About approval of Changes in Rules of transportation of passengers, baggage, cargo baggage and mail by railway transport of Ukraine

According to part two of article 8 of the Law of Ukraine "About rail transport", Item 3 of the Procedure for the servicing of citizens by rail approved by the resolution of the Cabinet of Ministers of Ukraine of March 19, 1997 No. 252, and Item 8 of the Regulations on the Ministry of the development of communities and the territories of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of June 30, 2015 No. 460 (in edition of the resolution of the Cabinet of Ministers of Ukraine of December 17, 2022 to No. 1400), I ORDER:

1. Approve Changes in Rules of transportation of the passengers, baggage, cargo baggage and mail railway transport of Ukraine approved by the order of the Ministry of Transport and Communications of Ukraine of December 27, 2006 No. 1196, registered in the Ministry of Justice of Ukraine on April 04, 2007 at No. 310/13577, which are applied.

2. To provide to management of rail transport submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3. To provide to the sector of external communications promulgation of this order on the official website of the Ministry of development of communities and the territories of Ukraine.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the deputy minister Andrey Kashubu.

Changes in Rules of transportation of passengers, baggage, cargo baggage and mail by the railway transport of Ukraine approved by the order of the Ministry of Transport and Communications of Ukraine of December 27, 2006 No. 1196, registered in the Ministry of Justice of Ukraine on April 04, 2007 at No. 310/13577

1. In Section 1:

Item 1.3 to state 1) in the following edition:

"1.3. Railway mail service is performed by carrier in the special cars equipped for transportation of mail on contractual conditions.";

Item 1.5 to state 2) in the following edition:

"1.5. Officials of carrier and the service provider of all levels of process control of transportation of passengers, baggage, cargo baggage and servicing of passengers shall perform personal reception of citizens concerning their servicing.

Information on procedure and graphics of reception of citizens is posted on the official website of carrier and in the representative of carrier or the service provider in the place, available to free acquaintance.";

3) in Item 1.7:

in paragraph nine to exclude the word "office";

the fifteenth to state the paragraph in the following edition:

"The waiting room of the increased comfort - the waiting room in which the additional paid and non-paid services directed to increase in comfort during stay of passengers are provided.";

the twenty fourth after words of "travel documents" to add the paragraph with words ", suburban tickets.";

to state the paragraph of the twenty seventh in the following edition:

"Compartment men's (women's) - compartment in which sale of travel documents only for persons of men's (female) floor respectively is performed and in which journey is allowed to children up to 6 years of any floor without acquisition of the separate travel document on the child if the child does not take the certain place in such compartment.";

add after the paragraph of the thirtieth with the paragraph the thirty first the following content:

"the service provider - the subject of managing providing the services connected with servicing of passengers.".

With respect thereto to consider paragraphs of the thirty first-eighty sixth respectively paragraphs the thirty second-eighty seventh;

in the paragraph the thirty sixth shall be replaced with words the words "in Item of initial departure" "on all transit";

in the paragraph fifty third "live" to replace the word with the word of "house";

in the paragraph the fifty fourth the words "Landing Document" shall be replaced with words "The landing document";

in the paragraph the fifty fifth shall be replaced with words the words "Service Transport" "The service the main (transport)";

to state the paragraph of the fifty sixth in such edition:

"Service additional - the part of transport service provided to passengers together with the main service (during registration of journey, acceptance of baggage or cargo baggage, stay in the train or at the station, during return of unused travel and carriage documents) or separately from it.";

after the paragraph of the fifty sixth to add with the paragraph the fifty seventh the following content:

"The representative of carrier or the service provider - physical person which is the worker or the official of carrier or the service provider and which provides provision of services on transportation of the passengers, baggage, cargo baggage or services connected about servicing of passengers.".

With respect thereto to consider paragraphs of the fifty seventh-eighty seventh respectively paragraphs the fifty eighth-eighty eighth;

to state the paragraph of the sixty sixth in the following edition:

"The baggage transceiver - the representative of service provider who accepts baggage and cargo baggage for shipment in the luggage car and issues it at stations of stop of the train to the representative of service provider or the passenger.";

in the paragraph the sixty ninth shall be replaced with words the words "in specialized cash desk" "in the cash desk determined by carrier";

to state the paragraph of the seventy second in such edition:

"Service center (lounge zone) - specially equipped room for servicing of passengers in the conditions of the increased comfort, provision of additional services by it (meeting rooms, rest areas, the high-speed Internet, etc.).".

2. In Section 2:

Paragraph one of Item 2.3 to state 1) in the following edition:

"2.3. In Items of sale of travel documents information with the schedule of movement of passenger trains on the station of arrangement of cash desks is placed.";

Item 2.13 to add 2) with two new paragraphs of the following content:

"At stations at which significant amount of foreigners and which list is determined by JSC Ukrzaliznytsya taking into account running of trains in the international message information of rather transport servicing (the schedule of movement of passenger trains, the fare and luggage transports and cargo baggage from station of origin to stations, the flow of passengers to which is the greatest, excerpts from rules of transportations of passengers, baggage, cargo baggage uses services working schedules and specialization of ticket, luggage offices, left-luggage offices, luggage, cargo luggage storages, storages of hand luggage, service which are provided at the station (station) and their cost, placement of station rooms, places and reception hours of passengers by officials of the service provider, the address and phone numbers of the service provider), along with state language take place also in English.

Information is provided to foreigners and stateless persons which address in service desks at stations in English by representatives of carrier or the service provider in address language.";

3) in Item 2.16 of the word of "cash desks of advance sale", "this" shall be replaced with words "sale Items", "it" respectively;

4) in Item 2.17:

in paragraph one of the word "At Stations, in City Railway Ticket Offices, Luggage Compartments, in Ticket Offices of Linear Stations and Stopping Points, in Passenger Trains" shall be replaced with words "At stations, in Items of sale of travel documents, luggage compartments, in cars of passenger trains";

add with the new paragraph of the following content:

"At stations, in Items of sale of travel documents, luggage compartments, in cars of passenger trains, and also other divisions of rail transport which provide services to passengers including on all objects of fixed retail chain stores, information with indication of official information channels of JSC Ukrzaliznytsya for the address of citizens concerning observance of regulations of quality of provision of services at stations and in trains is placed.";

Paragraph one of Item 2.19 to state 5) in the following edition:

"2.19. The representative of service provider (the chief of the station) shall perform daily acceptance of passengers concerning ensuring regulations of quality of the provided services in servicing of passengers at stations. On out-of-class and the I class stations such acceptance of passengers shall be performed several times in days.";

Item 2.20 to state 6) in the following edition:

"2.20. During mass departure of passengers (the beginning or the end of summer season, holiday or posleprazdnichny days, etc.) the carrier, based on monitoring of density of population of trains and demand in the directions, provides departure of passengers taking into account technical capability and handling capacity of infrastructure of rail transport.";

Item 2.21 to state 7) in the following edition:

"2.21. If the representative of carrier for any reasons cannot satisfy request on ensuring departure of persons specified in subitems 4, of the 5th Item 3.1 of Section 3 of these rules, then he shall inform on it the official of the relevant division of carrier for to make the decision on ensuring departure of such persons.";

To state Item 2.22 in the following edition:

"2.22. For ensuring temporary rest of passengers who will drive off the service provider shall provide availability at the station of waiting rooms and whenever possible recreation rooms, recreation rooms for passengers with children, waiting rooms of the increased comfort, halls for persons with disability, other rooms and the equipment necessary for provision of services connected with servicing of passengers.";

Paragraph two of Item 2.26 to state 9) in the following edition:

"On condition of the redemption of separate compartment payment of the places which are not occupied by passenger(s) is performed at full cost. Journey on the taken seats in a compartment is drawn up on separate forms with indication of surname and name of the passenger, the additional place(s) is drawn up (-yutsyatsya) on one of passengers who will follow in this compartment.";

Shall be replaced with words 10) in Item 2.32 of the word "on each place taken by children" also in figures "on each place taken by children on condition of placement on one shelf no more than 2 children under 6 years.";

11) in paragraph five of Item 2.34 of the word "landing document" in all cases shall be replaced with words "the landing document" in the corresponding cases, after words "conductor" to add with the word "(steward)";

The paragraph third Item 2.35 to add 12) with words ", including by interaction with the consent of person with other information and communication systems (mobile applications) providing possibility of electronic identification".

3. In Section 3:

Item 3.1 to state 1) in the following edition:

"3.1. Have the right of extraordinary execution of travel documents in sale Items (in case of the personal address with presentation of the identity certificate):

1) People's Deputies of Ukraine, deputies of the Autonomous Republic of Crimea (within the Autonomous Republic of Crimea);

2) persons having special merits before the Homeland according to the Law of Ukraine "About the status of veterans of war, guarantees of their social protection" and the faces having special labor merits before the Homeland according to the Law of Ukraine "About the basic principles of social protection of veterans of work and other citizens of advanced age in Ukraine";

3) combatants;

4) persons with disability owing to war I, II and III groups and persons equated to them;

5) persons with disability, children with disability and persons accompanying persons with disability of the first group or children with disability (no more than one person, accompanying person with disability of the first group or child with disability);

6) persons accompanying the sick children belonging to victims of the Chernobyl catastrophic crash to the place of treatment (rehabilitation), improvement and back (in the direction of medical institutions);

7) prosecutors and investigators;

8) police officers;

9) employees of the Security Service of Ukraine;

10) staff of Management of the state protection of Ukraine;

11) judges;

12) face of the private and the commanding structure of bodies and divisions of civil protection and rescuers;

13) the persons accompanying People's Deputies, specified in its business trip order;

14) persons awarded with three degrees of the sign "Railway Slava" - in case of personal trips and trips of family members;

15) members of the State extraordinary antiepizootic commission under the Cabinet of Ministers of Ukraine on duty;

16) the military personnel in case of the direction in business trip to the new place of passing of military service, and also to the place of use of leave;

17) honourable railroad workers.";

2) in Item 3.2 of the word and figures "in subitems "i" - "m", "п" Item 3.1 and in subitems "v", "e", "zh" of Item 3.4" shall be replaced with words also in figures "in subitems 7-12, 15 of Item 3.1 and in subitems 3, of 7, of the 9th Item 3.4 of this Section,";

To add 3) after Item 3.2 with Item 3.3 of the following content:

"3.3. The carrier takes organizational measures for ensuring first-priority and extraordinary servicing of persons listed in Items 3.1 and 3.4 of this Section.".

With respect thereto Items 3. 3.4 to consider 3, respectively by Items 3. 4, 3.5;

4) in Item 3.4:

in paragraph one of the word "in daily cash desks" shall be replaced with words "in Items of sale of travel documents";

in paragraphs the second - the tenth the letters "a)", "b)", "c)", "d)", "g") ", " д) ", " е) ", " э) ",")" to replace with figures "1)", "2)", "3)", "4)", "5)", "6)", "7)", "8)", "9)" respectively;

paragraphs the eleventh, twelfth to exclude;

Item 3.5 to state 5) in the following edition:

"3.5. Persons listed in subitems 7-12 of Item 3.1 and in the subitem 3 of Item 3.4 of this Section are provided with departure in days of departure of the train irrespective of availability of empty seats. In case of lack of empty seats landing in the train of the listed persons is performed in the staff car of the train.".

4. In Section 5:

1) in Item 5.1 of the word of "international agreements" to exclude;

Item 5.3 to exclude 2).

With respect thereto to consider Items 5.4-5.9 respectively Items 5.3-5.8.

5. In Section 6:

Item 6.3 to exclude 1).

With respect thereto to consider Items 6.4-6.19 respectively Items 6.3-6.18;

Item 6.16 to exclude 2).

With respect thereto Items 6. 6.18 to consider 17, respectively by Items 6.16-6.17.

6. In Section 7:

1) in Item 7.3:

in paragraph one after words "the train and the car," to add with words "like compartment (men's, women's),";

third to state the paragraph in the following edition:

"Passengers without travel documents or with invalid travel documents or with the travel documents processed with use of mobile communication, Internet, specialized self-service terminals with violation of requirements of carrier to compartment type (men's, women's), with surname and name in the travel document which do not correspond to data of the identity document (except for the allowed slips no more than three signs) without identity documents, with hand luggage there are more established regulations and with exceeding of the sizes established for hand luggage in the car are not allowed.";

2) in Item 7.7:

the second offer of paragraph one to state in the following edition: "If the place of the lowest category is provided to the passenger, then to it the fare difference after completion of trip according to the procedure, determined by these rules returns.";

add after paragraph one with the paragraph the second the following content:

"In case of execution of the travel document with use of mobile communication, Internet, specialized self-service terminals with violation of requirements of carrier to compartment type (men's, women's), with the consent of the passenger the place in other compartment (car) of the category specified in the travel document is provided.".

With respect thereto to consider paragraph two respectively the paragraph third;

Item 7.8 to state 3) in the following edition:

"7.8. Persons specified in subitems 7-12 of Item 3.1 and in the subitem 3 of Item 3.4 of Section 3 of these rules perform landing only in the staff car of the train on condition of presentation of the official ID and the document confirming the fact of making of trip.

The chief of the train (chief steward) within hour from the moment of departure of the train shall place the passenger of the specified category on the available empty seat and draw up journey in accordance with the established procedure.";

In paragraphs one and the second Item 7.9 of the word of "landing documents" shall be replaced with words 4) "landing documents";

Item 7.12 to state 5) in the following edition:

"In cars for passengers information which along with state language moves also in English, about the schedule of movement of this train (the through-car), about the services provided in the train, the location of the complaint book, number of the car in which there is chief of the train, the location of the owner of cars of the train, availability in the train of dining-car (car cafe), its placement according to the scheme of the train, operating mode, the plan of evacuation, the instruction sheet for passengers concerning actions in case of fire, and also excerpts from these Rules concerning the rights and obligations of passengers and conductors (stewards) of cars, information with indication of official information channels of the carrier/service provider or other subject of managing for the address of citizens concerning observance of regulations of quality of provision of services in the train is placed.".

7. In Section 8:

1) in paragraph one of Item 8.3 of the word "to the person on duty on the station, the station commander or the chief of the station" shall be replaced with words to "the representative of service provider at the station (station)";

2) in Item 8.8:

in the first offer of the word "to the station commander (station) who at the expense of seeing off sends the telegram (telephone message) to the chief of the train" shall be replaced with words to "the representative of service provider at the station (station) who at the expense of seeing off sends the telegram (telephone message) to the chief of the train (chief steward)";

in the second offer after words "the chief of the train" to add with words "(chief steward)";

3) in Item 8.12 of the word of "the chief of the station" shall be replaced with words "the representative of service provider at the station (station)", after words to "the chief of the train" to add with words to "(chief steward)";

Item 8.15 to state 4) in the following edition:

"8.15. The passenger who lagged behind the train shall address the representative of service provider at the station (station) which shall inform the representative of service provider at the station (station) on the train course where the train has stop at least 10 minutes, and the chief of the train (chief steward) about need of removal of things and the travel document of such passenger.";

Shall be replaced with words 5) in Item 8.16 of the word "station commander" "the representative of service provider at the station (station)";

Item 8.17 to state 6) in the following edition:

"8.17. Transfer of things and the travel document by the chief of the train (chief steward) to the representative of service provider at the station (station) is drawn up by the act of general form in duplicate with the description of things. Confirmation of the fact of obtaining of these by the prophetic passenger makes sure the signature of the passenger on both copies of the act.";

To "the person on duty on the station (station)" shall be replaced with words 7) in Item 8.18 of the word to "the representative of service provider at the station (station)".

8. In Section 10:

1) in Item 10.5:

word in paragraph one of "the states of the CIS" shall be replaced with words "other states";

in paragraphs the second or fourth the letters "a)", "b)", "c)" to replace with figures "1)", "2)", "3)" respectively;

state subitem 2 in the following edition:

"2) the ticket for driving through the territory of other states through the tariffs declared by carriers of these states;";

in subitem 3 to replace the word of "state" with the word of "carrier";

2) in Item 10.14:

word in paragraph one of "large dogs, small room animals and room decorative birds" shall be replaced with words "pets (dogs, cats, poultry, etc.)";

state paragraph two in the following edition:

"Transportation of seeing eye dogs, accompanying persons with disability, guard dogs accompanied by officials and dogs accompanied by the military personnel, is not paid.".

9. In Section 12:

1) in Item 12.1:

word in paragraph one of "travel and carriage documents" shall be replaced with words "travel, carriage documents and suburban tickets";

in the paragraph the second ambassador of the word of "document" to add with words ", the suburban ticket";

in the Abaze third "landing" to replace the word with the word of "landing";

after the paragraph of the ninth to add with the paragraph the tenth the following content:

"execution of the suburban ticket by the representative of carrier during travel by the local train;".

With respect thereto the tenth or twelfth to consider paragraphs respectively paragraphs the eleventh or thirteenth;

add with the new paragraph of the following content:

"registration of the reserved place on the travel document in the cash desk determined by carrier.";

Item 12.2 to add 2) with the new paragraph of the following content:

"The service fee (sales charge) on execution of suburban tickets is not levied if the cost of the suburban ticket, including preferential, is less than the size of service fee on registration.";

Item 12.4 to state 3) in the following edition:

"12.4. Procedure for establishment of service fee additional for group transportations and the amount of payment is determined by booking by carrier according to the procedure, not contradicting the legislation on protection of the economic competition.

The payment for booking for ensuring first-priority and extraordinary servicing of persons specified in Items 3.1 and 3.4 of Section 3 of these rules is not levied.".

10. To state Item 13.9 of Section 13 in the following edition:

"13.9. Running of the cars included in the train for office needs of JSC Ukrzaliznytsya is performed gratuitously, according to the personal written errand of the official of JSC Ukrzaliznytsya.".

11. In Section 15:

1) in heading of the Section of the word of "LIVE ANIMALS AND BIRDS" shall be replaced with words "PETS";

Item 15.7 to state 2) in the following edition:

"15.7. The passenger has the right to transport in case of himself pets who do not create threat to people around (dogs of small breeds, cats, poultry, etc.) in trains and cars of all categories in special means for transportation (cage, container, box, basket, backpack, bag or other reservoir with the waterproof absorbing bottom) that make impossible damage or pollution of the internal equipment of the car and things of passengers. It shall be transported on the places provided for placement of hand luggage (in cars of night trains - under the shelf or on the shelf near the passenger, in cars with places for sitting - on hands at the passenger or under places for sitting).

Transportation of dogs of small breeds without special means for transportation is allowed in cars of all categories with places for lying, on condition of the redemption of all unoccupied places on the fare of the adult passenger.

Dogs of large breeds (it is higher than 45 cm in withers) and the dogs (irrespective of the size) carried to the list of dangerous breeds of dog approved by the resolution of the Cabinet of Ministers of Ukraine of November 10, 2021 No. 1164, are transported in the presence of muzzle and lead (chain or belt binding):

a) in separate compartment of compartment car or the car more high-class no more than two individuals and on condition of the redemption of all unoccupied places on the fare of the adult passenger;

b) in trains of category "Intersiti" and "Intersiti +" - on condition of the redemption of all places placed by the single block near the place of the passenger of the attendant of dog on the fare of the adult passenger. At the same time placement of such dogs on places for sitting is forbidden. The dog takes place on floor under seats or near them provided that such placement does not create danger or inconvenience for other passengers. The attendant shall provide supervision of dog, for the purpose of non-admission of violation of tranquility and safety of passengers and office personnel of carrier.

In case of absence at carrier of opportunity to draw up journey in separate compartment for transportation of pets such transportation is not allowed.

In cars with seats:

a) dogs of large breeds (it is higher than 45 cm in withers) are transported in extreme platforms of the first and last cars in the presence of muzzle and lead (chain or belt binding) under observation of the accompanying person. At the same time the attendant shall go on site, located at exit from the car and to provide supervision of dog for the purpose of non-admission of violation of tranquility and safety of passengers and office personnel of carrier. Dogs of small breeds are transported on hands or under the owner's seat.

b) pets (dogs of small breeds, cats, poultry, etc.) (no more than two individuals) are transported in special means for transportation (cage, container, box, basket, backpack, bag or other reservoir with the waterproof absorbing bottom) that make impossible damage or pollution of the internal equipment of the car and things of passengers (no more than one place of hand luggage), take place on the places intended for hand luggage on hands at the passenger or under places for sitting.

Agricultural birds (hens, turkeys, geese, ducks, guinea fowls, quails, pigeons etc.) it is allowed to transportation only in general cars of passenger trains and in regional trains in special means for movement (no more than one place of hand luggage) which sizes do not exceed the sizes provided for hand luggage.

Availability of properly processed veterinary document for pets is obligatory.

The carriage charge of pets in case of the passenger in cars is paid for individual or the place on rate for luggage transport as for 20 kg, registration of transportation is performed according to the luggage receipt.

Transportation of seeing eye dogs, accompanying persons with disability, guard dogs (the dogs transported accompanied by the military personnel during action of legal regime of warlike situation in Ukraine and within 180 days from the date of its termination or cancellation) is performed in the presence of muzzle (except for seeing eye dogs of small breeds which are not carried to the list of the dangerous breeds of dog approved by the resolution of the Cabinet of Ministers of Ukraine of November 10, 2021 No. 1164) and lead (chain or belt binding) in cars and trains of all categories without additional payment.

The seeing eye dog shall be near the accompanying passenger and keep on short lead (chain or belt binding).

In all cases the passenger provides observance of sanitary and hygienic requirements in transit animals in case of whose violation provides their elimination.

In case of the unexpected situations connected with transportation of pets the chief of the train, (chief steward) takes necessary measures for their settlement.";

To add 3) in Item 15.9 after words of "hunting weapon" with the words "in the presence of the relevant document of allowing nature on right to use by this weapon)".

12. In Section 16:

1) in heading of the Section of the word of "LIVE ANIMALS AND BIRDS" shall be replaced with words "PETS";

The word "portable" to replace 2) in Item 16.2 with the word "automatic";

The word "carrier" shall be replaced with words 3) in Item 16.4 "service provider";

4) in Items 16. 16.6 after the word "storage" to add 5, with the words "to stationary left-luggage office";

5) in Item 16.7 of the word "animals and birds" shall be replaced with words "pets";

And figures "Things weighing more than 50 kg or large-size" to replace 6) in Item 16.9 of the word with the word "Things";

Shall be replaced with words 7) in Item 16.10 of the word "station commander", "carrier" "the representative of service provider at the station (station)", "the official of the service provider" respectively;

8) in Item 16.13:

in the first offer to replace the word "storage" with the word "storage";

in the fourth offer of the word of "station commander" shall be replaced with words "the official of the service provider at the station (station)".

13. In Section 17:

Item 17.2 to state 1) in the following edition:

"17.2. The things forgotten and found at the station (station) or in the train which arrived to terminal point or on stage, adjacent to the station, transfer to the representative of service provider who writes down them in the accounting book. On thing attach label with indication of the station and sequence number on which the subject is written down in the accounting book. On such things as node, sack, suitcase and others, seals or seals are set.

Before imposing of seal of thing open in the presence of the representative of police about what the separate statement with the description of things is drawn up. The copy of the description is issued to the person who found things.".

Paragraph two of Item 17.4 to state 2) in the following edition:

"If things are stored at the station (station) where they were found or handed over, then they are immediately issued to the owner according to the order of the official of the service provider after verification of the documents confirming the personality. If things are sent for realization, then the statement for their issue is transferred to the representative of service provider.".

14. To state paragraph two of Item 18.15 of Section 18 in the following edition:

"The chief of the train under this act to which the defective travel document is attached issues to the passenger free of charge new travel document / reserved seat for journey in the same category of the car and train on which reverse side the mark "It Is Issued instead of Withdrawn" is designated.
