About procedure for administration of the tariff quotas for import of white sugar and products from sugar

According to provisions of the Law No. 218/2001 on the entry of the Republic of Moldova into the World Trade Organization (The official monitor of the Republic of Moldova, 2001, Art. No. 59-61, 397) and articles I of the Law No. 172/2014 on approval of the Combined commodity nomenclature (The official monitor of the Republic of Moldova, 2014, Art. No. 231-237, 529), with subsequent changes, and also for the purpose of enhancement of the controling mechanism the tariff quotas for import of white sugar and products from sugar intended for the economic operators registered in the Republic of Moldova performing activities in sugar industry, the Government DECIDES:
1. The customs duty on commodity import, classified by goods items 1701 and 1702, provided within the established tariff quotas, is applied on the basis of the principle "the first came - is serviced by the first" within available amounts according to the note to group 17 "Sugar and sugar products" of the Combined commodity nomenclature approved by appendix to the Law No. 172/2014.
2. The amount in the amount of 3 000 tons from the preferential tariff quota provided in the amount of 5 500 tons for the products classified by goods items 1701 91 000 and 1701 99, is allocated to the economic operators registered in the Republic of Moldova who perform activities in processing industry and use sugar in production process, without the right of further realization or any other form of alienation of the imported sugar.
3. The economic operators registered in the Republic of Moldova who perform activities in processing industry and use sugar in production process, for receipt of the quota specified in Item 2, shall provide to Customs Service the declaration under the personal liability according to the sample provided in appendix about use of the imported sugar in production process, and also the expert opinion on determination of the producer of goods issued by Chamber of Commerce and Industry.
