About introduction of amendments to resolutions of the Cabinet of Ministers of Ukraine of December 25, 2013 No. 975 and of February 28, 2022 No. 168

The Cabinet of Ministers of Ukraine decides:

1. Bring in resolutions of the Cabinet of Ministers of Ukraine of December 25, 2013 No. 975 "About approval of the Procedure for appointment and payment of the one-time monetary assistance in case of death (death), disability or partial disablement without establishment of disability of the military personnel, persons liable for call-up and reservists called on educational (or checking) and special charges or for service in war reserve" (The Official Bulletin of Ukraine, 2014, No. 6, Art. 161; 2017, No. 43, Art. 1341, No. 94, Art. 2845; 2019, No. 34, Art. 1214; 2020, No. 95, Art. 3078; 2023, No. 68, Art. 3929; 2024, No. 20, the Art. 1289) and of February 28, 2022 No. 168 "Question of some payments to the military personnel, faces of the private and the commanding structure, to police and their families during action of warlike situation" (The Official Bulletin of Ukraine, 2022, No. 25, the Art. 1253, No. 29, the Art. 1577, No. 58, the Art. 3463, No. 80, Art. 4834; 2023, No. 13, Art. 778, No. 79, Art. 4481; 2024, No. 17, the Art. 1107) the enclosed changes.

2. This resolution becomes effective from the date of its publication and is applied regarding creation of the personal order by the serviceman, person liable for call-up and reservist called on educational (or checking) and special charges or to service in war reserve, and determinations of persons having the right to appointment and receipt of the one-time monetary assistance since March 29, 2024, except paragraphs of the third and fourth Item of 2 changes approved by this resolution which become effective from the date of publication of this resolution and are applied since May 4, 2024.

Procedure for appointment and payment of the one-time monetary assistance in case of death (death), disability or partial disablement without establishment of disability of the military personnel, persons liable for call-up and reservists called on educational (or checking) and special charges or for service in war reserve

1. This Procedure determines the mechanism of appointment and payment of the one-time monetary assistance in case of death (death), disability or partial disablement without disability establishment (further - the one-time monetary assistance) the military personnel, persons liable for call-up, reservists called on educational (or checking) and special charges or for service in war reserve, and persons discharged from military service (further - the serviceman, the person liable for call-up and the reservist).

Action of this Procedure extends to foreigners and persons without citizenship who on legal causes pass military service in Armed Forces, State special transservice and National guard under the contract (except Items 5-9, 13 of this Procedure).

2. The military personnel is considered carrying out obligations of military service in the conditions determined by the Law of Ukraine "About conscription and military service".

Persons liable for call-up and reservists are considered as the acting as military service, service in war reserve, in the conditions determined by the Law of Ukraine "About conscription and military service" and presidential decrees of Ukraine.

3. Day of emergence of the right to the one-time monetary assistance is:

in case of death (death) of the serviceman, the person liable for call-up, the reservist or person discharged from military service whose death came within year after its dismissal from military service, - the date of death specified in the death certificate;

in case of disability date establishment, specified in the reference of medico-social commission of experts, and in case of repeated survey and change of group of disability date, specified in the certificate of medico-social commission of experts of primary establishment of disability;

in case of establishment of degree of disability without disability establishment - the date of survey specified in the reference of medico-social commission of experts.
