About approval of Rules of state registration of pledge of tractors and the self-propelled chassis and mechanisms, trail cars manufactured on their base to them, including trail cars with the mounted special equipment, self-propelled agricultural, meliorative and roadway construction equipments and mechanisms, special machines of the increased passability

According to the subitem 17) of Item 1 of article 6 of the Law of the Republic of Kazakhstan "About state regulation of development of agro-industrial complex and the rural territories" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" I ORDER:

1. Approve the enclosed Rules of state registration of pledge of tractors and the self-propelled chassis and mechanisms, trail cars manufactured on their base to them, including trail cars with the mounted special equipment, self-propelled agricultural, meliorative and roadway construction equipments and mechanisms, special machines of the increased passability.

2. To provide to department of production and conversion of crop products and phytosanitary safety of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of state registration of pledge of tractors and self-propelled chassis and mechanisms, trail cars manufactured on their base to them, including trail cars with the mounted special equipment, self-propelled agricultural, meliorative and roadway construction equipments and mechanisms, special machines of the increased passability

Chapter 1. General provisions

1. These rules of state registration of pledge of tractors and the self-propelled chassis and mechanisms, trail cars manufactured on their base to them, including trail cars with the mounted special equipment, self-propelled agricultural, meliorative and roadway construction equipments and mechanisms, special machines of the increased passability (further – Rules) are developed according to the subitem 17) of Item 1 of article 6 of the Law of the Republic of Kazakhstan "About state regulation of development of agro-industrial complex and the rural territories", the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services) and the Law of the Republic of Kazakhstan "About registration of pledge of personal estate" (further – the Law).

2. These rules determine procedure for state registration of pledge of tractors and the self-propelled chassis and mechanisms, trail cars manufactured on their base to them, including trail cars with the mounted special equipment, self-propelled agricultural, meliorative and roadway construction equipments and mechanisms, special machines of the increased passability (further – machines) and rendering the state service "State registration (removal from registration) of pledge, registration of changes, amendments (including transition of the property right to other person, right to claim concession, the subsequent pledge (repledge)) and cancellation of the registered pledge, and also issue of the certificate or duplicate on state registration of pledge of tractors and the self-propelled chassis and mechanisms, trail cars manufactured on their base to them, including trail cars with the mounted special equipment, self-propelled agricultural, meliorative and roadway construction equipments and mechanisms, special machines of the increased passability" (further – the state service).

3. In these rules the following basic concepts are used:

1) The Government for Citizens State corporation (further – the State corporation) – the legal entity created according to the decision of the Government of the Republic of Kazakhstan for rendering the state services according to the legislation of the Republic of Kazakhstan, the organization of work on reception of applications on rendering the state services and issue of their results to uslugopoluchatel by the principle of "one window", ensuring rendering the state services electronically;

2) electronic registration of pledge – the registration of pledge of machines performed based on the statement electronically;

3) registering body – the structural division of local executive body of area, city of republican value, the capital, area and city of regional value performing registration of pledge of machines, and also the actions provided by these rules (further – registering body (service provider)).

Chapter 2. Procedure for rendering the state service

4. The state service is rendered to physical persons and legal entities (further – uslugopoluchatel) in the electronic (partially automated) or paper form.

5. For state registration (removal from registration) of pledge of machines, receipt of the certificate or the duplicate about state registration of pledge of machines the uslugopoluchatel submits to registering body (service provider) by means of the web portal of "the electronic government" (further – the portal), or through the State corporation, or through office of registering body (service provider) the statement in form according to appendix 1 to these rules.

For registration of changes, amendments (including transition of the property right to other person, concessions of right to claim, the subsequent pledge (repledge)) and cancellation of the registered pledge the uslugopoluchatel submits to registering body (service provider) by means of the portal, or through the State corporation, or through office of registering body (service provider) the statement in form according to appendix 2 to these rules.

The list of the main requirements to rendering the state service "State Registration (Removal from Registration) of Pledge, Registration of Changes, Amendments (including Transition of the Property Right to Other Person, Right to Claim Concession, the Subsequent Pledge (Repledge)) and Cancellation of the Registered Pledge, and also Issue of the Certificate or Duplicate on State Registration of Pledge of Tractors and the Self-propelled Chassis and Mechanisms, Trail Cars Manufactured on Their Base to Them, including Trail Cars with the Mounted Special Equipment, Self-propelled Agricultural, Meliorative and Roadway Construction Equipments and Mechanisms, Special Machines of the Increased Passability" are stated in annex 3 to these rules.

6. Rendering the state service is performed within 2 (two) working days from the moment of adoption of the statement by registering body (service provider).

7. In case of the address of uslugopoluchatel through the State corporation, the employee of the State corporation checks completeness of the submitted documents.

In case of factual determination of incompleteness of the submitted documents, and also documents with the expired effective period, the employee of the State corporation refuses reception of an application and issues the receipt on refusal in documents acceptance in form according to appendix 4 to these rules.

In case of documents acceptance through the State corporation, the receipt on acceptance of the relevant documents is issued to uslugopoluchatel.

The accepted documents go to registering body (service provider) the employee of the State corporation according to the Rules of activities of The Government for Citizens State corporation approved by the order of the Minister of investments and development of the Republic of Kazakhstan of January 22, 2016 No. 52 (it is registered in the Register of state registration of regulatory legal acts No. 13248).

In case of the appeal of uslugopoluchatel to the State corporation, day of documents acceptance rendering the state service does not enter in time.

8. The employee of office of registering body (service provider) performs acceptance and document registration in day of their receipt.

In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the Labor code of the Republic of Kazakhstan, acceptance of addresses and issue of results of rendering the state service are performed in the next working day following it.

Confirmation of adoption of the statement on paper in office of registering body (service provider) is the mark in its copy about registration with indication of date, time (hours, minutes), surname and initials, position of person who adopted the statement.

In case of representation by uslugopoluchatel of incomplete document package, and also documents with the expired effective period, the employee of office of registering body (service provider) refuses reception of an application and issues the receipt on refusal in documents acceptance in form according to appendix 4 to these rules.

In case of the address of uslugopoluchatel through the portal, in "personal account" of uslugopoluchatel the status about acceptance of request for rendering the state service, and also the notification with indication of date and time of receipt of result of the state service is displayed.

9. In case of the address of uslugopoluchatel through the portal, the registering body (service provider) in day of documents acceptance, checks completeness of the submitted documents, and in case of representation by the applicant of incomplete document package, and also documents with the expired effective period, prepares motivated refusal in further review of the statement and sends the notification to "personal account" of the uslugopoluchatel in electronic form signed by the digital signature (further – the EDS) the head of registering body (service provider).

10. By provision uslugopoluchately complete document package, the head of registering body (service provider) in day of documents acceptance determines the executive in charge of registering body (service provider) (further – the inspection engineer).

The inspection engineer within 1 (one) working day from the moment of adoption of the statement checks reliability of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them, and statement compliance, to the established requirements of article 9 of the Law.

The inspection engineer enters data from the statement in the register of pledge of machines in form according to appendix 5 to these rules, draws up result of rendering the state service – the registration certificate of pledge of machines in form according to appendix 6 to these rules, either the duplicate of the registration certificate of pledge of machines, or the notice of registration (removal from registration) of pledge, registration of changes, amendments (including transition of the property right to other person, concessions of right to claim, the subsequent pledge (repledge)), cancellation of the registered pledge, or the motivated answer about refusal in rendering the state service in form according to appendix 7 to these rules, and sends result of rendering the state service to uslugopoluchatel, or to the State corporation.

In case of the address of uslugopoluchatel through the portal, result of rendering the state service goes to "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the head of registering body (service provider).

11. Information on the carried-out electronic registration is stored in information systems of the pawnbroker, registering body (service provider) and does not require documentary confirmation.

12. The bases for refusal in rendering the state service are:

1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them;

2) discrepancy of the statement for pledge registration to requirements of article 9 of the Law;

3) the address with the statement for registration of pledge of inadequate person;

4) lack of the document confirming payment in the budget of collection for state registration of pledge of personal estate.

13. Registration of cancellation of the agreement of pledge is made by registering body (service provider) by cancellation of record about pledge in the register of pledge of machines.

14. In case of loss (loss, spoil) certificates on state registration of pledge of machines, the duplicate with entering of the corresponding data into the register of pledge of machines is issued.

15. Availability of data and provision of information on pledge registration (removal from registration) of machines, registration of changes, amendments and cancellation of the registered pledge is provided with registering body (service provider) according to article 18 of the Law.

16. The registering body (service provider) in case of issue of the duplicate of the certificate on state registration of pledge of machines, registration of changes, amendments and cancellation of the registered pledge makes entering of the corresponding data into the register of pledge of machines.

17. The registering body (service provider) provides entering of data on stage of rendering the state service into information system of monitoring of rendering the state services according to the subitem 11) of Item 2 of article 5 of the Law on the state services.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of registering body (service provider) and (or) his official, the State corporation and (or) its workers concerning rendering the state services

18. Consideration of the claim concerning rendering the state services is made by higher administrative authority, the official, authorized body by assessment and control of quality of rendering the state services (further – the body considering the claim).

The claim is submitted to registering body (service provider) and (or) the official whose decision, action (failure to act) is appealed.

In case of receipt of the claim according to item 4 of Article 91 of the Administrative procedural Procedure Code of the Republic of Kazakhstan (further – APPK RK) the registering body (service provider) sends it to the body considering the claim within 3 (three) working days from the date of receipt. The claim registering body (service provider) does not go to the body considering the claim in case of adoption of the favorable act, making of administrative action, completely meeting requirements specified in the claim.

The claim of uslugopoluchatel according to Item 2 of article 25 of the Law on the state services is subject to consideration:

registering body (service provider) – within 5 (five) working days from the date of its registration;

authorized body by assessment and control of quality of rendering the state services – within 15 (fifteen) working days from the date of its registration.

The term of consideration of the claim by registering body (service provider), authorized body by assessment and control of quality of rendering the state services according to item 4 of article 25 of the Law on the state services is prolonged no more than for 10 (ten) working days in need cases:

1) carrying out additional studying or check according to the claim or checks with departure into place;

2) receipts of the additional information.

In case of prolongation of term of consideration of the claim the official given authority on consideration of claims within 3 (three) working days from the moment of prolongation of term of consideration of the claim reports in writing (in case of submission of the claim on paper) or electronic form (in case of submission of the claim in electronic form) to the uslugopoluchatel who made the complaint about prolongation of term of consideration of the claim with indication of the prolongation reasons.

If other is not provided by the law, appeal to the court is allowed after appeal in pre-judicial procedure according to Item 5 of article 91 APPK RK.

In case of addresses of uslugopoluchatel after the termination of working hours, in days off and holidays according to the Code, acceptance of addresses and issue of results of rendering the state service are performed the next working afternoon.
8	List of documents necessary for rendering the state service	Uslugopoluchatel submits the following documents: 1) in case of addresses to the service provider and/or in the State corporation: the statement in form; the identity document of uslugopoluchatel or the representative, and also the document confirming powers of the representative, or the electronic document from service of digital documents (for identification); 2) in case of addresses on the portal: the statement in electronic form, the uslugopoluchatel signed by the digital signature. Data on the identity document, on registration (re-registration) of the legal entity, on registration of the individual entrepreneur, or on the beginning of activities as the individual entrepreneur, the service provider receives from the corresponding state information systems through lock of "the electronic government". Reclamation from uslugopoluchatel of documents which can be received from information systems is not allowed.
9	The bases for refusal in rendering the state service established by the legislation of the Republic of Kazakhstan	1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them; 2) discrepancy of the statement for pledge registration to requirements of article 9 of the Law of the Republic of Kazakhstan "About registration of pledge of personal estate"; 3) the address with the statement for registration of pledge of inadequate person; 4) lack of the document confirming payment in the budget of collection for state registration of pledge of personal estate.
10	Other requirements taking into account features of rendering the state service including rendered electronically and through the State corporation	Service of digital documents is available to the users authorized in mobile application. For use of the digital document it is necessary to undergo authorization in mobile application with use of the electronic and digital signature or one-time password, further to pass into the Section "Digital Documents" and to choose the necessary document. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of portal "personal account", and also Single contact - the center. Contact telephone numbers of service desks concerning rendering the state service are specified in the Single platform of Internet resources of www.gov.kz state bodies. Single contact center concerning rendering the state services: 1414, 8 800 080 7777.
