About change of resolutions of the State Customs Committee of the Republic of Belarus

Based on Item 7 of Article 64, Item 1 of Article 135, parts two of Item 2 of article 244 of the Law of the Republic of Belarus of January 10, 2014 No. 129-Z "About customs regulation in the Republic of Belarus", parts one of Item 3 of article 162 of the Tax Code of the Republic of Belarus, the paragraph of third Item 27 of the Regulations on the free customs zones created in the territories free (special, special) economic zones, No. approved by the Presidential decree of the Republic of Belarus of January 31, 2006 66, parts two of subitem 42.7 of Item 42 of the Regulations on free warehouses approved by the Presidential decree of the Republic of Belarus of February 9, 2012 No. 55, of part two of Item 3 of the Regulations on duty-free shops No. approved by the Presidential decree of the Republic of Belarus of April 22, 2014 175, Item 5, Item parts one 9, Item parts one 11, Item parts two 12, Item paragraph two 14, Item 15 of the Regulations on completion of action of customs procedure of free customs zone (free warehouse), Item part two 2, parts one of Item 6 of the Regulations on procedure for issue by customs authority of the permission allowing commodity exportation, No. approved by the resolution of Council of Ministers of the Republic of Belarus of March 21, 2014 241, of subitem 2.3-2 of Item 2 of the resolution of Council of Ministers of the Republic of Belarus of May 27, 2014 No. 509 "About measures for implementation of the Law of the Republic of Belarus "About customs regulation in the Republic of Belarus" and subitem 10.7 of Item 10 of the Regulations on the State Customs Committee of the Republic of Belarus No. approved by the Presidential decree of the Republic of Belarus of April 21, 2008 228, the State Customs Committee of the Republic of Belarus DECIDES:

1. Make changes to the following resolutions of the State Customs Committee of the Republic of Belarus:

1.1. in the resolution of the State Customs Committee of the Republic of Belarus of April 26, 2012 No. 11 "About procedure for accounting and submission to customs authorities of reports":

in Item 1:

to exclude from part one of subitem 1.3 of the word "About Instructions for Filling of Customs Declarations and Forms of Customs Declarations";

paragraph of the seventh of subitem 1. The paragraph of the seventh of subitem 1.7 and the paragraph the fifth parts three of subitem 1.8 to exclude 6,;

1, 3 and 9 to this resolution to be reworded as follows appendices (are applied);

in the Instruction about procedure for submission to customs authorities of reports approved by this resolution:

in Item 2 part one:

in paragraph one of the word "with obligatory representation in duplicate on paper following reports" shall be replaced with words "with representation at the request of customs in duplicate on paper the following reports";

the ninth to exclude the paragraph;

to add paragraph two of part one of Item 5 with the words "and date of repeated submission of the report";

in Item 7:

word in paragraph one "The instruction about procedure for filling of the declaration on goods approved" shall be replaced with words "The procedure for filling of the declaration on goods approved";

state subitem 7.2 in the following edition:

"7.2. in the column 1 "Declaration":

in the first subsection of the column:

when filling the report on sales of goods on boards the alphabetic EK code is specified;

when filling the report on MBT:

in case of sales of goods, placed under customs procedure of duty-free trade, to the physical persons decreasing from customs area of the Eurasian Economic Union, or the alphabetic EK code is specified to the physical persons leaving the Republic of Belarus in other state member of the Eurasian Economic Union;

in case of sales of goods, placed under customs procedure of duty-free trade, to the physical persons arriving to customs area of the Eurasian Economic Union, or the alphabetic IM code is specified to the physical persons driving to the Republic of Belarus from other state member of the Eurasian Economic Union;

in the second subsection of the column the alphabetic BT code when filling the report on MBT is specified, the alphabetic RT code when filling the report on sales of goods on boards;

the third subsection of the column is not filled;";

add Item 7-1 with part of the following content:

"After the term established by part four of this Item, change in the registered report on MBT or the report on sales of goods on boards can be brought:

at the request of customs authority;

at the initiative of the owner of duty-free shop after receipt of permission of customs authority.";

the fourth Item 8 to state the paragraph in the following edition:

"free warehouse, – the report on remaining balance of the goods placed under customs procedure of free warehouse on form according to appendix 9 to the resolution which approved this Instruction;";

state Item 9 in the following edition:

"9. In case of the termination of functioning of free customs zone the customs applicant of STZ represents to customs authority in which region of activities the free customs zone, the report on remaining balance of the goods placed under customs procedure on form according to appendix 9 to the resolution which approved this Instruction, or the report on the goods placed under customs procedure on form according to appendix 7 to the resolution which approved this Instruction is located.

The reports specified in part one of this Item are provided by the customs applicant of STZ within 10 working days:

from the date of, the decision making following behind day about the termination of functioning of free customs zone in case of liquidation free (special, special) economic zone according to subitem 10.1 of Item 10 of the Regulations on the free customs zones created in the territories free (special, special) economic zones;

from the date of, the approval by customs authority of the decision of administration of the free economic zone or other legal entity authorized according to legal acts following behind day to set limits of free customs zone, about abolition of free customs zone in case of abolition of free customs zone according to subitem 10.2 of Item 10 of the Regulations on the free customs zones created in the territories free (special, special) economic zones.";

in part one of Item 10 of the word "to everyone" shall be replaced with words "along with giving";

in Item 19:

exclude part one;

1.2. in paragraph one of Item 2 of the resolution of the State Customs Committee of the Republic of Belarus of February 12, 2016 "About determination of qualifiers and features of customs declaring" the words "About Instructions for Filling of Customs Declarations and Forms of Customs Declarations" shall be replaced with words No. 5 "About declaration form on goods and procedure for its filling";

1.3. in Item 8 of the Instruction on procedure for filling of calculation of the excises which are subject to the payment approved by the resolution of the State Customs Committee of the Republic of Belarus of April 25, 2018 No. 9, of the word "Instructions about Procedure for Filling of the Declaration on Goods Approved" shall be replaced with words "Procedure for the filling of the declaration on goods approved";

1.4. in Item 1 of the resolution of the State Customs Committee of the Republic of Belarus of August 14, 2019 No. 39 "About completion of action of customs procedure of free customs zone (free warehouse)":

in paragraph one of part one of subitem 1.1 of the word "The instruction about procedure for filling of the declaration on goods approved by the Decision of the Commission of the Customs union of May 20, 2010 No. 257 (further – the Instruction No. 257)" shall be replaced with words "The procedure for filling of the declaration on goods approved by the Decision of the Commission of the Customs union of May 20, 2010 No. 257 (further – the Procedure for filling of DT)";

in paragraph one of part one of subitem 1.2 and paragraph one of part one of subitem 1.3 of the word "Instruction No. 257" shall be replaced with words "Procedure for filling of DT";

in subitem 1.4 part one:

word in paragraph one "Instruction No. 257" shall be replaced with words "Procedure for filling of DT";

"41," to exclude from figure paragraph two;

in subitem 1.6 part one:

in the paragraph the second the words "TTPPP/HNNNNNN" shall be replaced with words "TTPPP/GHNNNNNN";

after the paragraph of third to add part with the paragraph of the following content:

"– the last figure of year of registration of the notification on waste, notifications on the equipment and (or) real estate objects in the territory of SEZ, notifications on the equipment and (or) real estate objects in the territory of free warehouse, the notification on consumption of goods;";

to add paragraph two of subitem 1.7 with the words "About Declaration Form on Goods and Procedure for Its Filling";

in subitem 1.9:

word part one in paragraph one "The instruction about procedure for filling of the declaration on goods approved by the Decision of the Commission of the Customs union of May 20, 2010 No. 257 (further – the Instruction No. 257)" shall be replaced with words "The procedure for filling of the declaration on goods approved by the Decision of the Commission of the Customs union of May 20, 2010 No. 257 (further – the Procedure for filling of DT)";

in paragraph one of part seven and in part eight of the word "according to the procedure, No. provided by the Instruction 257," shall be replaced with words "according to Procedure for filling of DT";

in part nine:

the paragraph of the seventh after the words "from STZ territory" to add with the words "and also about identification method in the goods which are exported from the territory of STZ, foreign goods placed under customs procedure of free customs zone, and the goods which are exported from STZ territory in case of their return import to this territory";

the paragraph of the eighth after words of "STZ which are exported from the territory" to add with the words "and also about identification method in the goods which are exported from the territory of STZ, foreign goods placed under customs procedure of free customs zone, and the goods which are exported from STZ territory, in case of their return import to this territory or when importing to such territory of goods, the made (received) from these goods as a result of making transactions on conversion (processing) of goods, production of goods, including assembly, installation, adjustment";

in the paragraph the second subitem 1.3 of the word "About Instructions for Filling of Customs Declarations and Forms of Customs Declarations" shall be replaced with words "About declaration form on goods and procedure for its filling".

2. This resolution becomes effective in the following procedure:

subitems 1. 1, 1.4 and 1.5 Items 1 – since July 1, 2022;

other provisions of this resolution – after its official publication.
