About modification and amendments in the order of the acting minister of health care and social development of the Republic of Kazakhstan of January 15, 2016 No. 20 "About approval of Rules of inclusion in regional quota of acceptance of kandas and immigrants" and the order of the Deputy prime minister - the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 22, 2023 No. 234 "About approval of Rules of voluntary resettlement of persons for increase in labor force mobility"
I ORDER:
1. Bring in the order of the acting minister of health care and social development of the Republic of Kazakhstan of January 15, 2016 No. 20 "About approval of Rules of inclusion in regional quota of acceptance of kandas and immigrants" (it is registered in the Register of state registration of regulatory legal acts for No. 13334) the following changes:
in Rules of inclusion in regional quota of acceptance of the kandas and immigrants approved by the specified order:
5) of Item 2 to state the subitem in the following edition:
"5) the immigrant – the internal migrant who moved to the regions determined by the Government of the Republic of Kazakhstan;";
state Items 14 and 15 in the following edition:
"14. For inclusion in regional quota of acceptance of immigrants citizens of the Republic of Kazakhstan from among persons who are looking for work and (or) the unemployed registered according to the procedure, provided by Rules of registration of persons who are looking for work, the unemployed and implementation of the labor mediation rendered by the career centers approved by the order of the Deputy prime minister - the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 9, 2023 No. 214 (it is registered in the Register of state registration of the regulatory legal acts for No. 32850) having at the time of filing of application permanent registration at least one year at the place of residence in the region, stipulated in Item 16, and also the term provided by the subitem 4) of Item 12 of Rules of voluntary resettlement of persons for increase in labor force mobility (further - Rules), approved by the order of the Deputy prime minister – the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 22, 2023 No. 234 (it is registered in the Register of state registration of regulatory legal acts for No. 32880) (further - uslugopoluchatel) is given to The Government for Citizens State corporation (further - the State corporation) or by means of object of informatization: the Migration.enbek.kz portal (further – the Migration.enbek.kz portal) or the web portal of "the electronic government" (further - the web portal) the statement for inclusion in regional quota of acceptance of the immigrants (further - the statement) in form according to appendix 6 to these rules with application of documents specified in Item 8 of the List of the main requirements to rendering the state service according to appendix 2 to these rules.
The state corporation in day of receipt of the statement and the documents of the applicant specified in Item 8 of the List of requirements to rendering the state service sends them to the service provider by means of lock of "the electronic government".
The specialist of the State corporation who adopted the statement provides quality of reproduction of electronic copies of the documents and their compliance to originals provided by the applicant according to the list of the main requirements to rendering the state service according to appendix 2 to these rules, certifies by means of the EDS then returns originals of documents to the applicant.
In case of the address through the State corporation, in case of representation by uslugopoluchatel of incomplete document package, and also documents with the expired effective period the specialist of the State corporation refuses reception of an application and issues the receipt on refusal in documents acceptance in form according to appendix 8 to these rules.
The specialist of the State corporation who adopted the statement, the applicant is handed the notification on adoption of the statement on inclusion in regional quota of acceptance of immigrants in form according to appendix 7 to these rules.
The applications submitted through the web portal are signed or certified by the EDS of the applicant.
15. In case of filing of application by means of the Migration.enbek.kz portal or the web portal in "personal account" of uslugopoluchatel the status about acceptance of request for rendering the state service is displayed.
Statements arrive in career centers of regions by means of AIS "Labor market".
Career centers of regions within one working day from the date of receipt of the statement, direct applications of applicants to the service provider.
In case of representation of complete document package, the main requirements to rendering the state service provided by the list, the uslugopoluchatel receives the notification on adoption of the statement on inclusion in regional quota of acceptance of immigrants in form, according to appendix 7 to these rules.
The service provider within two working days notifies uslugopoluchatel on refusal in reception of an application for inclusion in regional quota of acceptance of immigrants by means of the Migration.enbek.kz portal or the web portal and issues the receipt on refusal in documents acceptance in form according to appendix 8 to these rules in representation cases uslugopoluchatel:
1) incomplete document package, the main requirements to rendering the state service specified in Item 8 of the List, according to appendix 2 to these rules;
2) documents with the expired effective period, and (or) documents which effective period expires on the date of decision making about inclusion in regional quota of acceptance of immigrants.
The application submitted through the Migration.enbek.kz portal is registered the service provider in day of receipt of the address.";
appendix 2 to the specified Rules to be reworded as follows according to appendix 1 to this order;
appendices 4, 5 and 6 to the specified Rules to be reworded as follows according to appendices 2, 3 and 4 to this order;
appendices 9 and 10 to the specified Rules to be reworded as follows according to appendices 5 and 6 to this order.
2. Bring in the order of the Deputy prime minister – the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 22, 2023 No. 234 "About approval of Rules of voluntary resettlement of persons for increase in labor force mobility" (it is registered in the Register of state registration of regulatory legal acts at No. 32880) the following changes and amendments:
in Rules of voluntary resettlement of the faces for increase in labor force mobility approved by the specified order:
state Item 19 in the following edition:
