About modification and amendments in the order of the Chairman of Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan of April 18, 2019 No. 63 about / д "About approval of regulations on territorial authorities of Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan"

I ORDER:

1. Bring in the order of the Chairman of Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan of April 18, 2019 No. 63 about / д "About approval of regulations on territorial authorities of Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan" the following changes and amendments:

to state Item 1 of the order in the following edition:

2. To provide to management of organizational and personnel work of Committee:

1) the direction of this order in territorial authorities for taking measures, provided by the Law of the Republic of Kazakhstan "About state registration of legal entities and accounting registration of branches and representations";

2) the direction of this order in the state and Russian languages on official publication in Reference control bank of regulatory legal acts of the Republic of Kazakhstan.

3. To provide to chiefs of territorial authorities in the established legislative procedure:

1) state registration of this order in territorial authorities of justice;

2) within three working days after state registration of this order submission to Committee of data on execution of the subitem 1) this Item;

3) in a month reduction of the acts in compliance with this order.

4. To impose control of execution of this order on management of organizational and personnel work of Committee.

5. This order becomes effective from the date of its signing.

Regulations on Management of Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan on Akmola area

Chapter 1. General provisions

1. Management of Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan on Akmola area (further - Management) is territorial authority of Committee on legal statistics and the special accounting of the Prosecutor General's Office of the Republic of Kazakhstan (further - Committee) performing within the conferred powers of function on forming of legal statistics and conducting special accounting in the territory of the Akmola area.

2. Exercises control the activities according to the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan "About the state legal statistics and special accounting", "About law-enforcement service", "About prosecutor's office", the Regulations on Committee approved by the Presidential decree of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

3. Management is legal entity in form of business of public institution, has seals and stamps with the name in the state and Russian languages, forms of the established sample, according to the legislation of the Republic of Kazakhstan of the account in bodies of treasury.

4. The management enters the civil relations from own name.

5. The management has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation.

6. The management concerning the competence of the procedure established by the legislation makes the decisions which are drawn up by orders of the head of department and other acts, stipulated by the legislation the Republic of Kazakhstan.

7. The structure and limit of the number of staff of Management and its representatives affirm according to the current legislation.

10. This Provision is the constituent document of Management.

11. Financing of Management and its representatives is performed from the republican budget.

12. The management and its representatives are forbidden to enter contractual relations with subjects of entrepreneurship regarding accomplishment of the obligations which are control and supervising management functions.

If Management of legal acts is granted the right to perform the activities which are bringing in incomes, then income gained from such activities go to the income of the government budget.

Chapter 2. Tasks, functions, rights and obligations of Management

13. Tasks:

1) effective and sufficient providing state bodies, physical persons and legal entities with information on condition of legality and law and order in Akmola area on the basis of the single statistical principles and standards;

2) enhancement and development of the state legal information statistical system.

14. Functions:

1) forming of the state legal statistics;

2) accumulating, maintaining and processing of legal statistical information;

3) conducting special accounting, except for operational and departmental accounting;

4) carrying out statistical observations concerning legal statistics;

5) implementation of complex of the control and supervising measures directed to identification and elimination of violations of the law of the Republic of Kazakhstan, regulatory legal acts of the President of the Republic of Kazakhstan, the Attorney-General of the Republic of Kazakhstan and the Chairman of Committee in the field of legal statistics and special accounting including behind application of the legislation on acceptance, registration and accounting of statements for criminal offenses, and also behind work of the departmental commissions on control of accounting and registration discipline of criminal prosecution authorities;

6) implementation of information and analytical activities in the field of legal statistics and special accounting;

7) rendering the corresponding state services;

8) statistical support of implementation of the legislation of the Republic of Kazakhstan, program documents of counteraction of crime at the regional level, ensuring completeness and relevance of data of special accounting in the created automated databanks;

9) enhancement of the complex analysis and forecast of condition of legality and law and order in the region, creation of system of complex monitoring of the legal phenomena in society;

10) providing actions for enhancement of system of publications and distribution of legal statistical data and data;

11) participation in development of actions for enhancement of system of life-long professional education and training in the field of legal statistics and special accounting;

12) studying of the available international experience in the field of legal statistics and special accounting;

13) ensuring integrity, reliability and sufficiency of the created statistical data;

14) interaction with territorial subdivisions of the state and law enforcement agencies;

15) rendering the practical and methodical help to representatives of Management in implementation of accounting, statistical, information, analytical and supervising activities;

16) interaction with mass media within implementation of the Image program and Media plans of Committee, the Prosecutor General's Office of the Republic of Kazakhstan, in particular in questions of illumination of its role on protection and recovery of constitutional rights of citizens and subjects of small and medium business, enhancement of forms and methods of work, tracking and the analysis of the published information in relation to activities of Management;

17) implementation of activities for enhancement of the legislation in the field of legal statistics and special accounting, and its systematization;

18) providing the organization and development of the automated processing of accounting and reporting documentation, work on improvement of quality and reducing terms of their processing;

19) implementation of works on development, implementation and maintenance of the automated information systems of Committee;

20) conducting registration, accounting and control of the inspections which are carried out by the authorized state bodies performing control and supervising functions;

21) other functions, according to the legislation of the Republic of Kazakhstan.

15. Rights:

To receive 1) gratuitously from subjects of legal statistics and special accounting and other state bodies statistical and analytical information on questions of legal statistics and special accounting, the legal state statistical reporting, documents and forms of primary accounting for production of statistical data and conducting special accounting;

2) to demand from subjects of legal statistics of completeness and reliability of acts of primary accounting and the reporting, their representation in the terms determined by regulatory legal acts of the Attorney-General of the Republic of Kazakhstan;

3) to exercise control and supervision of integrity, objectivity, reliability and sufficiency of the legal statistical information provided by subjects of legal statistics and special accounting and also to take measures for elimination of violations of accounting and registration and reporting disciplines, including by introduction of acts of public prosecutor's reaction;

4) to refuse registration of acts of purpose of the inspections which are carried out by authorized state bodies in cases of identification of violations of the law of the Republic of Kazakhstan in case of their appointment;

5) to provide legality, protection of the rights and freedoms of physical persons and legal entities in case of registration of acts of purpose of the checks performed by state bodies;

6) to manage and dispose of the transferred property in the limits set by the legislation of the Republic of Kazakhstan;

7) to perform other rights, stipulated by the legislation the Republic of Kazakhstan and other regulatory legal acts.

16. Obligations:

1) to provide integrity, objectivity, completeness, reliability and sufficiency of legal statistical information;

2) to provide observance of the rights and legitimate interests of man and citizen, legal entities and the state when forming the state legal statistics and conducting special accounting;

3) to provide supervision of application of the legislation on acceptance, registration and accounting of statements for criminal offenses;

4) to provide state bodies according to the procedure, amounts and in the terms established by the legislation of the Republic of Kazakhstan, regulatory legal acts of the Attorney-General of the Republic of Kazakhstan and the Chairman of Committee legal statistical and analytical information;

5) directory servicing of physical persons and legal entities, state bodies in limits, amounts and the terms established by the legislation of the Republic of Kazakhstan;

6) timely provision to Committee of reliable and sufficient statistical data about condition of crime, fight against it, activities of prosecutors for implementation of supervision, courts for administration of law, execution of court resolutions and other information, for forming of summary data and centralized accounting on area;

7) to ensure safety of the received data constituting the state secrets and secrets protected by the law;

8) to provide protection of information systems against unauthorized access, spoil or destruction of data on objects of legal statistics and special accounting, control of rational use of computer and other equipment;

9) to plan the activities, proceeding from the current and perspective tasks, legality condition in activities of subjects of legal statistics and special accounting, crime conditions in the region, to make offers in work plans of Committee;

10) consideration at the operational meetings of Management of results of activities of departments and representatives in areas (cities) with designation of the arisen problems and ways of their permission, and also with the invitation of representatives of subjects of legal statistics and special accounting;

11) carrying out analytical and research work, development of offers and recommendations about the main directions of development of the state legal statistics and special accounting;

12) execution of other obligations, stipulated by the legislation and regulatory legal acts of the Republic of Kazakhstan.

Chapter 3. Organization of activities of Management

17. Management of Management is performed of the chief who bears the personal responsibility for accomplishment of the tasks assigned to Management and implementation of the functions by it.

18. The head of department is appointed to position and dismissed by the Chairman of Committee in coordination with the Attorney-General of the Republic of Kazakhstan.

19. The head of department has deputies (deputy) who are appointed to positions and are dismissed by the Chairman of Committee on representation of the head of department.

20. Head of department in accordance with the established procedure:

1) will organize work of Management and directs it, exercises control of timely and high-quality execution of planned actions, decisions of boards, operational, hardware meetings, orders and tasks of management of the Prosecutor General's Office of the Republic of Kazakhstan and Committee;

2) is provided by submission to Committee of statistic reports, accounting acts and materials for forming of centralized special accounting, the report on results of activities of Management;

3) following the results of half-year and year sends to the prosecutor of the Akmola area information on condition of reporting and accounting discipline;

4) determines obligations and powers of deputies (deputy), chiefs and the staff of departments, district representatives, controls their work;

5) brings in Committee of idea of assignment of class ranks to the staff of Management, appointment, movement, dismissal of deputies (deputy), chiefs of departments of entrusted Management, application of encouragement measures to them;

6) has the right of attraction to disciplinary responsibility of staff of entrusted Management, including chiefs of departments – before authority punishment in type "incomplete office compliance", except for deputies (deputy);

7) is performed by acceptance, appointment, movement, and dismissal of the senior prosecutors, prosecutors, administrative government employees, workers according to the employment contract of Management, using to them died encouragement, rendering financial support, imposing and removal of authority punishments;

8) presents to all staff and employees of Management, except for the deputies (deputy), all leave types;

9) according to the legislation of the Republic of Kazakhstan on work has the right to sign agreements on certain work types and services;

10) makes in Committee suggestions for improvement of structure, to change of the staff list of Management, and also other questions connected with activities of Management;

11) participates in meetings of board of prosecutor's office of Akmola area, Coordination Council on law enforcement, law and order and fight against crime, Public Council concerning law enforcement, meetings of subjects of legal statistics and special accounting by consideration of the questions concerning accounting and the reporting in the field of legal statistics and special accounting. In case of inclusion in the list of members of council on ethics of the Agency of the Republic of Kazakhstan for public service participates in meetings of council on ethics.

12) is represented by Management in state bodies, other organizations;

13) considers appeals of physical persons and legal entities, performs reception of citizens and representatives of legal entities;

14) issues orders, orders, instructions and fixing concerning activities of Management;

15) is approved by Regulations of work, the act of distribution of obligations of employees, work plans of Management;

16) exercises control of the correct and economical expenditure of material means, including the computer equipment, blanks products and their use to destination;

17) aims the activities at detection of system corruption schemes and mechanisms, and also the reasons and conditions promoting making of corruption offenses;

18) takes measures for counteraction and prevention of corruption offenses in own ranks;

19) informs the Chairman of Committee on activities of Management;

20) performs other powers according to the legislation of the Republic of Kazakhstan.

21. Management forms advisory advisory bodies, including the commissions and working groups.

22. Execution of powers of the head of department in the period of its absence is performed by person replacing it according to distribution of obligations between management of Management.

23. The certificate of the established sample is issued to the chief, his deputies (deputy), chiefs of departments, the senior prosecutors, prosecutors and administrative government employees of Management by the Chairman of Committee.

Chapter 4. Property of Management

24. Management can have on the right of operational management the isolated property in cases, stipulated by the legislation.

25. The property assigned to Management belongs to republican property.

26. Management has no right to alienate independently or to dispose otherwise of the property assigned to it and the property acquired for the account, the budgetary funds issued to it according to the plan of financing if other is not established by the legislation.

Chapter 5. Reorganization and abolition of Management

27. Reorganization and abolition of Management are performed according to the legislation of the Republic of Kazakhstan.

Chapter 6. The organization of activities of representatives of Management in regions (cities) of the Akmola area on supervision of legality in the field of legal statistics and special accounting

28. Management has representatives in the areas and the cities of Akmola area deployed in buildings district and city (city) prosecutor's offices from among the operational staff of Management and workers according to the employment contract (further – the Representative) for the purpose of achievement of the most effective results of activities of bodies of legal statistics and special accounting, accomplishment of complete amount of the assigned obligations, implementation of control and supervising activities in the field of legal statistics and special accounting, effective interaction with gorrayprokuror, timely receipt of complete and reliable legal information from subjects of legal statistics and special accounting.

29. Representatives are accountable and subordinated to the head of department and his deputies (deputy), and according to their instructions - to chiefs of departments of Management.

30. Representatives perform the activities according to the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan "About the state legal statistics and special accounting", "About law-enforcement service", "About prosecutor's office", the Regulations on Committee approved by the Presidential decree of the Republic of Kazakhstan, other regulatory legal acts of the Attorney-General of the Republic of Kazakhstan, the Chairman of Committee, the head of department, other regulatory legal acts of the Attorney-General of the Republic of Kazakhstan, the Chairman of Committee, the head of department and also this Provision.

31. The head of department and his deputies (deputy) according to the supervised questions are responsible for the organization of work of representatives.

32. Providing representatives with material and other means is performed by Management.

33. Representatives in limits of the respective area (city) according to the procedure, established by the legislation of the Republic of Kazakhstan, perform functions according to distribution of obligations of staff of Management.
