About approval of the Regulations on provision to citizens of the Republic of Belarus of one-time subsidies for construction (reconstruction) or acquisition of premises
Council of Ministers of the Republic of Belarus DECIDES:
1. Approve Regulations on provision to citizens of the Republic of Belarus of one-time subsidies for construction (reconstruction) or acquisition of premises it (is applied).
2. Determine that:
one-time subsidies are provided on construction of apartments in the economic apartment and blocked apartment houses of standard consumer qualities which list of projects (series) affirms the Ministry of Architecture, and also as the apartment and blocked apartment houses of other projects (series) which project documentation on construction is approved in accordance with the established procedure till June 1, 2013, on construction (reconstruction) of single-family apartment houses and on reconstruction or acquisition of premises to the citizens of the Republic of Belarus who are staying on the registry of the housing conditions needing improvement and having the right to their obtaining for construction (reconstruction) or acquisition of premises in any settlement of the republic according to the procedure, stipulated by the legislation, taking into account features, established in parts of the second or fourth of subitem 1.1 of Item 1 of the Presidential decree of the Republic of Belarus of January 6, 2012 No. 13 "About some questions of provision to citizens of the state support for construction (reconstruction) or acquisition of premises", with respect for the principle of odnorazovost of receipt of the state support, and also taking into account the provisions provided in parts of the third or ninth of subitem 1.3-1 of Item 1 of the Presidential decree of the Republic of Belarus of January 6, 2012 No. 13;
one-time subsidies for construction (reconstruction) of premises are provided in the period of construction (reconstruction) of premises before input of the apartment house in operation;
decisions on provision to citizens of one-time subsidies for acquisition of premises which construction was performed according to the state order are accepted to the conclusion of credit agreements on conditions and according to the procedure, provided by the Presidential decree of the Republic of Belarus of January 6, 2012 No. 13;
recalculation of one-time subsidies in connection with change of family composition, and also on other bases is not made, except as specified change of family composition in connection with cancellation of adoption (adoption).

1. This Provision determines conditions and procedure for provision of one-time subsidies (further - subsidies) on construction (reconstruction) or acquisition of premises to the citizens who are staying on the registry of the housing conditions needing improvement and having according to legal acts the right to the state support to the specified purposes.
2. The subsidy is form of the state non-paid support given to citizens for improvement of their housing conditions in the form of money which totally including housing quotas (personalized privatization checks "Housing") cannot exceed 70 percent of the subsidy of construction cost (reconstruction) of the normalized sizes of total area of premises determined for family according to Items 15 and 16 of this provision taken into consideration for determination of the size.
3. The subsidy is provided for the construction (reconstruction) or acquisition of the premises which are arranged well in relation to conditions of this settlement, conforming to the health and technical requirements established for accommodation and on the area at least 15 sq.m (in Minsk - 10 sq.m) to total area per capita, except as specified, specified in part two of this Item.
The subsidy for construction (reconstruction) or acquisition of premises on the area less than 15 sq.m (in Minsk - 10 sq.m) total area per capita can be provided to citizens:
exercising the right to joint use of subsidy and soft credit on condition of voluntary declaration of will of these citizens and members of their families included in lists on receipt of the soft credits, on removal from accounting needing improvement of housing conditions;
having in property and (or) ownership and use premises in this settlement (in case of construction (reconstruction) or acquisition of premises in Minsk - in Minsk and the Minsk district) and also if such premises are available in property and (or) ownership and use of members of their families provided that the security with total area of premises determined as the amount of total area of the premises which are available and under construction (reconstructed) or acquired with attraction of subsidy, constitutes more than 15 sq.m (in case of construction (reconstruction) or acquisition of premises in Minsk - more than 10 sq.m) on one person.
4. Citizens exercise the right to subsidy together with members of the family in the written consent of all her full age members.
5. The citizens staying on the registry of the housing conditions needing improvement only on place of employment have the right to submit the application for receipt of subsidy in district, city (the cities of regional and district subordination) executive committee, local administration of the area in the city (further – local executive and administrative organ) in the territory of which there is organization which registered them, in the absence of opportunity to provide subsidy on place of employment (except for the citizens registered on the preferential bases according to collective agreements). Subsidies for construction (reconstruction) or acquisition of premises are provided to the specified citizens according to the procedure, provided for staying on the registry in local executive and administrative organ, proceeding from time of their acceptance for accounting of the housing conditions needing improvement in the organization.
For the citizens staying on the registry of the housing conditions needing improvement at the place of residence and on place of employment, priority of receipt of subsidy for construction (reconstruction) or acquisition of premises, and also its size are determined by earlier date of registration.
6. The subsidy for construction (reconstruction) or acquisition of premises is provided according to the procedure of the priority established proceeding from time of acceptance of citizens for accounting of the housing conditions needing improvement.
To the citizens having the right to extraordinary receipt of subsidies according to legal acts, subsidies are provided according to the procedure of the priority established for the corresponding categories of citizens proceeding from time of their acceptance for accounting of the housing conditions needing improvement.
Subsidy for construction (reconstruction) or acquisition of premises to the family members needing improvement of housing conditions of the died (died) judge, the public prosecutor's worker, the serviceman, face of the private and the commanding structure of the Investigative Committee, law-enforcement bodies, bodies of financial investigations of the State Control Committee, bodies and divisions on emergency situations (except for military personnel of compulsory military service and cadets of military educational institutions, cadets and listeners of day form of education of educational institutions of law-enforcement bodies, bodies and divisions on emergency situations) in connection with execution of service duties, obligations of military service, service in the Investigative Committee, law-enforcement bodies, bodies of financial investigations of the State Control Committee, bodies and divisions for emergency situations (except for as a result of the illegal actions) it is provided to death (death) within six months from the date of death (death) by local executive and administrative organ in which the died (dead) stayed on the registry of the housing conditions needing improvement or in the territory of which there is state body which delivered on such accounting in the sizes established by acts of the legislation and this Provision.
7. Subsidies are provided by local executive and administrative organs within the budgetary funds provided on these purposes.
The organizations can provide to the workers for improvement of their housing conditions of subsidy in the form of money according to the procedure, established by the current legislation.
8. Subsidies for construction (reconstruction) or acquisition of premises are listed by the local executive and administrative organs, the organizations which made decisions on provision of subsidies into the special accounts "Subsidy" opened by each receiver of subsidy in open joint stock company "Belarusbank savings bank for accumulation of means of subsidies on it for construction (reconstruction) or acquisition of premises and used in non-cash form by transfer according to the written order of the receiver of subsidy.
Features of functioning of special accounts "Subsidy" are determined in appendix 1 to the Presidential decree of the Republic of Belarus of January 6, 2012 No. 13.
9. No. 877 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 30.06.2011
10. The subsidy for construction (reconstruction) of premises shall be used by its owner during the term of the construction stipulated in the construction agreement (reconstruction) of premises, but which is not exceeding three years since its transfer to the special account "Subsidy" in open joint stock company "Savings bank" Belarusbank. In case of acquisition of premises the term of use of subsidy for acquisition of premises shall not exceed six months.
11. Acceptance and accounting of petitions from citizens on receipt of subsidy are performed by local executive and administrative organs and the organizations.
12. The size of subsidy is determined as the amount of its basic share according to appendix 1, determined percentage of the subsidy of construction cost (reconstruction) of the normalized sizes of total area of premises, and housing quotas taken into consideration for determination of the size (personalized privatization checks "Housing") the citizen receiving subsidy and members of his family having the right to indexation of housing quotas according to the legislation (personalized privatization checks "Housing") and shown willingness to improve housing conditions with use of subsidy.
In case of the request of the citizen for subsidy after use of personalized privatization checks "Housing" on construction (reconstruction) or acquisition of these premises in case of determination of the size of subsidy is considered the amount of the indexed housing quota provided to citizens (personalized privatization checks "Housing").
13. The size of basic share of subsidy is determined proceeding from:
the time spent of the citizen for accounting of the housing conditions needing improvement, except the cases provided in Item 14 of this provision;
the number of the family members who expressed the consent to receipt of subsidy for construction (reconstruction) or acquisition of premises. The family composition of the citizen applying for receipt of subsidy for construction (reconstruction) or acquisition of premises, and the list of able-bodied members of his family are determined respectively according to paragraphs to the ninth and twelfth Item 5 of the Presidential decree of the Republic of Belarus of January 6, 2012 No. 13;
average monthly comprehensive income of family;
the size of total area of the premises on one or several family members taken into consideration when charging subsidy, determined according to Items 15 and 16 of this provision.
Calculation of basic share of subsidy is made at the cost of 1 sq.m of total area of the under construction (reconstructed) premises, but not exceeding limiting norm of the cost of 1 sq.m of total area of premises determined by Council of Ministers of the Republic of Belarus.
14. To the citizens receiving subsidies out of turn, and also the young families and citizens who are constantly living and working in rural settlements, the basic share of subsidy is charged irrespective of their time spent for accounting of the housing conditions needing improvement in the maximum size taking into account other criteria provided in Item 13 of this provision.
15. The standard rate of total area for charge to citizens of the amount of basic share of subsidy is established in the amount of 20 sq.m (in Minsk - 15 sq.m, and for large families - 20 sq.m) on one family member (in case of construction for one person of one-room apartment, the single-family apartment house - 30 sq.m).
For the citizens having according to the legislation of the Republic of Belarus the right to the additional area of premises for health reasons the standard rate of total area for charge of subsidy increases by 15 sq.m on each family member having such right.
16. The sums of basic share of subsidy taken into consideration when charging the normalized sizes of total area of premises are determined according to the procedure, No. 13 provided in parts of the first or sixth of subitem 1.6 of Item 1 of the Presidential decree of the Republic of Belarus of January 6, 2012 for determination of the normalized sizes of total area of premises for determination of size of soft credit, taking into account the number of the family members applying for receipt of subsidy.

19. The subsidy for acquisition of premises is charged according to the procedure, applied when subsidizing construction of premises.
Within the added amount the subsidy is provided on acquisition of premises, except for premises which construction was performed according to the state order, in the amount of the smallest cost of acquired premises determined according to the purchase and sale agreement or the conclusion about assessment (by determination of estimated value) premises (for premises in rural settlements - taking into account economic constructions) issued in the procedure established by the legislation by the organization for state registration of real estate, the rights to it and transactions with it.
19-1. No. 854 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 30.09.2013
19-2. The subsidy for acquisition of premises which construction was performed according to the state order is calculated local executive and administrative organs, the organizations according to the procedure, provided in Items 12-19 of this provision, to the conclusion with the citizen of the credit agreement on conditions and according to the procedure, provided by the Presidential decree of the Republic of Belarus of January 6, 2012 No. 13.
Calculation of basic share of subsidy for acquisition of premises which construction was performed according to the state order is made at the cost of 1 sq.m of total area in the specific house without the cost accounting, not included in summary estimate calculation of construction cost, but attributable to construction cost, and development costs of the project documentation, but not exceeding the limiting norm of the cost of 1 sq.m of total area of premises determined by Council of Ministers of the Republic of Belarus.
20. The basis for consideration of question of possibility of provision of subsidy to the citizen is its statement addressed to the chairman of local executive and administrative organ, the head of the organization in whom the citizen stays on the registry of the housing conditions needing improvement.
The documents and (or) data specified in subitem 1.1.24 of Item 1.1 of the list of the ministerial procedures performed by state bodies and other organizations for petitions from citizens, No. 200 approved by the Presidential decree of the Republic of Belarus of April 26, 2010 are enclosed to the application.
Data on the income and property of the citizen and members of his family are determined according to Regulations on reference of citizens to category needy for receipt of the state support for construction (reconstruction) or acquisition of premises, the approved resolution of Council of Ministers of the Republic of Belarus of December 20, 2000 No. 1955.
For decision making about provision to the citizen of subsidy the local executive and administrative organ, the organization request and receive data from the database of the able-bodied citizens who are not occupied in the economy provided in the paragraph the second Item 3 of the Decree of the President of the Republic of Belarus of April 2, 2015 No. 3 "About assistance of employment of the population", about reference of citizens to the able-bodied citizens who are not occupied in economy, provided by the permanent commissions created by district, city executive committees, local administrations of areas in the cities according to item 4 of the Decree of the President of the Republic of Belarus of April 2, 2015 No. 3 (further - the commissions), in place of registration at the place of residence and (or) the place of stay of the citizen and (or) able-bodied members of his family within 5 working days from the date of receipt of request, and also the following documents:
20.1. in case of construction (reconstruction) of premises as a part of the organization of builders, according to the procedure of equity in housing construction under the contract with the builder or other agreement on housing construction:
the statement from the decision of local executive and administrative organ on inclusion of the citizen in structure of the organization of builders, or the copy of the agreement on equity in housing construction, or the copy of other agreement on construction;
the certificate of construction cost (reconstruction) of premises in current prices determined based on estimate documentation for date of filing of application on receipt of subsidy (it is issued by the organization of builders, the builder);
20.2. in case of construction (reconstruction) of single-family apartment houses, apartments in the blocked apartment houses:
copies of the documents confirming availability at the receiver of subsidy of the project documentation coordinated in accordance with the established procedure and the permission for construction (reconstruction) of the apartment house or the apartment;
the certificate of construction cost (reconstruction) of the apartment house or the apartment, cost of the performed works and the purchased materials and products in current prices determined based on estimate documentation for date of filing of application on receipt of subsidy;
20.3. excluded
20.4. in case of acquisition of premises, except for premises which construction was performed according to the state order:
the copy of technical data sheet on acquired premises;
the conclusion about assessment (by determination of estimated value) premises issued in the procedure established by the legislation by the organization for state registration.
If the legislation provides payment for issue of the documents specified in parts four of this Item, request of these documents by local executive and administrative organ, by the organization is performed after representation by the citizen of the document confirming introduction of payment for their issue.
For decision making about provision of subsidy to the citizens and members of their families improving together with them housing conditions, belonging to the able-bodied citizens who are not occupied in economy, local executive and administrative organ:
requests in form according to appendix 2 and receives minutes abstracts of meetings of the commissions on place of registration at the place of residence and (or) the place of stay of the citizen and (or) the able-bodied members of his family containing decisions on recognition (non-recognition) of this citizen and (or) able-bodied members of his family by the able-bodied citizens who are not occupied in economy, being in difficult life situation, or not belonging to the able-bodied citizens who are not occupied in economy - if the bases for their reference to the able-bodied citizens who are not occupied in economy for date of filing of application about provision of subsidy disappeared;
explains to these citizens that the decision on provision of subsidy is made after acceptance by the commissions of the decisions specified in the paragraph the second to this part.
20-1. The organization providing subsidy for construction (reconstruction) or acquisition of premises in addition to the data and documents established in Item 20 of this provision requests and obtains information from the single database provided in part one of Item 10-1 of the Presidential decree of the Republic of Belarus of January 6, 2012 No. 13, provided by local executive and administrative organ in the territory of which there is the specified organization.
21. Based on data on the income and property of the citizen and the members of his family improving together with it housing conditions, the local executive and administrative organ, the organization determine availability or absence at the applicant for receipt of subsidy for construction (reconstruction) or acquisition of premises of the means necessary for difference covering between all-in cost of construction (reconstruction) or acquisition of premises and size of the provided subsidy.
In case of absence at the applicant of funds for difference covering between all-in cost of construction (reconstruction) or acquisition of premises and size of the provided subsidy for construction (reconstruction) or acquisition of premises the local executive and administrative organ, management of the organization can refuse charge of subsidy. The applicant has the right to repeatedly submit the application for provision of subsidy after emergence in it of necessary means.
22. The local executive and administrative organ, the organization check reliability of the data specified in the statement, make calculation of the size of subsidy for construction (reconstruction) or acquisition of premises, "Subsidy" and procedure for further use explain to the receiver of subsidy of condition of its transfer to the special account, and in refusal cases in provision of subsidy inform the applicant for receipt of subsidy on cause of failure.
23. One copy of the decision of local executive and administrative organ, the organization providing subsidy for construction (reconstruction) or acquisition of premises, with indication of the amount of the added subsidy, own or loan money of the receiver of subsidy, target direction of use of subsidy is issued to the citizen, other copy goes to open joint stock company "Belarusbank savings bank.
The payment for issue to the citizen of the copy of the decision on charge of subsidy is not levied.
Based on the specified copy of the decision open joint stock company "Savings bank" the Belarusbank signs with the receiver of subsidy the contract for opening of the special account "Subsidy" and accomplishment by it at the request of the receiver of subsidy of payments during construction (reconstruction) or in case of acquisition of premises.
23-1. The organization providing subsidy for construction (reconstruction) or acquisition of premises from the date of decision making about provision of subsidy submits the copy of this decision certified in accordance with the established procedure in local executive and administrative organ in the territory of which it is within five-day term, for inclusion of information on the citizens who are (being) receivers one-time subsidies and members of families of receivers of one-time subsidies taking into account which one-time subsidies, in the database provided in paragraph six of Item 10 of the Presidential decree of the Republic of Belarus of January 6, 2012 No. 13 are provided.
24. To the citizens exercising the right to joint use of subsidy and soft credit to construction (reconstruction) of premises, the subsidy is provided in the course of construction (reconstruction) of this room. The decision on provision of subsidy for acquisition of premises which construction was performed according to the state order is accepted to the conclusion of the credit agreement on conditions and according to the procedure, provided by the Presidential decree of the Republic of Belarus of January 6, 2012 No. 13. Crediting of construction or acquisition of premises which construction was performed according to the state order is performed within the construction cost (reconstruction) of the normalized sizes of total area of premises taken into consideration for determination of the size of soft credit less the size of the received subsidy.
In case of the address of the citizens who obtained soft credits, the subsidy is provided in the amount of, added in accordance with the established procedure, within the rest of construction cost (reconstruction) of the normalized size of preferentially credited area of premises.
25. In case of submission of all necessary documents the subsidy for construction (reconstruction) or acquisition of premises is transferred into the special account "Subsidy" addressed to her receiver in open joint stock company "Belarusbank savings bank.
26. After transfer of subsidy for construction (reconstruction) or acquisition of premises to the special account "Subsidy" in accounting case of the citizen staying on the registry of the housing conditions needing improvement into which special account the subsidy is transferred becomes the corresponding mark.
26-1. No. 854 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 30.09.2013
26-2. Recalculation of the size of subsidy is made from the date of its charge if after decision making about provision of subsidy the family composition of the citizen in connection with cancellation of adoption (adoption) during implementation of construction (reconstruction) of premises changed.
The local executive and administrative organ at the place of residence of adoptive parents within three working days from the date of receipt of the judgment about cancellation of adoption (adoption) represents the copy of this decision of the organization which provided subsidy, in the presence in the single database provided in part one of Item 10-1 of the Presidential decree of the Republic of Belarus of January 6, 2012 No. 13, of data on provision of subsidy to the citizen on whom the decision on cancellation of adoption (adoption) is made.
Recalculation of subsidy is performed by the relevant local executive and administrative organ, the organization which made the decision on its provision by modification of this decision of ten-day term from the date of receipt of the judgment about cancellation of adoption (adoption). One copy of this decision with indication of the amount of the counted subsidy goes to the citizen, other copy goes to open joint stock company "Belarusbank savings bank in the place of opening of the special account "Subsidy".
"The Belarusbank savings bank during three banking days from the date of receipt of the copy of the decision specified in part three of this Item is made by open joint stock company return of money from the special account "Subsidy" in the local budget or into the account of the organization which provided subsidy in the amount of difference between the size of the subsidy added before change of family composition of the citizen and after its change within means on the special account "Subsidy" for date of their return.
If the balance in cash on the special account "Subsidy" is less than the size of means which are subject to return, or money from the special account is listed in full on construction (reconstruction) of premises, open joint stock company "The Belarusbank savings bank returns money in the amount of their remaining balance on the special account. The cash amount which return is not performed by open joint stock company "Belarusbank savings bank on the circumstances specified in this part is subject to return by the citizen to which the subsidy is provided. In case of refusal of the citizen of return of the specified means in voluntary procedure they are collected judicially.
27. The subsidies for construction (reconstruction) or acquisition of premises provided to citizens are used in non-cash form in payment type, listed according to the written order of the owner of subsidy by open joint stock company "Belarusbank savings bank:
the organizations of builders, to the builder (contractor) – in case of construction of premises as a part of the organization of builders by equity, contract method;
to the seller - in case of acquisition of premises, except for premises which construction was performed according to the state order, construction materials, products and the equipment in case of housing construction by own forces.
into the account on accounting of credit debt of the customer - in case of acquisition of premises which construction was performed according to the state order.
28. In cases of agreement cancelation of creation of object of shared-equity construction, including refusal of one of the parties of execution of such agreement, exit or exception of organization members of builders, agreement cancelation of purchase and sale of premises which construction was performed according to the state order of the termination of construction of the single-family apartment house, the apartment in the blocked apartment house in connection with withdrawal of the parcel of land the money listed from the special account "Subsidy" shall be returned in local budgets or into the account of the organization which provided subsidy. Return of money is provided respectively with the builder or the organization of builders performing construction (reconstruction) of the apartment house, the customer performing construction of premises according to the state order or the citizen performing construction of the single-family apartment house, apartment in the blocked apartment house.
The returned cash amount, listed from the special account "Subsidy", is subject to recalculation, except as specified return of the subsidy provided on acquisition of premises which construction was performed according to the state order. Recalculation of the returned amounts of subsidy is performed using rate (rates) of refinancing of National Bank, operating (operating) with receipt date money from the special account "Subsidy" for construction (reconstruction) of premises before date of their return by the builder, organization of builders, the citizen on the formula given in Item 12 of the Regulations on procedure for return of money in case of the termination of participation in shared-equity construction, the termination of organizational membership of builders, agreement cancelation of purchase and sale of the premises built according to the state order, the Council of Ministers of the Republic of Belarus approved by the resolution of January 8, 2014 No. 6.
If money was not listed from the special account "Subsidy" for construction (reconstruction) of premises or acquisition of premises which construction was performed according to the state order, their return the Belarusbank savings bank taking into account the added percent in the amount of, provided for on-demand deposits is made by open joint stock company ".
29. In case of disposal of the citizen from organization members of builders and inclusion in its list of other citizen having the right to subsidy for construction (reconstruction) of premises, the subsidy in accordance with the established procedure returns the organization of builders to the local budget or into the account of the organization which provided subsidy for construction (reconstruction) or acquisition of premises.
In case of termination between the citizen and the customer of the purchase and sale agreement of premises which construction was performed according to the state order, and the conclusion of such contract with other citizen having the right to subsidy for construction (reconstruction) or acquisition of premises the subsidy in accordance with the established procedure returns the customer to the local budget or into the account of the organization which provided subsidy for construction (reconstruction) of premises.
To the citizens included in structure of the organization of builders instead of disposed from its structure (signed purchase and sale agreements of premises which construction was performed according to the state order, instead of the citizens who terminated such agreements), subsidies for construction (reconstruction) or acquisition of premises which construction was performed according to the state order are provided in accordance with the established procedure.
29-1. If the local executive and administrative organ, the organization makes the decision on provision to the citizen of subsidy, however the subsidy was not listed or is in full returned in the local budget or into the account of the organization which provided subsidy in connection with agreement cancelation of creation of object of shared-equity construction, including refusal of one of the parties of execution of such agreement, exit or exception of organization members of builders, agreement cancelation of purchase and sale of premises, withdrawal of the parcel of land, the decision on provision of subsidy is declared invalid by the relevant local executive and administrative organ, the organization which made this decision.
30. The disputes arising by provision of subsidy are considered by higher local executive and administrative organ or court in the procedure established by the legislation of the Republic of Belarus.
