About approval of Rules of nuclear and radiation safety in transit radioactive materials (PBPRM-2006)

According to the Regulations on the State committee of nuclear regulation of Ukraine approved by the Presidential decree of Ukraine of March 6, 2001 N 155, and for the purpose of reduction of regulations concerning transportation of radioactive materials to requirements "Rules of safe transportation of radioactive materials. Edition of 2005. Series of regulations of safety of IAEA, NTS-R-1" I ORDER:

1. Approve Rules of nuclear and radiation safety in transit of radioactive materials (PBPRM-2006) (further - Rules) which are applied.

2. To management of guarantees and (Lopatin S. D.) to ensure safety of transportations provision of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.

3. To management of guarantees and (Lopatin S. D.) to ensure safety of transportations bringing to permission of the interested organizations of information on entry into force of Rules.

4. In a month after state registration to provide to the state company "The State Scientific and Technological Center on Nuclear and Radiation Safety" (Vasilchenko V. M.) replication of Rules.

5. To impose control of execution of the order on the vice-chairman - the Chief state inspector on nuclear safety of Ukraine Demyanenko A. I.

Rules of nuclear and radiation safety in transit radioactive materials (PBPRM-2006)

Section 1. Introduction

 

General provisions

1.1. These Rules are prepared within the Program of integration of Ukraine into the European Union approved by the Presidential decree of Ukraine of September 14, 2000 N 1072, with changes regulations of radiation safety of Ukraine answer regulations of the Laws of Ukraine "About use of nuclear energy and radiation safety", "About protection of the person against impact of ionizing radiation", to requirements of the State hygienic standard rates "(NRBU-97)", the approved order MZ of Ukraine of 14.07.97 N 208, of N62 enacted from 01.01.98 by the resolution of the Chief state health officer of Ukraine of 01.12.97 (further - to NRBU-97), and the Basic health regulations of ensuring radiation safety of Ukraine approved by the order MZ of Ukraine of 02.02.2005 of N 54, registered in the Ministry of Justice of Ukraine 20.05.2005 for N552/10832.

Rules correspond to the document "Rules of safe transportation of radioactive materials. Edition of 2005. Series of regulations of safety NTS-R-1. IAEA" ("Regulations for the Safe Transport of Radioactive Material. 2005 Edition. Safety Standards Series NTS-R-1. IAEA").

These Rules establish the safety regulations providing the acceptable level of control of the radiation, and also connected with criticality and heat release danger to personnel, property and the environment in transit of radioactive materials. In these Rules the principles stated in the publication "Radiation protection and safe handling of radiation sources are used. - Series of editions on safety N 120, IAEA, Vienna (1996)" and in the publication "The international main standards of safety for protection against ionizing radiation and for safety of sources of radiation. - Series of editions on safety N 115, IAEA, Vienna (1996)".

1.2. These Rules are supplemented with managements on safety and documents on practice of safety which correspond to documents of IAEA: "Reference material to Rules of IAEA on safe transportation of radioactive materials. Series of regulations on safety of IAEA of NTS-G-1.1 (ST-2)"; "Planning of actions and readiness on case of the transport accidents connected with radioactive materials. Series of regulations on safety of IAEA of NTS-G-1.2 (ST-3)"; "Ensuring compliance with Rules of safe transportation of radioactive materials. Series of regulations on safety of IAEA of NTS-G-1.4" and to the document "Quality assurances for safe transportation of radioactive materials. Series of regulations on safety of IAEA of NTS-G-1.3".

1.3. In some Sections of these Rules implementation of specific actions is attributed, however responsibility for their implementation is not conferred on certain legal entity. Distribution of such responsibility is determined by the current legislation of Ukraine.

 

Purpose

1.4. The purpose of these Rules - to provide protection of persons, property and the environment against impact of radiation during transportation of radioactive material. This protection is reached by obligatory application:

a) protective cover (sealing) for radioactive content;

b) control of the external level of radiation;

c) actions of prevention of criticality;

d) actions of prevention of damage to result of thermal impact.

Accomplishment of these requirements is provided:

a) by application of stupenchaty approach to limits of content of packagings and means of transportation, and also to normative characteristics of designs of packaging sets depending on danger which is constituted by radioactive content;

b) by establishment of requirements to design and operation of packagings, and also to servicing of packaging sets, including taking into account nature of radioactive content;

c) by obligatory application of measures of administrative control, including, when necessary, procedures of approval by competent authorities.

1.5. In transit radioactive materials safety of certain people from the population or professional workers (personnel) is provided by observance of these Rules. It is reached by means of quality assurance programs and programs of ensuring compliance with Rules.

 

Scope of application

1.6. These Rules are applied to transportation of radioactive materials automobile, railway, sea, river and by air, including the transportation connected with use of radioactive material. Transportation includes all transactions and conditions connected with movement of radioactive material and constitutes this process, in particular:

designing, production, servicing and repair of packaging set;

preparation, loading, sending, transportation, including transit storage, unloading and acceptance in final destination of loads of radioactive materials and packagings.

In case of accomplishment of regulations of these Rules stupenchaty approach which can be characterized three general levels of complexity is applied:

a) usual conditions of transportation (without any incidents);

b) normal conditions of transportation (insignificant incidents);

c) transportation emergencies.

1.7. These Rules do not extend on:

a) the radioactive materials which are integral part of means of transportation;

b) radioactive materials which move within any organization and fall under action of the corresponding safety rules existing in this organization when movement does not provide use of automobile ways or the railroads public;

c) the radioactive materials implanted or entered into human body or animal for the purpose of diagnostics or treatment;

d) the radioactive materials containing in the consumer goods allowed by regulating authority to use after their sale to the end user;

e) the natural materials and ores containing natural radionuclides which or are in their natural state or were processed for the purposes of others, than for production of radionuclides and which are not provided to be overworked for the purpose of use of these radionuclides provided that specific activity of material does not exceed more than by 10 times of value specified in Items 4.2 b and 4.7 or calculated according to items 4. 3, 4.5 and 4.6;

f) the non-radioactive firm objects with radioactivity which is present at any surfaces at the quantity which is not exceeding the levels determined in Item 2.25.

1.8. These Rules do not provide such actions of control as the choice of route or ensuring physical protection which can take root for the reasons which are not connected with radiation safety. Any such actions of control shall consider radiation and not radiation hazard without variations from safety regulations which are established by these Rules.

1.9. The corresponding rules of transportation of dangerous goods which act on this mode of transport shall be applied to the radioactive materials having additional danger and also during transportation of radioactive materials together with other dangerous goods in addition to these Rules.

 

Structure

1.10. Within the structure these Rules contain:

Section 2: terms and determinations which are applied in Rules;

Section 3: general provisions of rather radiation protection, emergency actions, quality assurance, ensuring compliance with Rules, discrepancy to Rules, special conditions, training;

Section 4: determination, classification and requirements to radioactive materials;

Section 5: determination, classification and requirements to packaging sets;

Section 6: preparation of radioactive materials for transportation, in particular choice of the corresponding packaging set, packing, determination of category, drawing signs of danger and marking, filling of the transportation documentation;

Section 7: requirements to sending, transportation, transit storage of packagings;

Section 8: requirements to testing;

Section 9: requirements concerning approval and administrative control.

1) Section 2. Terms and determinations

In these Rules such determinations are applied:

Alpha emitters of low toxicity (Low toxicity alpha emitters)

2.1. Alpha emitters of low toxicity - natural uranium; depleted uranium; natural thorium; uranium-235 or uranium-238; thorium-232; thorium-228 and thorium-230, that contain in ores, or in the form of physical and chemical concentrates; or alpha emitters with half-life period it is less than 10 days.

Consignment

2.2. Load - any packaging or any packagings, or any batch of radioactive material provided by the consignor for transportation.

Cargo container (Freight container)

2.3. Cargo container - the transport equipment designed for simplification of transportation of the packed or unpacked cargoes by one or several modes of transport without intermediate overload of the loads placed in it which shall not open self-willedally shall be rather tough and strong for reuse and shall be equipped with the devices facilitating work with it, especially in case of overload from one funds of transportation for another or from one mode of transport on another. The small cargo container is container, any of outside dimensions of which does not exceed 1,5 of m or the unobstructed capacity of which makes no more than 3 cubic meters. Any other cargo container is considered large cargo container.

Consignor

2.4. The consignor - any legal entity or physical person preparing load for transportation.

Consignee

2.5. The consignee - any legal entity or physical person receiving load.

Exclusive use (Exclusive use)

2.6. Exclusive use - use only by one consignor of means of transportation or large cargo container concerning which all initial, intermediate and final transactions of loading and unloading are performed according to instructions of the consignor or consignee.

Ensuring compliance with Rules (Compliance assurance)

2.7. Ensuring compliance with Rules - the program of systematic actions which are performed by competent authority for the purpose of ensuring accomplishment of provisions of these Rules in practice.

Quality assurance

2.8. Quality assurance - the program of systematic actions of control and inspections which is performed by any organization or body which are taking part in transportation of radioactive materials, and aimed at providing sufficient confidence that safety regulations which are attributed by these Rules, adhere in practice.

Means of transportation (Conveyance)

2.9. Means of transportation means:

a) for transportation by highways or the railroad - any vehicle;

b) for transportation by water roads - any vessel or any hold, compartment or the designated part of the deck of the vessel;

c) for transportation by air - any aircraft.

Approval

2.10. Multilateral approval (Multilateral approval) approval of country of source of design by the relevant competent authority or transportations in appropriate case and also in case the load be transported through the territory or on the territory of any other country, approval of this country by competent authority. The terms "through the territory or on the territory" specially do not join the concept "over the territory", i.e. requirements about approval and the message shall not extend to the country over which territory radioactive material onboard the aircraft is transported provided that in this country the planned landing is not provided.

2.11. Unilateral approval (Unilateral approval) approval of design which is required from competent authority only of country of source of this design.

Competent authority (Competent authority)

2.12. Competent authority - any national or international regulating authority or the organization given authority for any purpose in connection with these Rules or otherwise acknowledged as such.

According to the Regulations on the State committee of nuclear regulation of Ukraine approved by the Presidential decree of Ukraine of March 6, 2001 N 155, functions of competent authority are performed by the State committee of nuclear regulation of Ukraine (daleegosatomregulirovaniye of Ukraine).

Design

2.13. Design - the description of radioactive material of special form, radioactive material with low capability to dispersion, packaging or packaging set which gives opportunity completely to identify them. This description can include the specifications, technical documentation (drawing), reports confirming observance of the regulating requirements, and also other corresponding documentation.

Container of average load-carrying capacity for bulk goods (Intermediate bulk container)

2.14. Container of average load-carrying capacity for bulk goods (IBC) - portable packaging set, which:

a) no more than 3 CBM have amount;

b) has the design giving opportunity to perform cargo operations using heavy lift gears;

c) steady against the loadings arising during cargo operations and transportation of goods as it is determined by testing for confirmation of work characteristics;

d) designed according to the regulations stated in the Section devoted to recommendations for containers of average load-carrying capacity for bulk goods (IBC), the document "by Recommendations on the Transport of Dangerous Goods, Ninth Revised Edition (ST/SG/AC.10/1/Rev. 9), UN, New York and Geneva (1995)".

Maximum normal working pressure (Maximum normal operating pressure)

2.15. The maximum normal working pressure - the maximum pressure exceeding atmospheric pressure at sea level which can arise in system of protective cover within one year in the conditions of the temperature condition and solar radiation corresponding to surrounding conditions without aeration or dumping of excessive pressure, outside chilling by means of additional system or without measures of operational control during transportation.

Unirradiated uranium (Unirradiated uranium) 3

2.16. Unirradiated uranium - the uranium containing no more than 2x10 Bq of the 6th plutonium on gram of uranium-235, is no more than 9x10 Bq of fission products on-3 grams of uranium-235 and no more than 5x10 g of uranium-236 on uranium-235 gram.

Unirradiated thorium (Unirradiated thorium)-7

2.17. Unirradiated thorium - thorium which contains no more than 10 g of uranium-233 on thorium-232 gram.

Unstable radioactive pollution (Non-fixed contamination)

2.18. Unstable radioactive pollution - radioactive pollution which can be eliminated from surface in case of usual conditions of transportation.

Carrier (Carrier)

2.19. Carrier - any legal entity or physical person transporting radioactive material any kind of transport.

Specific activity (Specific activity)

2.20. Specific activity of radionuclide - activity per unit mass this radionuclide. Specific activity of material - activity per unit mass material in which radionuclides are generally distributed regularly.

Aircraft

2.21. The cargo aircraft (Cargo aircraft) - any aircraft, except the passenger aircraft, transporting loads or property.

2.22. The passenger aircraft (Passenger aircraft) the aircraft transporting any person except crew members, employees working for carrier and being on duty, the authorized representative of the relevant national authority or person accompanying load.

The designated part of the deck (Defined deck area)

2.23. The designated part of the deck - part of the main deck of the vessel or the deck for vehicles of the rolling vessel or the ferry boat on which the place for placement of radioactive materials is allocated.

Program of radiation protection (Radiation Protection Programme)

2.24. The program of radiation protection - systematic actions which purpose is ensuring proper planning and accounting of actions of radiation protection.

Radioactive pollution (Contamination)

2.25. Radioactive pollution - radioactivity availability on surface in the quantities exceeding 0,4 of Bq/quarter of cm for beta and gamma-emitters and for alpha emitters of low toxicity or 0,04 of Bq/quarter of cm for all other alpha emitters.

Radioactive content (Radioactive contents)

2.26. Radioactive content - radioactive material together with any is radioactive the contaminated or activated solid substances, liquid and gases which contain in packaging set.

Tank

2.27. The tank - container tank, the portable tank, truck tank, the cistern car or reception reservoir capacity is at least 450 liters for liquids, powders, granules, mixes or solid substances which when filling are in gaseous or liquid type both afterwards harden, and at least than 1000 liters for gases. The container tank shall be suitable for transportation by overland and water roads, for filling and emptying without withdrawal of its constructional equipment, shall have the stabilizing elements and outside fixing devices and to be suitable for rise in the filled condition.

Level of the radiation (Radiation level)

2.28. Radiation level - the corresponding capacity of dose expressed in millisieverts an hour.

System of protective cover (sealing) (Containment system)

2.29. System of protective cover (sealing) - the system of elements of packaging set determined by the designer as the system intended for content of radioactive material during transportation.

System of localization (Confinement system)

2.30. System of localization - the system of placement of divisible material and elements of packaging set determined by the designer and approved by competent authority as the system intended to ensure safety on criticality.

Special conditions (Special arrangement)

2.31. Special conditions - the conditions approved by competent authority according to which loads, unsatisfactory all applicable requirements of these Rules can be transported.

Vessel

2.32. The vessel - any ocean ship or means for swimming by inland waterways which is used for cargo hauling (the self-propelled or not self-propelled floating construction which is used or can be used as means for transportation of goods).

Vehicle

2.33. The vehicle - the road vehicle (the constituted vehicle, i.e. the tractor with semitrailer truck, inclusive) either railway platform or the rail car. Each trail car shall be considered as the separate vehicle.

Transport packet (Overpack)

2.34. Transport packet - the means (cover), for example box, box or sack intended for placement and laying of one or several packagings for the purpose of forming of separate unit of cargo which is applied by one consignor to convenience in case of cargo operations and transportation.

Shipment

2.35. Transportation - special movement of load from the place of its origin to the destination.

The natural uranium which is grown poor, enriched (Uranium - natural, depleted, enriched)

2.36. Natural uranium - the uranium (which can be chemically allocated) containing natural mix of isotopes of uranium (approximately 99,28 of % of uranium-238 and 0,72 of % of uranium-235 on weight).

Depleted uranium - the uranium containing smaller amount of uranium-235 in percentage expression on weight in comparison with natural uranium.

Enriched uranium - the uranium containing amount of uranium-235 in percentage expression on weight is more than % 0,72. In all cases there is very small at percentage expression on weight amount of uranium-234.

The fixed radioactive pollution (Fixed contamination)

2.37. The fixed radioactive pollution - the radioactive pollution which is not unstable radioactive pollution.

Section 3. General provisions

Radiation protection

3.1. Doses of individual radiation shall not exceed the corresponding limits of doses. Protection and safety shall be optimized so that the size of individual doses, number of persons which are exposed to radiation, and probability of radiation kept at reasonably accessible low level taking into account economic and social factors, within restriction which comes down to the fact that the doses received by individuals fall under limiting action of doses. It is necessary to apply structural and system approach in which the interrelation of transportation with other types of activity is considered.

3.2. The program of radiation protection shall be developed for transportation of radioactive materials. Nature and scales of actions which are provided in the program depend on size and probability of radiation. The program shall consider the requirements stated in Items 3. 1, 3.3-3.5 and 3.11. Documents of the program shall be provided on demand for check which is carried out by Gosatomregulirovaniya of Ukraine.

3.3. In case of professional radiation in case of performance of works, connected with transportation when according to total assessment the effective dose can reach:

a) 1-6 мЗв in year - it is necessary to perform programs of assessment of doses by radiation control of workplaces or individual radiation control;

b) more than 6 мЗв in year - it is necessary to carry out individual radiation control.

Individual radiation control or radiation control of workplaces is documentary drawn up according to requirements of Item 14.5 of the Basic health regulations of ensuring radiation safety of Ukraine.

 

Emergency actions

3.4. In case of accidents or incidents during transportation of radioactive materials it is necessary to observe the procedures of the relevant national and/or international organizations established on case of accidents for the purpose of ensuring protection of people, property and the environment. Instructions concerning such procedures contain in the Provision concerning planning of actions and actions on case of accidents during transportation of radioactive materials approved by Gosatomregulirovaniya's order of Ukraine of 07.04.2005 of N 38, registered in the Ministry of Justice of Ukraine 22.04.2005 for N431/10711.

3.5. Emergency procedures shall consider possibility of formation of other dangerous substances owing to interaction of content of load with the environment in case of accident.

 

Quality assurance

3.6. Quality assurance programs shall be developed and performed concerning designing, production, testing, development of documentation, use, servicing and inspections concerning all radioactive materials of special form, radioactive materials with low capability to dispersion and packagings, and also rather transport transactions and transit storage for the purpose of ensuring accomplishment of relevant provisions of these Rules. The producer, the consignor or the user shall give to Gosatomregulirovaniya of Ukraine opportunity to perform during production or use and to show that:

a) methods which are applied to production and materials correspond to specifications for the approved design;

b) all packaging sets are periodically checked, if necessary are repaired and contain as appropriate to continue to meet all relevant requirements and specifications even after reusable use.

In case of approval according to Item 9.2 of Gosatomregulirovaniya of Ukraine it is necessary to consider availability of the quality assurance program and its adequacy.

 

Ensuring compliance with rules

3.7. Gosatomregulirovaniya of Ukraine bears responsibility for ensuring compliance with these Rules. Implementers of this responsibility include development and implementation of the program of control of designing, production, testing, inspection and servicing of packaging sets, radioactive materials of special form and radioactive materials with low capability to dispersion, and also behind preparation of packagings, documentation, processing and laying of packagings by consignors and carriers for confirmation of accomplishment of provisions of these Rules in practice.

3.8. The Ministry of Health of Ukraine (further - MZ of Ukraine) and Gosatomregulirovaniya of Ukraine exercise selective control of the doses of radiation received in connection with transportation of radioactive materials to be convinced that the system of protection and safety correspond to NRBU-97.

 

Discrepancy to rules

3.9. In case of discrepancy of levels of radiation or radioactive pollution to any limits set by these Rules (except as specified accidents during transportation):

a) the consignor shall be informed on discrepancy:

i) carrier if discrepancy is revealed during transportation;

ii) the consignee, if discrepancy is revealed in case of receipt of load;

b) the carrier, the consignor or the consignee according to the competence shall:

i) take immediate measures to reduce discrepancy effects;

ii) investigate discrepancy and its reasons, circumstance and effect;

iii) take adequate measures for elimination of the reasons and circumstances which resulted in discrepancy and to prevent their repeating;

iv) report in Gosatomregulirovaniya of Ukraine about the reasons of discrepancy and the adjusting or preventive measures which were or will be accepted;

c) the message on discrepancy needs to be sent to the consignor and to Gosatomregulirovaniya of Ukraine as soon as possible in each case when there is emergency radiation.

 

Special conditions

3.10. Loads concerning which it is practically impossible to reach compliance to provisions of these Rules need to be transported only under special conditions. If as Gosatomregulirovaniya of Ukraine it is recognized that compliance to provisions of these Rules cannot be reached practically and that the obligatory rules of safety established by these Rules are respected by application of the means alternative to provisions of these Rules, then Gosatomregulirovaniya of Ukraine can approve transactions on transportation under special conditions of separate cargo or the planned series of several loads. General level of safety in transit shall be equivalent at least to the level which would be provided in case of accomplishment of all applied requirements. For international cargoes of this kind multilateral approval is required.

 

Training

3.11. Professional workers (personnel) shall have the corresponding preparation on radiation protection, including ogovorochny actions to which it is necessary to adhere to reduce professional radiation to which they are exposed and radiation of other persons who could suffer as a result of their actions.

3.12. Persons involved in transportation of radioactive materials shall be trained concerning requirements of these Rules in the part concerning obligations of these persons.

3.13. Persons, which:

classify radioactive materials;

pack radioactive materials;

apply marking and signs of danger on packagings;

prepare transport documents on radioactive materials;

send or accept radioactive materials for transportation;

move or handle radioactive materials during transportation;

mark or put precautionary signs, load or unload packagings on / or from means of transportation;

fill packaging sets or cargo containers;

are otherwise directly involved in transportation of radioactive materials as these it is determined by competent authority, shall undergo the following training:

a) general fact-finding training:

i) each person shall be trained, the providing acquaintance with general provisions of these Rules;

ii) such training shall include the description of types of radioactive materials; requirements to drawing signs of danger, marking, precautionary signs; requirements to packaging sets and to separation in case of placement of radioactive materials; the description is more whole also than contents of transport documents on radioactive materials; the description of the available documents of response to emergency;

b) functional and specialized training:

each person shall undergo the detailed training concerning specific requirements in transit of the radioactive materials applicable to activities of this person;

c) training in safety issues:

taking into account risk of radiation in case of leakage of radioactive materials and job responsibilities, each person shall be trained on:

i) to methods and procedures which need to be applied to avoidance of accident, such as the correct use of the cargo equipment and the corresponding methods of laying of radioactive material;

ii) information of rather emergency reaction and its use;

iii) to the general possible dangers connected with different types of radioactive materials and methods of prevention of radiation in case of such dangers, including if it is necessary, use of individual protection equipment and the equipment;

iv) to immediate procedures which shall be applied in case of accidental release of radioactive material, including any procedures of immediate response to emergency for which person is responsible, and also procedures of individual protection to which it is necessary to adhere.

3.14. Training which is required according to Item 3. 13, it shall be provided or confirmed in case of position assignment, connected with transportation of radioactive materials, and it shall be supplemented periodically with retraining according to the established requirements.

Training programs shall be approved with Gosatomregulirovaniya of Ukraine.

Section 4. Requirements to radioactive materials

Determination of radioactive material

4.1. Radioactive material - any material containing radionuclides in which specific activity, and also total activity of load exceed the values specified in Items 4.2-4.7.

Major importances for radionuclides

4.2. Such major importances for separate radionuclides are given in tab. 1:

a) And yes And in TBK, 1 2

where A - value of activity of radioactive material of special 1 form which is specified in tab. 1 or is determined according to provisions of Items 4.3-4.7 and used in case of determination of limits of activity for requirements of these Rules,

A - value of activity of other radioactive material 2 (radioactive materials of other form) which is specified in tab. 1 or is determined according to provisions of Items 4.3-4.7 and used in case of determination of limits of activity for requirements of these Rules;

b) specific activity for materials to which full relief, in Bq/g extends;

c) activity limits for loads to which full relief, in Bq extends.

Determination of major importances for radionuclides

4.3. rather separate radionuclides which are not listed in the tab. 1, determination of major importances about which it is in Item

4. 2, requires multilateral approval. It is allowed to use the value A calculated with use of dose per unit of 2 inhalation receipts (dose coefficient according to the tab.
