About modification and amendments in the orders of the Government of the Republic of Kazakhstan of December 11, 2018 No. 820 "About some questions of ensuring long-term tengovy liquidity for the solution of task of available crediting" and of December 31, 2019 No. 1060 "About some measures of the state support of private entrepreneurship"

The government of the Republic of Kazakhstan DECIDES:

1. Bring the following changes and amendments in some decisions of the Government of the Republic of Kazakhstan:

1) in the order of the Government of the Republic of Kazakhstan of December 11, 2018 No. 820 "About some questions of ensuring long-term tengovy liquidity for the solution of task of available crediting":

in the mechanism of crediting and financial leasing of priority projects approved by the specified resolution:

add with Item 7-1 of the following content:

"7-1. The financial agency on the credits / over 10 (ten) billion tenges in case of financial performance of SChP (taking into account payback period, net profit, internal return rate, cash flows) showing lack of need for subsidizing of part of rate of remuneration on the credits / to financial leasing according to the Technique of assessment of financial performance of projects approved by internal regulating documents of the financial agency in coordination with authorized body on entrepreneurship refuse to the financial leasing directed to the investment purposes with loan amount subsidizing.";

state Item 9 in the following edition:

"9. Conditions of subsidizing of the SChP projects on conversion in agro-industrial complex, in processing industry and services:

Subsidizing is performed at the expense of the funds allocated for implementation of actions of the national project on development of the entrepreneurship for 2021 - 2025 approved by the order of the Government of the Republic of Kazakhstan of October 12, 2021 No. 728, and this mechanism.

Financing of subsidizing of rate of remuneration on the issued BVU, by LX and AKK to the credits / financial lysinedin of SChP is performed from means of the republican budget.

Subsidizing of projects on conversion in agro-industrial complex, in processing industry and services is performed on the credits / to leasing transactions with the nominal rate of remuneration which is not exceeding the base rate established by National Bank of the Republic of Kazakhstan and the difference increased by 4,5 (four and a half) percent points from which 13,25 of % is subsidized with the state and is paid by SChP. The projects approved before approval of the above-stated rate of remuneration act on earlier approved conditions with authorized body of the financial agency before complete execution by entrepreneurs of the obligations on them.

Subsidizing of projects in processing industry on OKED 1101 (distillation, rectification and mixing of alcoholic drinks) is performed on the credits / to leasing transactions with the nominal rate of remuneration which is not exceeding the base rate established by National Bank of the Republic of Kazakhstan and the difference increased by 4,5 (four and a half) percent points from which 13,25 of % is subsidized with the state and is paid by SChP. The projects approved before approval of the above-stated rate of remuneration act on earlier approved conditions with authorized body of the financial agency before complete execution by entrepreneurs of the obligations on them.

In case of reduction of the base rate established by National Bank of the Republic of Kazakhstan for December 6, 2022, the part of rate of remuneration subsidized by the state decreases on equivalent change, to the reduced value of base rate of National Bank of the Republic of Kazakhstan.

The term of subsidizing of the credits / financial leasing directed to investments constitutes no more than 5 (five) years without the prolongation right.

The term of subsidizing of the credits and financial leasing allocated for replenishment of current assets constitutes no more than 3 (three) years without the prolongation right.

The term of subsidizing of the credits / financial leasing according to the list of the key (priority) sectors of economy directed to investments according to appendix 3 to this mechanism, constitutes no more than 7 (seven) years, except for the projects provided by the seventh and eighth paragraphs of this Item.

Subsidizing of projects according to the list of key (priority) sectors of economy, according to appendix 3 to this mechanism, is performed on the credits / to leasing transactions with the nominal rate of remuneration which is not exceeding the base rate established by National Bank of the Republic of Kazakhstan and the difference increased by 4,5 (four and a half) percent points from which 13,25 of % is subsidized with the state and is paid by SChP.

In case of reduction of the base rate established by National Bank of the Republic of Kazakhstan for December 6, 2022, the part of rate of remuneration subsidized by the state decreases on equivalent change, to the reduced value of base rate of National Bank of the Republic of Kazakhstan.

The credits / the financial leasing directed to refinancing of credits/agreements of financial leasing, earlier approved/issued to BVU/LK, which is under sanctions and corresponding to the conditions specified in this mechanism are also subject to subsidizing.

At the same time refinancing is performed only at the expense of own means of BVU/LK.

Conditions, procedure and the mechanism of subsidizing, and also monitoring of implementable projects within this mechanism are regulated by Rules of subsidizing of part of rate of remuneration within the national project on development of entrepreneurship for 2021 - 2025.";

to be reworded as follows appendix 2 to the mechanism of crediting and financial leasing of priority projects according to appendix 1 to this resolution;

add with appendix 3 to the mechanism of crediting and financial leasing of priority projects according to appendix 2 to this resolution;

2) in the order of the Government of the Republic of Kazakhstan of December 31, 2019 No. 1060 "About some measures of the state support of private entrepreneurship":

in Rules of provision of portfolio subsidizing of part of rate of remuneration and partial guaranteeing on the credits/microcredits of subjects small, including microentrepreneurships, within the national project on development of entrepreneurship for 2021 - 2025, approved by the specified resolution:

third of Item 9 to state part in the following edition:

"For subjects of social entrepreneurship subsidizing and guaranteeing on credits/financing are performed without industry restrictions, except for activities of pawnshops, the microfinancial, factoring organizations and leasing companies, and with the nominal rate of remuneration which is not exceeding the base rate established by National Bank of the Republic of Kazakhstan and the difference increased by 7 (seven) percent points from which 16,75 of % is subsidized with the state and the entrepreneur pays.";

in the Rules of subsidizing of part of rate of remuneration within the national project on development of entrepreneurship for 2021 - 2025 approved by the specified resolution:

to state subitem 17-2) of Item 3 in the following edition:

"– the schedule signed within the agreement of bank loan / financial leasing between bank / leasing company and the borrower with separation on subsidized and not subsidized speak rapidly 17-2) payment schedule under the agreement of accession, approved according to the procedure, established by these rules of subsidizing;";
