pass in the relevant ministries and departments for payment of cost of the services rendered to passengers having the right to free pass.

27. The relevant ministries and departments based on the documents submitted by carrier within 10 working days from the moment of receipt of documents transfer to the account of carrier the amount of the rendered services to persons having the right to free pass.

6. Final provisions

28. The covering of expenses for preferential use (50 percent) of the transport services provided by legal acts is also performed according to requirements of this Procedure.

29. Persons who are not observing the requirement of this Procedure are made responsible according to the legislation of the Republic of Tajikistan.
