1. Approve the enclosed Instruction for creation of electronic land cadastral maps.

2. To provide to management committee with land resources of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Instruction for creation of electronic land cadastral maps

Chapter 1. General provisions

1. This Instruction for creation of electronic land cadastral maps (further – the Instruction) is developed according to subitem 4-7) of Item 1 of Article 14 of the Land code of the Republic of Kazakhstan (further – the Code) and determines procedure for creation of electronic land cadastral maps.

2. In this Instruction the following basic concepts are used:

1) geony – the generalizing concept for streets, squares, lines, avenues, boulevards, roads, embankments, lanes, avenues, drives;

2) geographical information system (further – GIS) – the information system providing collection, processing, the analysis, modeling, storage, distribution and other use of space information on Earth about objects of the land surface, natural, technogenic and public processes;

3) the settlement – the part of compactly populated territory of the Republic of Kazakhstan which developed as a result of economic and other public work of citizens, with population at least 50 people, considered and registered in the procedure established by the laws of the Republic of Kazakhstan and managed by local representative and executive bodies;

4) No. 416 is excluded according to the Order of the Minister of Agriculture of the Republic of Kazakhstan of 05.12.2023

5) the parcel of land – the part of the earth fixed in the procedure established by the Code behind subjects of land relations allocated in the closed borders;

5-1) information system of the single State Immovable Property Cadastre (further – IS EGKN) – the information system containing data of land and legal inventories which procedure for maintaining is determined by the Code and the Law of the Republic of Kazakhstan "About state registration of the rights to real estate";

6) No. 416 is excluded according to the Order of the Minister of Agriculture of the Republic of Kazakhstan of 05.12.2023

3. The choice of accounting quarter for work on creation of electronic land cadastral maps is performed taking into account the following criteria:

1) quantity of the parcels of land in accounting quarter of the settlement – 999 parcels of land;

2) if the quantity of the parcels of land in accounting quarter of the settlement makes less than 999 parcels of land, the choice of accounting quarter for work is performed on several accounting quarters with respect for the criterion specified in the subitem 1) of this Item;

3) in case of change of borders of administrative and territorial units newly created accounting quarter or accounting quarter which borders underwent to change with respect for the criteria specified in subitems 1) and 2) of this Item is subject to the choice.

4. Land cadastral maps are cartographic basis of the state land cadastre in the Republic of Kazakhstan (further – the Inventory) according to Item 9 of the Rules of maintaining the state land cadastre in the Republic of Kazakhstan approved by the order of the Minister of national economy of the Republic of Kazakhstan of December 23, 2014 No. 160 (it is registered in the Register of state registration of regulatory legal acts No. 10147).

In case of the automated maintaining the Inventory the cartographic basis is created in the form of the electronic land cadastral map using GIS and production of copies on papers.

5. On electronic land cadastral maps the following borders are displayed:

1) administrative borders of areas, cities of republican value and capital;

2) administrative borders of areas and cities of district and regional value;

3) borders of rural districts;

4) borders of settlements;

5) borders of components of the settlement (residential districts, areas in the city, the square, avenues, boulevards, streets, lanes, parks, squares, bridges and other parts);

6) borders of accounting quarters;

7) borders of the parcels of land.
