About introduction of amendments to some orders of the Minister of Defence of the Republic of Kazakhstan

I ORDER:

1. Bring in the order of the Minister of Defence of the Republic of Kazakhstan of January 24, 2017 No. 28 "About approval of Rules of military accounting of persons liable for call-up and recruits" (it is registered in the Register of state registration of regulatory legal acts at No. 14881) the following changes:

in Rules of military accounting of the persons liable for call-up and recruits approved by the specified order:

The requirements to rendering the state services including the characteristic of process, form, content and result of rendering and also other data taking into account features of provision of the state services are stated in the form of the list of the main requirements to rendering the state services:

issue to recruits of certificates of addition to draft sites and duplicates of certificates in appendix 31 to these rules;

issue of military IDs or their duplicates (temporary certificates instead of military IDs) to officers, sergeants, soldiers of inventory in appendix 32 to these rules;

in the cities of republican and regional values, the capital – 7 (seven) working days;

in areas – 5 (five) working days.

The service provider in day of receipt of documents performs their acceptance, registration and transfer for execution to the executive in charge.

Consideration by the contractor of document package on compliance of the requirements established by these rules preparation of result of the state service for the signature to the head is performed in 2 (two) working days prior to the expiration of rendering the state service.

Are result of rendering the state service issue of the military ID or their duplicate (the temporary certificate instead of the military ID) to officers, sergeants, soldiers of inventory, or the motivated answer about refusal in rendering the state service.

lack of entry in the book of protocols of the draft commission for category of citizens: exempted from places of detention; not reached 27 years which are subject to transfer on military accounting of persons liable for call-up for health reasons; reached 27 years which did not pass military service in communication by provision of draft deferments; citizens of military age at whom one of relatives (the father, mother, the brother or the sister) died, died or became the face with disability of the first or second group on duty during passing of military service; having academic degree; priests of the registered religious associations.

In the presence of the bases for refusal in rendering the state service the service provider notifies uslugopoluchatel on the provisional solution, on refusal in rendering the state service, and also on time and the place (method) of carrying out hearing for provision of opportunity to express to uslugopoluchatel line item according to the provisional solution.

submit the application in form according to appendix 40 to these rules (for citizens, from among officers, sergeants, soldiers);

2) for removal from military accounting submit the application in form according to appendix 41 to these rules.

The term of rendering the state service constitutes 4 (four) working days.

The service provider in day of receipt of documents performs their acceptance, registration and transfer for execution to the executive in charge.

Consideration by the contractor of document package on compliance of the requirements established by these rules preparation of result of the state service for the signature to the head is performed within 2 working days.

The notification on statement or removal and with the military accounting of persons liable for call-up and recruits, in electronic form signed by the EDS of the service provider according to appendices 43 and 44 to these rules, or the motivated answer about refusal in rendering the state service is result of rendering the state service.

The refusal in rendering the state service is performed, in cases:

establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them;

discrepancies of uslugopoluchatel and (or) the provided materials, supplied and the information necessary for rendering the state service, to requirements the established these rules.

appendices 6, 30, 31, 32, 33, 35 and 36 to Rules to be reworded as follows according to appendix 1, of 2, of 3, of 4, of 5, 6 and 7 to this order.

2. Bring in the order of the Minister of Defence of the Republic of Kazakhstan of November 5, 2020 No. 605 "About approval of Rules of rendering the state service "Provision of Draft Deferment" and Rules of rendering the state service "Release of Citizens from Appeal on Military Service" (it is registered in the Register of state registration of regulatory legal acts at No. 21613) the following changes:

in the Rules of rendering the state service "Provision of Draft Deferment" approved by the specified order:

state Item 5 and 6 in the following edition:

"5. In case of submission of documents through the portal electronic copies of documents of the main requirements to rendering the state service specified in the list are attached to the statement on rendering the state service.

6. The requirements to rendering the state service including the characteristic of process, form, content and result of rendering and also other data taking into account features of provision of the state service are stated in the form of the list of the main requirements to rendering the state service according to appendix 2 to these rules.";

appendix 1 and 2 to Rules to be reworded as follows, according to appendix 8 and 9 to this order;

in the Rules of rendering the state service "Release of Citizens from Appeal on Military Service" approved by the specified order:

state Item 5 and 6 in the following edition:

"5. In case of submission of documents through the portal electronic copies of documents of the main requirements to rendering the state service specified in the list are attached to the statement on rendering the state service.

6. The requirements to rendering the state service including the characteristic of process, form, content and result of rendering and also other data taking into account features of provision of the state service are stated in the form of the list of the main requirements to rendering the state service according to appendix 2 to these rules.";

appendices 1, 2 and 3 to Rules to be reworded as follows, according to appendix 10, 11 and 12 to this order.

3. To provide to department of organizational and mobilization work of the General Staff of Armed Forces of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Defence of the Republic of Kazakhstan after its first official publication;

3) the direction of data in Legal department of the Ministry of Defence of the Republic of Kazakhstan on execution of the actions provided by subitems 1) and 2) of this Item within ten calendar days from the date of state registration.

4. To impose control of execution of this order on the First Deputy Minister of Defence - the chief of the General Staff of Armed Forces of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.
