About introduction of amendments to some orders of the Ministry of Finance of the Republic of Kazakhstan

I ORDER:

1. Approve the enclosed list of some orders of the Ministry of Finance of the Republic of Kazakhstan to which changes are made.

2. To provide to committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan::

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

Bring in the order of the Deputy prime minister of the Republic of Kazakhstan – the Minister of Finance of the Republic of Kazakhstan of April 28, 2014 No. 191 "About approval of Rules of holding qualification examination" (it is registered in the Register of state registration of regulatory legal acts at No. 9479) the following changes:

"1. These rules of holding qualification examination of the administrator (further – Rules) are developed according to subitem 1-4) of article 15 of the Law of the Republic of Kazakhstan "About rehabilitation and bankruptcy", the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law) and the subitem 103) of Item 15 of the Regulations on the Ministry of Finance of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of April 24, 2008 No. 387 "About some questions of the Ministry of Finance of the Republic of Kazakhstan" and determine procedure for rendering the state service "Holding Qualification Examination of Persons Applying for the Right to Perform Activities of the Administrator (the Temporary Administrator, Rehabilitation, Interim and Bankrupt Managing Directors)" (further – the State service) the central state body performing state regulation in the field of rehabilitation and bankruptcy.";

"6. Uslugopoluchatel for receipt of the State service submits to the service provider through the portal the application for the admission to passing qualification examination according to appendix 1 to these rules.

The list of the main requirements to rendering the state service "Holding Qualification Examination of Persons Applying for the Right to Perform Activities of the Administrator (the Temporary Administrator, Rehabilitation, Interim and Bankrupt Managing Directors)" is provided according to appendix 2 to these rules.

7. The structural division of the service provider responsible for documents acceptance, in day of receipt of the statement and documents performs their acceptance and registration.

Information on the status of adoption of the statement to rendering the state service goes to "personal account" of uslugopoluchatel through the portal.

In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays, reception of applications and issue of results of rendering the state service is performed the next working day.

"27. The claim of uslugopoluchatel which arrived to the service provider according to Item 2 of article 25 of the Law is subject to consideration within 5 (five) working days from the date of its registration.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within 15 (fifteen) working days from the date of its registration.";

Bring in the order of the First deputy Premier-Ministra of the Republic of Kazakhstan – the Minister of Finance of the Republic of Kazakhstan of April 1, 2020 No. 343 "About approval of Rules of placement on Internet resource of the Ministry of Finance of the Republic of Kazakhstan of the list of persons having the right to perform activities of the administrator, appointment and discharge of rehabilitation and bankrupt managing directors" (it is registered in the Register of state registration of regulatory legal acts at No. 20278) the following changes:

The consent of uslugopoluchatel provided according to article 8 of the Law of the Republic of Kazakhstan "About personal data and their protection" to access to personal data of limited access which are required for rendering the state service
