1. Bring in the resolution of the Cabinet of Ministers of Ukraine of November 11, 2022 No. 1275 "Some questions of implementation of defense purchases for action of legal regime of warlike situation" (The Official Bulletin of Ukraine, 2022, No. 91, the Art. 5666, No. 97, Art. 6047; 2023, No. 50, the Art. 2800) the enclosed changes.
2. Determine that:
1) the defense purchases begun before entry into force of this resolution come to the end according to the procedure and on the conditions operating before entry into force of this resolution;
2) as a part of the cost (price) determined in public contracts (contracts) for delivery of goods, performance of works and provision of services for ensuring needs of the sector of safety and defense, and also other goods, works and services for secured provision of requirements of safety and defense of Ukraine all taxes and fees, general production, administrative, operating and other expenses of the contractor connected with production of goods, performance of works and provision of services and also profit (supplying remuneration) of the contractor are considered.
3. To the state customers in the field of defense, certain resolution of the Cabinet of Ministers of Ukraine of March 3, 2021 No. 363 "Questions of defense purchases" (The Official Bulletin of Ukraine, 2021, No. 33, the Art. 1916), tax till January 15, 2024. To the ministry of questions of strategic industries the report on the number of the conducted defense procurements, dynamics of the change in price in the field of defense purchases, the size of overdue receivables and payables under the signed contracts (agreements) on defense purchases for generalization and representation to the Cabinet of Ministers of Ukraine till January 30, 2024.
