About approval of Rules of forming, collection, storage, use and issue of data of National fund of space data
According to the subitem 12) of article 13 of the Law of the Republic of Kazakhstan "About geodesy, cartography and space data", the subitem 217) of Item 15 of the Regulations on the Ministry of the digital development, innovations and the aerospace industry of the Republic of Kazakhstan approved by the Order of the Government of the Republic of Kazakhstan of July 12, 2019 No. 501, I ORDER:
1. Approve the enclosed Rules of forming, collection, storage, use and issue of data of National fund of space data.
2. Recognize invalid some orders according to appendix to this order.
3. To provide to committee of geodesy and cartography of the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan;
3) within 10 (ten) working days after state registration of this order submission to Legal department of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.
4. To impose control of execution of this order on the supervising vice-minister of digital development, innovations and the aerospace industry of the Republic of Kazakhstan.
5. This order becomes effective after ten calendar days after day of its first official publication.

1. These rules of forming, collection, storage, use and issue of data of National fund of space data (further – Rules) are developed according to the subitem 12) of article 13 of the Law of the Republic of Kazakhstan "About geodesy, cartography and space data" (further – the Law), the subitem 2) of article 4 of the Law of the Republic of Kazakhstan "About National Archive Fund and archives" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" and determine procedure for forming, collection, storage, use and issue of data of National fund of space data (further – Fund).
Authorized body in the field of geodesy, cartography and space data within three working days from approval date or change of the subordinate regulatory legal act determining procedure for rendering the state service staticize information on procedure for its rendering and sends to Single contact center, to the operator of information and communication infrastructure of "the electronic government".
2. Data of Fund represent set of the geodetic, topographical, cartographic, hydrographic, aerokosmosjemochny, gravimetric materials and data obtained as a result of implementation of geodetic and cartographic activities and having nation-wide cross-industry, special and (or) industry values.
The specified data of Fund the list of materials and data according to appendix 1 to these rules is included.
3. Data of Fund on papers are created, systematized, considered, take place and stored on work types in the rooms (storages) which are specially adapted for this purpose.
Data of Fund in electronic form are stored in electronic system of Fund for storage and cataloguing of archives and space data, with indication of the location of data of Fund.
Interaction of Fund with subjects of geodetic and cartographic activities and submission of data are performed through geographical information system and (or) in paper form.
4. Data of Fund are created in the directions of geodetic and cartographic activities taking into account scales and terms of their storage.
Materials and data of Fund are registered and stored in electronic system of Fund for storage and cataloguing of archives and space data, with indication of the location of data of Fund.
The electronic system of Fund for storage and cataloguing of archives and space data provides centralized storage of all space data of Fund.
5. The subjects performing geodetic and cartographic activities shall represent gratuitously one copy of copies of the materials and data created by them at the expense of budgetary funds to Fund according to the legislation of the Republic of Kazakhstan on copyright and the related rights.
Materials and the supplied, containing information constituting the state secrets are contributed to Fund according to the procedure, established by the legislation of the Republic of Kazakhstan.
6. Data of Fund in graphical, digital, electronic, photographic, paper and other forms and types are subject to centralized state accounting and storage.
7. Reference of materials and data to structure of Fund, selection of materials and data on storage, and also their destruction on the expiration of storage durations are made based on state examination of value of documents.
8. Data of Fund are used for providing state bodies, physical persons and legal entities for the purpose of carrying out geodetic and cartographic works.
9. It is provided to state bodies of the data of Fund free of charge.
10. Data of Fund of office information of limited distribution are issued with the permission of the state body exercising public administration in the field of geodesy, cartography and space data.
Transfer of data of office information of limited distribution to state bodies, physical persons and legal entities is performed according to requirements of Rules of reference of the data to office information of limited distribution and work with it approved by the order of the Government of the Republic of Kazakhstan of June 24, 2022 No. 429.
10-1. The data of Fund constituting the state secrets are issued to state body or the organization, being customers of the works connected with use of the data constituting the state secrets (further – the customer) with the permission of the head of the state body exercising public administration in the field of geodesy, cartography and the space information supplied according to Rules of transfer constituting the state secrets in connection with accomplishment of the joint and other operations approved by the order of the Government of the Republic of Kazakhstan of May 31, 2001 No. 743 (further – Rules of transfer of the state secrets).
The customer transfers the data constituting the state secrets according to Rules of transfer of the state secrets, to physical persons and legal entities, in connection with accomplishment of joint and other operations, with the permission of state body at which disposal the corresponding data, and only at the amount necessary for accomplishment of these works are. At the same time before transfer of the data constituting the state secrets, the customer shall be convinced available at the organization of permission to work with use of data of the corresponding degree of privacy, and at physical persons – the corresponding admission.
11. Issue to subjects of geodetic and cartographic activities of data on geodetic and cartographic study of the area on sites of planned activities is the state service (further – the state service).
The list of the main requirements to rendering the state service are stated according to appendix 2 to these rules.
Service prices on submission of data of Fund it is estimated according to appendix 3 to these rules.
12. For receipt of the state service physical persons and legal entities (further – uslugopoluchatel) direct:
in the Republican state company on the right of economic maintaining "The national center of geodesy and space information" the Ministries of digital development, innovations and the aerospace industry of the Republic of Kazakhstan (further – the service provider):
1) for receipt of materials and geodetic data of office information of limited distribution:
the statement for receipt of materials and geodetic data of office information of limited distribution in paper form, according to appendix 4 to these rules;
payment document (receipt) on payment of the state service;
2) for receipt of materials and geodetic data of open use by means of the web portal of "the electronic government" www.egov.kz (further – the portal):
the statement for receipt of materials and geodetic data of open use in electronic form, according to appendix 6 to these rules;
payment document (receipt) on payment of the state service.
13. The service provider in day of receipt of the statement performs their acceptance, registration and sends to the employee of responsible structural division of the service provider (further – the worker of the service provider) for execution.
In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of applications and issue of results of rendering the state service is performed the next working afternoon.
Data on identity documents, on registration (re-registration) of the legal entity, registration of the individual entrepreneur, or on the beginning of activities as the individual entrepreneur, confirming payment (in case of payment through payment gateway of "the electronic government" (further - PShEP) the service provider receives documents from the corresponding state information systems through PShEP.
14. In case of delivery by uslugopoluchatel of the statement through the portal in "personal account" the status about adoption of the statement goes for rendering the state service, and also the notification with indication of date and time of receipt of result of rendering the state service.
15. The worker of the service provider from the moment of registration of a statement within three working days:
1) for receipt of materials and geodetic data of office information of limited distribution is determined by amount of works and the worker of the service provider within one working day prepares and sends inquiry for issue of data of office information of limited distribution to state body under which authority the specified data on geodetic and cartographic study of the area on sites of planned activities are (further – data).
The state body under which authority the specified data within two working days are from the moment of receipt of request sends to the service provider the affirmative or negative answer about opportunity or impossibility of issue of data of office information of limited distribution.
2) for receipt of materials and geodetic data of open use in the terms specified in Item 15 is determined by amount of works and sends the invoice for payment through the portal, to "personal account" of uslugopoluchatel.
In case of identification of the bases for refusal in rendering the state service the service provider notifies uslugopoluchatel on the provisional solution about refusal in rendering the state service, and also time and the place (method) of carrying out hearing for opportunity to express to uslugopoluchatel line item according to the provisional solution.
The notification on hearing goes in advance, but not later than three working days before completion of term of rendering the state service. Hearing is carried out no later than two working days from the date of the notification.
By results of hearing the service provider sends to state body under which authority the specified data request for receipt of the data requested by uslugopoluchatel are or creates motivated refusal in rendering the state service
The motivated refusal goes by means of the portal to "personal account" of uslugopoluchatel or through office of the service provider.
16. The worker of the service provider within one working day in case of affirmative answer sends to the terms specified in Item 15 to uslugopoluchatel the notification on need of payment for rendering the state service with indication of the invoice for payment (further – the notification).
In case of the address of uslugopoluchatel through the portal, the notification goes to "personal account" of uslugopoluchatel.
17. Uslugopoluchatel within two working days from the date of receipt of the notification performs payment for rendering the state service.
Payment for rendering the state service is made by cash or non-cash method through banks of the second level.
In case of the direction of the statement for receipt of materials and geodetic data of open use in electronic form by means of the portal payment for rendering the state service can be performed through PShEP.
18. In case of not payment by uslugopoluchatel of means for rendering the state service, the worker of the service provider directs within one working day, the motivated answer signed by the head of the service provider about refusal in rendering the state service, according to appendix 7 to these rules.
19. After provision by uslugopoluchatel of the payment document in the terms specified in Item 17 of these rules the worker of the service provider within eight working days starts matching, production of data and following the results of creates:
in case of the address on receipt of materials and geodetic data of office information of limited distribution of the data of office information of limited distribution;
in case of the address on receipt of materials and geodetic data of open use of the data of open use.
The worker of the service provider sends to uslugopoluchatel the notification of the readiness and the place of receipt of required data within one working day.
In case of the address of uslugopoluchatel by means of the portal the notification of the readiness and the place of receipt of required data goes to "personal account" of uslugopoluchatel.
Issue of ready data to uslugopoluchatel is performed by the service provider through Fund for presentation of the identity certificate or the electronic document from service of digital documents and (or) the power of attorney confirming powers of the representative.
20. The service provider provides entering of data on stage of rendering the state service into information system of monitoring of rendering the state services according to the procedure, established by authorized body in the field of informatization.
21. Consideration of the claim concerning rendering the state services is made by higher administrative authority, the official, authorized body by assessment and control of quality of rendering the state services (further – the body considering the claim).
The claim is submitted to the service provider and (or) the official whose decision, action (failure to act) are appealed.
The service provider, the official, whose decision, action (failure to act) are appealed, no later than three working days from the date of receipt of the claim send it and administrative case to the body considering the claim.
At the same time the service provider, the official whose decision, action (failure to act) are appealed, has the right not to send the claim to the body considering the claim if he within three working days adopts the favorable administrative act, will make administrative action, completely meeting the requirements specified in the claim.
If other is not provided by the laws of the Republic of Kazakhstan, appeal to the court is allowed after appeal in pre-judicial procedure.
The claim of uslugopoluchatel which arrived to the service provider is subject to consideration within five working days from the date of its registration.
The claim of uslugopoluchatel which arrived to body, considering the claim, is subject to consideration within fifteen working days from the date of its registration.

1. Engineering designs on accomplishment of land and cartographic works.
2. Technical reports, catalogs of coordinates and heights both other materials, and data on creation, development and maintenance in working order state leveling networks, geodetic networks of all classes and categories, gravimetric fundamental and first class of networks.
3. Primary and derivative materials and data of remote sensing of Earth (aerial photography and space shooting) for the purpose of ensuring geodetic and cartographic activities, and also the passport of aerial photography, data of special devices, schemes of cartographic binding of shootings.
4. Materials and data of geodynamic researches based on geodetic, gravimetric, space measurements.
5. Technical reports on surveys of the area (scale 1:2000 more small), including shelf of the seas, lakes, rivers and water storage basins.
6. Originals and copies of the state topographic maps, including the shelf of the seas, lakes, rivers, water storage basins, plans of the cities and settlements (scale 1:2000 more small) in graphical, digital, photographic, electronic forms, and also drawing prints of the specified maps and plans.
7. Originals of all-geographical, political and administrative, scientific and administrative, scientific and help and other thematic cards and atlases of nation-wide and cross-industry appointment, education cartographic guidances, drawing prints of the cartographic materials which are basis for creation of derivative products.
8. (Help) topographic maps on duty with documentation, including materials on establishment of frontier of the Republic of Kazakhstan and borders of administrative and territorial units and borders of foreign states.
9. The state catalog of place names and initial materials to it, dictionaries and reference books of names of geographical objects in the territory of the Republic of Kazakhstan, foreign states, continents and oceans.
10. Normative and technical documents in the field of geodetic and cartographic activities, archiving, the privacy mode.

Reception of an application and issue of result of rendering the state service is established from 9:00 to 17:30 o'clock with lunch break from 13:00 to 14:00 o'clock. The state service is rendered in turn, without making an appointment and the accelerated servicing; 2) the portal – round the clock, except for technical breaks in connection with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan and article 5 of the Law on holidays, reception of an application and issue of result of rendering the state service is performed the next working afternoon). 1.
