About determination of the size of the salary for purpose (recalculation) of long-service pension

Based on part three of Item 3 of article 68 of the Law of the Republic of Belarus of June 1, 2022 "About public service" the Council of Ministers of the Republic of Belarus DECIDES: No. 175-Z

1. Approve Regulations on provision and receipt of information on the size of the salary of the government civil servant and equating of the state civil positions it (is applied).

2. Determine that:

2.1. the salary size for purpose (recalculation) of long-service pension to the government civil servant (further if other is not determined, – the civil servant) is determined based on information on the size of the salary containing in corporate management information system the social and labor sphere of the Ministry of Labour and Social Protection (further – TURNED SOUR "Management").

"Management" is the owner of PUSSYCATS the Ministry of Labour and Social Protection, the operator TURNED SOUR "Management" – the republican unitary enterprise "Center of Information Technologies of the Ministry of Labour and Social Protection of the Republic of Belarus" (further – the operator);

2.2. for determination of the size of the salary from which it is appointed the long-service pension according to the Law of the Republic of Belarus "About public service", on the state civil positions (is recalculated) (further if other is not determined, – civil position), not stipulated by the legislation, to civil positions, stipulated by the legislation, equating is applied:

state bodies according to appendix 1;

state bodies (the state organizations), structural divisions of state bodies according to appendix 2;

territorial authorities of state bodies according to appendix 3;

2.3. equating of the civil positions which are earlier provided by staff lists of state bodies (organizations) which names do not correspond to the names provided in appendix 1 to the Presidential decree of the Republic of Belarus of June 6, 2022 No. 195 "About the state civil positions" is performed by the permanent commission of the Ministry of Labour and Social Protection.

Regulations on the commission and its structure affirm the Ministry of Labour and Social Protection.

3. Equating not of stipulated by the legislation civil positions with civil positions, stipulated by the legislation, concerning the civil servants holding civil positions:

in the Ministry of Foreign Affairs (including in diplomatic representations and consular establishments of the Republic of Belarus), Operational analytical center in case of the President of the Republic of Belarus, the Presidential Security Service of the Republic of Belarus, the Investigative Committee, the Ministry of Internal Affairs, the Ministry of Emergency Situations, the Ministry of Defence, Committee for State Security, the State committee of judicial examinations (the state bodies which are logging in (entering) their) it is performed by the permanent commissions of these state bodies (central offices of system of state bodies) in the procedure determined by them;

in system of customs authorities, bodies of prosecutor's office, it is performed by the permanent commissions of the customs authorities, bodies of prosecutor's office and the state organizations created in system of bodies of prosecutor's office, according to the procedure, determined by the State Customs Committee, the Prosecutor General's Office respectively.

4. Determine that for purpose (recalculation) of long-service pension:

4.1. the salary is determined by the civil position held by the civil servant after March 1, 1994;

4.2. as a part of the salary on civil position:

the allowance for class of the civil servant is considered according to the class provided on position according to appendix 1 to the Presidential decree of the Republic of Belarus of June 6, 2022 No. 195;

the allowance for the class rank of the public prosecutor's worker, personal rank of the official of customs authorities, diplomatic rank of the diplomatic worker, qualification class of the judge is considered on the class rank which is actually appropriated to the civil servant, personal rank, diplomatic rank, qualification class;

4.3. on civil positions, not stipulated by the legislation, equated to civil positions, stipulated by the legislation, the salary size (including the allowance for class, official coefficient, monthly surcharge for accomplishment of organizational and administrative functions) is determined by the equated position. At the same time the allowance for the class rank, personal rank, diplomatic rank, qualification class is determined by actually appropriated class rank, personal rank, diplomatic rank, qualification class.

When equating civil positions change of their names according to appendix 4 to the Presidential decree of the Republic of Belarus of June 6, 2022 is considered No. 195.

In case of the double name of position of the civil servant equating is established according to its first name.

Names of positions of specialists, except for positions of the state inspectors, the state inspectors of taxes, controllers-auditors, legal executives, reflecting type of professional activity (the economist, the engineer, the accountant, the legal adviser, the lawyer, the doctor, the translator, the expert, the construction engineer, the state expert, the instructor, the inspector and others) and (or) the containing words "leader", "main" (the leading engineer, the leading accountant, the chief economist, the general counsel and others), are equated respectively to civil positions "specialist", "leading expert", "chief specialist";

4.4. information on the size of the salary of the civil servant, and also information on equating not of stipulated by the legislation civil positions with civil positions, stipulated by the legislation (further if other is not provided, – information on the size of the salary and (or) equating of positions of civil servants), is created in PUSSYCATS "Management" based on appendix 1 to the Presidential decree of the Republic of Belarus of June 6, 2022 No. 195, of appendices 1-3, of decisions of the commission specified in subitem 2.3 of Item 2 of this resolution, information on the size of the salary and equating of positions of civil servants provided by state bodies (the state organizations) specified in Item 3 of this resolution, legislation on compensation of civil servants and in the automated mode is transferred to the state information system of social protection.

5. To the Ministry of Labour and Social Protection to take measures for implementation of this resolution.

6. This resolution becomes effective in the following procedure:

Items 1-4 – since January 1, 2023;

other provisions of this resolution – after its official publication.
