About modification of the technical regulation of the Customs union "The technical regulation on fat-and-oil products" (TR CU 024/2011)"
According to article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 29 of appendix № 1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 № 98, Council of the Eurasian economic commission decided:
1. Bring in the technical regulation of the Customs union "The technical regulation on fat-and-oil products" (TR CU 024/2011) accepted by the Decision of the Commission of the Customs union of December 9, 2011 No. 883 (further – the technical regulation), changes according to appendix.
2. Determine that the standard rate of indicator "Trans-isomers of fatty acids" established in line item 2 groups of products of the II appendix 1 to the technical regulation is applied from the date of inclusion of method of determination of the specified indicator in the list of the international and regional (interstate) standards, and in case of their absence – the national (state) standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of requirements of the technical regulation of the Customs union "The technical regulation on fat-and-oil products" (TR CU 024/2011) and implementation of assessment of conformity of objects of technical regulation, No. 53 approved by the Decision of Board of the Eurasian economic commission of March 29, 2022.
3. This Decision becomes effective after 1 year from the date of its official publication.

Appendix
to the Decision of Council of the Eurasian economic commission of December 12, 2023 No. 149
1. To add Item 1 of Article 1 with the subitem "about-1" following contents:
"about-1) the cocoa butter substitutes which are not tempered the mixed type;".
2. In Article 2:
a) in Item 3:
state subitems 12 and 13 in the following edition:
"12) oil (fat) the hydrogenated refined deodorized – the oil (fat) received in the course of hydrogenation of vegetable oil with addition or without addition of melted animal fats, fats of fishes and marine mammals, which underwent purification process including deodorization;
13) oil (fat) the reesterified refined deodorized – the oil (fat) received in the course of transesterification of vegetable oil with addition or without addition of melted animal fats, fats of fishes and marine mammals, which underwent purification process including deodorization;";
in subitem 14 of the word "animal fats" shall be replaced with words "melted animal fats";
state subitem 18 in the following edition:
"18) spread – the emulsion fatty product with mass fraction of general fat at least 39 percent having plastic consistence with temperature of melting of fatty phase is not above 36 degrees Celsius, made of milk fat, and (or) cream, and (or) butter and the unmodified and (or) modified vegetable oils, and (or) substitute of milk fat or only of the unmodified and (or) modified vegetable oils, and (or) substitute of milk fat with addition or without addition of nutritional supplements and other food ingredients;";
state subitem 21 in the following edition:
"21) mixes melted – products with mass fraction of fat at least 99 percent made by way of mixing of the heated to temperature of complete fusion of milk fat, and (or) cream, and (or) butter and unmodified and (or) modified vegetable oils, and (or) substitute of milk fat or only from the unmodified and (or) modified vegetable oils, and (or) substitute of milk fat or by application of other processing methods with addition or without addition of nutritional supplements and other food ingredients;";
in subitem 24 of the word of "animal fats" shall be replaced with words "melted animal fats";
in subitems 26 and 27 of the word "vegetable oils (ellipa, Borneo, palm, Sal, ши, кокум, from mango kernels)" shall be replaced with words "vegetable oils (illipa (Borneo, тенгкаванг), palm, Sal, ши, кокум, from mango kernels)";
add with subitem 30-1 of the following content:
"30-1) substitutes of cocoa butter which are not tempered the mixed type – products with mass fraction of fat at least 99 percent which are not needing tempering, made on the basis of mixes of the modified vegetable oils, containing from 1 percent to 40 percent of mass fraction of lauric acid, at least 70 percent of mass fraction of solid triglycerides in case of 20 degrees Celsius with addition or without addition of nutritional supplements and other food ingredients;";
in subitem 35 of the word of "animal fats" shall be replaced with words "melted animal fats";
b) in the subitem 1 of Item 5 of the word of "animal fats" shall be replaced with words "melted animal fats".
3. In Article 3:
a) add Item 1 with the subitem "v" of the following content:
"c) repeated purification (additional cleaning) – the process of additional cleaning on partial cycle of the unmodified and modified vegetable oils or their mixes, mixes refined refined and not refined unmodified and modified vegetable oils which is carried out for decrease in content of substances, including contaminants the, and/or substances unusual for them exceeding the established levels;".
b) in Items 2 and 3 shall be replaced with words the word "high-temperature" "the purification stage representing high-temperature";
c) in item 4 shall be replaced with words the word "process" "the purification stage representing process".
4. In Article 8:
a) add Item 1 with the subitem 7 of the following content:
"7) for the unmodified and modified vegetable oils or their mixes, held for use as food (food) staples and subjects of purification or repeated purification (additional cleaning) at the companies for production of food fat-and-oil products, in the name their purpose and need of carrying out purification or repeated purification (additional cleaning) in addition is specified. For example, "The sunflower oil which is not refined. Held for use as food (food) staples. The palm-oil refined is subject to purification at the companies for production of food fat-and-oil products", ". Held for use as food (food) staples. Oil coconut refined is subject to repeated purification at the companies for production of food fat-and-oil products" or ". Held for use as food (food) staples. Is subject to additional cleaning at the companies for production of food fat-and-oil products.";
b) add Item 2 with the paragraph of the following content:
"In case of content in food fat-and-oil products of components which mass fraction constitutes 2 percent and less it is allowed to specify them in any sequence after components which mass fraction constitutes more than 2 percent.";
c) the subitem 4 of Item 9 after words "lauric type," to add with words of "the substitutes of cocoa butter which are not tempered the mixed type";
d) to add the subitem 5 of Item 10 after words of "lauric type" with words ", the substitutes of cocoa butter which are not tempered the mixed type".
5. To add Item 5 of Article 10 with paragraphs of the following content:
"The unmodified and modified vegetable oils or their mixes after transportation filling by water activities of transport in engineering procedure of production of food fat-and-oil products are subject to purification on complete or partial cycle or repeated purification (additional cleaning), including deodorization with ensuring control of indicators of oxidizing spoil. At the same time the measure value "peroxide number" of the unmodified and modified vegetable oils or their mixes, the production supervision included in the program, at deodorization process completion stage (at the exit from deodorant) shall not exceed 0,2 мэкв active oxygen/kg.
The unmodified and modified vegetable oils or their mixes which underwent the purification or repeated purification (additional cleaning) and intended for the direct use by the person in food or uses for production of food products shall conform to requirements to the admissible levels of indicators of safety provided by appendices 1 – 3 to this technical regulation and other technical regulations of the Eurasian Economic Union (Customs union) which action extends to them.".
6. In Article 15:
a) state Item 3 in the following edition:
"3. Transportation of food fat-and-oil products in closed cars, containers and automotive vehicles together with other products is not allowed if it can lead to pollution of food fat-and-oil products.
Transportation of food fat-and-oil products according to the list according to appendix 6 to this technical regulation, in bulk is not allowed by all modes of transport.
Transportation of food fat-and-oil products in bulk by water activities of transport in reservoirs of vehicles in which just before food fat-and-oil products loads according to the list according to appendix 7 to this technical regulation were transported is not allowed.
Transportation of food fat-and-oil products by filling automobile and by rail is performed in the specialized automobile tanks, railway tank cars, container tanks allowed for transportation of food products or other fat-and-oil products according to regulatory legal acts of state members of the Eurasian Economic Union.
Reservoirs of the vehicles allowed for transportation of food fat-and-oil products, except the unmodified and modified vegetable oils or their mixes, held for use as food (food) staples and subjects of purification or repeated purification (additional cleaning) with modification or without modification at the companies for production of food fat-and-oil products, shall be made of stainless steel or of other materials permitted for contact with food products.";
b) add with Item 7 of the following content:
"7. Transportation of food fat-and-oil products in bulk is allowed by water activities of transport:
1) in tankers which reservoirs are made of stainless steel or have covering from epoxy or its technical equivalents provided that prior load was foodstuff or load according to the list according to appendix 8 to this technical regulation;
2) in tankers which reservoirs are made of other materials or have other covering, not specified in the subitem of 1 this Item provided that three prior loads were foodstuff or loads according to the list according to appendix 8 to this technical regulation.".
7. Add Article 20 with Item 3-1 in the following edition:
"3-1. In case of confirmation (declaring) of compliance to requirements of technical regulations which action extends to the unmodified and modified vegetable oils or their mixes held for use as food (food) staples and the subject purifications or repeated purification (additional cleaning) with modification or without modification at the companies for production of food fat-and-oil products, in the declaration the name of oil with purpose of its use and need of carrying out purification or repeated purification (additional cleaning), for example, "The sunflower oil which is not refined is specified. Held for use as food (food) staples. The palm-oil refined is subject to purification at the companies for production of food fat-and-oil products", ". Held for use as food (food) staples. Oil coconut refined is subject to repeated purification at the companies for production of food fat-and-oil products "or". Held for use as food (food) staples. Is subject to additional cleaning at the companies for production of food fat-and-oil products".
On the unmodified and modified vegetable oils or their mixes, held for use as food (food) staples and the subject purifications or repeated purification (additional cleaning) at the companies for production of food fat-and-oil products the declaration of conformity is adopted only on the specified products type.".
8. To state appendix 1 to the specified technical regulation in the following edition:

9. In appendix 2 to the specified technical regulation in the column of the first line item "Fats of special purpose, including fats culinary, confectionery, baking; substitutes of milk fat; the cocoa butter substitutes which are not tempered lauric type, mix melted vegetable and fatty" after words "lauric type" to add cocoa butter equivalents, improvers of cocoa butter of SOS type, substitutes of cocoa butter of POP type, the cocoa butter substitutes which are not tempered not lauric type with the words "the cocoa butter substitutes which are not tempered the mixed type".
10. In appendix 3 to the specified technical regulation in the column second of the word "¼Ý¬ó/kg" shall be replaced with words "мэкв active oxygen/kg".
11. Add with appendices 6 – 8 following contents:
