About change of resolutions of Council of Ministers of the Republic of Belarus

Council of Ministers of the Republic of Belarus DECIDES:

1. Make changes to resolutions of Council of Ministers of the Republic of Belarus according to appendix.

2. Determine the diagnostic card of the vehicle as an alternative to the international certificate of technical inspection.

3. To the Ministry of Transport and Communications together with the Ministry of Foreign Affairs in accordance with the established procedure to organize forwarding of sample of the diagnostic card of the vehicle to the Secretary general of the United Nations.

4. To the republican state bodies and other organizations subordinated to the Government of the Republic of Belarus in two-month time to take measures for implementation of this resolution.

5. This resolution becomes effective in the following procedure:

Item 17, subitem 20.1 of Item 20, subitem 22.12 of Item 22 and Item 25 of appendix – since January 1, 2024;

other provisions of this resolution – after its official publication.

The list of the changes made to resolutions of Council of Ministers of the Republic of Belarus

1. In Regulations on the approval procedure on the admission to the MDP procedure and use of MDP of books, introduction in it of changes, suspensions, cancellation of permission to the admission to the MDP procedure and use of books of MDP approved by the resolution of Council of Ministers of the Republic of Belarus of December 29, 1998 No. 1996:

1.1. state Item 5 in the following edition:

"5. For receipt of permission to the admission the interested person submits the application in Association.

In the statement except the data provided in part one of Item 5 of article 14 of the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "About bases of ministerial procedures" are specified:

the list of the motorized vehicles declared for implementation of international carriages of loads with indication of information on the owner of the motorized vehicle, about the origin bases at the applicant who is not the owner of the motorized vehicle, right of possession the motorized vehicle and also about registration sign of the motorized vehicle;

details of the documents confirming passing by the head of the legal entity, the individual entrepreneur or workers authorized by them performing the organization of international carriages, training in rate "The organization of the international motor transportations of loads under customs control using the MDP procedure" in the organization of education accredited by International union of road transport and also the name and the location of such organization of education.

Together with the statement the following documents are provided:

the copies of registration certificates of vehicles (technical data sheets) certified by the applicant concerning the motorized vehicles declared for implementation of international carriages of loads if such motorized vehicles are at the applicant in temporary ownership and use under the agreement of finance lease (leasing);

the copies of the documents confirming right of possession and (or) uses for the term of at least one year concerning the motorized vehicles declared for implementation of international carriages of loads certified by the applicant;

the copy of the balance sheet certified by the applicant with appendices, stipulated by the legislation about financial accounting and the reporting, in the quarter preceding date of the request of the legal entity for issue of permission to the admission;

the copies of documents certified by the applicant, confirmatory:

availability at the legal entity in property, economic maintaining or operational management of fixed assets – vehicles, buildings, constructions, machines, the equipment and other property considered as such means according to the legislation on financial accounting and the reporting which residual cost is equivalent to the amount at least:

9000 euros on the official rate of Belarusian ruble to euro established by National Bank on the date of the request for issue of permission to the admission when using only of one motorized vehicle declared by the interested person for implementation of international carriages of loads;

5000 euros on the official rate of Belarusian ruble to euro established by National Bank on the date of the request for issue of permission to the admission for each subsequent motorized vehicle declared by the interested person for implementation of international carriages of loads;

availability at the individual entrepreneur in property of property (except for apartments, apartment houses, country houses, garden lodges, garages, living rooms, economic constructions, cars) a minimum of:

9000 euros on the official rate of Belarusian ruble to euro established by National Bank on the date of the request for issue of permission to the admission when using only of one motorized vehicle declared by the interested person for implementation of international carriages of loads;

5000 euros on the official rate of Belarusian ruble to euro established by National Bank on the date of the request for issue of permission to the admission for each subsequent motorized vehicle declared by the interested person for implementation of international carriages of loads;

at least 10 international commodity-transport superimposed "CMR" certified by the applicant of the copy;

the declaration obligation in the form determined by International union of road transport signed by the individual entrepreneur either the head of the legal entity or persons authorized by them.";

1.2. to exclude from Item 6 of the word "of October 28, 2008 No. 433-Z";

1.3. in Item 7:

to state paragraphs of the first and second in the following edition:

"7. In case of decision making about issue of permission to the admission or about refusal in issue of permission to the admission to the interested person Association:

In case of change of the name of the legal entity who got permission to the admission, or surname (own name) of the individual entrepreneur who got permission to the admission, the interested person for modification of permission to the admission submits in Association the application for modification of permission to the admission, and also the declaration obligation in the form determined by International union of road transport signed by the individual entrepreneur either the head of the legal entity or persons authorized by them.";

1.6. add the Provision with Item 14-1 of the following content:

"14-1. In case of decision making about modification of permission to the admission or about refusal in modification of permission to the admission the Association by means of the nation-wide automated information system receives from the Single state register of legal entities and individual entrepreneurs of the data on change of the name of the legal entity who got permission to the admission, or surnames (own name) of the individual entrepreneur who got permission to the admission.";

1.7. in paragraph seven of Item 19 and Item 20 to replace the word "statements" with the word "notifications".

2. In Regulations on procedure for state registration and the state accounting of vehicles, their removals from accounting and modification of the documents connected with state registration of vehicles, No. 1849 approved by the resolution of Council of Ministers of the Republic of Belarus of December 31, 2002:

2.1. the eleventh parts two of Item 13 and the paragraph the fourth parts two of Item 37 to exclude the paragraph;

2.2. in appendices 1 and 2 to this Provision of the word "The following documents are attached: _______ No. ___________" shall be replaced with words the registration certificate (technical data sheet) "The following documents (data) are attached: electronic passport of the _______ vehicle No. ____________".
