About streamlining of activities of the state companies under the Ministry of emergency situations of the Kyrgyz Republic

For the purpose of optimization of activities of the Ministry of emergency situations of the Kyrgyz Republic, increase in efficiency and streamlining of activities of the organizations subordinated to it, according to Articles 92-94 of the Civil code of the Kyrgyz Republic, Articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Reorganize by transformation:

- public institution "The Jalal-Abad portable mechanized group" under the Ministry of emergency situations of the Kyrgyz Republic in the state company "The Jalal-Abad Portable Mechanized Group" under the Ministry of emergency situations of the Kyrgyz Republic;

- public institution "The Talas portable mechanized group" under the Ministry of emergency situations of the Kyrgyz Republic in the state company "The Talas Portable Mechanized Group" under the Ministry of emergency situations of the Kyrgyz Republic;

- public institution "The Batken portable mechanized group" under the Ministry of emergency situations of the Kyrgyz Republic in the state company "The Batken Portable Mechanized Group" under the Ministry of emergency situations of the Kyrgyz Republic;

- public institution "Interregional center for protection of the territories" under the Ministry of emergency situations of the Kyrgyz Republic in the state company "Interregional Center for Protection of the Territories" under the Ministry of emergency situations of the Kyrgyz Republic;

3. Authorize the Ministry of emergency situations of the Kyrgyz Republic on approval of transfer acts by the reorganization specified in Item 1 of this resolution.

4. Approve:

1) the Charter of the state company "The Jalal-Abad Portable Mechanized Group" under the Ministry of emergency situations of the Kyrgyz Republic according to appendix 1;

2) the Charter of the state company "The Talas Portable Mechanized Group" under the Ministry of emergency situations of the Kyrgyz Republic according to appendix 2;

3) the Charter of the state company "The Batken Portable Mechanized Group" under the Ministry of emergency situations of the Kyrgyz Republic according to appendix 3;

4) the Charter of the state company "Interregional Center for Protection of the Territories" under the Ministry of emergency situations of the Kyrgyz Republic according to appendix 4;

5) the Charter of the state company "Osh Center for Emergency Response" under the Ministry of emergency situations of the Kyrgyz Republic according to appendix 5;

6) the Charter of the state company "MONTH Textiles" under the Ministry of emergency situations of the Kyrgyz Republic according to appendix 6.

5. Bring in the order of the Government of the Kyrgyz Republic "About streamlining of activities of the state companies" of September 11, 2019 No. 468 the following changes:

in appendix 1 to the Regulations on the state companies approved by the above-stated resolution:

- add with Items 18-24 of the following content:

6. Bring in the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About some questions of the Ministry of emergency situations of the Kyrgyz Republic" of November 15, 2021 No. 262 the following changes:

The scheme of management of the Ministry of emergency situations of the Kyrgyz Republic approved by the above-stated resolution to state 1) in edition according to appendix 7;

2) in the Charter about the State company "The Air Enterprise under the Ministry of Emergency Situations of the Kyrgyz Republic" approved by the above-stated resolution:

- declare Item 61 invalid.

7. Recognize invalid:

1) Item 1 of the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About modification of some decisions of the Cabinet of Ministers of the Kyrgyz Republic concerning project implementation "Construction of the international business center "Bishkek City" of September 9, 2022 No. 498;

2) the subitem 2 of Item 1 of the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About introduction of amendments to the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About some questions of the Ministry of emergency situations of the Kyrgyz Republic" of November 15, 2021 No. 262" of February 6, 2023 No. 47;

3) the paragraph third Item 1 of the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About introduction of amendments to the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About some questions of the Ministry of emergency situations of the Kyrgyz Republic" of November 15, 2021 No. 262" of October 7, 2022 No. 546.

8. To the ministry of emergency situations of the Kyrgyz Republic:

1) in accordance with the established procedure to carry out the state re-registration of legal entities in judicial authorities;

2) to take other measures following from this resolution.

9. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

10. This resolution becomes effective after ten days from the date of official publication.

The charter of the state company "The Jalal-Abad Portable Mechanized Group" under the Ministry of emergency situations of the Kyrgyz Republic

1. General provisions

1. The state company "The Jalal-Abad Mechanized Group" under the Ministry of emergency situations of the Kyrgyz Republic (further - the Company) is the independent legal entity formed in form of business of the state company founded on the right of economic maintaining by state-owned property.

2. The company in the activities is guided by the Constitution and the laws of the Kyrgyz Republic, other regulatory legal acts of the Kyrgyz Republic, the conventional principles and rules of international law, international treaties which became effective according to the legislation of the Kyrgyz Republic, and also departmental acts of the Ministry of emergency situations of the Kyrgyz Republic (further - the Ministry) and this Charter.

3. Founder of the Company is the Cabinet of Ministers of the Kyrgyz Republic.

4. The state managing body of the Company is the Ministry.

12. Main objectives of the Company are:

- holding actions for the prevention and liquidation of the emergency situations of natural and technogenic nature, with use which are available on balance of special technical and engineering vehicles;

- carrying out complex of emergency and recovery and other urgent works.

13. The main objectives of the Company are:

- holding actions for purchase, storage, transportation of the inventory items used for the purpose of the prevention and mitigation of consequences of emergency situations;

- production and storage of the inventory items necessary for the Ministry;

- carrying out construction, emergency and recovery and shore protection works on potentially dangerous objects in case of threat of emergence of emergency situations;

- attraction and rational use of the extrabudgetary financial resources which are not prohibited by the legislation of the Kyrgyz Republic;

- use of the fixed assets (including repair shops and others) used in accordance with general practice;

- work on protection of settlements;

- effective use of the fixed assets, current assets and material resources of the Ministry transferred to the economic jurisdiction of the Company;

- holding actions for purchase, storage and transportation of material means Civil protection, used for the purpose of the prevention and liquidation of emergency situations;

- participation in works on evacuation, in rescue, emergency recovery operations in case of threat and mitigation of consequences of emergency situations;

- acceptance, storage and leave of humanitarian aid;

- ensuring delivery of the humanitarian assistance to the area of emergency situations, and also to the border CIS countries and SCO;

- providing the objects which were affected by emergency situations, construction and other inventory items according to decisions of the Cabinet of Ministers of the Kyrgyz Republic and the Ministry;

- carrying out complex of organizational and technical actions for expansion of material and technical resources of the Company;

- accumulating and storage of fuels and lubricants, and also creation and operation of network of gas stations and Items for ensuring requirement of divisions of the Ministry;

- construction of roads and bridge constructions;

- construction of hydroconstructions;

- implementation of activities for delivery of consumer goods;

- performance of works as the prime contractor on designing, construction, reconstruction and capital repairs of objects for the state (municipal) organizations and organizations.

15. The Company performs separate types of activity which implementation requires availability of special permission (license) of the authorized ministries and departments after receipt of the corresponding permission (license).

3. Rights and obligations of the Company

16. The company for implementation of the tasks determined by this Charter has the right:

- have the isolated property;

- make offers in the Ministry;

- in coordination with the Ministry to acquire on its own behalf the property and personal non-property rights and to perform duty;

- be claimant and the defendant in judicial authorities;

- take measures for ensuring safety of the state-owned property which is under economic authority;

- organize release of consumer goods, perform business activity;

- organize wholesale and market trade by fuels and lubricants;

- create production and construction sites in coordination with the Ministry, according to authorized tasks of the Company;

- create and contain subsidiary farm, process products of agricultural industry;

- sign contracts with legal entities and physical persons;

- according to the procedure, established by the legislation of the Kyrgyz Republic to render services in requests of legal entities and physical persons on contractual basis;

- perform activities for accomplishment of the special works and works which are bringing in incomes;

- be engaged in other types of activity which are not prohibited by the legislation of the Kyrgyz Republic.

17. Belongs to duties of the Company:

- ensuring effective implementation of the tasks and functions determined by this Charter;

- providing social, medical and other obligation types of insurance of employees of the Company, and also providing safe working conditions;

- as required, in coordination with the Ministry to provide with inventory items the Cabinet of Ministers of the Kyrgyz Republic, and also to perform the activities connected with the organization and holding official actions;

- as required, in coordination with the Ministry to render assistance in the organization of the charity events which are carried out by Administration of the President of the Kyrgyz Republic, the Cabinet of Ministers of the Kyrgyz Republic, the Ministry, other public authorities and local government bodies;

- as required according to the decision of the Ministry to render assistance directed to improvement of working conditions of staff of the Ministry.

4. Competence of the state managing body of the Company

18. The ministry is the state managing body of the Company within which competence are:

1) preparation of offers on introduction of amendments to the Charter or approval of the Charter in the new edition;

2) introduction to the founder of offers on reorganization or liquidation of the Company;

3) approval of the strategic plan of development of the Company;

4) approval of the draft of the annual budget of the Company;

5) development and approval of industry performance indicators of financial and economic activities of the Company;

6) analysis and monitoring of implementation of the strategic plan of development of the Company;

7) approval of qualification requirements for candidates for position of the director of the Company;

8) introduction to authorized body in the field of management of state-owned property of candidates for position assignment of the director of the Company for the subsequent representation to the Chairman of the Cabinet of Ministers of the Kyrgyz Republic;

9) approval of participation (membership) of the Company in activities of funds, associations (unions) of non-profit organizations and (or) commercial legal entities;

10) the solution of other questions carried to competence of the Ministry according to the legislation of the Kyrgyz Republic and this Charter.

19. The ministry has the right:

1) to instruct the Company, concerning questions of industry policy in the supervised fields of activity;

2) to request and obtain from the Company information on its financial and economic activities, documents of the financial (accounting) reporting, and also materials, made and the explanations necessary for carrying out the analysis of financial and economic activities and the strategic plan of development of the Company;

3) to visit the territory of the Company for the solution of the questions carried to its competence;

To bring 4) to authorized body in the field of management of state-owned property of the offer on release of the director of the Company from position, application of encouragement measures to it and disciplinary responsibility.

The ministry also has other rights according to the legislation of the Kyrgyz Republic.

20. The ministry shall:

1) to provide timely forming of governing bodies of the Company;

2) to provide initiation and promotion of drafts of the decisions of the Cabinet of Ministers of the Kyrgyz Republic connected with activities of the Company;

3) to inform law enforcement agencies on the facts of violation by heads and employees of the Company of the legislation of the Kyrgyz Republic which became to it known;
