About change of resolutions of Council of Ministers of the Republic of Belarus

In pursuance of Item 2 of the Presidential decree of the Republic of Belarus of September 6, 2022 "About change of presidential decrees of the Republic of Belarus" the Council of Ministers of the Republic of Belarus DECIDES: No. 311

1. Make changes to the following resolutions of Council of Ministers of the Republic of Belarus:

1.1. in Regulations on the procedure for confirmation and calculation of length of service for purpose of pensions approved by the resolution of Council of Ministers of the Republic of Belarus of December 24, 1992 No. 777:

state Item 11 in the following edition:

"11. The periods of business activity, work as members of peasant farms, and also working hours of the physical persons which are independently paying compulsory insurance premiums to the budget of fund till July 1, 1998 are confirmed by data of city, district and district departments (sectors) in the cities regional (The Minsk city) managements of Social Security Fund of the population of the Ministry of Labour and Social Protection (further – bodies of Fund) about the period of payment of compulsory insurance premiums in the budget of fund, and from July 1, 1998 till January 1, 2003 – data of bodies of Fund on payment of compulsory insurance premiums in the budget of fund and about the income from which they are estimated persons paying compulsory insurance premiums independently.";

in Items 23 and 28 of the word "district (city) departments" to replace with the word "bodies";

the second Item 24 after the word of "Fund" to add part with words of "social protection of the population of the Ministry of Labour and Social Protection";

1.2. in the resolution of Council of Ministers of the Republic of Belarus of March 11, 1998 No. 379 "About approval of the Regulations on patent agents of the Republic of Belarus":

state Item 1 in the following edition:

"1. Approve Regulations on patent agents of the Republic of Belarus it (is applied).";

in the Regulations on patent agents of the Republic of Belarus approved by this resolution:

to state the name of Chapter 3 in the following edition:

"CHAPTER 3. STATE CERTIFICATION AND REGISTRATION OF CANDIDATES FOR PATENT AGENTS. PROLONGATION OF EFFECTIVE PERIOD OF THE CERTIFICATE. CONSIDERATION OF CLAIMS OF INTERESTED PERSONS AND REPRESENTATIONS OF OFFICIALS OF PATENT BODY. MODIFICATION (CORRECTIONS) OF THE REGISTER. ISSUE OF THE DUPLICATE OF THE CERTIFICATE";

to add Item 11 part one after the word "certificates" with words ", modification (corrections) of the Register, and also issue of the duplicate of the certificate";

in Item 12:

to state the paragraph of the seventh in the following edition:

"makes addressed to the head of patent body offers on prolongation of effective period of the certificate or on refusal in prolongation of effective period of the certificate;";

the paragraph of the eighth after the word "accepted" to add with words "patent body";

the ninth to exclude the paragraph;

third Item 14 to exclude the paragraph;

to exclude from part one of Item 15 of the word "or decisions by results of consideration of question of prolongation of effective period of the certificate";

in Item 16:

from paragraphs of the first and second word"," to exclude the patent agent;

the fifth to exclude the paragraph;

third Item 25 to state the paragraph in the following edition:

"two color photos of 30 x 40 millimeters in size.";

the first offer of part one of Item 26 to state in the following edition:

"26. Registration of the patent agent and issue of the certificate to him in form according to appendix 3 are performed in fifteen-day time from the date of giving by the candidate for patent agents of the statement and documents who underwent certification, stipulated in Item the 25th this provision.";

state Item 28 in the following edition:

"28. During certificate effective period according to the application of the patent agent submitted to patent body changes are entered in the Register.

The statement for modification (corrections) of the Register (further – the application for modification) is submitted to patent body on Belarusian or Russian.

The statement for modification shall contain:

surname, own name and middle name (if that is available), and also the residence of the patent agent;

date and number of registration of the patent agent;

data, change (correction) of which is asked, in the same type in what they are specified in the Register;

data in that type in what they shall be entered in the Register;

signature of the patent agent;

the address for correspondence on the statement for modification.

The signature in the statement is deciphered (initials, surname and position (in the presence) of signatory person are specified).

The document confirming payment of patent fee for modification, corrections in the Register, and also the document which is the basis for modification is enclosed to the application for modification.

The application for modification is submitted within a month from the date of emergence of the actual circumstances which entailed change of the data containing in the Register. In case of non-compliance with this requirement to the patent agent by the Appeal commission on representation of officials of patent body the measure provided by the paragraph the second parts one of Item 9 of this provision that does not exempt the patent agent from obligation to submit the application for modification to patent body can be applied.

The patent body has the right to enter on own initiative in the Register correction of grammatical, typographical and other plain errors.

Responsibility for reliability and correctness of the documents and data submitted to patent body is born by the patent agent who submitted the application for modification.

The application for modification is considered within one month from the date of its giving in patent body.

In case of consideration of the application about modification the patent body checks availability of necessary documents and their compliance to the requirements established by parts second or heel of this Item. In the presence of all documents and their compliance to the established requirements the patent body enters changes (correction) in the Register and grants the certificate which is drawn up on the new form.

From date of issue of the certificate specified in part ten of this Item, earlier granted certificate is considered invalid.

Date of modification (corrections) of the Register date of filing of application about modification of patent body is considered.

The patent body notifies the patent agent who submitted the application for modification, for the made changes (corrections) and in accordance with the established procedure publishes data on the made changes (corrections) in the statement of patent body.

If the documents necessary for modification (corrections) of the Register are not provided or the established requirements to contents of the statement for modification are not observed, the patent body refuses adoption of such statement and returns to the patent agent who gave it the submitted documents.";

add the Provision with Item 28-1 of the following content:

"28-1. In the presence of request of patent body concerning the information about the patent agent entered in the Register, the patent agent shall report in writing about required data in patent body from the date of receipt of the corresponding request of patent body by it in a month and if necessary submit the application for modification of the same term.

In case of non-compliance with this requirement to the patent agent by the Appeal commission on representation of officials of patent body the measure provided by the paragraph the second parts one of Item 9 of this provision that does not exempt the patent agent from obligation to report about required data can be applied and if necessary to submit the application for modification of patent body. In case of the repeated not message in the fifteen-day time of the data requested by patent body the patent agent can be excluded from the Register.";

state Item 31 in the following edition:

"31. The patent body in the presence of the document confirming payment of patent fee for prolongation of effective period of the certificate adopts the statement for prolongation of effective period of the certificate and transfers him to Certifying commission for consideration.";

in Item 32:

the paragraph one to state in the following edition:

"32. The patent body within fifteen days from the date of receipt of the statement for prolongation of effective period of the certificate makes the decision on prolongation of effective period of the certificate the next five years estimated from the date of the termination of the previous five-year term based on the proposal of Certifying commission on prolongation of effective period of the certificate if the patent agent:";

add Item with part of the following content:

"In case of decision making about prolongation of effective period of the certificate the patent body enters the corresponding data in the Register and at the request of the patent agent – in the certificate.";

in Item 33 of the word "Certifying commission" shall be replaced with words "patent body based on the proposal of Certifying commission on refusal in prolongation of effective period of the certificate";

state Item 34 in the following edition:

"34. During certificate effective period according to the application of the patent agent submitted to patent body the duplicate of the certificate can be issued if such certificate is lost or became useless.

The application for issue of the duplicate of the certificate is submitted to patent body on Belarusian or Russian.

The statement for issue of the duplicate of the certificate shall contain:

surname, own name and middle name (if that is available), and also the residence of the patent agent;

date and number of registration of the patent agent;

signature of the patent agent;

the address for correspondence on the statement for issue of the duplicate of the certificate.

The signature in the statement is deciphered (initials, surname and position (in the presence) of signatory person are specified).

The document confirming payment of patent fee for issue of the duplicate of the certificate is enclosed to the application for issue of the duplicate of the certificate. The become useless certificate is also enclosed to the application (if the certificate became useless).

The application for issue of the duplicate of the certificate is considered by patent body within fifteen days from the date of submission of such statement in patent body.

The patent body enters data on issue of the duplicate of the certificate in the Register and in accordance with the established procedure publishes data on the issued duplicate of the certificate in the statement of patent body.

In case of loss of the certificate data on invalidity of the original certificate are published in the statement of patent body along with the publication of data on issue of the duplicate of the certificate.

In the duplicate of the certificate data for date of its issue taking into account the previous changes entered in the Register are entered.

Date of issue of the duplicate of the certificate date of filing of application about issue of the duplicate of the certificate is considered.

From date of issue of the duplicate of the certificate the original certificate is considered invalid.

If the documents necessary for issue of the duplicate of the certificate are not provided or the requirements to contents of the statement for issue of the duplicate of the certificate established by parts second or heel of this Item are not observed, the patent body refuses adoption of such statement and returns to the patent agent who gave it the submitted documents.";

1.3. in the resolution of Council of Ministers of the Republic of Belarus of June 4, 2001 No. 834 "About approval of Rules of content of domestic dogs, cats, and also catching of neglected animals in settlements of the Republic of Belarus":

in Item 1:

exclude the word "enclosed";

add Item with the word "(are applied)";

in Rules of content of domestic dogs, cats, and also catching of neglected animals in the settlements of the Republic of Belarus approved by this resolution:

in subitem 4.2 of item 4 of the word "the organizations performing registration of animals" shall be replaced with words "district, city executive committee, local administration of the area in the city";

state Item 8 in the following edition:

"8. Registration of dogs, cats with issue of the registration certificate and counter is performed by district, city executive committee, local administration of the area in the city.";

state Item 13 in the following edition:

"13. The district, city executive committees, local administrations of the area in the city performing registration of dogs, cats shall inform under list of their owners of these rules, and also health and veterinary regulations.";

exclude Item 14;

state Item 15 in the following edition:

"15. Control of timely registration of the dogs, cats belonging to citizens is performed by district, city executive committee, local administration of the area in the city.";

1.4. in Regulations on the provision to citizens of the Republic of Belarus of one-time subsidies for construction (reconstruction) or acquisition of premises approved by the resolution of Council of Ministers of the Republic of Belarus of April 30, 2002 No. 555:

in part one of Item 5 of the word "local executive and administrative organ" shall be replaced with words "district, city (the cities of regional and district subordination) executive committee, local administration of the area in the city (further – local executive and administrative organ)";

in paragraph one of part four of Item 20 of the word "and administrative organs, local administrations" shall be replaced with words "committees, local administrations of areas in the cities";

1.5. in Regulations on order of registration of acts of civil status and issue of documents and (or) references by the bodies registering acts of civil status, No. 1454 approved by the resolution of Council of Ministers of the Republic of Belarus of December 14, 2005:

to add Item 10 after part four with parts of the following content:
