About approval of Rules of marking of separate types of the grocery and other food products packed into consumer packaging, means of identification and the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning separate types of the grocery and other food products packed into consumer packaging

The government of the Russian Federation decides:

1. Approve the enclosed Rules of marking of separate types of the grocery and other food products packed into consumer packaging, means of identification.

2. Determine that participants of turnover of separate types of the grocery and other food products packed into consumer packaging, determined in the subitem "an" of Item 3 of this resolution (further - grocery products), according to the Rules approved by this resolution:

a) give to the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further - information system of monitoring), the statement for registration in information system of monitoring since March 1, 2025 (except for the participants of turnover of grocery products specified in the subitem "in (1)" Item 3 of this resolution which submit to information system of monitoring the application for their registration in information system of monitoring since September 1, 2025, the participants of turnover of grocery products specified in the subitem "in (2)" Item 3 of this resolution, and the participants of turnover of meat products specified in subitems "in (3)" and "in (4)" Item 3 of this resolution which submit to information system of monitoring the application for their registration in information system of monitoring since March 1, 2026), but no later than 7 calendar days from the date of emergence of need of implementation by the participant of turnover of grocery products of the activities connected with input in turnover and (or) turnover, and (or) conclusion from turnover of grocery products concerning which the input prohibition in turnover, and (or) turnover, and (or) conclusion from turnover of grocery products not marked by means of identification (except for the participants of turnover of grocery products falling under action of provisions of Items 3 and 7 of article 2 of the Federal law "About Use of the Control and Cash Equipment when Implementing Calculations in the Russian Federation" is established. At the same time the specified participants of turnover of grocery products in the remote or hardly accessible areas perform registration in information system of monitoring within 30 calendar days from the date of emergence of need of implementation of the activities connected with input in turnover by them and (or) turnover, and (or) conclusion from turnover of grocery products;

b) provide no later than 15 calendar days from the date of registration in information system of monitoring readiness of own software and hardware for information exchange with information system of monitoring and send to the operator of information system of monitoring the request for passing of testing of information exchange electronically;

c) for work on ensuring readiness of own software and hardware for information exchange with information system of monitoring and for passing of testing of information exchange electronically after registration in information system of monitoring send to the operator of information system of monitoring electronically the request for provision of remote access to the issue registration device placed in infrastructure of information system of monitoring;

d) pass test of information exchange of own software and hardware and information system of monitoring according to the procedure posted on the official site of the operator of information system of monitoring on the Internet concerning the transactions connected with marking of grocery products, its input in turnover, turnover and conclusion from turnover according to the Rules approved by this resolution no later than 15 calendar days from the date of readiness of own software and hardware for information exchange with information system of monitoring and the direction of the request according to the subitem "b" of this Item.

3. Determine that:

c) concerning sauces, spices, seasonings, spices, dry broths, dry soups and vinegar relating to codes of the commodity nomenclature 0712 20 000 0, 0712 90 900 0, of 0904, of 0905, of 0906, of 0907, of 0908, of 0909, of 0910, 1211 90 860 8 (regarding food products, except for mixes for production of drinks), 2103, 2104 10 000 0, 2209 00 and to codes of the OKPD2 01.28.1, 01.28.3 qualifier (regarding food products, except for mixes for production of drinks), 10.84.1, 10.84.2, 10.89.11.110, 10.89.11.130, 10.39.13. 000, packed into consumer packaging, the participants of turnover of grocery products performing input in turnover of such grocery products put funds of identification for grocery products and represent to information system of monitoring of the data on drawing means of identification and input in turnover of grocery products according to the Rules approved by this resolution since July 1, 2025;

d) the participants of turnover of grocery products (except for specified in paragraphs second and third this subitem) performing conclusion from turnover of grocery products (as in case of conclusion from turnover when implementing calculations using the control and cash equipment, and different ways) and (or) turnover of grocery products, represent to information system of monitoring of the data on conclusion from turnover and (or) turnover of grocery products according to the Rules approved by this resolution since September 1, 2026;

the participants of turnover of grocery products performing turnover and (or) conclusion from turnover of grocery products concerning the grocery products determined by the subitem "in (1)" this Item, represent to information system of monitoring of the data on conclusion from turnover and (or) about turnover of such grocery products according to the Rules approved by this resolution since June 1, 2027;

the participants of turnover of grocery products performing turnover and (or) conclusion from turnover of grocery products concerning the grocery products determined by the subitem "in (2)" this Item, represent to information system of monitoring of the data on conclusion from turnover and (or) about turnover of such grocery products according to Rules of marking of grocery products since November 1, 2027;

e) the participants of turnover of grocery products falling under action of provisions of Items 3 and 7 of article 2 of the Federal law "About Use of the Control and Cash Equipment when Implementing Calculations in the Russian Federation" having the right to represent the data specified in the Section VIII of the Rules approved by this resolution within 30 calendar days:

from the date of shipment (transfer or acceptance) grocery products by transfer (acceptance) of grocery products within the transactions providing transition of the property right to grocery products and also within commission agreements, and (or) agency agreements, and (or) works agreements, and (or) agreements of the order;

from the date of conclusion of grocery products from turnover in case of conclusion of grocery products from turnover;

from the date of return of grocery products to turnover in case of return of grocery products with the unimpaired means of identification;

from the date of modification of the data provided by Sections III, IV and VIII of the Rules approved by this resolution, according to the procedure, provided by the Section IX of the Rules approved by this resolution (if changes were made to such data);

e) participants of turnover of grocery products have the right to put funds of identification for grocery products and to represent to information system of monitoring of the data on drawing means of identification, input in turnover, about turnover and about conclusion from turnover of grocery products according to the Rules approved by this resolution since March 1, 2025, and concerning the grocery products determined by the subitem "in (1)" this Item, since September 1, 2025, concerning the grocery products determined by the subitem "in (2)" this Item, since March 1, 2026.

4. Determine that in the territory of the Russian Federation input in turnover of grocery products without drawing funds of identification for it and representation in information system of monitoring of data on marking of grocery products is allowed by means of identification before the corresponding dates, the stipulated in Item 3 presents of the resolution from which drawing funds of identification for grocery products and representation in information system of monitoring of data on drawing on grocery products of means of identification and its input in turnover becomes obligatory.
