1. Bring in the order of the Minister of Transport and Communications of the Republic of Kazakhstan of September 26, 2013 No. 750 "About approval of Rules of issue and prolongation of effective period of certificates of aviation personnel" (it is registered in the Register of the state regulatory legal acts of the Republic of Kazakhstan for No. 8782) the following change:

The rules of issue and prolongation of effective period of certificates of aviation personnel approved by the specified order to state according to appendix to this order (further – Rules).

2. To provide to committee of civil aviation of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication, except for the second paragraph of the subitem 3) of Item 3 of Rules, subitems 2) and 11) of part one of Item 8 of appendix 4 to Rules which become effective since November 3, 2022.

Rules of issue and prolongation of effective period of certificates of aviation personnel

Chapter 1. General provisions

1. These rules of issue and prolongation of effective period of certificates of aviation personnel (further – Rules) are developed according to Item 3 of article 54 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further – the Law) and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services) and determine procedure for issue and prolongation of effective period of certificates of aviation personnel and rendering the state service "Issue of Certificates to Aviation Personnel" (further – the state service).

2. In these rules the following terms and determinations are used:

1) aviation personnel – the physical persons having special and (or) professional training, performing activities for accomplishment and ensuring flights of aircrafts, airborne transportations and aviation works, maintenance of aircrafts, the organization and servicing of air traffic, air traffic control;

2) the certificate of aviation personnel – the document confirming qualification and powers of aviation personnel;

3) the register of the granted certificates of aviation personnel (further – the Register) – the document in which record about issue of certificates of aviation personnel is kept;

4) authorized organization in the field of civil aviation – the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety;

5) the organization of civil aviation – the legal entity performing activities in the field of civil aviation;

6) special mark – the additional record made in the certificate in which special conditions, the rights or restrictions, including mark about level of proficiency in language, and information relating to this certificate are specified;

7) the commander of the aircraft under observation – the second pilot performing functions and obligations as KVS under observation (further – KVS). Time of PICUS is fixed in the flight book of the second pilot, makes sure the signature of the instructor and is set off in general raid as KVS;

8) qualification mark – the record made in the certificate or having relation to it, which is its part in which the special conditions, the rights or restrictions relating to this certificate are specified;

9) the applicant – the physical person or legal entity (the organization of civil aviation) which addressed to authorized organization in the field of civil aviation for receipt of the certificate of aviation personnel;

10) the unmanned aerial vehicle – the aircraft which is carrying out flight without pilot (crew) onboard and managed in flight automatically, the operator from control center or combination of the specified methods;

11) the external pilot – physical person which performs necessary actions for accomplishment of flight of the unmanned aerial vehicle and which manages relevant organs of flight control during flight time;

12) the member of flight crew – the person belonging to aviation personnel, having the existing certificate of aviation personnel to whom the obligations connected with management of the aircraft during flight time are assigned.

3. Certificates are granted to the following aviation personnel:

1) members of flight crew:

the pilot of the extralight aircraft (motor-hang-glider, autogyro, the airship, the aircraft with system of increase in carrying power);

pilot of the light aircraft (airplane, helicopter);

the private pilot (the airplane, the helicopter, the airship, the aircraft with system of increase in carrying power);

the pilot of commercial aircraft (the airplane, the helicopter, the airship, the aircraft with system of increase in carrying power);

pilot of polynomial crew (airplane);

the linear pilot (the airplane, the helicopter, the aircraft with system of increase in carrying power);

pilot of free aerostat;

pilot of glider;

2) members of flight crew other than pilots:

navigator;

flight engineer (aircraft mechanic);

bortradist;

3) other aviation personnel:

the external pilot (the airplane, the airship, glider, rotary-wing aircraft, the aircraft with system of increase in carrying power or free aerostat);

dispatcher of servicing of air traffic;

personnel on maintenance of aircrafts;

personnel on maintenance of light and extralight aircrafts;

the employee on ensuring flights or the flight dispatcher;

operator of the aviation station.
