About measures for implementation of the Presidential decree of the Republic of Belarus of August 26, 2024 No. 335

In pursuance of Item 3 of the Presidential decree of the Republic of Belarus of August 26, 2024 "About rendering services of cellular mobile telecommunication" the Council of Ministers of the Republic of Belarus DECIDES: No. 335

1. Determine that the operators of cellular mobile telecommunication rendering services of cellular mobile telecommunication it is direct to the population, direct annually part of the net profit of the current year got from rendering of services of cellular mobile telecommunication, in the amount of 20 percent from the total amount of the specified net profit to projects implementation and the actions called in paragraphs third or pole of subitem 1.1 of Item 1 of the Presidential decree of the Republic of Belarus of August 26, 2024 No. 335.

2. Approve:

requirements to scope of the territory of the Republic of Belarus (are attached) by services of cellular mobile telecommunication and their quality;

The regulations on procedure of control (supervision) of scope of the territory of the Republic of Belarus (are applied) by services of cellular mobile telecommunication and their quality.

3. Make changes to the following resolutions of Council of Ministers of the Republic of Belarus:

3.1. add appendix to the resolution of Council of Ministers of the Republic of Belarus of May 30, 2003 with No. 724 "About measures for implementation of system of the state social standards for servicing of the population of the republic" Item of 21 following contents:

"21. Scope baseline of services of cellular mobile telecommunication

during calendar month – 200 minutes of voice traffic in all networks of telecommunication in the territory of the Republic of Belarus, 2 GB of traffic of data transmission, 50 SMS messages

The presidential decree of the Republic of Belarus of August 26, 2024 No. 335 "About rendering services of cellular mobile telecommunication";

3.2. in Rules of rendering the services of telecommunication approved by the resolution of Council of Ministers of the Republic of Belarus of August 17, 2006 No. 1055:

in Item 3:

in the paragraph the nineteenth to replace the word of "Sms" with the word of "SMS messages";

in the paragraph the forty fourth to replace the word "Sms" with the word "SMS message";

the sixth Item 9 to state part in the following edition:

"Rendering other services of telecommunication, except provided by the agreement, can be performed after making by the subscriber of actions, stipulated in Item 3 Articles 408 of the Civil code of the Republic of Belarus. At the same time the consent of the subscriber to rendering (the rendering termination) by the operator of telecommunication, the service provider of telecommunication to the subscriber of information services of help and (or) entertaining nature is expressed to one of the following methods:

putting down of mark in personal account of the subscriber in the official site of the operator of telecommunication, the service provider of telecommunication on the Internet (mobile application);

direction of the USSD request or SMS message;

filing of application in the service center of the operator, the service provider of telecommunication;

the method specified in part three of Item 11 of these rules.";

in Item 12:

in part one to replace the word "Sms" with the word "SMS messages";

to state the paragraph of the sixth part two in the following edition:

"SMS message;";

in paragraphs the eighteenth or twentieth Item 28 to replace the word of "Sms" with the word of "SMS messages";

to add part one of Item 40 with the offer of the following content: "The minimum effective period of tariff plan on services of cellular mobile telecommunication constitutes two years from the date of its establishment.";

in Item 50 part two to replace the word "Sms" with the word "SMS messages";

appendix to these Rules to be reworded as follows (is applied).

4. To the Ministry of Communications and Informatization till April 1, 2025 to approve technique of assessment of fulfillment of requirements to scope of the territory of the Republic of Belarus by services of cellular mobile telecommunication and to their quality.

5. This resolution becomes effective in the following procedure:

Items 2 and 3 – since April 1, 2025;

other provisions of this resolution – after its official publication.

Regulations on procedure of control (supervision) of scope of the territory of the Republic of Belarus services of cellular mobile telecommunication and their quality

1. This Provision determines procedure of control (supervision) of fulfillment of requirements to scope of the territory of the Republic of Belarus by services of cellular mobile telecommunication and to their quality (further – requirements to cellular communication).

For the purposes of this provision requirements to cellular communication are understood as ensuring cellular mobile telecommunication with operators in the territory of the Republic of Belarus of levels of useful signals of the transferring (basic) stations of networks of cellular mobile telecommunication on entrance of receivers of the test hardware and software, test mobile stations is not lower than the values established:

requirements to scope of the territory of the Republic of Belarus the services of cellular mobile telecommunication and their quality approved by the resolution of Council of Ministers of the Republic of Belarus which approved this Provision;

Items 1-19 of appendix to the Rules of rendering services of telecommunication approved by the resolution of Council of Ministers of the Republic of Belarus of August 17, 2006 No. 1055;

technical regulatory legal acts, obligatory for application.

2. For the purposes of this provision terms and their determinations in the values established by the Law of the Republic of Belarus of July 19, 2005 No. 45-Z "About telecommunication", the resolution of Council of Ministers of the Republic of Belarus of August 17, 2006 No. 1055 "About approval of Rules of rendering services of telecommunication are used".

3. Control (supervision) of fulfillment of requirements to cellular communication is exercised by the State inspectorate of the Republic of Belarus for telecommunication of the Ministry of Communications and Informatization (further – the State inspection) by holding the following events (further – actions for control (supervision):

planned and unplanned measurements of levels of useful signal from the transferring (basic) stations of cellular mobile telecommunication, parameters (indicators) of service quality of cellular mobile telecommunication and other technical parameters necessary for assessment of their compliance to requirements to cellular communication;

carrying out technical calculations of zones of servicing of the transferring (basic) stations of cellular mobile telecommunication, other parameters (indicators) of service quality of cellular mobile telecommunication, creation of cards of scope of the territory of the Republic of Belarus services of cellular mobile telecommunication;

"PRAISING" entering of results of the measurements taken by the State inspection into information resources of system *, including concerning the revealed sites of the territory of the Republic of Belarus on which the scope is not provided with services of cellular mobile telecommunication and (or) parameter value (indicators) of service quality of cellular mobile telecommunication, network functioning of telecommunication and servicing of subscribers do not correspond to the values established in requirements to cellular communication (further – shortcomings);

services of cellular mobile telecommunication and their quality based on data of system "PRAISING" monitoring of scope of the territory of the Republic of Belarus;

assessment of accomplishment by operators of cellular mobile telecommunication of requirements to cellular communication;

control (supervision) of use in the territory of the Republic of Belarus the radiating radio-electronic means and high-frequency devices.

* For the purposes of this resolution under system "PRAISING" the quality control system of services of cellular mobile telecommunication of the State inspection consisting of the monitoring systems of radio-frequency range, stationary (serviced and unattended) and (or) mobile technical complexes of radio control and measuring instruments, others technical, software and information resources used for control (supervision) of fulfillment of requirements to cellular communication is understood.

4. Actions for control (supervision) shall not break production economic activity of operators of cellular mobile telecommunication.

5. The state inspection determines from among the workers the officials who are directly realizing powers on control (supervision) of fulfillment of requirements to cellular communication.

6. Actions for control (supervision) are performed according to the annual plan of control (supervision) approved by the State inspection and also can be carried out within consideration of addresses of citizens, including individual entrepreneurs, legal entities and (or) at the request of the Ministry of Communications and Informatization.

7. Control (supervision) of fulfillment of requirements to cellular communication is exercised in the territory of settlements, infrastructure facilities, along automobile and long distance railways and in other territories of the Republic of Belarus specified in requirements to cellular communication.

8. In case of identification of violations of requirements to cellular communication the State inspectorate has the right to take out to the operator of cellular mobile telecommunication obligatory for accomplishment by it the instruction about remedial action (further – the instruction).

In the instruction are specified:

start and end dates of control (supervision) of fulfillment of requirements to cellular communication;

information on the operator of cellular mobile telecommunication who allowed failure to meet requirements to cellular communication;

list of shortcomings;

terms for elimination of the revealed shortcomings and informing the State inspection on accomplishment of the instruction;

surname, own name, middle name (if that is available), position of person which took out the instruction.

9. The instruction within three working days from the date of its signing by the head of the State inspection or the official authorized by it goes in writing or in electronic form by means of system of interdepartmental electronic document management of state bodies (for subscribers of this system) to the operator of cellular mobile telecommunication who allowed failure to meet requirements to cellular communication or is handed to the authorized representative of the operator of cellular mobile telecommunication under list.

The operator of cellular mobile telecommunication in the terms established in the instruction eliminates defects and informs the State inspectorate on accomplishment of the instruction.

10. Operators of cellular mobile telecommunication realize actions for elimination of the revealed shortcomings.

Data on such actions are entered by operators of cellular mobile telecommunication into the system "PRAISING" no later than the 15th following quarter in which were entered into the system "PRAISING" data on shortcomings.

The term of elimination by operators of cellular mobile telecommunication of shortcomings cannot exceed two years from the date of entering of data on these shortcomings into system "PRAISING".

11. Operators of cellular mobile telecommunication after remedial action enter into the system "PRAISING" the corresponding mark.

The state inspection within two months after introduction of cellular mobile telecommunication of mark by the operator about remedial action performs actions for control (supervision) of their elimination.

12. "PRAISING" access to system it is provided by the State inspection:

to operators of cellular mobile telecommunication according to the order of interaction of the Ministry of Communications and Informatization, State inspection, operators of cellular mobile telecommunication for the purpose of improvement of quality of work of networks (rendering services) of cellular mobile telecommunication approved by the Minister of Communications and Informatization;

to state bodies on a grant basis for accomplishment of the tasks and functions assigned to them (according to the decision of the Minister of Communications and Informatization).

13. The state inspection in coordination with the Ministry of Communications and Informatization determines structure placed in open access, including on the official site of the State inspection on the global computer Internet, data on results of monitoring procedure (supervision) of fulfillment of requirements to cellular communication and about the revealed shortcomings, including about shortcomings, data on which are entered into the system, "PRAISING".
