About modification and amendments in some orders of the Minister of Agriculture of the Republic of Kazakhstan

I ORDER:

1. Approve the enclosed list of some orders of the Minister of Agriculture of the Republic of Kazakhstan to which changes and additions are made.

2. To provide to committee of veterinary control and supervision of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication.

The list of some orders of the Minister of Agriculture of the Republic of Kazakhstan to which changes and additions are made

1. In the order of the Minister of Agriculture of the Republic of Kazakhstan of October 30, 2014 No. 7-1/559 "About approval of regulatory legal acts in the field of veterinary science" (it is registered in the Register of state registration of regulatory legal acts No. 9891):

The list of especially dangerous diseases of animals in case of which obligatory withdrawal and extermination of the animals, products and raw materials of animal origin constituting health hazard of animals and the person are carried out, approved by the specified order to be reworded as follows according to appendix 1 to this list of some orders of the Minister of Agriculture of the Republic of Kazakhstan to which changes and additions are made (further – the List).

2. In the order of the Minister of Agriculture of the Republic of Kazakhstan of December 9, 2014 No. 16-04/647 "About approval of Rules of issue of the import permit, import and transit of the moved (transported) objects taking into account assessment of epizootic situation in the corresponding territory" (it is registered in the Register of state registration of regulatory legal acts No. 10254):

in Rules of issue of the import permit, import and transit of the moved (transported) objects taking into account assessment of epizootic situation in the corresponding territory approved by the specified order:

3) of Item 2 to state the subitem in the following edition:

"3) the web portal of "the electronic government" (further – the portal) – the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically.";

to state heading of Chapter 2 in the following edition:

"Chapter 2. Approval procedure for export, import and transit of the moved (transported) objects taking into account assessment of epizootic situation in the corresponding territory";

4, 5 and 6 to state Items in the following edition:

"4. The state service "Issue of the Import Permit and Import of the Moved (Transported) Objects taking into account Assessment of Epizootic Situation in the Corresponding Territory" (further – the state service) appears the Chief state veterinary health inspector of the Republic of Kazakhstan or his deputies (further – the service provider).

Physical persons and legal entities (further – uslugopoluchatel) for receipt of the import permit, import of the moved (transported) objects taking into account assessment of epizootic situation in the corresponding territory till the expected beginning of movement submit through the portal the application in form according to appendix 3 to these rules in electronic form, certified by the digital signature (further – the EDS) uslugopoluchatel.

4) quantity of the moved (transported) subject and unit of its measurement;

5) the exporting country or the importer and the country origin of the moved (transported) object;

6) mode of transport;

7) the list of check points through Frontier of the Republic of Kazakhstan through which import and export of the moved (transported) object will be performed;

8) route, stops, overloads, places of feeding (poyeniye) of animals, condition of transportation (stage) approved with the chief state veterinary health inspector or his deputies of the corresponding administrative and territorial unit through which territories transit of the moved (transported) object is performed.";

24, 25 and 26 to state Items in the following edition:

"24. The executive in charge of department within 1 (one) working day checks completeness and reliability of the provided data specified in Item 22 of these rules, and also compliance of the moved (transported) object to Item 23 of these rules.

In case of factual determination of completeness and reliability of the data specified in the letter and compliance to Item 23 of these rules, the executive in charge of department within 1 (one) working day draws up permission to transit of the moved (transported) objects taking into account assessment of epizootic situation in the corresponding territory in form according to appendix 4-1 to these rules, or motivated refusal.

25. The executive in charge of department sends to authorized body in the field of veterinary science of the importing country or the exporting country in electronic form permission to transit of the moved (transported) objects taking into account assessment of epizootic situation in the corresponding territory, or motivated refusal, signed by the Chief state veterinary health inspector of the Republic of Kazakhstan or his deputy.

26. The term of consideration of the letter and issue of permission or motivated refusal constitutes 2 (two) working days.";

"28. The chief state veterinary health inspector of the Republic of Kazakhstan or his deputy refuses issue of permission to transit of the moved (transported) object taking into account assessment of epizootic situation in the conforming territory in case of discrepancy to the requirements specified in Item 23 of Rules.";
