According to provisions of Items c) and d) article 22 of the Law No. 467/2003 on informatization and the state information resources (The official monitor of the Republic of Moldova, 2004, Art. No. 6-12, 44), with subsequent changes, DECIDES: the Government

1. Found the Information system on management of financial guarantees on the credits.

2. Approve:

1) the Concept of the Information system on management of financial guarantees on the credits according to appendix No. 1;

2) Regulations on procedure for maintaining the information resource created by the Information system on management of financial guarantees on the credits according to appendix No. 2.

3. Appoint the Ministry of Economic Development and digitalizations as the owner and public organization "Organization for Development of Entrepreneurship" as the holder of the Information system on management of financial guarantees on the credits.

4. Perform organization, development, servicing and ensuring functioning of the Information system on management of financial guarantees on the credits for the account and within the financial resources approved annually in the budget of the Ministry of Economic Development and digitalization due to the external help which is received by public organization "Organization for Development of Entrepreneurship", and also from other legal sources.

5. To impose control of execution of this resolution on the Ministry of Economic Development and digitalizations.

6. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

The concept of the Information system on management of financial guarantees on the credits

Chapter I Introduction

One of core activities of public organization "Organization for Development of Entrepreneurship" (further - PU ORP) according to provisions of article 13 of the Law No. 179/2016 on the small and medium companies is management of Fund of guaranteeing the credits for the small and medium companies (further - FGK). The mission of FGK is directed to simplification of access to financing for the entrepreneurial circle of the Republic of Moldova by means of issue of financial guarantees on the credits requested by entrepreneurs from banks or non-bank credit institutions, thus dividing credit risk and covering insufficiency of mortgage providing.

Simplification of process of interaction of the parties participating in guaranteeing process requires creation and implementation of information system which would manage all processes of request, consideration, issue, monitoring, execution and compensation of PU "ORP" of financial guarantees on the credits requested by the entrepreneurial circle. Implementation of information system in the activities connected with these processes, on the one hand, will promote optimization of the ministerial procedures connected with provision of guarantees, and on the other hand, will allow to perform monitoring, accounting, the statistical and analytical reporting with bigger efficiency and effectiveness.

In this context, proceeding from the actual situation, and also from provisions of the regulatory base of rather small and medium companies, there was need to make the decision on creation and implementation of the Information system on management of financial guarantees on the credits (further - IS UFGK).

Chapter II General provisions

1. The concept of IS UFGK (further - the Concept) establishes the purposes, tasks and functions of system, the organizational structure and the regulatory base necessary for its creation and functioning, information objects and the list of data which are stored in system, technological infrastructure and measures for safety and information security, and also the measures connected with creation, implementation, operation and servicing of system.

2. IS UFGK represents set of the interdependent resources and information technologies, methods and personnel intended for registration, storage, processing, provision and use of information and forming of information resource about files of financial guarantees on the credits about applicants on financial guarantees on the credits from the moment of their registration and until archiving of data.

3. The concepts used in this Concept if other is not determined, have the values provided in the Law No. 179/2016 on the small and medium companies, the Law No. 467/2003 on informatization and the state information resources and the Order of the Government No. 709/2022 on approval of the Regulations on the organization, functioning and use of Fund of guaranteeing the credits for the small and medium companies.

4. IS UFGK tasks:

1) creation of information resource of the activities for guaranteeing the credits performed by PU "ORP" for the purpose of creation and storage of information on request, issue, monitoring, execution and compensation of financial guarantees, providing the adequate level of data protection, circulating in system;

2) provision to the entrepreneurial circle of the information tool capable to reduce time necessary for request and receipt of necessary guarantees on the requested credits, and also receipts in real time of information on traceability of process of consideration of request for issue of guarantee;
