About introduction of amendments to the order of the Ministry of Internal Affairs of Ukraine of August 21, 1998 No. 622

According to subitems 16, 17 parts one of article 26 of the Law of Ukraine "About National police", Item 12 of the Regulations on unified information system of the Ministry of Internal Affairs approved by the resolution of the Cabinet of Ministers of Ukraine of November 14, 2018 No. 1024, of Item 9 of the Regulations On authorization system approved by the resolution of the Cabinet of Ministers of Ukraine of October 12, 1992 No. 576, of the subitem 17 of item 4 of the Regulations on the Ministry of Internal Affairs of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of October 28, 2015 No. 878, for the purpose of enhancement of the automated accounting of weapon, ammunition to it, the main parts, devices and cartridges to them, explosive materials:

1. Bring in the order of the Ministry of Internal Affairs of Ukraine of August 21, 1998 No. 622 "About approval of the Instruction about procedure for production, acquisition, storage, accounting, transportation and use of the fire, pneumatic, cold and cooled weapon, devices of national production for shooting of the cartridges equipped with metal shells of nonlethal action, and cartridges, rubber or similar on the properties, to them, and also ammunition to weapon, the main parts of weapon and explosive materials", No. 637/3077, registered in the Ministry of Justice of Ukraine on October 07, 1998 such changes:

1) in Item 2:

in paragraph one of the word ""Shall Be Replaced with Words" Structural Divisions of the Central Governing Body of National Police and the Office of the Ministry of Internal Affairs the National Police of Ukraine and the Ministry of Internal Affairs";

in paragraph three of subitem 2.1 of the word "Creation and regular replenishment in each control room of card-indexes of owners of fire, pneumatic and cold weapon" shall be replaced with words "filling of functional subsystem "The unified register of weapon" unified information system of the Ministry of Internal Affairs (dalee-EVR) (divisions) of police of access to it";

state subitem 2.4 in the following edition:

"2.4. Expert service of the Ministry of Internal Affairs of Ukraine:

conducting criminalistic accounting of bullets and sleeves with weapon traces, received in case of control shooting of the withdrawn, voluntarily handed over and found weapon, devices, departmental and office and regular weapon, are stored and used on objects of authorization system, and also cut weapon, devices, gas guns (revolvers) which are in property of citizens;

forming and maintaining the electronic qualifier of weapon, ammunition to it, the main parts of weapon and explosive materials for the purposes of maintaining EVR;

entering into EVR of data on firearms, the main parts of weapon which have identification numbers, the cooled, neutralized, pneumatic weapon of caliber over 4,5 of millimeter and the speed of flight of bullet over 100 meters per second, cold weapon, devices, gas;

survey of technical condition of weapon, main parts of weapon, devices, gas guns (revolvers), and also shooting of weapon, main parts of weapon, devices";

third subitem 2.5 to exclude the paragraph;

Subitem 3.1 of Item 3 after the word of "accounting" to add 2) with words "(including electronic)";

3) in the text of the order of the word "police agencies" in all cases shall be replaced with words "bodies (divisions) of police" in cases.

Approve Changes in the Instruction about procedure for production, acquisition, storage, accounting, transportation and use of the fire, pneumatic, cold and cooled weapon, devices of national production for shooting of the cartridges equipped with metal shells of nonlethal action, and also ammunition, rubber or similar on the properties, to weapon, the main parts of the weapon and explosive materials approved by the order of the Ministry of Internal Affairs of Ukraine of August 21, 1998 No. 622, registered in the Ministry of Justice of Ukraine on October 07, 1998 for No. 637/3077, which are applied.

3. National police of Ukraine timely to enter data on the address of weapon, ammunition to it, the main parts of weapon, devices, cartridges to them and explosive materials of functional subsystem "The unified register of weapon" of unified information system of the Ministry of Internal Affairs with observance of requirements of the Laws of Ukraine "About electronic confidential services", "About electronic documents and electronic document management", Regulations on functional subsystem "The unified register of weapon" of unified information system of the Ministry of Internal Affairs approved by the order of the Ministry of Internal Affairs of Ukraine of January 10, 2022 No. 2, registered in the Ministry of Justice of Ukraine on January 26, 2022 for No. 90/37426.

4. To department of informatization (Mikhaylov A.) provide submission of this order to state registration in the Ministry of Justice of Ukraine on established procedure.

5. This order becomes effective in six months from the date of its official publication.

6. To impose control over the implementation of this order on the deputy minister of internal affairs of Ukraine according to distribution of functional obligations.

1. In the Section I:

1) in Chapter 1:

state Item 1.5 to the following edition:

"1.5. For obtaining in bodies (divisions) of police of the permissions determined by this Instruction personally or through the representative, the physical person submits the application (appendix 1) (further – the Statement), the authorized person (representative) of the company, organization, organization, the physical person – the entrepreneur submits the petition (appendix 2) (further – the petition) in paper or electronic form.

Documents which list is determined by this instruction, for decision making about provision of the corresponding permission are enclosed to the application (petition).

Documents are filed:

personally physical person or authorized person (representative);

through the operator of mail service (the registered mail with the inventory of investment and with the assurance of receipt of the mailing) who provides the subsequent visit by the applicant of body (division) of police in appointed day and time;
