About approval of Rules of licensing of activities for digital mining

According to the subitem 6) of Item 1 of article 4 of the Law of the Republic of Kazakhstan "About digital assets in the Republic of Kazakhstan" I ORDER:

1. Approve the enclosed Rules of licensing of activities for digital mining (further – Rules).

2. To provide to development department of the electronic industry and the industry of digital assets of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of digital development, innovations and the aerospace industry of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication, except for Item 7, of the subitem 3) of Item 9 and the subitem 2) of Item 10 of appendix 3 and the subitem 4) of Item 1 of appendix 11 to Rules which become effective since January 1, 2024.

Rules of licensing of activities for digital mining

Chapter 1. General provisions

1. These rules of licensing of activities for digital mining (further - Rules) are developed according to the subitem 6) of Item 1 of article 4 of the Law of the Republic of Kazakhstan "About digital assets in the Republic of Kazakhstan" (further - the Law), the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further - the Law on the state services), the subitem 4) of Item 1 of article 12 of the Law of the Republic of Kazakhstan "About permissions and notifications" (further - the Law on permissions and notifications) and determine procedure for licensing of activities for digital mining and procedure for rendering the state service "Licensing of Activities for Digital Mining" (further - the state service).

2. In these rules the following concepts are used:

1) qualification requirements – set of the quantitative and high-quality standard rates and indicators characterizing capability of the applicant and uslugopoluchatel to be engaged in the separate licensed type of activity and (or) subspecies of the licensed type of activity, shown as when licensing and (or) appendices to the license, and throughout the entire period of time of its reality;

2) the license – the permission of the first category issued by the licensor to physical person or legal entity, and also branch of the foreign legal entity which object of activity is rendering financial services, on implementation of the licensed type of activity or subspecies of the licensed type of activity connected with the high level of danger;

3) authorized body in the field of digital assets (further – the service provider) – the central executive body performing management and cross-industry coordination in the field of digital assets;

4) digital mayner – the individual entrepreneur or the legal entity of the Republic of Kazakhstan performing activities for digital mining;

5) digital mining – the process of carrying out computing transactions with use of computer capacities according to the set algorithms of enciphering and data processing providing confirmation of integrity of blocks of data by means of blokcheyn;

6) the web portal of "the electronic government" www.egov.kz – the object of informatization representing "single window" of access to all consolidated government information including the regulatory legal base, and to the state and other services rendered electronically;

7) data-processing center of digital mining – the object of information and communication infrastructure consisting of the hardware and software for the digital mining and the factory building located out of the territory of the living area, using electrical energy according to the Law of the Republic of Kazakhstan "About power industry";

8) the digital signature (further – the EDS) – set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

Chapter 2. Procedure for licensing of activities for digital mining

3. The license for activities on digital mining is granted on the following subspecies:

The I subspecies – implementation of activities for digital mining the digital mayner having data-processing center of digital mining on the property right or other legal causes;

The II subspecies – implementation of activities for digital mining the digital mayner who does not have data-processing center of digital mining on the property right or other legal causes and performing digital mining with use of the hardware and software belonging to it on the property right for the digital mining placed in data-processing center of digital mining.

4. For receipt of the state service individual entrepreneurs or legal entities (further – uslugopoluchatel), send through the web portal of "the electronic government" www.egov.kz, www.elicense.kz (further – the portal) to the service provider the statement for receipt of the state service in forms, according to appendices 1 and 2 to these rules with application of documents and the data of the main requirements to rendering the state service stated the List according to appendix 3 to these rules (further – the List).

5. In case of delivery the uslugopoluchatel of documents in "personal account" displays the status about acceptance of request for rendering the state service, and also the notification with indication of date and time of receipt of result of rendering the state service.

In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of applications and issue of results of rendering the state service is performed the next working afternoon.

6. The office of the service provider in day of receipt of the statement and documents performs their acceptance and registration.

7. The service provider within 2 (two) working days from the moment of document registration checks their completeness.

In case of representation uslugopoluchately incomplete document package and (or) documents the expired effective period, the worker of the service provider directs to the specified time to uslugopoluchatel motivated refusal in further review applications.

8. By provision uslugopoluchately complete document package and (or) data the worker of the service provider within 13 (thirteen) working days checks compliance of the documents submitted by uslugopoluchatel to qualification requirements for implementation of activities for digital mining and the list of the documents confirming compliance to them approved by the order of the acting minister of digital development, innovations and the aerospace industry of the Republic of Kazakhstan of April 26, 2023 No. 165/Tax Code (it is registered in the Register of state registration of regulatory legal acts for No. 32416) according to subitem 1-1) of Item 1 of article 12 of the Law on permissions and notifications and on compliance to requirements of these rules.

9. By results of verification of documents of uslugopoluchatel, and also in the absence of the bases for refusal, the executive in charge of the service provider in the specified time draws up the license on implementation of activities of digital mining in form according to appendices 4 and 5 (further – the license) and (or) appendix to the license in form according to appendices 6 and 7 (further – appendix to the license) to these rules and goes to "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the authorized person of the service provider.

10. In case of identification of the bases for refusal in licensing the service provider notifies uslugopoluchatel on the provisional solution about refusal in licensing, and also time and the place (method) of carrying out hearing for provision to uslugopoluchatel of opportunity to express line item according to the provisional solution.

The notification on hearing goes at least in 3 (three) working days prior to completion of term of rendering the state service. Hearing is carried out no later than 2 (two) working days from the date of the notification.

By results of hearing of uslugopoluchatel by the executive in charge of the service provider the license and (or) appendix to the license or motivated refusal in rendering the state service in form is drawn up, according to appendix 8 to these rules and goes to "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the authorized person of the service provider.

11. Renewal of the license on implementation of activities of digital mining is made on the bases and according to the procedure, established by articles 33 and 34 of the Law on permissions and notifications.

12. For renewal of the license and (or) appendix to the license individual entrepreneurs or legal entities send through the portal to authorized body in the field of digital assets:

the statement for receipt of the state service in forms, according to appendices 9 and 10 to these rules with application of documents and the data stated the List.

13. The office of the service provider in day of receipt of the statement and documents performs their acceptance and registration.

14. The service provider within 1 (one) working day from the moment of document registration checks their completeness.

In case of representation uslugopoluchately incomplete document package and (or) documents with the expired effective period, the worker of the service provider directs to the specified time to uslugopoluchatel motivated refusal in further review applications.

15. In case of representation uslugopoluchately complete document package the service provider considers the submitted documents within 2 (two) working days from the moment of document registration on compliance to requirements of these rules for renewal of the license and/or appendix to the license.

Following the results of verification of the documents specified in the subitem 2) of Item 9 of the list of the main requirements to rendering the state service, data and (or) proper document creation the employee of the service provider within 2 (two) working days from the moment of registration renews the license or prepares motivated refusal in renewal of the license and sends to "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the authorized person of the service provider.

16. In case of change of information on implementation of the activities of digital mining through digital mayningovy pool provided in the subitem 3) of Item 1 and the subitem 2) of Item 2 in the form of data to qualification requirements on implementation of activities for digital mining and the list of the documents confirming compliance to them according to appendix 11 to these rules, the digital mayner within 2 (two) working days notifies on it authorized body in the field of digital assets by means of information system.

17. The service provider grants to uslugopoluchatel the license in the Kazakh and Russian languages.

18. The service provider provides entering of data on stage of rendering the state service into information system of monitoring of rendering the state services according to the procedure, established by authorized body in the field of informatization.

When rendering the state service by means of the state information system of permissions and notifications, data on stage of its rendering arrive in the automatic mode in information system of monitoring of rendering the state services.

18-1. Suspension, action renewal, deprivation of the license and (or) appendix to license for activities on digital mining is made on the bases, the stipulated in Article 9 Laws and article 45 of the Law on permissions and notifications.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of service providers and (or) officials concerning rendering the state service

19. Consideration of the claim concerning rendering the state services is made by higher administrative authority, the official, authorized body by assessment and control of quality of rendering the state services (further – the body considering the claim).

The claim is submitted to the service provider and (or) the official whose decision, action (failure to act) are appealed.

20. The service provider, the official, whose decision, action (failure to act) are appealed, no later than three working days from the date of receipt of the claim send it and administrative case to the body considering the claim.

At the same time, according to item 4 of Article 91 of the Administrative procedural Procedure Code of the Republic of Kazakhstan the service provider, the official whose the administrative act, administrative action (failure to act) are appealed has the right not to send the claim to the body considering the claim if he within 3 (three) working days adopts the favorable administrative act, will make administrative action, completely meeting requirements specified in the claim.

21. The claim of uslugopoluchatel which arrived to the service provider according to Item 2 of article 25 of the Law on the state services is subject to consideration within 5 (five) working days from the date of its registration.

22. The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within 15 (fifteen) working days from the date of its registration.

23. If other is not provided by the law, appeal to the court is allowed after appeal in pre-judicial procedure. If the law provides possibility of appeal to the court without the need for appeal in higher body, administrative authority, the official, the administrative act, administrative action (failure to act) of which are disputed, along with response bring motivated line item of the head of higher administrative authority, the official into court.

8	Working schedule	1) the service provider – Monday through Friday from 9:00 till 18:30 o'clock with lunch break from 13:00 till 14:30 o'clock, except days off and holidays; 2) the portal – round the clock, except for the technical breaks connected with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays reception of applications and issue of results of rendering the state service is performed the next working afternoon).
9	List of documents	1) for receipt of the license: the statement in form according to appendices 1 or 2 to these rules; form of data to qualification requirements on implementation of activities for digital mining and the list of the documents confirming compliance to them according to appendix 11 to these rules. 2) in case of renewal of the license: the statement in form according to appendix 9 and 10 to these rules; copies of the documents containing information on changes, which formed the basis for renewal of the license, except for documents from which information contains in the state information systems. The service provider receives through lock of "the electronic government" the following data about: 1) identity documents; 2) registration (re-registration) of the legal entity, registration of the individual entrepreneur, or about the beginning of activities as the individual entrepreneur; 3) information on payment in the budget of the license fee.
10	The bases for refusal in rendering the state service established by the laws of the Republic of Kazakhstan	1) occupation type of activity is forbidden by the laws of the Republic of Kazakhstan for this category of physical persons or legal entities; 2) the license fee is not brought; 3) the uslugopoluchatel does not conform to qualification requirements; 4) concerning uslugopoluchatel there is decision (sentence) of court on suspension or prohibition of activities, or the separate types of activity which are subject to licensing took legal effect; 5) court based on representation of the legal executive the uslugopoluchatelyu-debtor is temporarily forbidden to grant the license; 6) unauthenticity of the documents submitted by uslugopoluchatel for receipt of the license, and (or) these (data) containing in them is established; 7) discrepancy of uslugopoluchatel and (or) the provided materials, objects, supplied and the information necessary for rendering the state service, to the requirements established by these rules; 8) lack of consent of the uslugopoluchatel provided according to article 8 of the Law of the Republic of Kazakhstan "About personal data and their protection" on access to personal data of limited access which are required for rendering the state service.
11	Other requirements taking into account features of rendering the state service including rendered electronically	1. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of portal "personal account", and also single contact center. 2. Uslugopoluchatel receives the state service electronically through the portal on condition of EDS availability. 3. Contact telephone numbers of service desks concerning rendering the state service are specified on Internet resource of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan to moap@mdai.gov.kz. 4. Uslugopoluchatel obtains information on procedure and the status of rendering the state service of open use in the mode of remote access by means of portal "personal account", and also single contact center. 5. Form of data to qualification requirements on implementation of activities for digital mining and the list of the documents confirming compliance to them

1. For the digital mayner having data-processing center of digital mining on the property right or other legal causes – І subspecies:

1) information on availability on the property right or other legal cause of data-processing center of digital mining (the electronic copy of the document confirming availability on the property right or on other legal cause of data-processing center of digital mining with indication of the location of data-processing center);

2) information on arrangement of data-processing center of digital mining out of the living area (the electronic document confirming arrangement of data-processing center of digital mining out of the living area: the guaranteed letter in any form);

3) information on implementation of activities of digital mining through digital mayningovy pool (the electronic document confirming implementation of activities of digital mining through digital mayningovy pool in case of accredited mayningovy pools in the territory of the Republic of Kazakhstan (in the presence on the property right or other legal causes of the hardware and software for digital mining): the reference, the written answer or the electronic copy of the agreement signed with digital mayningovy pool);
