1. Approve the enclosed Rules of exchange of electronic transportation agreements of load, electronic way bills, electronic road sheets, electronic receipts on cargo reception for transportation, by the data containing in them between carrier and the sender and the directions of such documents and data containing in them in the state information system of electronic carriage documents.

2. This resolution becomes effective since September 1, 2024 and is effective till September 1, 2030.

Rules of exchange of electronic transportation agreements of load, electronic way bills, electronic road sheets, electronic receipts on cargo reception for transportation, the data containing in them between carrier and the sender and the directions of such documents and data containing in them in the state information system of electronic carriage documents

1. These rules define procedure for exchange by electronic transportation agreements of load, electronic way bills, electronic road sheets, electronic receipts on cargo reception for transportation (further - electronic documents), the data containing in them between carrier and the sender and the directions of such documents and data containing in them in the state information system of electronic carriage documents provided by the Federal Law "Charter of Road Transport and Urban Land Electric Transportation" (further - the state information system).

2. The concepts used in these rules mean the following:

"consignee" - person authorized on receipt of the load delivered by carrier in destination according to the transportation agreement of load specified in article 67 of the Code of inland water transport of the Russian Federation (further - the transportation agreement of load);

"information system of the participant of information exchange" - information system in the value determined in the Federal Law "About Information, Information Technologies and on Information Security" which components belong to the participant of information exchange on the property right and (or) other legal cause;

"other receivers" - legal entities or physical persons which interact with participants of information exchange also are specified by them in the file of exchange as his receiver;

"sender" - person who signed the transportation agreement of load, and also any person who handed over load to carrier on its own behalf;

"the pair file of exchange" - the file of exchange interconnected with other file of exchange. Lack of the pair file of exchange does not allow to use other file of exchange interconnected with it in case of execution of the electronic document;

"pool (array of values)" - the structure of data storing set of values (array elements) identified on index or set of the indexes accepting whole (or brought to whole) values from some set continuous range;

"the agreement on electronic document management of electronic documents" - the service provision agreement in the direction of the electronic documents and data containing in them in the state information system. Such agreement is the public agreement and can also provide rendering services in forming of the electronic documents and data containing in them;

"the unique identifier of the document" - unique code of the electronic document;

"the strengthened unqualified digital signature" - type of the digital signature which certificate of key of check is created and is used in the infrastructure providing information and technological interaction of the information systems used for provision of the state and municipal services electronically in the procedure established by the Government of the Russian Federation and on condition of the organization of interaction of physical person with such infrastructure using the means of information protection which underwent in accordance with the established procedure assessment procedure of compliance;

"participants of information exchange" - the sender, the consignee, carrier who signed the agreement on electronic document management of electronic documents with the operator of information system of electronic carriage documents;

"the file of exchange" - the XML file which is part of the electronic document and consisting of separate data of the electronic document.

In these rules the concept "operator of information system of electronic carriage documents" is used in the value determined in the Federal Law "Charter of Road Transport and Urban Land Electric Transportation", the concept "the strengthened qualified digital signature" is used in the value determined in the Federal Law "About the Digital Signature", the concept "carrier" is used in the value determined in the Code of inland water transport of the Russian Federation.

3. Exchange of the electronic documents and data containing in them between participants of information exchange, and also the direction of the electronic documents and data containing in them in the state information system are performed by means of use of information systems of the electronic carriage documents provided by the Federal Law "Charter of Road Transport and Urban Land Electric Transportation" (further - information system of electronic carriage documents).

4. The direction and receipt of files of exchange between participants of information exchange, and also the direction of files of exchange in the state information system are performed through information system of electronic carriage documents in compliance:

a) with Rules of the direction of electronic transportation agreements of load and the data containing in them in the state information system of electronic carriage documents according to appendix No. 1 according to the scheme of exchange of electronic transportation agreements of load and the data containing in them according to appendix No. 2;

b) with Rules of the direction of the electronic way bills and data containing in them in the state information system of electronic carriage documents according to appendix No. 3 according to schemes of exchange of the electronic way bills and data containing in them according to appendix No. 4;

c) with Rules of the direction of the electronic road sheets and data containing in them in the state information system of electronic carriage documents according to appendix No. 5 according to the scheme of exchange of the electronic road sheets and data containing in them according to appendix No. 6;

d) with Rules of the direction of electronic receipts on cargo reception for transportation and the data containing in them in the state information system of electronic carriage documents according to appendix No. 7 according to the scheme of exchange of electronic receipts on cargo reception for transportation and the data containing in them according to appendix No. 8.

5. Information exchange between participants of information exchange is performed on the basis of the principles of ensuring completeness, reliability, relevance and integrity of the information provided and received within information exchange, and also ensuring confidentiality of information, restriction of access to which is set by the legislation of the Russian Federation.

6. The electronic documents and data containing in them are represented to the state information system by operators of information systems of electronic carriage documents.

7. Representation in the state information system of the electronic documents and data containing in them is performed from the moment of forming of files of exchange on the formats approved by the Federal Tax Service. The term of submission of the electronic documents and data containing in them the operator of information system of electronic carriage documents in the state information system shall not exceed 10 minutes from the moment of receipt of such information from participants of information exchange.

8. Operators of information systems of electronic carriage documents provide compliance of the electronic documents and data containing in them, to the established formats of files of exchange approved by the Federal Tax Service.

9. The operator of information system of electronic carriage documents who signed the agreement on electronic document management of electronic documents with the participant of information exchange when obtaining from the participant of information exchange of the file of exchange performs:

a) verification of the file of exchange for compliance to the format approved by the Federal Tax Service;

b) check of the unique identifier of the document on its uniqueness;

c) check of the unique identifier of the document on accessory to pool (array of values) of the unique identifiers of the document issued to the participant of information exchange on its request from pool (array of values) of the unique identifiers of the document which are earlier received by the operator of information system of electronic carriage documents from the state information system;

d) check of validity of the strengthened qualified digital signature or the strengthened unqualified digital signature.
