About change of resolutions of Council of Ministers of the Republic of Belarus of January 27, 2009 No. 99 and of September 30, 2016 No. 789

Based on paragraph one of part two of subitem 1.2 of Item 1 of the Presidential decree of the Republic of Belarus of August 29, 2016 "About provision of non-cash housing subsidies" and subitem 3.5 of Item 3 of article 3 of the Law of the Republic of Belarus of July 16, 2008 No. 405-Z "About consumer protection of housing and communal services" the Council of Ministers of the Republic of Belarus DECIDES: No. 322

1. Make changes to the following resolutions of Council of Ministers of the Republic of Belarus:

1.1. in the resolution of Council of Ministers of the Republic of Belarus of January 27, 2009 No. 99 "About measures for implementation of the Law of the Republic of Belarus "About consumer protection of housing and communal services":

in preamble shall be replaced with words the word "years" "No. 405-Z";

in Item 1:

to exclude the word "enclosed" from paragraph one;

the second or twelfth to add paragraphs with the word "(is applied)";

after the paragraph of the fourth to add Item with the paragraph of the following content:

"The regulations on procedure for the conclusion of the service provision agreement on running repair of the apartment house (are applied);";

add Item 11 with paragraphs of the following content:

"the standard agreement on rendering service of electric utility service according to appendix 3;

the standard agreement on rendering services of heat supply (heating) and (or) hot water supply (water heating) in the single-family (blocked) apartment houses according to appendix 4;

the standard agreement on rendering service in maintenance of the elevator according to appendix 5.";

in Item 12 of the word to "appendix 3" shall be replaced with words to "appendix 6";

add the resolution with Regulations on procedure for the conclusion of the service provision agreement on running repair of the apartment house it (is applied);

in appendix 3 to this resolution:

in signature stamp of the word "Appendix 3" shall be replaced with words "Appendix 6";

in subitem 1.5 of Item 1 of figure "15" to replace with figures "30";

add the resolution with appendices 3-5 (are applied);

1.2. in the resolution of Council of Ministers of the Republic of Belarus of September 30, 2016 No. 789 "About setting standards (standard rates) of consumption of housing and communal services for calculation of non-cash housing subsidies":

in Item 5 of appendix 1 to this resolution of figure "0,026" to replace with figures of "0,0272";

to be reworded as follows appendix 4 to this resolution it (is applied).

2. The agreements of electric utility service with the citizens using electrical energy for household consumption signed in writing before entry into force of this resolution are subject to reduction in compliance with its requirements when entering into the specified agreements of other changes.

3. The agreements of heat supply signed in writing with the citizens living in the single-family (blocked) apartment houses, thermal networks and which heatinstallations are attached to thermal networks of the power supplying organizations, before entry into force of this resolution are subject to reduction in compliance with its requirements when entering into the specified agreements of other changes.

4. This resolution becomes effective after its official publication.

Action of Item 1 of appendix 4 to the resolution of Council of Ministers of the Republic of Belarus of September 30, 2016 No. 789 in edition of this resolution extends to the relations which arose since September 1, 2021.

Regulations on procedure for the conclusion of the service provision agreement on running repair of the apartment house

1. This Provision regulates procedure for the conclusion of the service provision agreement on the running repair of the apartment apartment house financed by means of consumers (further - the agreement).

2. For the purposes of this provision terms and their determinations in the values established by the Housing code of the Republic of Belarus and the Law of the Republic of Belarus "About consumer protection of housing and communal services" are used.

3. To the conclusion of the agreement the authorized person on management of common property of joint household, partnership of owners, the organization of builders (further - the customer):

3.1. no later than month prior to work on running repair provides to consumers information:

about the planned terms of carrying out repair work;

about main types of repair work;

about the total estimated cost of repair and the amount necessary for cost recovery per 1 sq.m of total area of the residential (non-residential) rooms occupied by consumers;

about the official of the customer with indication of contact telephone numbers, time and the place of acceptance of consumers for the solution of organizational matters on carrying out running repair (determination of the list and quality of the materials used for repair, the choice of color scheme, the authorized person (persons) from consumers on acceptance of the performed works and other questions);

about date, the place and time of holding general meeting of consumers, the agenda (no later than 10 days before holding general meeting of consumers);

3.2. no later than 10 days prior to work on running repair holds general meeting of consumers on which:

the decision of consumers on carrying out running repair (if need of repair is not caused by unsatisfactory technical and esthetic condition of structural elements and engineering systems of the apartment house) and terms of accomplishment of repair work with consideration of the local estimate (local estimate calculation) is made;

the authorized representative (representatives) of consumers for the solution of the organizational and other matters connected with carrying out repair work including acceptance of the performed works is elected;
