RESOLUTION OF BOARD OF THE PENSION FUND OF UKRAINE

About approval of Changes in Regulations on the organization of acceptance and servicing of persons addressing to bodies of the Pension fund of Ukraine

According to Items 9, 10 Regulations On the pension fund of Ukraine, the Cabinet of Ministers of Ukraine approved by the resolution of July 23, 2014 280, the Board of the Pension fund of Ukraine DECIDES: No.

1. Approve changes in Regulations on the organization of acceptance and servicing of persons addressing to bodies of the Pension fund of Ukraine approved by the resolution of Board of the Pension fund of Ukraine of July 30, 2015 No. 13-1, registered in the Ministry of Justice of Ukraine on August 18, 2015 at No. 991/27436, which are applied.

2. To department of provision of pensions, insurance payments, social services, housing subsidies and privileges () submit to Okhrimenko A. this resolution on state registration to the Ministry of Justice of Ukraine.

3. This resolution becomes effective from the date of its official publication, except the paragraph of the third subitem 2 of Item 1 of Changes in Regulations on the organization of acceptance and servicing of the persons addressing to bodies of the Pension fund of Ukraine, approved by this resolution which becomes effective at the same time with entry into force of the Law of Ukraine of December 01, 2022 No. 2801-IX "About modification of some legal acts of Ukraine concerning ensuring agreement signature between Ukraine and the European Union about mutual recognition of qualified electronic confidential services and implementation of the European Union law in the field of electronic identification".

Changes in the Regulations on the organization of acceptance and servicing of persons addressing to bodies of the Pension fund of Ukraine

1. In the Section I:

The word "Telecommunications" to replace 1) in Item 1 with the word of "technical means of electronic communications";

2) in Item 2:

in paragraph three:

shall be replaced with words the words "About Electronic Confidential Services" "About electronic identification and electronic confidential services";

after the words "About Personal Data Protection" to add with words "(further - the Laws)";

add after the paragraph of the fifth with paragraphs the sixth or ninth the following content:

"electronic case of the receiver of privileges for payment of housing and communal services, acquisition of solid fuel and the liquefied gas in cash (further - electronic case of the receiver of privileges) - set of information which is processed based on centralized information technologies in the form of electronic data for ensuring accounting, appointment, calculation/recalculation, not appointments and payments of privilege for payment of housing and communal services, acquisition of solid fuel and the liquefied gas in cash (further - privilege) is created and conducted according to requirements of the Laws, including obligatory information on passport data of the exempt, registration number of accounting card of the taxpayer, the address of the declared (registered) residence (stay) or the address of the actual residence, the document confirming the right to privileges, copies of documents based on which the privilege is appointed and its payment is made; the list of housing and communal services on which the privilege, other information taking into account which the size of the appointed privilege and the size of privilege to payment since its appointment before solution of the case of the receiver of privilege is determined is provided;

electronic case of the receiver of subsidy for expense recovery for payment of housing and communal services, acquisition of the liquefied gas, solid and liquid oven household fuel (further - electronic case of the receiver of housing subsidy) - set of information which is processed based on centralized information technologies in the form of electronic data for ensuring appointment/not appointment of refusal in appointment, calculation/recalculation and subsidy payment for expense recovery for payment of housing and communal services, acquisition of the liquefied gas, solid and liquid oven household fuel (further - housing subsidy) is created and conducted according to requirements of the laws, including obligatory information on passport data of the receiver of housing subsidy, registration number of accounting card of the taxpayer, the registered/declared residence; the list of housing and communal services on which the housing subsidy is provided, copies of documents based on which the housing subsidy is appointed and is made its payment; other information taking into account which the size of the appointed housing subsidy and the size of housing subsidy before payment since their appointment before solution of the case of the receiver of housing subsidy is determined;

electronic case of person, information on which is entered in the Unified state automated register of persons having the right to privileges (further - electronic case of the exempt), - set of information which is entered in the Unified state automated register of persons having the right to privileges in the form of electronic data for ensuring accounting of exempts;

electronic case on the insurance payments and social services provided by the Law of Ukraine "About obligatory national social insurance" (further - electronic case on insurance payments), - set of information which is fixed in the form of electronic data and is used for purpose, recalculation and implementation of insurance payments;".

With respect thereto the sixth or twelfth to consider paragraphs respectively paragraphs the tenth or sixteenth;

the thirteenth to state the paragraph in the following edition:

"the service acceptance and servicing of insured persons, persons staying on the registry in bodies of the Pension fund as exempts, receivers of pensions, housing subsidies, insurance payments, the social services provided by the Law of Ukraine "About obligatory national social insurance" (further - insurance payments) and other payments which according to the legislation are performed at the expense of the means of the Pension fund of Ukraine and other sources determined by the legislation or have the right to their appointment, allowance payment to burial, insurers or persons authorized by them for the purpose of the solution of question which they ask in bodies of the Pension fund;";

the fifteenth after the words "provided in the Laws of Ukraine" to add the paragraph with the words "About Obligatory National Social Insurance",";

3) in Item 5:

the paragraph one after words "the legislation about" to add with the words "social and";

add after the paragraph of the fourth with the paragraph the fifth the following content:

"get acquainted with the data containing in the Unified state automated register of persons having the right to privileges (further - the Register), and in case of disagreement with them to address in writing to body of the Pension fund about their correction".

With respect thereto to consider paragraphs of the fifth or eighth respectively paragraphs the sixth or ninth;

to state paragraphs of the sixth and eighth in the following edition:

"get acquainted with materials of pension case (to receive the statement from the order about purpose (recalculation) of pension, about the periods of insurance years of service and the salary which is considered in case of pension calculation, the copy of the documents which are in pension case), put the receiver of housing subsidy, case of the receiver of privileges, cases of the exempt, case on insurance payments, to receive the statement from decisions (orders, resolutions) on purpose (recalculation) of pension / housing subsidy / privilege, the copy of documents which are in pension case / case of the receiver of housing subsidy / case exempt/case on insurance payments;";

"get advice and explanations concerning application of the legislation on obligatory national social insurance, obligatory national pension insurance, provision of pensions, concerning purpose of housing subsidy and provision of privileges, including concerning the rights and obligations of the payer of single fee and insured person;";

4) in Item 6:

the fifteenth to state the paragraph in the following edition:

"data on circumstances (employment, dismissal about works, registration or removal from accounting as physical person - the entrepreneur, etc., and also any data specified in Provision Item 2 on the Unified state automated register of persons having the right to privileges, the Cabinet of Ministers of Ukraine approved by the resolution of January 29, 2003 No. 117) which cause change of the size of retirement benefit, housing subsidy, privileges, temporary disability benefits, lump-sum allowance in case of permanent loss of professional working capacity or the death of the victim, monthly insurance payment of the lost victim's earnings (further - monthly insurance payment), insurance payment to the victim in the amount of its average monthly earnings in case of its temporary transfer on easier, below-paid work, monthly insurance payment to persons having the right to it in case of the death of the victim cost recoveries of burial of the victim and funeral services connected with it, or the terminations of their payments.";

the offer third of the paragraph of the eighteenth to add with words "/electronic case of the receiver of housing subsidy / electronic case of the exempt / electronic case of the receiver of privileges/case on insurance payments";

Paragraph two of Item 7 to state 5) in the following edition:

"provide gratuitously to any person, including the exempts, receivers of housing subsidy, injured participants of mass actions of public protest and members of their families, the companies and the organizations providing services which address to body of the Pension fund directly or by communication, on the questions which are within the competence of bodies of the Pension fund, consultation of oral and written form concerning application of the legislation on provision of pensions, purpose of housing subsidy, privileges, implementation of insurance payments, accounting of persons which are subject to obligatory national social insurance, their rights and obligations, payment procedure of insurance premiums, filling of the reporting and other questions;".

"reception of applications, provided by paragraph one of Item 1.1 of the Section I, Item 5.1 of the Section V of the Procedure for representation and document creation for purpose (recalculation) of pensions according to the Law of Ukraine "About obligatory national pension insurance", the Board of the Pension fund of Ukraine approved by the resolution of November 25, 2005 No. 22-1, registered in the Ministry of Justice of Ukraine on December 27, 2005 at No. 1566/11846 (in edition of the resolution of Board of the Pension fund of Ukraine of July 07, 2014 No. 13-1) (further - the Procedure for giving and document creation for purpose (recalculation) of pension), statements for confirmation of length of service according to procedure for confirmation of the periods of work enlisted in years of service for award of pension the Board of the Pension fund of Ukraine approved by the resolution of November 10, 2006 No. 18-1, of U-2116\1231/13105, of the statement provided by the paragraph the fourth Item 9, and the declaration provided by the paragraph the eighth Item 9 of the Regulations on procedure for the purpose of housing subsidies approved by the resolution of the Cabinet of Ministers of Ukraine of October 21, 1995 No. 848 registered in the Ministry of Justice of Ukraine on November 24, 2006 under \(in edition of the resolution of the Cabinet of Ministers of Ukraine of August 14, 2019 No. 807) (dalee-Polozheniye about procedure for purpose of housing subsidies), the statement provided by paragraph one of Item 5 of the Regulations on the Unified state automated register of persons having the right to privileges, the Cabinet of Ministers of Ukraine approved by the resolution of January 29, 2003 No. 117 (further - Regulations on the Unified state automated register of persons having the right to privileges), statements, stipulated in Item 3-1 procedure for provision of privileges for payment of housing and communal services, acquisition of the solid fuel and the liquefied gas in cash approved by the resolution of the Cabinet of Ministers of Ukraine of April 17, 2019 No. 373 (further - the Procedure for provision of privileges), the statements approved by the order of executive directorate of Social Insurance Fund of Ukraine of September 29, 2018 No. 444-PIECE "About approval of forms of statements and samples of resolutions for carrying out insurance payments to the victims and persons which have the right to insurance payments" and the order of executive directorate of Social Insurance Fund of Ukraine of June 22, 2020 No. 283-PIECE "About approval of form of statements for purpose of payment according to the Procedure of insurance payments in case or the death of health workers in connection with infection with sharp respiratory disease of COVID-19, of SARS-CoV-2, caused by coronavirus and the determination of their sizes approved by the resolution of the Cabinet of Ministers of Ukraine of 17.06.2020 No. 498" (further - the statements approved by orders of Social Insurance Fund of Ukraine);";

add after the paragraph of the seventh with the paragraph the eighth the following content:

"conducting electronic case on insurance payments - concerning the decision on the insurance payments this about the victim and persons having the right to insurance payments, the amount of payments and their terms or reasons for refusal in payments.".

With respect thereto paragraphs the eighth, ninth to consider respectively paragraphs the ninth, tenth;

the paragraph the ninth after words "data of pension case," to add with words "cases of the receiver of housing subsidy, privilege, case on insurance payments,";

2) the paragraph the fourth Item 3 after the words "concerning provision of pensions" to add with the words "provision of housing subsidies, privileges, insurance payments";

Item 5 paragraph two after the words "on receipt of retirement benefits" to add 3) with words ", housing subsidies, privileges, insurance payments, social services".

3. In the Section IV:

1) in Item 1:

the fourth to state the paragraph in the following edition:

"access for the user of electronic service to information on condition of information about insured person, the exempt, retirement benefits, housing subsidies, privileges, insurance payments and social services, condition of data of the register of insured persons of the State register (including information of the electronic register of sick leave notes of disability), condition of settlement according to obligations of the payer (on condition of confirmation of identification of person getting access by registration of person in the database of the web portal);";

word in paragraph five "electronic type" shall be replaced with words to "electronic form";

to state the paragraph of the sixth in the following edition:

"representation by the user of electronic services through the web portal with use of the digital signature which is based on the qualified digital signature certificate, the statements provided by the paragraph the second Item 1.1 of the Section I, the paragraph the second Item 3.1 of the Section III of the Procedure for representation and document creation for purpose (recalculation) of pensions and the statement for confirmation of length of service according to Procedure for confirmation of the periods of work enlisted in years of service for the award of pension approved by the resolution of Board of the Pension fund of Ukraine of November 10, 2006 No. 18-1, of the Ministry of Justice of Ukraine on November 24, 2006 at No. 1231/13105, of the statement, provided by the paragraph the fourth Item 9, and the declaration provided by the paragraph the eighth Item 9 of the Regulations on the Procedure for purpose of housing subsidies, the statement provided by paragraph one of Item 5 of the Regulations on the Unified state automated register of persons having the right to privileges statements, stipulated in Item 3-1 Procedure for provision of privileges, statements approved by orders of Social Insurance Fund of Ukraine together with the scanned copies of documents which correspond to originals of documents and are suitable for perception of their content (shall contain the accurate image of complete structure of the text of the document and its details);";

Item 9 to state 2) in the following edition:

"9. Application forms, provided by Procedure for representation and document creation for purpose (recalculation) of pensions, Procedure for submission of documents for appointment and payment of monthly perpetual monetary pay to the judges in resignation of the Pension fund of Ukraine by territorial authorities approved by the resolution of Board of the Pension fund of Ukraine of January 25, 2008 No. 3-1, registered in the Ministry of Justice of Ukraine on March 12, 2008 at No. 200/14891 (in edition of the resolution of Board of the Pension fund of Ukraine of March 20, 2017 No. 5-1), the statement provided by the paragraph the fourth Item 9, and declarations, Item 9 of the Regulations on the Procedure for purpose of housing subsidies, the statement, provided by paragraph one of Item 5 of the Regulations on the Unified state automated register of persons having the right to privileges, statements, stipulated in Item 3-1 Procedure for provision of privileges, statements approved by orders of Social Insurance Fund of Ukraine, take place on the web portal:";

3) in Item 10:

paragraph one after the words "with charge and pension payment " to add with words ", housing subsidies, privileges, insurance payments";

to state paragraphs of the sixth and eighth in the following edition:

"By results of working off of the received address concerning procedure for appointment (recalculation) for housing subsidies, privileges, insurance payments, pensions, transfer from one type of pension into another, payment of housing subsidies, privileges, pensions and/or the help on burial, to the applicant goes to the method of the notification chosen by it in which the procedure for the request for purpose (recalculation) of the corresponding payments / provision of social services, the list of necessary documents, term of their representation, the location of the service center (remote workplace) of body of the Pension fund in which it is possible to address convenient dates and time for the address is specified.";

"If the answer to the address contains information with limited access, including data from the register of insured persons of the State register or other data reported by person for appointment (recalculation, provision) the payments performed by bodies of the Pension fund, then such answer goes through the Internet in encrypted form with use of the digital signature which is based on the qualified digital signature certificate (in case of provision by the applicant of the certificate of enciphering of the qualified digital signature of the applicant, or the mailing to the address specified in pension case of the receiver, to case of the receiver of housing subsidy, privileges, case on insurance payments as the residence (residence) of such receivers and in case of disagreements in the data on person reported by the applicant with data of such cases of receivers or impossibility to identify the identity of the applicant the refusal in satisfaction of the address with indication of the reasons of such refusal goes to the e-mail address of the applicant.";

the paragraph the ninth after the words "to the statement for award of pension" to add with words "housing subsidy, privileges, insurance payment and provision of social service,";

Paragraph two of Item 11 to state 4) in the following edition:

"Personal data of physical persons are provided to these persons from the register of insured persons of the State register in the amount provided by the Regulations on the register of insured persons of the State register of obligatory national social insurance approved by the resolution of Board of the Pension fund of Ukraine of June 18, 2014 No. 10-1, registered in the Ministry of Justice of Ukraine on July 08, 2014 at No. 785/25562 (in edition of the resolution of Board of the Pension fund of Ukraine of March 27, 2018 No. 8-1), on electronic case of the receiver is provided information concerning type and the amount of the appointed payment (pension - taking into account allowances, increases, additional pension, the target monetary assistance, pension for special merits in front of Ukraine, indexation and other pension supplements established by the legislation), payment dates and the ends of payment, deduction.";

Paragraph one of Item 16 to state 5) in the following edition:

"16. Target individual informing citizens, insured persons and insurers, including physical persons - the entrepreneurs, persons providing themselves with work independently at the initiative of body of the Pension fund concerning provision of pensions, obligatory national pension insurance, provision of housing subsidies and privileges, insurance payments and other questions, is performed on a centralized basis by means of the web portal based on the administrative document of relevant organ of the Pension fund.".

4. In the Section V:

Item 3 to state 1) in the following edition:

"3. During remote servicing of persons information with limited access, including data from the register of insured persons of the State register, electronic pension case, electronic case of the receiver of housing subsidy, electronic cases of the receiver of privileges and the exempt, about insurance payments or other data reported by person for appointment (recalculation, provision) the payments performed by bodies of the Pension fund information on the residence, number of accounting card of insured person by person performing study (consideration) of the address is not provided.";

2) the paragraph the fourth item 4 after the words "concerning provision of pensions" to add with words ", provision of housing subsidies, privileges, insurance payments".

5. To be reworded as follows appendix 2 to the Provision enclosed.
