About the organization and functioning of National inspectorate for technical supervision

Based on Items b) and e) article 7 of the Law No. 136/2017 on the Government (The official monitor of the Republic of Moldova, 2017, No. 252, the Art. 412), with subsequent changes, parts (1) and (7) Article 14 and part (1) article 15 of the Law No. 98/2012 on the central branch public management (The official monitor of the Republic of Moldova, 2012, Art. No. 160-164, 537), with subsequent changes, DECIDES: the Government

1. Reorganize technical supervision Agency by transformation to National inspectorate for technical supervision - the administrative authority subordinated to the Ministry of infrastructure and regional development.

2. The national inspectorate for technical supervision is successor of the rights and obligations of the Agency on technical supervision.

3. Establish the extreme number of staff of National inspectorate for technical supervision in number of 149 units with the annual salary fund according to the legislation.

4. To perform change or the termination of the office relations of personnel after approval and registration by the State office of the staff list of National inspectorate for technical supervision.

To perform release of personnel as a result of reorganization according to the Law No. 158/2008 on the state position and the status of the government employee and with the labor law.

5. Before position assignment of the chief of National inspectorate for technical supervision this position is temporarily performed by the head of the Agency on technical supervision who has rights of acceptance of all necessary measures for implementation of process of reorganization according to legislation provisions.

6. Transfer to National inspectorate for technical supervision property of the Agency on technical supervision, including archive, according to the Regulations on procedure for transfer of objects of public property approved by the Order of the Government No. 901/2015.

7. Approve:

1) Regulations on the organization and functioning of National inspectorate for technical supervision according to appendix No. 1;

2) Structure of National inspectorate for technical supervision according to appendix No. 2;

3) to Organigramm of National inspectorate for technical supervision according to appendix No. 3;

4) Changes which are made to some orders of the Government, according to appendix No. 4.

8. To the head of National inspectorate for technical supervision:

1) within 5 days from the effective date of this resolution to request from the Agency of the state services entering of necessary records and changes into the state registers according to the legislation;

2) within 10 working days from the effective date this resolution:

a) approve the staff list and submit it for approval to the State office;

b) previously to notify personnel of the reorganized administrative authority according to provisions of the regulatory base.

9. The state office in five-day time from the date of receipt to approve and register the staff list of National inspectorate for technical supervision.

10. To provide to national inspectorate for technical supervision till December 31, 2024 issue to all inspectors of figurative systems of video surveillance.

To the inspectors who are not provided with figurative systems of video surveillance to perform control activities without the specified systems of video surveillance according to the procedure of departure from requirements of Item 7 of the Regulations on the organization and functioning of National inspectorate for technical supervision before issue to all inspectors of figurative systems of video surveillance.

11. To cover expenses on enforcement of this resolution for the account and within the approved budgetary appropriations.

12. Declare invalid the Order of the Government No. 1088/2017 about the organization and functioning of the Agency on technical supervision (The official monitor of the Republic of Moldova, 2017, No. 440, the Art. 1212), with subsequent changes.

13. To impose control over the implementation of this resolution on the Ministry of infrastructure and regional development.

14. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.
